Abstract:Directive 93/13/EEC requires any court which hears an action for annulment of an arbitration award to determine whether the arbitration agreement is void and to annul the award if it finds that that arbitration agreement contains an unfair term to the consumer’s detriment, where this issue is raised in the action for annulment but was not raised by the consumer in the arbitration proceedings. This ruling is based on an analogy with the Eco Swiss judgment and on the public interest of the protecting the consumer, in view of the risk that of the latter being is unaware of his rights or of encountering difficulties in enforcing them. These grounds as well as the questionable finding that the Directive amounts to Community public policy, are subjected to critical review in this paper, following the Cofidis case – the latter being the second occasion on which a national procedural rule had to yield to the principle of effectiveness. The most striking feature of this judgment is the contrast between the Court’s far-reaching intervention in the domestic procedural legal order, at the expense of the principle of procedural autonomy on the one hand, and its will to leave the assessment of what constitutes an unfair term to the discretion of the national courts on the other. If the Court has its way, the harmonisation of the protection against unfair contract terms will be procedural rather than substantive by nature. Résumé: La directive 93/13/CEE implique qu’une juridiction nationale saisie d’un recours en annulation d’une sentence arbitrale apprécie la nullité de la convention d’arbitrage et annule cette sentence au motif que ladite convention contient une clause abusive, alors même que le consommateur a invoqué cette nullité non pas dans le cadre de la procédure arbitrale, mais uniquement dans celui du recours en annulation. Cette décision est fondée sur une analogie avec l’arrêt Eco Swiss et sur l’intérêt public de la protection du consommateur, eu égard au risque que celui-ci soit dans l’ignorance de ses droits ou rencontre des difficultés pour les exercer. Ces fondements ainsi que la reconnaissance douteuse du caractère d’ordre public communautaire de la directive sont soumis à une évaluation critique. Aprèès l’affaire Cofidis, la Cour fait une seconde fois plier une règle de procédure nationale devant l’effet utile de la directive. L’aspect le plus frappant de cet arrêt est le contraste entre l’immixtion dans l’ordre procédural interne, au prix du principe de l’autonomie procédurale, et sa volonté de laisser la définition de ce qui constitue une clause abusive à la discrétion du juge national. S’il en tient à la Cour, l’harmonisation de la protection contre les clauses abusives sera celle des procédures nationales plutôt qu’une harmonisation sur le plan du contenu de la directive. Zusammenfassung: Richtlinie 93/13/EWG impliziert, daß ein nationales Gericht, das über eine Klage auf Aufhebung eines Schiedsspruchs zu entscheiden hat, die Nichtigkeit der Schiedsvereinbarung prüft und den Schiedsspruch aufhebt, wenn die Schiedsvereinbarung eine missbräuchliche Klausel zu Lasten des Verbrauchers enthält, auch wenn der Verbraucher diese Nichtigkeit nicht im Schiedsverfahren, sondern erst im Verfahren der Aufhebungsklage eingewandt hat. L’ordre juridique arbitral existe-t-il ? S’il est perçu par les arbitres, souvent de manière intuitive mais très réelle, c’est qu’il existe. L’ordre juridique arbitral ne doit pas cependant être exclusivement conçu comme une représentation mentale du rôle des arbitres et de la source de leur pouvoir de juger. Il existe en tant que système de droit. L’auteur propose trois visions structurantes de l’arbitrage susceptibles d’éclairer l’intégralité des questions relevant de la matière. L’ordre juridique arbitral est l’une de ces visions, celle qui conçoit l’arbitrage comme un phénomène transnational et s’attache à la forte convergence entre les ordres juridiques nationaux. En premier lieu, l’auteur examine les critères distinctifs de l’ordre juridique arbitral et l’existence d’un tel ordre juridique du point de vue des arbitres. Il aborde en particulier le caractère complet d’un système de normes possédant tous les degrés d’impérativité, l’aptitude de l’ordre juridique arbitral à penser ses sources, ses sujets et ses organes, ainsi que son effectivité. Il aborde également les conséquences qui s’attachent à l’existence d’un ordre juridique arbitral, notamment en ce qui concerne des questions aussi importantes que celles de l’effet des anti-suit injunctions hostiles à l’arbitrage et des normes à impérativité renforcée. En second lieu, l’auteur explore le point de vue des autres ordres juridiques sur l’ordre juridique arbitral. En particulier, la reconnaissance de l’ordre juridique arbitral par les ordres juridiques nationaux est illustrée par la mise en œuvre de notions telles que l’ordre public transnational, la faculté de renoncer à tout recours en annulation ou la reconnaissance des sentences annulées au siège. L’auteur aborde ensuite la question plus délicate des rapports entre l’ordre juridique arbitral et l’ordre juridique international.

Abstract:
A successful enone version of an intramolecular aza-[3 + 3] annulation reaction is described here. Use of piperidinium trifluoroacetate salt as the catalyst and toluene as the solvent appears to be critical for a successful annulation. We also demonstrated for the first time that microwave irradiation can accelerate aza-[3 + 3] annulation reactions. An attempt to expand the scope of the enone aza-[3 + 3] annulation was made in the form of propyleine synthesis as a proof of concept. While synthesis of the enone annulation precursor was successfully accomplished, the annulation proved to be challenging and was only modestly successful.

Abstract:
Writers usually exert many efforts in writing sentences with the proper length. Some of them stick to short sentences, which can make their writing looks choppy. Others like to write with long sentences, which can make the writing seems long-winded or wordy, even if it is not. In English language, the length of a sentence refers to how many words are there in that sentence. In almost all formulas, this number is used to estimate how much the sentence is difficult. Still, sometimes, a short sentence shows more difficulty to be read than a long one. Sometimes, longer sentences lead to facilitate comprehension, especially those that contain coordinate structures. This study discusses the basic grammatical notion of sentence, and its length from different points of view. Innumerable definitions of sentence exist and some of these are presented here to get a workable definition to this key term. A definition of sentence length is also presented. Different treatments of the so called sentence length are to be discussed . The various techniques , that have been devised to deal with the sentence in different types of texts as to get better writings, are accounted for in this study . These points are discussed to reach the end , i.e. the conclusion of good sentence length .

Abstract:
Because the sentence is the basic unit of language, and to understand it is a prerequisite for understanding the supersentential levels of language, this study aims at investigating the structural properties of a sentence as well as the speaker-listener relationship which helps to establish a mutual understanding of each other’s intention. Besides, the present study also aims at finding out the reasons behind ambiguity in sentences and how to disambiguate such sentences. The study involves investigating the perceptual mechanisms utilized by the listener and helps him/ her to understand the meaning of the sentence he hears or listens to .If the listener understands what the speaker means or intends to convey, the conversation can continue and the speaker can realize his aim by encouraging the listener to establish a social relationship which is one of the basic functions of any human language. But if the listener fails to understand the speaker, no communication can continue between them. Not only this, but misunderstanding or misinterpreting the speaker lead to adverse results that may spoil social ties instead of enhancing them.
