Abstract:
This thesis seeks to address the question: to what extent is the EU Directive on Antitrust Damages Actions sufficiently framed in its terms to achieve its underlying aims and objectives? It is argued that the Directive has one overriding goal: to make it easier for the victims of infringements of EU competition law - typically end-consumers - to claim compensation from the infringers. It is also argued that the authors of the Directive present a convincing case that one of the main reasons for the lack of victims claiming - let alone being awarded - compensation, prior to the adoption of the Directive, is weaknesses with the existing legal framework governing competition law damages actions at national level. The thesis examines four of the main areas covered by the Directive: disclosure of evidence; the effect of NCA decisions; limitation periods; and indirect purchaser standing and the passing-on defence. In each case, the relevant rules from the Directive are set out and an assessment is carried out. A crucial part of this assessment consists of seeking to ascertain the problems facing potential claimants prior to the adoption of the Directive and asking whether the Directive appears well-framed in terms of addressing those problems. As well as considering case law of the EU courts, the legal rules and jurisprudence of two leading Member States - the United Kingdom and Italy - are used as primary case studies in carrying out this assessment. The assessment of the measures considered in this thesis is a nuanced one. It is argued that the measures set out in Chapter II of the Directive on disclosure of evidence are generally well-framed and beneficial for claimants, crucially showing a keen understanding of the relationship between private and public enforcement. The assessment of Article 9, on the effect of NCA decisions is much less positive. It is argued that the measures are drafted in vague terms and compare unfavourably with existing rules and practices in the two case-study Member States. It is argued that while the measures set out in Article 10 on limitation periods do represent an improvement for claimants in certain respects, there are a number of key issues that they fail to address. Finally, the assessment of Articles 12 to 15 on indirect purchaser standing and the passing-on defence is positive in some respects, but it is argued that many of the measures do not adequately address the issues that they purport to tackle. It is also argued that these measures are unlikely to bear fruit, without certain issues which are not covered by the Directive, being addressed. Ultimately it is concluded that the Directive makes some important strides towards the realisation of its underlying aims and objectives, but that many of the measures examined are found to be too vague, too weak or too incomplete to fully address the key issues and that the Directive also fails to address some important issues at all.

Abstract:
The question which animates this thesis is the extent to which study of extant leadership theory and research is relevant to the fostering of educational leadership. Because this question cannot be answered without an adequate account of leadership in education, the thesis develops a conception of educational leadership and assesses the relevance of the leadership literature in light of that conception. The foundations upon which this conception of educational leadership is built are as follows: (1) the ordinary language meaning of "leadership," (2) the ideals fundamental to a liberal, democratic society, and (3) our ideal of the educated person. Conceptual analysis of "leadership" reveals that it is used both descriptively (to denote positions) and normatively (to rate something positively). The normative use spans a continuum of standards from weak to strong. Weak-normative leadership is ascribed according to the extent to which a leader has been able to influence others to pursue a goal. Strong-normative leadership is ascribed according to the extent to which the leader's ends and means are worthwhile. It is argued that, in general, people who want educational administrators to exercise leadership want strong-normative leadership, i.e., they want administrators to envision worthwhile goals and to use morally appropriate means to influence their colleagues to pursue these goals. Thus, the sense of leadership upon which the conception of educational leadership is based is the strong-normative sense. The ideals taken to be fundamental to a liberal democracy are: (1) equal respect for persons, (2) use of intelligence in problem solving and promoting change, (3) cooperation and pooled experience in setting values and solving problems, and (4) respect for individual rights. The ideal of the educated person is characterized in terms of the acquisition of worthwhile knowledge through means which respect rational autonomy. A conception of educational leadership compatible with these ideals is explicated and defended. Rival conceptions of educational leadership are examined. It is argued that the conception of educational leadership developed here is preferable to its rivals in that it incorporates their strengths and avoids many of their weaknesses. Leadership theory and research are examined and shown to be generally incompatible with the conception of educational leadership explicated and defended in this thesis, and with the ordinary language concept of leadership. The thesis concludes that it is probably not appropriate to make such theory and research the central component of courses which aim to foster or improve the exercise of educational leadership; rather, study of works which attempt to clarify and justify educational goals and means would seem to be more promising.

This thesis is a reflection on the importance of the inspirited school and the value of living the great mythic questions. I am suggesting that we are living in a mythic and spiritual crisis that stems from an education informed by an uninspiring myth. While our traditional pedagogical aim has been to further the education of students, to develop their minds into keen and sharp tools capable of contributing to our economic society, we have forgotten to ask what that means exactly: what does it mean to be educated? Through an exploration of the roles spirituality, authenticity, and narrative play in education, this thesis proposes a vision of the inspirited school providing a rich alternative to the present myth. With authenticity as the goal of inspirited education, narrative and the writing process are the means by which to achieve this goal.

Abstract:
Over the last two decades more attention has been paid by the governments of developed and developing countries to the role of higher education in general and universities in particular. Their major concern is the growing demand for higher education and the growing expenditure of that sector. These two reasons led to an inquiry into the role of higher education institutions, their objectives and their effective use of the resources allocated to them. The need to achieve better understanding and definition of the role of higher education institutions and effectiveness requires better understanding of the institutional objectives and their measure of achievement by the various constituencies involved in the institutions' activities. This study aimed to investigate the different objectives and to examine the appropriateness and degree of achievement of measures of a set of institutional goals in four Arab Universities. The study approach used included a literature survey of studies conducted on higher education institutions in Europe, North America and the Arab States and the collection of data by a questionnaire. The population sample represents administrators and faculty members in the four Arab Universities. Mean scores were used to generate the ranking of the objective areas, in terms of their perceived preferences among the four universities and among the respondent groups. Also, the analysis of variance technique was used to ascertain which of the objective areas and their measures received divergent views among the four universities and among the respondent groups. The analysis of variance technique was followed by Duncan's New Multiple Comparison test to identify pairs of factors which differ significantly, to help in the interpretation of the findings. The study revealed that there were differences in respondent ratings of the objective areas, their measures and degree of achievement among the four universities but not among the different respondents categories. The findings of the study provided the conclusion that: only in some objective areas were priorities perceived differently by the universities and by respondent groups; homogeneity exists among the respondent groups on the appropriateness of the measures and the degree of achievement of these measures; close correlation appears to exist between the ratings of the objective areas and their associated measures; and, finally, there was consensus among the respondents that all universities were performing poorly on the most highly rated objective areas. The results and conclusions of the study were utilised to draw up some recommendations which might be useful to decision-makers in achieving their institutional objectives.

In two-player zero-sum games on graphs, the protagonist tries to achieve an objective while the antagonist aims to prevent it. Objectives for which both players do not need to use memory to play optimally are well-understood and characterized both in finite and infinite graphs. Less is known about the larger class of half-positional objectives, i.e., those for which the protagonist does not need memory (but for which the antagonist might). In particular, no characterization of half-positionality is known for the central class of ω-regular objectives. Here, we characterize objectives recognizable by deterministic Büchi automata (a class of ω-regular objectives) that are half-positional, both over finite and infinite graphs. This characterization yields a polynomial-time algorithm to decide half-positionality of an objective recognized by a given deterministic Büchi automaton.

Abstract:
Purpose – the article aims to explore how service modularisation objectives are compatible with organisa- tional objectives. Research methodology – the paper is a part of continuous research. It takes a conceptual approach and integrates rele- vant literature to develop a framework on the potential avenues to create a decision-support tool that assists in service modularity planning. The research proceeds with evidence from the peer-reviewed literature. The relevant literature was identified through “pearl growing” and citation chasing techniques using the assembled body of topic literature from authors’ previous research and employing the related keywords for filtering. Findings – the previous literature is silent on establishing objectives for service modularisation with the consideration of what a provider will achieve by engaging in this. The paper addresses this gap and discovers how antecedents of service modularisation transform into organisational objectives. Research limitations – although bibliographic research methods are limited, they enable the analysis and identification of structure within the research. Such analysis has implications by suggesting future directions in investigating how modularity approach can be used in the service context and how it can be applied in practice more actively. Practical implications – the findings provide potentially vital information to service organisation managers and allow better understand how service modularisation would benefit performance results in gaining service competitiveness. Originality/Value – the study contributes to the discourse on service modularity planning and provides a basis for comprehension of service modularisation merit when pursuing competitiveness.

The purpose of this report is to analyze different aspects of two levelling courses in Chemistry, offered to entry-levels students in the Degree in Geology (Universidad Complutense de Madrid) and in the degree in Agricultural Engineering (Universidad de Almería). We comparatively analyze the motivations for offering the course, its aims and objectives, the course design and finally the methodology ans assessments of the course in both universities. The assessment of the learning process is done through quizzes at the beginning and at the end of the courses. Voluntary and anonymous surveys show that the students are very satisfied with the courses. In the future, the aim is to improve the learning methodology in order to achieve greater student motivation

Abstract:
Northwest Pacific including Sea of Japan and Yellow Sea is a transboundary region for several countries with very different socio-economical situations: China, Japan, Republic of Korea, North Korea and Russia. UNEP NOWPAP (Northwest Pacific Action Plan) is one of the UNEP Regional Seas programs with aims to support ecologically based management of coastal and marine environment. Development of the Ecological Quality Objectives (EQOs) is one of the NOWPAP activities for the time being and near future. Aims of this paper are to suggest the list of EQOs for the northwest Pacific, as well as targets and indicators, which can be used for the monitoring of the achievements of them. Another goal is to assess relevance for the northwest Pacific the proposed targets and indicators including analysis of the problems and limitations based on the experience of EQOs implementation in other regions. Abstract:
Northwest Pacific including Sea of Japan and Yellow Sea is a transboundary region for several countries with very different socio-economical situations: China, Japan, Republic of Korea, North Korea and Russia. UNEP NOWPAP (Northwest Pacific Action Plan) is one of the UNEP Regional Seas programs with aims to support ecologically based management of coastal and marine environment. Development of the Ecological Quality Objectives (EQOs) is one of the NOWPAP activities for the time being and near future. Aims of this paper are to suggest the list of EQOs for the northwest Pacific, as well as targets and indicators, which can be used for the monitoring of the achievements of them. Another goal is to assess relevance for the northwest Pacific the proposed targets and indicators including analysis of the problems and limitations based on the experience of EQOs implementation in other regions. Digitalization offers innovative solutions through which firms can address sustainable challenges and be sustainable in the long run. The implementation of digitalization for sustainability sake can create both positive and negative impacts internally and externally to a business. While digital technologies can optimize resource management and enhance social outcomes, they also pose risks of increased energy consumption and e-waste generation. This research aims to explore how firms can balance the benefits of digitalization with that of the associated risks to enhance sustainability performance. By investigating the dynamics between digital transformation strategies, business models, and sustainability, it seeks to create new knowledge on the method of how digital sustainability should work. The paper will employ a multiple case study approach with qualitative and quantitative data collection methods. Although the research is in its initial stages, it anticipates that businesses will increasingly adopt digital transformation to comply with environmental regulations. The study expects to contribute in digital sustainability strategy in response to evolving regulatory landscapes.

his Rapid Review is an attempt to instigate a broader discussion on child labour by considering the various dimensions and angles associated with the phenomenon beyond the straitjacket definitions provided in most reports. Its objectives are threefold. First, it aims to determine whether re-analysis of existing data sets is likely to yield new insights into the forms, prevalence and drivers of children’s work in agriculture in Ghana. Second, it aims to provide specific guidance on how these re-analyses might be undertaken and framed. And third, it aims to determine whether any of the available data sets might be used to map the number or density of children to the main agro-ecological zones or agricultural systems. In doing this, the review describes the nature of child work in the agricultural sector, highlighting areas that have often been ignored in the literature. The conclusion offers suggestions for future research on child labour based on our renewed understanding of the broad concept of child work.

The present case study is part of a larger research project undertaken for the Inter-American Development Bank, concerning the issue of indigenous peoples and poverty reduction in Latin America. In introducing the Guatemalan study, it is important to clarify its scope and objectives. It aims both to broaden the knowledge of IDB officials themselves regarding the complex issues to be addressed in reducing the poverty of indigenous peoples in a country like Guatemala; and also to prepare the ground for a future dialogue between IDB officials and the Government of Guatemala on this same subject. Given this dual objective, the study of necessity contains more background information than for a document prepared exclusively for the Government of Guatemala. At the same time, the main focus is on policy concerns rather than a descriptive account of the poverty facing indigenous peoples in Guatemala.

To assist the Welsh Government in balancing the productivity-related objectives with the societal objectives of lifelong learning, the Wales Centre for Public Policy was asked to conduct an evidence review into lifelong learning. This review aims to inform policy discussions and support the implementation of the Tertiary Education and Research (Wales) Bill published on 1st November 2021 which renews the emphasis on lifelong learning in Wales through the establishment of the Commission for Tertiary Education and Research (CTER). The report is structured around key areas of lifelong learning: the context in which it takes place; lifelong learning in visions and strategies; rights and entitlements to lifelong learning; the need to strike the balance between targeting and universal provision; barriers to learning; balancing the economic and social objectives; the roles and responsibilities of different stakeholders and lifelong learning governance structures; effective forms of support for learning institutions; and comparing lifelong learning in Wales with other parts of the UK. The report concludes with a set of consolidated recommendations to the Welsh Government.
