Abstract:
This study aims to discuss how the explanation of having sex outside of marriage in the perspective of hadith. This research uses qualitative type method with content analysis through literature study. The results and discussion in this study include a general view of adultery, takhrij sanad in the hadith regarding adultery, and how to explain the prohibition of adultery. The conclusion of this study shows that adultery is a behavior that is prohibited both religiously and legally in Indonesia, and the hadith that explains the prohibition of adultery is a saheeh hadith. This study warns of the dangers and other negative impacts of adultery.

Abstract:
Scholars differ on whether the repentance of an adulterer can abrogate the punishment of the limit ?. Some scholars state that there is no fall at all, while others state that the punishment is limited to fall. In this regard, Ibn Taymiyyah's opinion is the same as the last opinion that the repentance of an adulterer can remove the demand of the limit as long as it has not been submitted to the ruler, but if it has been submitted to the ruler then the limit does not fall so it remains punished and his repentance is accepted by Allah SWT. As for the research method is qualitative, the type of literature research, research data from library materials in the form of books of jurisprudence, law, and other relevant literature then the data that has been collected, both from primary, secondary, and tertiary data, then analyzed by descriptive-analysis. The results of the study showed that according to Ibn Taymiyyah, the perpetrator of adultery who repented before being complained to the government, fell ḥadd adultery. The perpetrator does not have to admit his actions because the attitude is seen as better. As for the adulterer who repents after being complained to the government, then it does not fall ḥadd adultery. The perpetrator must still be punished, his repentance is accepted by Allah SWT., While the punishment of ḥadd as a consummation of his repentance. The argument used by Ibn Taymiyyah about the fall of ḥadd zina due to repentance refers to the provisions of the QS. al-Nisā 'verse 16, QS. al-Māidah verses 33-34, QS. Ṭāhā verses 121-122, and the hadith narrated by Abū Dawud about the punishment of Maiz. The method of istinbāṭ that he uses tends to use heroic reasoning, that is, looking at the sides and rules of language, general and special relations, cause and effect, and understanding the words of the Qur'an.

Abstract:
In Islam, adultery is a very bad act and a big sin for the perpetrator. However, in modern times, it is not uncommon for Muslims to know about the prohibition of adultery but still do it. Therefore this paper tries to explore further the interpretation of adultery (zina) according to Ash-Shabuni in the Shafwatu Tafasir commentary book. This study uses a library research method, which is a research whose data collection method is based on literature from scientific books related to the problem of adultery. The results of the research according to Ash-Shabuni zina for unmarried adulterers (ghairu muhsan) were beaten a hundred times and exiled for a year while adultery for married offenders (muhsan) was stoned to death.

Abstract:
Adultery is an offense or activity that is commonplace in large and metropolitan cities such as Jakarta. Perpetrators of adultery will usually receive legal and social sanctions from the surrounding community. The same thing happened to the woman who was caught in adultery in the text John 8:1-11. The woman was judged unfairly according to the law by the scribes and Pharisees. In contrast to the scribes, Jesus was there to provide forgiveness and assistance to the woman who committed adultery. Through this research, the author wants to provide the example and method that Jesus gave as a guide to how to deal with cases of adultery which are rampant among Christians in Jakarta. This research uses the hermeneutic method and literature study of the story of the woman who committed adultery in the text John 8:1-11. Through this research, it is hoped that Christians, especially God's servants, will be able to emulate the attitude of Jesus who forgave and accompanied every Christian in Jakarta who fell into the sin of adultery.

Abstract:
he lineage of the children of adultery as agreed by religious scholars (‘ulam?’) and Indonesian Ulama Council (MUI) is ascribed to the mother, not the father. This is due to the unclarity of the marital bond between the woman and the man who conduct adultery, and due to the uncertainty of sperms that fertilize the ovum (egg cell) of a woman. Consequently, the children of adultery become exiled and marginalized in society, bearing mistakes of their ‘parents’. In fact, Islam has emphasized that every child born is essentially chaste. If the child born from adultery is ascribed to the mother, he/she does not have whatever rights from the father. Therefore, it is important to review the question regarding the lineage of the children of adultery, in order to determine the future of the children. Based on the literature research with critical analysis method, this article argues that the children of adultery remain to be biologically ascribed to the father together with their rights from the latter. The children born from adultery do not bear the mistakes of their ‘parents.’ In the contemporary era, to determine the children lineage can use such a tool as DNA test that is believed as accurate.

Abstract:
This thesis examines literary images of masculinity and femininity, their function and depiction in marriage roles and homo-social relationships in the context of crisis: wifely adultery. The study is heavily reliant upon vernacular texts, especially Old French works from the twelfth and thirteenth century including works from the genres of romance, lais, fables, and fabliaux. Latin works including historia and prescriptive texts such as customaries, penitentials, etiquette texts and medical and canon law treatises are also used to contextualise themes in the Old French literature. The introduction summarises modern literary and historical criticism concerning sexuality in the Middle Ages. It then discusses the influences of the Church, philosophy, medicine, natural theory and society on medieval definitions of sexuality to contextualise the literature which is focal to this thesis. The following four chapters each consider a single character in the adulterous affair: the adulteress, the husband, the lover and the accuser. The literary images of each character are analysed in detail revealing the diversity of depictions between and also within genres. This enables the identification of medieval sexual constructs, challenging some previous critiques of representations of sexuality in the Middle Ages. The final chapter explores the language by which the sexual act is presented. Furthermore, it shows how language is used and occasionally abused in committing, prosecuting and evading punishment for adultery and how it can be wielded as a weapon of women. Through the focus of a body of literature rich in depictions of sexuality, this thesis questions the misogynist overtones often attributed to medieval literature. The diversity of images shows that the literature illustrates a wide range of opinions and ideas reflective of the complexity of sexuality in medieval society.

Abstract:
This thesis examines the sociolegal context of the representation of infidelity in the Anglo-American novel. It locates the first serious Anglo-American treatment of infidelity in the novels of Henry James and Ford Madox Ford; and it situates these writers for the first time in their immediate legal context. The dominant mode through which infidelity was discursively defined during this period was simultaneously legal and sensational: the publication of "Divorce Court" trials in the daily newspapers. The implication of this context for the novel is twofold. The focus on narration from the perspective of the betrayed party prompts a local questioning of knowledge (of knowing one's spouse), and a more general questioning of the epistemoloigcal premises of the realist novel itself. The novels considered here make clear the limitations of a legal discourse committed to a disinterested record of "what happened." In the process, they illustrate several of the narrative innovations most distinctive to the modernist novel. Secondly, what will be called an "aesthetics of suspicion" and "domestic surveillance" distinguishes James's and Ford's novels from the central critical tradition which reads the representation of infidelity as subversive of social norms. Instead, these novels reinforce, thematically and formally, the legal policing of infidelity. Doubt of both conjugal and narrative fidelity, then, becomes the means through which the legal policing of infidelity in the divorce court is covertly extended in the novel.

Abstract:
This thesis is an examination of how the themes of adultery and regeneration are interwoven and explored by selected English novelists in the first half of the twentieth century. It is essential to establish that Ford, Lawrence, Waugh and Greene do not adhere to the ‘archetypal' pattern of the adultery novel established in the nineteenth century and, in fact, turn that pattern on its head. Ford's The Good Soldier and Parade's End provide two differing perspectives. The first uses adultery as a metaphor for the disintegration of English society, mirroring the social disintegration that accompanied the First World War; Parade's End, however, presents an adulterous relationship as being a regenerative force in the post-war society. Lawrence's Lady Chatterley's Lover also uses an adulterous relationship as a means of addressing the need for social, and national, regeneration in the inter-war years. Waugh's A Handful of Dust presents a woman's adultery as the ruin of not only a good man, but also civilisation in general; Brideshead Revisited is more religious in tone and traces the spiritual regeneration of its central character, whose conversion, ironically, is made possible through his adulterous relationship. Similarly, Greene's The Heart of the Matter and The End of the Affair portray the process of spiritual regeneration; in both novels this movement towards salvation is intertwined with an exploration of adulterous love. The ultimate question probed in this thesis is how the twentieth century novel of adultery overturns the traditional literary approach to the subject. Adulterous unions and illegitimate children are no longer presented as being exclusively socially destabilising or subversive in these novels; most intriguingly significant is that, in some of these novels, the illegitimate child becomes a symbol of hope, and, indeed, of regeneration.

Luigi Pirandello's two short stories La verita and Certi obblighi and the play derived from them Il berretto a sonagli seem to be, at least on the surface, about adultery. The three male protagonists' dilemmas come about as a result of their wives' sexual transgressions, which consequently impose certain "obligations" upon them. The themes of adultery and betrayal, however, are merely surface elements, used to explore the theatrical nature of identity and of all social experience. Specifically, the three works show how role-playing-within-roles safeguards the identity of the betrayed husbands, by protecting them from social humiliation.
Since all Pirandellian characters role-play, and as a consequence portray and assume multiple identities, this thesis examines the function and significance of this technique in both narrative and theatrical contexts. It attempts to show that while the device is a feature common to all three works, it is in the dramatic adaptation that role-playing in relation to identity acquires its more visible and effective treatment.

O presente trabalho dissertativo tem por finalidade demonstrar de que forma a temática do adultério feminino – abordada nos contos A cartomante, de Machado de Assis, e A dama do lotação, de Nelson Rodrigues – aponta para a metamorfose do discurso identitário feminino no decurso de aproximadamente um século, descortinando a influência das mudanças próprias da evolução da sociedade (tanto no âmbito jurídico, como no campo da moral e dos costumes) na ficção literária trazida a efeito pelos autores nos referidos contos. Em decorrência da riqueza temática do corpus literário elegido para análise nesta pesquisa, e no intuito de investigar a evolução do discurso identitário feminino em relação ao histórico do crime de adultério no ordenamento jurídico pátrio, desponta a necessidade de utilização de um referencial teórico interdisciplinar para subsidiar as reflexões concernentes ao processo de construção/transformação da identidade feminina, ao adultério (em especial o praticado pela mulher) e à relação entre o Direito e a Literatura. A partir de tais reflexões, fundamentadas no aporte teórico de autores como Antonio Candido, Arnaldo Sampaio Moraes de Godoy, Michel Foucault, e Simone de Beauvoir, dentre outros, pretende-se demonstrar que as escritas empreendidas por Machado de Assis e por Nelson Rodrigues em A cartomante e A dama do lotação, respectivamente, sugerem certa consonância com os panoramas social e jurídico em vigor no Brasil nos diferentes períodos em que os textos foram produzidos. Finalmente, mediante a análise das tramas desenvolvidas no corpus literário em questão, busca-se, ainda, explorar a factível ideia de que o processo inventivo de seus autores terá sido influenciado pelo olhar social lançado à figura da mulher, no passado subordinada à dominação masculina e hoje potencialmente mais liberta e independente.
This paper aims to demonstrate how the female adultery issue, that appears in the tales: A Cartomante, by Machado de Assis, and A dama do Lotação, by Nelson Rodrigues – reveals the transformation of the female identity discourse during almost a century, showing that the authors’ tales were influenced by the society changing and evolution, both in the legal and in the moral and manners field. Due to the richness theme of each tale and in order to analyze the evolution of the female identity discourse related to the historical adultery crime on Brazilian legal System, it was observed an interdisciplinary theoretical framework to guide reflections on aspects related to the female identity construction/transformation; adultery (mainly those committed by women) and the relationship between law and literature. Based on these reflections, supported by the work of several authors like Antonio Candido, Arnaldo Sampaio Moraes de Godoy, Michel Foucault, Simone de Beauvoir, among others; the paper aims to demonstrate that the literary works developed by Machado de Assis and Nelson Rodrigues in A Cartomante and A dama do lotação, respectively, suggest a certain level of conformity with the social and legal context established in Brazil at the time the texts were produced. Finally, analyzing the plots developed in the literary corpus under consideration, it is possible to explore the perfectly feasible idea that the authors creative process have been influenced by the way the society looked at the woman – in the past subjected to male domination and now potentially more independent and free.

Abstract Legal scholarship has increasingly borrowed from other, non-law, disciplines; as it has done so, legal scholars have taken increasing interest in the possibilities and limits of interdisciplinarity. Tellingly, virtually all discussions of interdisciplinary scholarship call upon two related metaphors. The first is a metaphor of border-guarding. This is an immigrant—emigrant scholarship, employing tropes of insiders and outsiders, residents and aliens; it relies on images of imperialism, scavenging, and parasitism. The second metaphor is one of fidelity. This metaphoric realm employs tropes of seduction, enchantment, betrayal, faithlessness and abandonment, calling on images of marriage, adultery, and divorce. The two metaphors are linked by a common theme, the theme of boundaries that can be respected or crossed.

Abstract:
This introductory chapter provides a background of the pericope adulterae—the episode involving Jesus and a woman caught in adultery. The pericope adulterae boasts a long, complex history of reception and transmission, which, at least early on, placed it on the margins of Christian interpretation. Today the story is so widely known, so widely quoted, and so often alluded to in art, literature, film, and public discourse of all sorts that “throwing stones” serves as a cliché. Even so, the textual instability of the episode has not been forgotten, especially by biblical scholars, who continue to debate the implications of its unusual past. By now, most scholars have concluded that the pericope was not original to the Gospel; rather, it was added by a well-meaning interpolator at some later date, after the Gospel of John was already circulating.

Abstract When Ovid was relegated in AD 8, he left a notorious problem for scholarship. Some attribute his downfall to the Ars Amatona, whose second edition appeared about r sc, but that raises questions about the time-lag as well as about the misunderstanding of literature. Others emphasize the disgrace of Augustus’s granddaughter Julia, banished for adultery in the same year as Ovid, but doubts remain about the degree of complicity needed to explain the poet’s punish¬ ment. Again it has been supposed that the domestic scandal masks a political plot, a possibility that has also been canvassed over the disgrace of the elder Julia in 2 BC. Unfortunately the evidence for the various theories is so scattered that it may distract attention from the tone of particular poems, yet in this psychological drama overall impressions ought to count as well as fragments of fact. Here I shall try to interpret a single elegy, Tristia 4. 3, looking at it in sections as it comes; though the debate about the exile will not be repeated in detail, a view will emerge at the end about what happened.

El periodo de transición entre la infancia y la adultez requiere de un proceso de acompañamiento en diversos aspectos, dentro de los cuales se incluye la conducta vocacional. Diferentes estudios han demostrado que la deserción universitaria se encuentra asociada, en gran medida, a una inadecuada orientación vocacional y profesional, que permite que el estudiante identifique si sus actitudes son apropiadas o afines al área de estudio escogido. Así mismo, es claro que las nuevas generaciones buscan pedagogías innovadoras, que los haga sentir partícipes del proceso, razón por la cual, los juegos serios se convierten un aliado clave el proceso de enseñanza al ser herramientas que permiten capacitación y diagnóstico de comportamientos considerados deseables en un grupo de individuos que comprenden una organización o un colectivo. Se evidencia la oportunidad de medir el nivel de afinidad del público objetivo con los pregrados de Ingeniería Administrativa e Industrial de la Institución Universitaria Pascual Bravo, implementando juegos serios con el propósito de mitigar la deserción estudiantil en los programas como consecuencia de falta de asesoramiento vocacional. Para el desarrollo de esta investigación se parte de un marco teórico sobre el concepto, los antecedentes en el ámbito académico, el contexto nacional e internacional, las características y factores que determinan la vocación, así como también, teorías de elección profesional y la forma en la cual, los juegos serios favorecen su abordaje. La identificación de la problemática permite determinar que el objetivo general sea el diseño de un juego serio que permita medir el nivel de afinidad con los pregrados de Ingeniería Administrativa e Industrial, de la Institución Universitaria Pascual Bravo, lo cual se espera lograr a partir de la identificación, mediante un análisis bibliométrico de los aspectos relevantes asociados a vocación profesional, juegos serios, e Ingeniería Administrativa e Industrial y aplicar el juego serio diseñado a participantes del sector académico y real, con el propósito de analizar los resultados obtenidos. Se establece entonces que el enfoque metodológico mixto es el que mejor se ajusta a las necesidades del proyecto, el cual permite la inclusión de variables cualitativas y cuantitativas, que permitan el análisis desde la literatura, pero también incluya a los actores afectados, con un alcance exploratorio - descriptivo. La investigación está sustentada en fases metodológicas, a partir de los objetivos específicos anteriormente mencionados. Finalmente, con la ejecución del presente proyecto de semillero de investigación se espera tener como resultados un informe final de investigación, la participación en dos eventos científicos que permitan la divulgación de los resultados y el desarrollo de un juego serio.

Las nuevas generaciones que demandan servicios educativos en las Universidades en Colombia están llegando cada vez más a temprana edad, mientras que a finales del siglo XX el promedio de edad era de 18 años, dos décadas después, el promedio es de 16. Además de la conveniencia de neutralizar la tendencia a una adultización temprana, el tránsito de la educación media a la educación superior en la fase final de la adolescencia, demanda reflexionar sobre la formación básica, los desarrollos pedagógicos y curriculares de inicio de carrera y el acompañamiento, ya que como reporta la literatura, las adaptaciones y ajustes acontecen en momentos del Complejo de la Langosta. Ante las características y expectativas de las nuevas generaciones, las demandas cognitivas, de orientación al logro, desarrollo de habilidades blandas en el primer año de Universidad, sumado al compromiso que adquieren los estudiantes con sus familias; los semilleros de investigación devienen como espacios extracurriculares flexibles, de autoformación y empoderamiento, de formación integral e interdisciplinariedad que facilitan el encuentro y acompañamiento entre pares, el trabajo en red y el agenciamiento con horizontalidad de inquietudes y búsquedas en los que la ciencia y la solución de problemas en contexto, son motor e impulso. Si bien, en la variada tipología de semilleros de Ingenierías en la educación superior en Colombia hay una tendencia a que la participación, ingreso y permanencia en estos espacios de investigación-acción se favorezca hacia mitad de carrera, hay cada vez más experiencias exitosas sobre el lugar e importancia de los semilleros al inicio de la formación profesional. Los semilleros en primer año aportan de manera decidida a la permanencia estudiantil dadas las oportunidades de reconfiguración de sí, del apoyo y abrigo que ofrece la comunidad de aprendizaje entre pares, el acceso y uso de saberes expertos en la solución de problemas contextuados y de incidencia social, y la libertad de experimentar un viaje de conocimiento flexible pero focalizado desde el saber-hacer, donde el semillerista atraviesa el camino en condiciones de aprendizaje activo y participación colectiva. Además, continuar este camino desde el inicio de la carrera permite que el estudiante reconozca mejor su orientación vocacional, explore espacios y recursos tales como: laboratorios, biblioteca, sistemas de habitación y profesores, así como estimula el empoderamiento de las mujeres en las ingenierías. El trabajo muestra el impacto de los semilleros de investigación en Ingeniería en la Universidad Autónoma de Occidente, espacios de formación regulados y flexibles en los que participan estudiantes de las 14 ingenierías que actualmente oferta la Universidad, y que para el caso de las nuevas generaciones, ofrece en primer año de formación atajos para el fortalecimiento de sí, para potenciar el trabajo colaborativo, la solidaridad, pertenencia, autoaprendizaje, horizontalidad y agenciamiento entre pares, todo ello, fundamental en el complejo paso de la adolescencia a la adultez, y en el singular y prometedor espiral existencial de las nuevas generaciones.
