Full textGood management of shared spaces requires taking into account the multiplicity of stakeholders who each have their own values and objectives. It is subject to two recurring problems. The first is the lack of consensus, the second is a consensus on an ineffective solution in its response to the problems raised. Combining the participatory aspect with technical assistance makes it possible to address both aspects. It is possible both to help the actors in the decision-making process, while at the same time directing their reasoning towards a coherent result. In order to provide technical assistance, we choose to use the theory of viability, which proposes to users to define a set of constraints grouping the interests and objectives of each. This method has two advantages. On the one hand, it is no longer necessary to aggregate or prioritise the criteria. On the other hand, viability allows an infinite time horizon to be taken into account, implying respect for intergenerational equity. Moreover, we draw inspiration from the techniques used for the design of serious games in order to give an educational and awareness-raising aspect to our tool for participatory management. This thesis work focuses on the design, development and impact study of a tool for participatory management based on viability theory. We have implemented a prototype of an IT assistant that gives concrete form to the ideas proposed in the thesis. Then we conducted a first experimentation of its use in order to analyse its interest and the benefits brought to decision making and negotiation. This evaluation allowed us to assess the influence of this tool from the point of view of decision support, negotiation support and awareness of the issues raised by resource sharing. An application inspired by the case of Brazilian extractive reservation allowed us to illustrate this approach

Full textLModes of negotiation OECD DAC are organized around the rule of consensus and an iterative process led peer. These modes of negotiation produced the concept of fragile state from 2004 to 2010, an idea ready to use and ready to be extended by its promoters as the original by all representatives of donors who choose to invest. The concept and agenda for fragile states come into the race in 2005 to demonstrate the legitimacy of official development assistance as necessary complements and as competitors on the agenda of the effocacité help. However the same modes of negotiation and organizational constraints and normative encountered in aid bureaucracies involved in this construction have tended to standardize the content and limit the political and bureaucratic implementation of this new agenda. In the DAC, these constraints also reduce the scope of the proponents of the fragile states agenda should deal with established standards. This agenda has yet been released quickly because of its malleability, nature proinstitutionnelle of its arguments and the normative and political risk he is taking relatively small actors who use them to promote their own strategic visions of the official development assistance. It contributes to produce norms, to determine life conditions at work, to organize relations between social actors. If the analysis of structural determinings is essential to understand these process, it's also important to understand the way how the local actors take over, work on again and make use of established social norms, how singular and complex shapes can be built up, to lead to original situations of negotiation, with permanent changes. The work of negotiation, like every work, needs time for learning, request mobilization of resources, require abilities, and involve some cost for the actors. Starting from the analysis of the activity of those who negotiate, we'll see how complex are these process in witch, in fact, several negotiations run into each other, with heterogeneous actors who implicitly base their action on the loyalty of behaviours, and in witch there is always a trace of conflict

Full textThe establishment of a contract can be achieved by negotiation, but the conclusion of some of them however have had no prior discussion between the two sides. The absence of negotiation can lead to lack of expertise and to the demands of the changing economy. Such an absence has generally the effect on the contractual clauses being drafted up unilaterally by the strongest side. These subscription contracts contain not only a breach of liberty but also a contractual imbalance. These faults are mainly found in consumer contracts, stricto sensu banking contracts, insurance contracts, leasing contracts and transport contracts. If contractual rights can not be recovered during the fulfilment of the contract, the contractual balance could be obtained, a posteriori, by a judge. Yet, such an appeal is not automatic. Therefore, our study concerned the research of a procedure to establish the adherance to contracts combining the respect of contractual freedom, the research of a contractual balance, maintaining sufficient protection for the contributors and a certain swiftness of the agreements. The choice of a collective bargaining procedure between the grouping of professionals and consumer associations enables them to reconcile the different objectives. Following the example of collective bargaining applying to “right of work” and “house leasing rights”, it is the matter of working out the rules for negotiations, for conclusions and to apply the consumer agreements

So this PhD work aims to rebuild the actual forms of non-union representation in collective bargaining process to give a legitimate and more attractive access to an efficient form of labour relations in spite of the unavailability of representative trade unions. Full textThis research deals with the role of uncertainty in the negotiation process. Making use of the theory of bounded rationality, a new concept is introduced to help explain why certain negotiations fail to lead to agreement. This concept is named uncertainty concerning one's own interests in the negotiation. This research aims to explore how particular strategies may help to unblock failing negotiations by removing uncertainty. Two hypotheses are offered to explore the consequences of this uncertainty in the negotiation process. Firstly, it is argued that the presence of uncertainty may conceal the existence of possible grounds for agreement between the two parties and thus hinder progress. Secondly, concrete solutions are suggested which would reduce the level of uncertainty and thus favour the completion of successful negotiations. Emphasis is placed on the need to remove ambiguity from key negotiating points by clearly signalling the area of uncertainty. This research shows that focusing attention on uncertainty concerning one's own interests in the negotiation ; serves to reduce uncertainty. Indeed, the progress of reducing uncertainty may itself form part of the negotiation process. These two hypotheses are tested in two real negotiation situations : the reduction of working time in france and the establishment by I. B. M. Of a european works council

Full textOne can have reservations about the idea of negotiation in criminal law. Yet, theinitiative of reaching consensus in the field of repression – an initiative that derives from thetraditional adversarial model of criminal justice – can nevertheless be observed in theprocedural system with regard to procedures the implementation of which is entirelydetermined by the confession. The negotiation has been used to curb anti-competitivepractices, to handle class action lawsuits or to fight organized crime, and has definitelybecome a key process for lawmakers to consider. This observation has led to an examinationof this phenomenon through a definition which shall help to understand, on the one hand, thearticulation of the many forms of negotiation with the standard criminal procedure, and on theother, to appraise its consequences, especially those that are in conformity with the mainguiding principles of criminal justice. By placing the prosecution at the center of the justicesystem, plea-bargaining requires a strict legal framework to protect the basic rights of peoplesubject to trial. If discussions between the prosecution and the defendant have brought tolight some sort of agreement, the study of the inner workings of the bargaining procedureshas not exposed the existence of a contract. This dissertation aims to demonstrate that thecurrent development of plea-bargaining, a process which is illustrative of the probationaryrationale of the repressive North American criminal justice system, calls for some balancebetween the imperatives of efficiency and the respect of the distinctive characteristics of theFrench justice system

Full textIn the first chapter, after a presentation of institutional settings, I will focus on the use of sector-level agreements by large firms to reduce competition. Indeed, wage floors are binding for all firms of the industry, whether they sit at the negotiating table or not. This chapter provides a theoretical framework showing that such agreements can be used by dominant firms to reduce competition. In this framework, the higher the over-representation of large firms in employers' federations, the larger the bargained wage floors. This leads to the eviction of small firms. This prediction is tested on French administrative data. I document the domination of large firms within federations and devise an instrumental strategy to show that when the bargaining firms are relatively large compared to the industry standard - ie the lower the federation's representativeness, the higher are wage floors.In the second chapter, I look at the effect of sector-level agreements on innovation. It is based on a model with monopolistic competition between products of an industry on the one hand, and between industries on the other hand. First, I find that when the bargaining process occurs at the industry level, negotiating parties take into account that a wage increase will deter investments of competitors. Indeed, when the wage negotiated at the industry-level increases, the labor cost increase implies that the reward for innovations decrease. As this will reduce the probability to be outperformed, this will generate a wage surplus when the bargaining takes place at the industry-level, reducing both production and employment. Furthermore, it will decrease the research effort of the industry reducing the productivity growth.In the final chapter, I find that international competition mitigates the previous effects. Indeed, collective wage bargaining allows firms of a given industry to coordinate. However, international competition makes this collusive equilibrium unsustainable. Indeed, domestic firms face competition from foreign competitors which are not bound by those agreements. To support this argument, a Melitz-type model is developed and its implications tested on French data using the China Shock as a source of exogenous variation. The rent extracted during sector-level agreements no longer exist when domestic firms face Chinese competition

An evident norm from the Renaissance, secrecy could veil both the negotiation process and outcome. It was then contested from the Enlightenment to Wilson's ambition of an open diplomacy. In contemporary times, an injunction of transparency gradually exposes negotiation arenas and their processes. Following this perspective, this research examines from the viewpoint of negotiation theories the justifications and consequences of secrecy and transparency towards third-parties. It demonstrates that the latter constitute a dilemma : neither can permanently exclude the other. Concrete ways of articulating secrecy and transparency in international negotiations are explored. A study of the international negotiations on air services agreements illustrates and verifies the previous findings

Full textThis thesis is a reflection on the international collective bargaining and, more generally, professional relations in multinational firms. The study is constructed around two main ideas which are based on two questions. The first question concerns the very existence of multinational collective bargaining as a social fact. Has anyone ever negotiated on an international level? At first, the results of this research on experiences of multinational collective bargaining appear disappointing. Disappointing, but not utterly hopeless. One particular case was found which concerned professional collective bargaining on an international level that was finalized by a written contract. This unique experience was worth describing and subsequently analyzing. The second question concerns collective bargaining controls. Will we have in the near future a regulation governing international collective bargaining? It is impossible to find, in the international juridical order, a rule that could be used as a substitute for national regulations, which already encourage an ever increasing number of collective agreements. In order to consider the experience described in part one as an example of an international collective bargaining and collective agreement regulation then one must accept as possible the existence of some kind of “professional law” enacted by a “socio-professional juridical order”

To avoid mass litigation, some specific litigations, or big criminal organizations, negotiation appeared as a new tool to settle criminal disputes. Rarely established by texts, negotiation nevertheless interferes in Courts' pratice using the defendant's agreement. Only confined to criminal transaction for a long time, which puts off criminal prosecution, based on the defendant's agreement to plead guilty and to accept his sentence, criminal sentence negotiation has significantly increased during the last years. With the same mechanism of their precursor, the French criminal "composition" and the plea bargaining must allow, disregarding debates on guilt, to speed disputes resolution, in order to reduce Courts congestion. With criminal mediation disputes, negotiation provides a new purpose to criminal dispute resolution, to restore the social link between an offender and his victim. More limited but also more controversial, negotiation, in order to obtain evidences, and the regret of a criminal organization member, confers on alternative dispute resolution a bad reputation. Several critics blamed that for establishing bargaining, deeply altering the role of traditional actors in criminal procedures, and its difficult compatibility with the guiding principles of the criminal justice system

Full textLa négociation territoriale nécessite de considérer de manière attentive des acteurs faibles, des acteurs absents et des valeurs morales pour une décision à la fois respectueuse des hommes et des écosystèmes. La méthodologie proposée est testée sur un site d'application situé dans la Plaine du Forez (Loire, France), secteur rural et agricole en bordure du fleuve Loire, où cohabitent un industriel du granulat et une association de protection de la nature. Ce site, qui a subi de nombreuses modifications et altérations d'origine anthropique (exploitation de granulats, agriculture intensive, endiguement du fleuve, barrage hydroélectrique), fut aussi pionnier en matière d'aménagement à vocation écologique d'anciennes gravières.
L'application proposée se focalise sur la nappe phréatique de la zone et aborde le territoire en 3 dimensions. Une dimension physique prise en charge par un modèle mathématique aux différences finies d'écoulement souterrain. Une dimension biologique qui combine analyses physico-chimiques et indicateurs biologiques (invertébrés souterrains et macrophytes des gravières). Une dimension humaine qui est explorée à l'aide d'un modèle d'inspiration sociologique appelé l'acteur en 4 dimensions. Les résultats de ces 3 études spécifiques permettent d'une part d'améliorer la connaissance de la ressource en eau du territoire, notamment l'aquifère, et d'autre part d'obtenir des représentations territoriales validées et complémentaires (cartes issues de SIG). Il s'agit d'améliorer et de compléter les représentations physiques du territoire à l'aide des représentations biologiques et réciproquement. L'étude sociologique permet de connaître les représentations territoriales les plus adaptées en fonction des acteurs. Au final, ces représentations, une fois converties en argumentaires spatiaux adaptés, sont mobilisables en tant qu'outils d'aide à la négociation/médiation territoriales, par exemple, pour le choix du site d'implantation et l'aménagement d'une gravière en milieu alluvial.
Au final, ce travail a permis de mettre en oeuvre une plate-forme pédagogique informatisée qui permet de tester l'argumentation spatiale et de simuler un processus de négociation en incluant jeu de rôles (acteurs, médiateurs), outils d'aide à la négociation/médiation et représentations territoriales. La négociation simulée vise à choisir l'emplacement et le mode de réhabilitation/réaffectation d'une gravière en milieu alluvial selon un processus participatif. La simulation propose ainsi un partage des connaissances acquises dans ce travail, ainsi qu'un déroulement permettant aux apprenants (joueurs) de se familiariser avec des outils d'aide à la négociation et les processus de négociations multi-acteurs. Cette simulation a permis de tester les argumentaires spatiaux développés dans le cadre de ce travail.

Full textIn civil liability actions, the proportion of cases that are settled through conciliation remains very low in some countries. Negotiation failures lead to trials, the cost of which is high for both the state and the parties involved in litigation. in this thesis, we use a wide range of empirical tools to investigate the determinants that contribute to the success or failure of settlement between two parties involved in a legal action. We contribute to this topic through four original studies. We first investigate the rationality of players in one of the most simple bargaining games : the ultimatum game. For that purpose, we perform a metaanalysis of the three last decades of experimental research. Proposers’ choices, that do no match the theoretical equilibrium of the game, are found to be rationalegiven the observed behavior of responders. Subsequently, we perform a comparative meta-analysis of the ultimatum and the dictator game to investigate the “fairness hypothesis” according to which off ers in these two games are not significantly different. We find that the more developed a country, the more likely the “fairness hypothesis” is to be rejected. In a third place, we aim to identify the forces that shape decision-making in the pretrial conciliation phase of French labor courts. The results are twofold. First, conciliation is less likely when plaintiff s are assisted by a lawyer. Second, we find that the likelihood of settlement decreases as the amount at stake increases. Finally, through an original experiment, we empirically investigate the behavior of individuals who do not want to bargain, but are forced to do so. We show that individuals who are forced to bargain make less generous offers and are less likely to conciliate

Full textIn a context of globalization, facing increased trade and the increasing complexity of international contracts, pre-contractual negotiations take a special dimension: creating new obligations, stretching the length of talks, multiplications of preliminary contracts, are leading to transform this simple transition in a primordial stage of contracts. The different phases of negotiation between international partners and will generate interest litigation private international law.Indeed, the legal negotiation differs from one legal regime to another. Common law countries adopt an individualistic principle for talks with extensive contractual freedom, whereas civil law circumscribes the freedom of contract in respect of a duty of good faith. Therefore, it is essential for the parties to know with certainty the law applicable to their pre-contractual relationship.However, the existing conflict rules, supposed to guarantee the legal security of the negotiating parties by ensuring predictability solutions are not appropriate at this time. In this perspective, the purpose of the research focuses on considering the specificities of the pre-contractual period and issues of private international law relating thereto and attempts to provide effective responses by providing conflict rules adapted to ensure legal certainty aspired parties to the negotiation

Full textOur research is embedded into the scope of studies on the linguistics of verbal exchanges in business. This research allows us to fully understand the functioning of verbal exchanges in business negotiations and particulary in terms of the use of various linguistic and strategic elements used by the participants in the four sessions of a Chinese and French corpus. The interaction analysis of the corpus allowed us to work in different dimensions : linguistic, business and cultural. The inter-cultural researches permitted us to show the differences in behavior between Chinese and French businessmen : the different ways of using strategic argumentation as well as the politeness. Bases on crossed studies of the verbal interactions and the business negotiation, some didactic conclusions are raised. These are incorporated into the course of the FLE in China, entitled : "business negotiations"

Full textThis thesis focuses on the effects that information has on incentives. The three papers provide and explore some results when the information is the main variable of interest, it is made endogenous, not homogeneous between actors and evolving over time in a way that is not necessarily rational. The first paper studies hold-up problems in vertical hierarchies with adverse selection showing that as the bargaining power of the worker increases, distortions coming from asymmetric information vanish. Moreover, it studies the effect of schooling and degree of heterogeneity in the workforce on the allocation of bargaining power in regulating markets. The second paper relaxes the common assumption of homogeneous beliefs in principal-agent relationships with adverse selection. In an evolutionary learning set-up, which is imitative, principals can have different beliefs about the distribution of agents’ types in the population. Convergence to a uniform belief depends on the relative size of the bias in beliefs. In addition, the set-up is a version of a stable cobweb model. Our approach offers explanations for alternating periods of oscillating and relatively steady quantity. The third paper studies how the informative content of legal policies as strict-liability and fault-based, in case of moral concerns, influences the optimal design of liability regimes. Many recent cases show that an individual found to have caused harm faces not only the possibility of a legal sanction — e.g., the damages he must pay — but also social boycott, disapproval or stigma. Having presented the debates and developments, political as well as legal, leading to this established fact, it seems obvious that these contract-like instruments can only be improperly termed contracts. At the most they are declarations of intent without any legal effect and without right of reply. However, the requirements of continuity and stability of the system and the impact of international and European law demand a change in this state of affairs

Edgeworth, the study of bargaining phenomena, and especially the problem of the indeterminacy on the bargaining outcome has become on the important problems for economics and management sciences. The purpose of this work is to establish the diagnostic elements which are at the origin of the indetermanicy on the bargaining outcome. This research tends to emphasize the place of the power within the general framework of the logic of the bargaining process. The bargaining power expresses itself through its capacity to modify or produce these rules. The point of view insists on the hypothesis that the specific models of bargaining used must be contingent upon the context of the problem, while disproving the symmetry postulate included in game theoretical models, either in the axiomatic conception with complete information or in terms of a bayesian equilibrium with incomplete information. The approach also captures the autonomy of the bargainers by introducing to a bargaining model the concept of the adhesion of players. By using a formalized approach which models the reputation phenomena as a heterogeneity factor into strategic and organizational aspects of negotiation. It is then possible to extend the h. A. Full textAt first glance, it may seem surprising to focus on negotiation in insolvency law since this branch of law is marked by the seal of public order. However, the logic of dialogue between the debtor and his creditors is increasingly observed in most of the procedures offered to the debtor to deal with his difficulties. The legislator's perspectives have changed: it is no longer just a question of sanctioning, but more of preventing difficulties and safeguarding companies. This evolution has given rise to the desire to understand the current phenomenon of negotiation in its effects on the law of companies in difficulty. The aim was to determine, in the texts, the reality of the negotiations and, as a counterpoint, the real share of the judge's power. The promotion of the negotiation process in dealing with business difficulties has upset, on the one hand, the balances within the procedures. Negotiations appear to have been strengthened in procedures that were originally judicial and collective and in which unilateralism was prevalent. Conversely, mutual agreement procedures are more judicial in nature than before. As a result, the dividing line between amicable and judicial proceedings is less clear than in the past. The development of negotiation has also upset the balances between the players: at the heart of the search for a solution to the company's difficulties, the debtor and his creditors are placed at the forefront of the processing. The changes brought about by the integration of negotiation into the law of companies in difficulty are also changing the values traditionally attached to the subject. Traditional principles such as the equality of creditors are reduced. However, these changes offer above all a more balanced and attractive law. If the judge's traditional office seems to be distorted, his power is strengthened accordingly. The negotiation process requires the establishment of a strict legal framework and significant judicial control to ensure that the fundamental rights of the parties are guaranteed. Above all, the debtor and his creditors will more easily accept a solution in their control. This development shows that the law is more based on the idea of trust. Thus, because of the many advantages known to it, the amicable way could still play its charms with the French legislator

But, since 1950, the french legislator has decided on the principle of a free salary bargaining between the employers' organisation and the workers' unions as well as on the mechanism of the implementation. This mechanism has been improved under the law of 13 july 1971 instituting the right to collective bargaining and under the law of 13 november 1982, known as "loi auroux" (auroux law) which makes it compulsory to nogotiate salaries each year. But in wiew of the legal and administrative measures taken since 1952, one can rightly ask the question as, to whether, the principle and the mechanism of its implementation have not became obsolete. Indead, the political autorities have set up a number of hurdles which make it impossible to implement the law of ii february 1950, under the allegation of economic reasons, namely the necessity of inflation control. The thesis gathers three contributions that deal with the impact of the process of interaction on price formation thought the emergence of negotiation and the existence of price discrimination. It shows that institutions like decentralised negotiations are considered as a way to diffuse information between agents and allow them to act under uncertainty about other agents' reservation prices. Moreover, negotiations allow agents to participate to the market activity whatever their demand. If their personal characteristics allow, agents should be loyal, buy as most as possible to the same seller and bargain, in order to obtain an acceptable 'price'

Full textThere is no consensus on Beninese land and environmental law at the level of rural communities because of the exogeneity of its legal referents. The fiction that characterizes positive law does not make it possible to respond effectively to the needs for standards of actors at the various levels of land and environmental regulation. The legal complexes with regard to the law of the colonizer and the unfavourable prejudices on legal endogeneity constitute potential threats to the national ecological interest and to the land tenure-environmental security of rural communities that live exclusively from family farming. In the face of the declared ecological emergency, climate change and the insecurity of land tenure in protected areas and common land heritages, a new legal perspective must be given to the relationship to land and the biotic elements it supports. The challenge for Beninese positive law is twofold: (a) taking account of local practices, customs and habits, insofar as their legality has been proven, which makes it possible to establish State law in its socio-cultural and economic context and to ensure its effectiveness in the governance of land and environmental resources; (b) the establishment of transparent mechanisms for the settlement of rural land conflicts and the development of mechanisms to take social arrangements out of orality for more formalism and socio-ecological coviability. Socio-ecological coviability depends on the country's ability to bridge the gap between legal endogeneity and State law. And only negotiation in land tenure-environmental regulation makes it possible to move towards this pragmatic legal perspective through a socio-anthropological approach to negotiated law

From a right based on a segregated nature to a right based on a systemic and dynamic approach of the interrelations between man and his environment, we work in 2017 with a flexible and negotiated right. Knowledge exchange through expertise gradually opens up a space for negotiation where economic interests and scientific reality merge, giving rise to a modernized conception of nature: the assessment of biodiversity by Services it renders to man. However, the complexity of nature surpasses the apprehension that man can have. Therefore, although the legal procedures applicable to environmental impact assessments still reflect the limits imposed by the economic power over nature, the law nevertheless opens up a breach through the development of digital tools that could equilibrate forces. The emergence of an ecological negotiation in which secular scientific expertise, public participation and the creation of a common knowledge of biodiversity would also influence public decision-making may well be emerging

Full textConstatant l’actuelle internationalisation enthousiaste de la négociation de plaidoyer et craignant ses conséquences possibles sur les impératifs de justice qualitative, l’auteur propose de remettre en question l’opportunité du recours à cette pratique en étudiant l’adéquation des discours relatifs à la négociation de plaidoyer avec leur mise en oeuvre, c’est-à-dire la mesure dans laquelle les espoirs et appréhensions attachés au recours à la négociation de plaidoyer s’avèrent fondés. L’auteur adopte d’abord une approche historique dans le cadre de laquelle il étudie l’évolution des discours qui encadrent l’introduction de la négociation de plaidoyer par la pratique aux États-Unis et au Canada et par initiative législative en France. L’étude de l’opposition initiale des acteurs anglo-saxons à la négociation de plaidoyer, de leur acceptation progressive de cette pratique et de l’introduction des formes françaises de négociation de plaidoyer que sont la composition pénale et la comparution sur reconnaissance préalable de culpabilité révèlent les principaux espoirs et appréhensions attachés au recours à la négociation de plaidoyer. D’aucuns vantent ses avantages en matière d’efficience et de répression, alors que d’autres craignent qu’elle contrevienne aux principes fondamentaux de justice pénale, induise des plaidoyers de culpabilité non volontaires et produise une justice aléatoire. Empruntant une approche sociologique, l’auteur entreprend ensuite d’étudier la littérature disponible afin d’évaluer la mesure dans laquelle les modèles américain, canadien et français de négociation de plaidoyer réalisent une mise en balance équilibrée des impératifs d’efficience et de justice qualitative. Les données disponibles permettent de constater l’existence d’un grave déséquilibre aux États-Unis et d’un fragile équilibre en France, bien qu’elles s’avèrent insuffisantes pour dresser un portrait de la situation canadienne. L’auteur en conclut que l’ampleur des enjeux et la faiblesse de l’adéquation entre les discours relatifs à la négociation de plaidoyer et leur mise en oeuvre commandent non pas enthousiasme mais prudence dans le recours à cette dangereuse pratique.
