Forsberg, Lisa. Crime-Preventing Neurointerventions and the Law. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198758617.003.0003.

Full text
Abstract:
Anti-libidinal interventions (ALIs) are a type of crime-preventing neurointervention (CPN) already in use in many jurisdictions. This chapter examines different types of legal regimes under which ALIs might be provided to sex offenders. The types of legal regimes examined are dedicated statutes that directly provide for ALI use, consensual ALI provision under general medical law principles, mental health legislation providing for ALI use (exemplified by the mental health regime in England and Wales), and European human rights law as it pertains to ALI provision. The chapter considers what we might learn from ALIs in respect of likely or possible arrangements for the provision of other CPNs, and draws attention to some ethical issues raised by each of these types of regime, worth keeping in mind when considering arrangements for CPN provision.

Full text
Abstract:
The theory of mentalizing and epistemic trust introduced by Peter Fonagy and colleagues at the Anna Freud Centre has been an important perspective on mental health and illness. This book is the first comprehensive account and evaluation of this perspective. The book explores 20 primary concepts that organize the contributions of Fonagy and colleagues: adaptation, aggression, the alien self, culture, disorganized attachment, epistemic trust, hypermentalizing, reflective function, the p-factor, pretend mode, the primary unconscious, psychic equivalence, mental illness, mentalizing, mentalization-based therapy, non-mentalizing, the self, sexuality, the social environment, and teleological mode. The biographical and social context of the development of these ideas is examined. The book also specifies the current strengths and limitations of the theory of mentalizing and epistemic trust, with attention to the implications for both clinicians and researchers.

Bortolotti, Lisa. Why Delusions Matter. Bloomsbury Publishing Plc, 2023. http://dx.doi.org/10.5040/9781350163331.

Full text
Abstract:
Delusions can be many things. They can be symptoms of mental health problems, such as schizophrenia, clinical delusions, or simply the beliefs that people cling to which are unsupported by evidence. We call the latter everyday delusions and they can include anything from the benefits of homeopathy to the dangers of alien abduction. Yet, why do people adopt delusional beliefs and why can they be so reluctant to part with them? In Why Delusions Matter, Lisa Bortolotti explains what delusions really are and that despite their negative reputation, that they can also play a positive role in someone's life, such as providing meaning to people’s experiences and strengthening their identities. In a clear and accessible style, she contributes to the growing study of philosophy and the cognitive sciences, providing an intelligent and nuanced view of delusions.

Szmukler, George. A new United Nations ‘disability’ convention. Oxford University Press, 2017. http://dx.doi.org/10.1093/med/9780198801047.003.0008.

Full text
Abstract:
The United Nations Convention on the Rights of Persons with Disabilities (CRPD) presents in a tailored form the rights of such persons. Mental health disabilities are included. While the Convention is most welcome, it is hugely challenging when it comes to involuntary treatment. Important authorities have interpreted it as excluding all forms of ‘substitute decision-making’. The Convention demands ‘respect for the rights, will and preferences’ of persons with disabilities. This chapter examines the meaning of ‘will’ and of ‘preference’. A problem arises when a person’s currently expressed ‘preference’ (or desire or wish) diverges from the person’s ‘will’ (taken to mean a person’s relatively enduring and deeply held value commitments). Both cannot be respected at the same time. Which should have precedence? The method of ‘interpretation’ discussed in Chapter 7 allows such a determination to be made, and aligns the ‘fusion law’ proposal with the objectives of the Convention.

Selby, Christine L. B. Who Am I? ABC-CLIO, LLC, 2021. http://dx.doi.org/10.5040/9798216035374.

Abstract:
This book explores what identity is, what factors contribute to it, how it develops, and the impacts that a strong or weak sense of self can have on a person's health, happiness, and future. Many teens grapple with the seemingly simple question, "Who am I?" and struggle to integrate their experiences at school, at home, and with friends into their burgeoning sense of identity. How teens see themselves can influence the friends they choose, the decisions they make, and their mental and physical well-being. Having a strong sense of self can help them resist peer pressure, avoid risky behaviors, and make choices and plans that align with their values and interests. Yet research shows that such factors as heavy social media use can have a strongly negative effect on healthy identity formation for today's teens. Who Am I? Understanding Identity and the Many Ways We Define Ourselves examines the subjects of identity and identity formation across the lifespan, with special emphasis on the teenage years. Beyond simply discussing relevant psychological theories, the book focuses on how identity formation happens in the real world and how it affects the daily lives of teens. It also includes a collection of fictional case studies that provide concrete, relatable illustrations of concepts discussed in the book.

Amos, Claire, and Grant Gillett. The Discourse of Clinical Ethics and the Maladies of the Soul. Edited by John Z. Sadler, K. W. M. Fulford, and Cornelius Werendly van Staden. Oxford University Press, 2015. http://dx.doi.org/10.1093/oxfordhb/9780198732365.013.38.

Full text
Abstract:
Discursive ethics focuses on the positioning of people in situations that validate certain constructions (such as mental disorder, individual dysfunction, the biological basis of psychiatric conditions). The soul (or psyche) results from disciplines that have shaped a person’s experience and are inscribed in their body, thought and behavior in terms of such constructions. A discursive critique examines the relationship between such constructions, a marginalized or suffering soul, and the clinical situations into which they enter. Psychiatric narratives begin with “detection” pathways shaped by the biomedical model. They create “docile bodies,” the workings of which are considered to be evident to experts as the patient and their clinical journey become subject to disciplines that may be alien to their own politico-aesthetic project, creating discursive situations that can all-too-easily silence the voice of suffering and what it is trying to say. However, patients and clinicians can work together within a responsive mode of ethics - one which generates a powerful, co-constructed conception of health, ethical truth, and justification.
