Abstract:
Animal law and animal law studies both suffer from shortcomings in their underlying ethics. For the most part, (global) animal law draws from utilitarian welfarism and rights-based approaches to animals. Animal law academics have, thus far, paid little attention to more critical animal ethical studies, although these hold great potential for improving the justness and effectiveness of animal law. This article proposes delineating a ‘second wave of animal ethics’ consisting of a number of critical ethical lenses that are capable of addressing four key shortcomings in ‘first wave animal ethics’. This article draws particularly on feminist, posthumanist and earth jurisprudence studies to draw out four key lessons. First, the need to stop assuming that animals only deserve moral and legal consideration if they are like humans, and instead to accept, celebrate, reward and legally protect difference. Second, the need to stop assuming that moral and legal considerations should extend to animals and no further. Third, the need to stop over-relying on liberal concepts like rights and start engaging with (intersectionally) marginalized communities to theorize viable alternative paradigms that might work better for animals. Fourth, the need to stop assuming that animal ethics need to be the same everywhere. In making this argument, this article intends to inspire further research on ‘second wave animal ethics’ ideas amongst animal law scholars.

The paper discusses and criticizes views on various aspects of the situations of animals within human societies offered by authors presenting at the seminar held at the Research Centre for Public Policy and Regulatory Governance. They include legal, ethical as well as socio-psychological problems about animal welfare and the attempts to improve the conditions in which animals are treated. The author hints at the theoretical background as well as implications of some of the ideas that are advocated in the ongoing legal and ethical debates over animal welfare. The discussion aims to shed some light on how the cross-disciplinary studies and exchanges that include biologists, psychologists, sociologists as well as legal researchers may contribute to numerous controversies in the contemporary animal law scholarship.

Abstract:
Abstract Although the sterilization of pregnant companion animals occurs regularly in private veterinary clinics and animal shelters, there is growing concern amongst veterinarians and animal welfare supporters about the appropriateness of carrying out this procedure. The ethical and legal perspectives of the procedure have not been widely discussed in the available literature. This paper aims to remedy this situation. It considers the sterilization of pregnant companion animals using four ethical frameworks: animal rights, utilitarian, relational and contractarian. The possible interests of all involved parties, including the animal itself, the unborn young, the veterinarian, shelter and clinic staff, and the wider community are included. Where the science on companion animals in this area is limited, the paper draws on science involving other species. The legal aspects are discussed with analogies to human abortion laws. The paper concludes by providing a framework that veterinarians and others can use when making ethical decisions.

A telling arena for observing ethical human behavior is the human treatment of nonhuman animals. How one treats or mistreats animals is a decision mostly grounded in his or her ethical beliefs. This article examines animal ethics and discusses the value of intrinsic motivation through the lens of teaching a freshman animal ethics. In addition, this opinion piece argues the merit of the pass/fail paradigm in lieu of the traditional grading paradigm by using the triad of Kohn’s (1999) intrinsic motivation, Thorndike’s (1913) law of readiness, and Bandura’s (1997) social cognitive notion of self-regulation while exploring the human ethical notions related to learning about animal rights.

Abstract:
Experimental animal models offer possibilities of physiology knowledge, pathogenesis of disease and action of drugs that are directly related to quality nursing care. This integrative review describes the current state of the instrumental and ethical aspects of experimental research with animal models, including the main recommendations of ethics committees that focus on animal welfare and raises questions about the impact of their findings in nursing care. Data show that, in Brazil, the progress in ethics for the use of animals for scientific purposes was consolidated with Law No. 11.794/2008 establishing ethical procedures, attending health, genetic and experimental parameters. The application of ethics in handling of animals for scientific and educational purposes and obtaining consistent and quality data brings unquestionable contributions to the nurse, as they offer subsidies to relate pathophysiological mechanisms and the clinical aspect on the patient.

This article describes the Swedish rules about experiments on animals and the function of the Swedish animal ethics experimentation committees. A small survey of the rules about experiments on animals in Norway, Denmark, Finland, England and Wales, and the EU, is included. The Swedish rules on animal experimentation are examined in order to see how their form and functions relate to theories about different kinds of decision making in public law. The extents to which the rules agree with the aims of the law and with existing normative patterns are also examined. The difficulties to handle the ethical weighting between the importance of the experiment and the suffering of the animals are discussed.

Abstract:
Passing federal laws and national guidelines is one of the best revenues to protect animals used in experimentation. The laws can establish standards of care for animals in scientific research such as housing standards and treatment for the animals. At international level, animal ethics and law for the care and use of animal in experimentation have been widely discussed for decades ago. There are several well-known international documents and guidelines that have been referred by many countries when constructing their own federal laws governing the subject matter. They are Terrestrial Code, European Directives, and International Guiding Principles for Biomedical Research Involving Animals. In Malaysia, the Animal Welfare Act 2015 finally has been enforced on 18th July 2017 where the Act among others will regulate the use of animal for scientific purposes in the country. Besides, it will validate the practice of Institutional Animal Care and Use Committee (IACUC) which was based on self-regulation before the enactment of the Act and the Act is significant of having legal enforcement in order to give better protection to the animals subjected to experimentation. Thus, the law has taken its role in enhancing the animal ethics for the care and use of animal in science in Malaysia. This paper aims to analyses the provisions of law in several international documents governing the subject matter that reflect the international practice. Then it will look into the practice of research institutions in Malaysia, applying the existing animal ethics and law in the subject matter. This paper adopts doctrinal approach considering primary and secondary sources of law. Relevant to this, Animal Welfare Act 2015 (AWA) and Malaysian Code of Practice for the Care and Use of Animals for Scientific Purposes (My Code) are analysed. Besides, it also employed empirical study by way of interviews and observation. This paper is significant to inform the practice of animal ethics at international level to be learned by Malaysia as the country is still at an early stage of having the new Act.

Abstract: This dissertation intends to follow the counter-discourse on animal experimentation in order to elucidate it as a social movement. It is focused on the processing of Arouca Law, recently passed the Congress to regulate vivisection nationwide. From this law, the focus is on the social actors involved and the political conflicting forces for this matter of scientific controversy. In parallel, other practical manifestations of counter-discourse will be followed in order to enrich the material for analysis to highlight the arguments that contribute to the symbolic status of laboratory animals. However, the broader nature in which the antivivisection movement is inserted, namely the fight against the exploitation of nonhuman animals, will not be lost

Analysis of the construction of public policies for animals in Brazil, from the discussion of animal rights as an ethical issue, legal, social and political. It identifies the historical aspects of animal use that mark the relations between men and these. Analyzes the ethical discussions about the existence of moral rights for animals since ancient times, who founded the contemporary discussion of the acceptance of animals as subjects of rights. Analyzes the construction of animal rights in the Brazilian legal system, in infra laws and constitutions. Identifies the transformation of the issue of animal rights in a public issue, by inserting the Brazilian political agenda and demanding animal protection actions of the government through public policy formulation and implementation. Thus, we consider the relevance and responsibility of the Brazilian government in the promotion of public policies of animal protection.

Thesis (MPhil)-- Stellenbosch University, 2001.
ENGLISH ABSTRACT: This ethical case study of public slaughter has indicated that there is an urgent need to address the issue of public slaughter, because it has resulted in animosity and polarisation between black and white people living in the Goldfields. Black people feel that their rights are violated, and they are not protected by the government because they encounter problems when practising their rituals. White people feel that the government is not protecting them from the health hazards caused by black people. The ultimate aim of the study is to contribute to and amplify the existing body of knowledge with regard to the extent of the problem experienced by people in the Goldfields, its impact in their every day lives and to propose guidelines that will help when regulations governing environmental issues are drawn. In order to accomplish these aims the following objectives should be realised by this study: • South Africa is a multi-racial country so a uniting policy is needed. • Each culture is unique and it has a special value, so no culture must be marginalised. • The old policy needs to be revised and amendments made. • Identify the actual causes of these problems. Are they racist driven or are they driven by genuine health concerns? This ethical study also indicates that the following are central values that should inform decision-making: • Health. • Respect and tolerance. • Communication. • Participation. Transparency. • Commitment. Based on the findings from the research conducted it is clear that both clashing parties (black and white people) need to live in peace at the ultimate end although their description of peaceful life differs, so the following recommendations are made as to how to address and alleviate problems caused by public slaughter. • A formal meeting must be convened to discuss this critical issue. • Drafted proposals must be produced. • The proposals must be debated. • The proposal must be adopted. • The existing bylaws must be changed.

Abstract:
This research aims to unravel the many difficulties and problems that family farms in Galicia are facing in order to maintain their livelihood, which hinges on a combination of livestock farming and agriculture. This livelihood is at risk of disappearing, threatening the future of these farms. I try to understand the characteristics of these family farms and to unveil their place within a capitalist economy. To do this, this work explores the contradictions and ambiguities that emerge vis-à-vis the various spheres of relations wherein these farms operate (market, peasant or traditional economies), while paying particular attention to several contradictions around the economic relations that structure these Galician exploitations, which hamper their productive process to a point that, in many occasions, they are forced to close down. I examine two main issues in relation to these phenomena. On the one hand, there appears to be a dichotomy between market and society or market value and social value which, if explored in detail, seems to suggest that both elements are dynamic and encompass certain ambiguities and even some overlaps. This reveals that the actual practices of these farmers are more complex that it might seem at first sight. On the other hand, there is also a rather common feeling among members of these farms of “being trapped” (in a material, ideological and moral sense) between the market and the desire of a good life: a level of life that provides wellness and allows them to maintain their environment and lifestyle. In other words, a life that allows them to continue being farmers. There are two concepts that are central to my analysis of these different issues. The first one is the idea of sustainability and particularly the tensions between three relevant dimensions of sustainability: economic, social and environmental. These tensions render more complex and complicated the productive process of these farms and their resilience. The other key concept is the just price, which is the main demand of these farmers and the element that they consider centerpiece to subsist and maintain their livelihood; in other words, the key to the reproduction of their families and households and to having a decent life.

The animal protection law has been in place for more than two decades. During this period, animal protection awareness is getting higher and higher. In fact, not as it was twenty years ago, the purpose of the Animal Protection Law was to adapt to the world trend. Through understanding the basic theory of environmental ethics to clarify the provisions of the Animal Protection Law of content. In addition to the traditional legal implications, the possibility of ethical implications should be included. This study incorporates animal protection through the expansion of the concept of environmental protection. On the one hand, it shows that animals are not purely legal objects, but on the other hand, as a subject of rights, there is still a gap with human beings. Explain the provisions of the Animal Protection Law that contain ethical implications, and in the future, when the legislators amend or review the law, when the court applies the animal protection laws, and when the civil servants perform the animal protection business, they can further understand the value behind animal protection. Obligations and behavioral restrictions imposed on the people due to animal protection. In addition to the legal provisions, the search for its constitutional basis has its inherent meaning. In particular, there are many restrictions on the basic rights of the people. The basis of these restrictions or interventions is that this article is based on environmental protection. Because animal protection limits the people's freedoms and rights, it is justified in the case of proportionality. And this article believes that the ultimate measure of interest in animal protection is still tilted toward humanity.

"Equal Treatment for Equal Relevance: The Unjustifiable Exemption of Farm Animals from Animal Cruelty Laws." Master's thesis, 2012. http://hdl.handle.net/2286/R.I.14654.

Full text
Abstract:
abstract: In the past 100 years pet, zoo/aquarium, and research animals have gained unprecedented legal protection from unnecessary human harm via the creation of strict animal cruelty laws. Due to the work of moral philosophers and compassionate lawyers/judges animal cruelty laws have been improved to provide harsher punishments for violations, had their scopes widened to include more animals and had their language changed to better match our evolving conception of animals as independent living entities rather than as merely things for human use. However, while the group of pet, zoo/aquarium, and research animals has enjoyed more consideration by the US legal system, another group of animals has inexplicably been ignored. The farm animals that humans raise for use as food are exempted from nearly every state and federal animal cruelty law for no justifiable reason. In this paper I will argue that our best moral and legal theories concede that we should take animal suffering seriously, and that no relevant difference exists between the group of animals protected by animal cruelty laws and farm animals. Given the lack of a relevant distinction between these two groups I will conclude that current animal cruelty laws should be amended to include farm animals.

Claprood, Sonia.

Abstract:
Xenotransplantation that is, the transplantation of non-human animal cells, tissues and organs into humans, is considered a solution to the organ shortage problem. However, this technology could be the source of new diseases; therefore, it is necessary to have measures aimed at assuring the health of animal donors as well as the quality and safety of the xenografts in order to minimize the risks of disease transmission from animal to human, called xenozoonosis. The subject of this master's thesis is to verify if the standards that exist in Canada and in Quebec are appropriate to assure the safety of the recipients and the population. In the first place, we have examined the standards that could apply to the surveillance and control of the health of animal donors. These standards that apply to known diseases do not meet the specificities of xenotransplantation. As for the xenografts, their qualification is problematic: drugs or medical devices? This possibility of a double status could affect the uniformity of the decisions relative to their quality and safety. We have also studied the Proposed Canadian Standard for Xenotransplantation. The latter may resolve the unsuitability of normative standards that exists in Canada. A comparison of such a Canadian standard with the WHO recommendations and the measures in place in the United States allows us to recommend on how to improve it. Our study reveals that a Canadian normative standard that focuses on the security of the xenografts is still to be implemented. An essential element to be considered in its development, is the need to establish a worldwide compatible and suitable control system.

Abstract:
AbstractAgency is central to humans’ individual rights and their organization as a community. Human agency is recognized in the Universal Declaration of Human Rights through guaranteed rights, such as the right to life, basic education, freedom of expression, and the freedom to form personal relationships, which all protect humans from tyranny and oppression. Though studies of animal agency consistently suggest that we grossly underestimate the capacity of animals to make decisions, determine and take action, and to organize themselves individually and as groups, few have concerned themselves with whether and how animal agency is relevant for the law and vice versa. Currently, most laws offer no guarantee that animals’ agency will be respected, and fail to respond when animals resist the human systems that govern them. This failure emerges from profound prejudices and deep-seated anthropocentric biases that shape the law, including law-making processes. Law and law-making operating exclusively as self-judging systems is widely decried and denounced—except in animal law. This chapter identifies standpoint acknowledgement as a means to dismantle these tendencies, and provides instructions on how to ask the right questions. It concludes by calling for an “animal agency turn” across disciplines, to challenge our assumptions about how we ought to organize human-animal relationships politically and personally, and to increase our civic competence and courage, empathy, participation, common engagement, and respect for animal alterity.

Abstract:
AbstractThe preceding chapter has argued that animals could have (some) human rights. Granted that the proposition of human rights for animals is conceptually plausible on naturalistic grounds, the question remains whether it is politically desirable on practical grounds. Would the inclusion of animals under the human rights framework be a good thing? Through the lens of political conceptions, this chapter explores a range of practical reasons why animals should be afforded human rights. I will argue that the extension of human rights to animals is warranted both for principled or ethical reasons (as a matter of justice for animals) and for prudential or instrumental reasons (as a means of better safeguarding human rights). In short, human rights are good for animals and animal rights are good for humans.

Abstract:
Graduate students in many fields are required to receive formal training in scholarly integrity. Some institutions offer general courses to address this need, but statistics students may benefit from training more specific to the discipline. We have developed a “Scholarly Integrity in Biostatistics” course, which addresses the competencies mandated by several U.S. funding agencies, while emphasizing the key roles that statisticians have in collaborative research. The course meets one hour per week, and its topics include student/mentor relationships, communication skills, gender bias, conflict resolution, authorship, human and animal subjects’ issues, statistical review of manuscripts, plagiarism, copyright laws, conflicts of interest and commitment, reproducible research, and publication bias. Course credit and grades are based on attendance, class participation, short writing assignments, and a term project. The course has been offered four times, and has been received favorably by the students and by the administration.

Abstract:
In this paper, statements from popular science sources are contrasted with data from primary science articles and studies. It is observed to what extent the opinions and statements of the popular science articles differ from the studies and scientific articles in terms of ethics and acceptance. For this purpose, the field is divided into 4 fields, which are processed independently. To begin with, the industrial robots are examined. These are used in the area of production as well as in the area of maintenance and repair. These robots are able to learn from each other and to work with each other and with humans. Even a tire change can be carried out by an industrial robot today. Likewise, new developments offer construction spaces that are difficult for humans to access. Activities that do not serve industrial production, but rather the performance of services for people and facilities, are carried out by service robots. They are freely programmable motion devices that perform services partially or fully automatically and are used in the areas of care, gastronomy, tourism, as well as private households. In the future, skills such as flexibility and judgment must be perfected. The use of some service robots is already safe for humans. Similar to service robots, social robotics also focuses on interaction between humans and robots. These are sensorimotor robots that can communicate with humans in a social manner. In doing so, they can build social relationships and constantly learn. The social robots are usually in a human-like (humanoid) or animal-like (animaloid) body, but can also be used merely as software. Examples for application are care, therapy and entertainment robots. In addition to the three physical robots, software robots (software bots) are virtual robots used for process automation. They are the result of the application of Robotic Process Automation (RPA), which includes various approaches and technologies. They are used in almost every industry. In the following paper, the applications of softwarebots in finance, healthcare, public administration, and law are examined. Only minor discrepancies between the secondary literature studied and the state of the art can be observed in the texts examined. For the industrial robots, no deviations from statements from popular science sources can be found. In the secondary literature, however, these are not found as frequently as the other robot types studied. This is probably since the interested parties tend to be companies that are advertised through other channels. Nevertheless, some publications can be found for the manufacturing and maintenance and repair sectors. The largest application area today is still manufacturing. However, current robot developments offer promising and potential benefits for the maintenance and repair of industrial plants. In comparison, the research on service robots have shown that a variety of characteristics and capabilities are attributed to them in the secondary literature, most of which are consistent with the status quo of service robotics. In the next area examined, social robotics, the claims from the secondary literature, as with the previous robot types, deviate little from the primary scientific facts. In the technical area, the claims of the secondary literature are fundamentally true, although the ability of robots is generalized in some aspects. Softawarebots, on the other hand, are partially distinct from the previously mentioned robots. Especially the terms used for software applications as software bots in popular science articles do not refer to scientific classifications.
