This paper deals with explaining the definition of adultery in language and Sharia، the extent of the limit for adultery and the evidence for prohibition. It also shows the limit of the unmarried adulterer in Islamic law and the limit of the married adulterer in Islamic law. The researcher then talked about the limit of adultery in Islamic law، compared to the punishment issued by the Iraqi Penal Code of 1969. A comparative study is conducted and arrived at consequences of both that: If adultery spreads in a nation، then it withers away and its population decreases، and there some scientist who state that adulterers must be stoned for a hundred times and their skin is probably thrown also.

Adultery is derived from a French word, about that has evolved from the Latin verb, “adulterium”, means to corrupt[1]. Adultery is defined as the consensual extramarital sexual relationship that is considered objectionable on social, religious and, moral and earlier on the legal grounds as well. Though adultery is decriminalized, it still exists as a delinquent act as it violates social norms which an individual is believed to be followed. Since the last 158 years, it was treated as a crime but after the verdict of Hon’ble Supreme Court in Joseph Shine v. Union of India, adultery is decriminalized and remained merely a civil wrong rather criminal offence. There were two major contentions for the decriminalization of adultery. They were:- This section provided husbands with the right to prosecute their wives’ adulterer while wives were deprived to complain against the adulteress of their husbands. The section was ignorant on the matter of the adulterous act of the husband.

Punishment has also been determined This article aims to describe the review of Islamic law and the criminal law code against the practice of adultery. A very bad act not only from an Islamic point of view but also from the point of view of the Criminal Code. However, by using the method of comparative analysis found differences between Islamic Law and the Criminal Code in defining the term adultery and its legal consequences. Sexual relations between young couples are not categorized as adultery in the Criminal Code because they are not currently in a legal marriage bond. The Criminal Code also does not ensnare adulterers who do not comply with Article 27 BW even though they are in a legal marriage bond. In addition, if the husband or wife of the adulterer gives permission to his partner to commit adultery, then Article 284 cannot prosecute him. Abstract. The main feature of the research discusses the adultery on Hester Prynne and Arthur Dimmesdale in Hawthorne’s The Scarlet Letter. Adultery is caused by several things and has impact to the doers. The research purposed is to find out the factors cause adultery done by the two main characters and the impacts on the doers. The research is qualitative research. Therefore, it applies descriptive method since the writer describes the analysis based on the data and the theories. The research uses psychological approach that just focuses on the psychological condition of adultery’s doers. The data are collected from the original text of The Scarlet Letter, then analyzed in terms of factors and impacts of adultery. The result of the research was clearly found and explained that the act of adultery is caused by several things, namely need of safety, need of affection, need of love and belongingness, and need of sex. while its impacts make the doers experience certain psychological conditions, these are esteem need, psychotic anxiety, safety need, develop superego, neurotic anxiety, mental disorder, and psychosomatic illness . The act of adultery makes the doers have different conflicts because they have different ways in facing the impacts of adultery. Hester has external conflict such as conflict with the society, magistrates, her husband, and her child. While Dimmesadle has internal conflict such as double avoidance conflict, double approach conflict, and approach avoidance conflict.

Currently, the provision regarding the offence of adultery is regulated in Article 284 of the Criminal Code. One of the reasons for this regulation is to protect marriage from things such as vigilante actions based on adultery and the spread of disease, as well as other potentially damaging influences such as the rapidly growing prostitution industry which poses a threat to society. The punishment received by the perpetrator is a maximum imprisonment of 9 months in accordance with Article 284 paragraph (1) number 1 letter a of the Criminal Code. If your husband or wife has an affair, they, and others, are all responsible. The spouse of the person having the affair is also caught in the net by the provisions of this article. Article 284 of the KUHP defines adultery as an "offence of complaint", meaning that a complaint must come from the spouse of the adulterer before criminal proceedings can commence. In Islam, engaging in adultery carries heavy condemnation and guilt. Divorce is a legal option for infidelity and marital discord. Moreover, infidelity is also synonymous with adultery, a vice condemned by most religions.

Penelitian tentang formulasi hukum pidana terhadap rumusan tindak pidana perzinaan dalam pembaharuan hukum di Indonesia bertujuan untuk mengetahui dan menganalisis tentang kebijakan formulasi hukum pidana dalam merumuskan delik perzinaan dimasa sekarang dan yang akan datang terhadap pembaharuan hukum di Indonesia. Hasil penelitian dan analisis data dalam penelitian ini menyatakan bahwa: pertama, pada dasarnya saat ini sudah terdapat kebijakan hukum pidana yang berkaitan dengan rumusan perzinaan. Yaitu, KUHP Pasal 284 tentang perzinaan, Yurisprudensi MA Nomor 93/K/Kr/1976 yang menyatakan bahwa “pengadilan negeri berwenang untuk memeriksa dan memutus perbuatan yang menurut hukum adat dianggap sebagai perbuatan pidana yang mempunyai bandingan dengan KUHP”. Keputusan MA No 349/K/Kr/1980 tanggal 26 Desember 1980 mengenai perkara Pasal 284 (1) Ia KUHP. Namun beberapa kebijakan ini belum berlaku secara maksimal, karena masih mengandung beberapa kekurangan antara lain dalam perumusan delik Pada Pasal 284 yang mengkategorikan zina sebagai delik aduan absolut. Kemudian dalam sistem perumusan sanksi yang tidak tepat dan jumlah sanksi pidana penjara serta denda masih relatif kecil. Kedua, adanya kelemahan dalam kebijakan saat ini maka perlu adanya kebijakan formulasi hukum pidana dalam upaya perumusan delik perzinaan. Kebijakan hukum yang akan datang berkaitan dengan perumusan delik perzinaan adalah konsep RUU KUHP Versi September 2019. Didalam telah merumuskan perzinaan dalam segala bentuknya, baik adultary (muhson) ataupun fornication (ghairu muhson). Selain itu, juga terdapat rumusan mengenai kumpul kebo serta incest.Kata kunci: formulasi, hukum pidana, perzinaan.Research on the formulation of criminal law on the formulation of criminal acts of adultery in legal reform in Indonesia aims to find out and analyze the policy on the formulation of criminal law in formulating offenses for adultery in the present and future of legal reform in Indonesia. The results of research and data analysis in this study states that: first, basically there is now a criminal law policy relating to the formulation of adultery. Namely, KUHP Article 284 regarding adultery, MA Jurisprudence Number 93 / K / Kr / 1976 which states that "the district court has the authority to examine and decide upon acts which according to customary law are considered as criminal offenses which have a comparison with the Criminal Code". MA Decree No. 349 / K / Kr / 1980 dated December 26, 1980 regarding the case of Article 284 (1) He is the Criminal Code. However, some of these policies have not yet been implemented to the fullest, because they still contain some shortcomings, including in the formulation of offense Article 284 which categorizes adultery as an offense of absolute complaint. Then in the formulation system of improper sanctions and the number of sanctions imprisonment and fines are still relatively small. Second, there are weaknesses in the current policy so it is necessary to formulate a criminal law policy in the formulation of an offense for adultery. The next legal policy relating to the formulation of the offense for adultery is the concept of the Criminal Code Bill for the September 2019 version. It has formulated adultery in all its forms, both adultary (muhson) or fornication (ghairu muhson). In addition, there are also formulations regarding cohabiting and incest gatherings.Keywords: formulation, criminal law, adultery

Abstract:
The phenomenon of parents abandoning their children due to adultery is quite common these days. In the marriage legal system in Indonesia, children born outside a legal marriage cannot be recognized as legitimate children, so their civil aspects follow those of their mother. Children resulting from adultery lose some of their rights as children of a father, and this has the potential to disrupt their future. This research aims to analyze the rights of children resulting from adultery and whether there are solutions that can be taken so that children resulting from adultery still receive their rights even without a cross-breed relationship with their biological father. The research method used is a library research with a sociological-legal approach. Data sources were obtained from the law and several important articles related to this research problem. Apart from that, this article also uses the results of empirical research to strengthen the arguments in this research. Based on the research results, it was found that, from various studies, there is often a neglect of children's rights as a result of adulterous relationships. Men tend to leave their partners, and in the end, women often become single parents to meet the child's needs. Legally, the state can punish the adulterer (biological father) for being responsible for the needs of the child resulting from his adultery.

Abstract:
This article examines the sleep call phenomenon as the beginning of adultery with a focus on studying the hadiths about adultery. By using a qualitative descriptive-analytical type of library research, this article draws the following conclusions; First, the understanding of hadiths about adultery shows that adultery is not only interpreted as having intimate relations between men and women, but adultery includes a broad meaning that can lead to the true meaning of adultery, such as adultery of the eyes, adultery of the ear, adultery of the hands, adultery heart, and so on. Second, the sleep call phenomenon that is currently happening especially among teenagers, with reference to the understanding of hadiths about adultery, is an act that can approach adultery and the beginning of adultery. Explanation of the Prophet's hadith which shows that many things can approach true adultery, such as ear adultery, tongue adultery, hand adultery, and heart adultery, can position the sleep call phenomenon as including actions that are close to adultery so that it can lead to true adultery, namely having sex between men -male and female.

Abstract:
This dissertation examines the representation of spatiality in female adultery novels by women. I explore the ways in which the characters of female adulterers negotiate public and private space, and how adultery affects women's access and mobility in terms of domesticity and acceptable forms of femininity. I argue that in representation there are often multiple and conflicting spatial frameworks and that for women, negotiating these spaces can be a feminist act. I examine four novels within this framework that all deal with female adultery and spatiality-Possession by A.S. Byatt, Other Women by Evelyn Lau, Written on the Body by Jeanette Winterson, and Brick Lane by Monica Ali. There is an anxiety present in these narratives concerning the ways that public and private space inter-relate and the gendered body negotiates that space. This anxiety is represented in these texts as a spectral presence - in terms of ghosts, haunting, or a warning of what is to come. The repetition and reproduction of this anxiety binds the narratives to a repressive and sexist literary tradition where Victorian values linger in the lives of the characters, their actions, and the spaces that they occupy; the female adulterers' narrative spaces remain haunted by their literary forbears. The feminist negotiation of space in these adultery narratives is undermined through the creation of binaries-the presence and repetition of a failed domesticity suggests that there may be a successful way to produce domesticity-a model that cannot include the female adulterer. Further, failed domesticity and women's relationship to public and private space, especially in relation to marriage, can be linked to literary constructions of feminine respectability. The female adulterer becomes a site for all of these conflicts, contradictions, and anxieties and her relationship to spatiality becomes key for understanding her narrative function in a feminist literary canon. I argue that she is a feminist figure because her negotiation of space actually reveals the extent to which women are still limited by patriarchal discourses that espouse heteronormative constructions of marriage, fidelity, and family as the only socially acceptable and viable norms for women.

Abstract:
This thesis uses the language of adultery to examine the relationship between law and society in ancient Rome. In particular, questions will be asked about the ways in which this exchange functioned – do social norms determine law or vice versa? To begin, the lex Iulia de adulteriis coercendis will be contextualised within Augustus’ wider programme of moral reform, and definitions will be given for adulterium and stuprum, the terms which the law used to classify the actions it penalised. The thesis will use these two terms as a lens through which to investigate changes in attitudes to adultery following the introduction of the lex Iulia. A survey of the use of adulterium and stuprum, including their derivatives and the borrowed Greek form moechus, will be made within Latin literature from the 2nd century BC until the 2nd century AD. It will be argued that changes in the use and meaning of the terms following the introduction of the lex Iulia are indicative of changes in attitudes to adultery within the Roman male elite. This in turn will show that law can and does impact on society and it can be used as a positive force to change society’s conception of a given behaviour. Chapter two looks closely at the punishment of adultery in the republic in order to provide a framework through which to understand the lex Iulia as an innovative piece of legislation. The provisions of the law will then be recreated using the juristic texts of the sixth century legal compilations and the chapter will conclude by looking at the attempts to revive the lex Iulia by later emperors and the changes that were made to the law. The focus of chapters three and four is the use of the terms adulterium and stuprum in prose and verse literature. A selection of authors has been chosen to provide a sample that covers the chronological period in question and to include a wide range of genres. It will be shown that in the republic stuprum was the more frequent term as it could be used to refer to sexual transgression in general, including adultery. However, following the introduction of the adultery law, adulterium is found with much greater frequency and its use reflects the new legal definition of adultery and the need to qualify accusations in terms of the law. Moreover, whereas previously stuprum had been conceived of as the more damaging and disgraceful concept, adulterium became to be of greater concern. The legal significance which the lex Iulia gave to adultery and the terms used to describe it are also evident. Overall, it is the aim of this thesis to show how the introduction of the lex Iulia de adulteriis coercendis shaped and altered attitudes to adultery within Roman society. Nevertheless, the validity of using law to control morality continued to be questioned by some of the authors studied and there were negative effects on ideas of marital fidelity and sexual morality as a result of the law.

Abstract:
This thesis examines the sociolegal context of the representation of infidelity in the Anglo-American novel. It locates the first serious Anglo-American treatment of infidelity in the novels of Henry James and Ford Madox Ford; and it situates these writers for the first time in their immediate legal context. The dominant mode through which infidelity was discursively defined during this period was simultaneously legal and sensational: the publication of "Divorce Court" trials in the daily newspapers. The implication of this context for the novel is twofold. The focus on narration from the perspective of the betrayed party prompts a local questioning of knowledge (of knowing one's spouse), and a more general questioning of the epistemoloigcal premises of the realist novel itself. The novels considered here make clear the limitations of a legal discourse committed to a disinterested record of "what happened." In the process, they illustrate several of the narrative innovations most distinctive to the modernist novel. Secondly, what will be called an "aesthetics of suspicion" and "domestic surveillance" distinguishes James's and Ford's novels from the central critical tradition which reads the representation of infidelity as subversive of social norms. Instead, these novels reinforce, thematically and formally, the legal policing of infidelity. Doubt of both conjugal and narrative fidelity, then, becomes the means through which the legal policing of infidelity in the divorce court is covertly extended in the novel.

Abstract:
This thesis offers an investigation into the roles of slaves and freedmen and the extent of their involvement in the Romans’ legal and literary discourse on adultery and the legislation introduced to address it – the lex Iulia de adulteriis coercendis. It also seeks to assert their place more firmly within the context of the Roman familia and explore what this means in the context of the adultery statute. This thesis reasserts the position of slaves and freedmen within the Roman familia as a whole and, more specifically, as individuals deserving and requiring of consideration within the context of the analysis of the adultery statute and other social legislation. A multi-disciplinary approach has been adopted in this thesis to address the multiple avenues apparent in the investigation. A detailed analysis of the primary extant source of the statute, found in Justinian’s Digest, was carried out to determine the extent of the inclusion of the servile and freed in adulterous relationships and how much consideration was shown to them by the legal writers, or jurists. As a corollary to this analysis, a range of literary works, from Ovid, the Elder Seneca, Quintilian, Tacitus and Suetonius, was examined to provide a counterpoint to the legal perspective on the inclusion of slaves and freedmen within adulterous relationships, and, subsequently, the familia. Re-assessing the roles of slaves and freedmen within adulterous relationships and the legislation aimed at controlling this crime also necessitates another reassessment – namely, that of the motivations behind the introduction of the statute itself. Notoriously difficult to determine, this thesis posits, in conclusion, that, rather than being an instrument of the moral indignation of the contemporary Roman population, the adultery legislation was instituted as an instrument of economic control to counter the potential dilution of the wealth of the elite of Rome by illegitimate children. Slaves and freedmen were, then, a crucial element of a deceptively complex piece of legislation typically assumed to affect and address members of the Roman elite only.

Abstract:
Adultery, which is defined in the most general sense as sexual ac- tivity between persons, one of whom is married to another person, has long been considered a serious crime. In an effort to protect marriage and the family, the social community has considered adultery as a very serious crime since ancient times, especially if it was committed by a married woman. The laws often prescribed the death penalty for adultery, but from the 18th and 19th centuries adultery began to be viewed differently, the punishments for adultery became milder, and requests for the decriminalization of adultery became more frequent. Today, in most countries, adultery is not considered a criminal act, but a moral offense, but there are also a number of countries where adultery is sanctioned even with the death penalty. The paper analyzes the concept of adultery, how adultery has been punished throughout history, what are the consequences of adultery, and finally, how adul- tery was decriminalized in most countries. In a separate chapter, the punishment of adultery in Serbia was considered, up to its decrimi- nalization. After many centuries and the suffering of a large number of women due to this controversial criminal act, it was learned that strict measures of criminal legal protection are not a suitable means of suppressing certain negative social phenomena.

Abstract:
Provisions on crimes against sexual morality can be found in several Serbian legal sources, the most important of which are the Code of Saint Sava (Nomocanon) and Dušan's Code. In the Nomocanon, among other things, there were several provisions that protected sexual morality, especially when it came to incest, dishonor of a virgin, sodomy..., and these criminal acts that were considered a violation of the canon were under the jurisdiction of church authorities. The paper specifically reviews the provision on rape, i.e. kidnapping, which was provided for in Dušan's code and which was strictly punished, and for which it is characteristic that there was an important difference in terms of punishment, depending on the class affiliation of the perpetrator and the victim. That class difference in criminal law matters (if we can call it that!), but also in other areas of law, is nothing unusual and should be observed in the spirit of that time and, accordingly, the value system of that time. However, although the class social order of the time was protected, it was not an obstacle for this Code to be considered the most modern at that time. Also, a review was given to the second article of this Code, which punished the fornication (adultery) of a landlady, for which severe (corporal) punishments were also provided. We also pointed to several ruling charters (King Milutin, Stefan Dečanski, Dušanov) that were passed in the first half of the 14th century and in which rape is mentioned for the first time under the name of ``loom'' and ``girl's loom''. Unfortunately, there are no more detailed historical data on when and how the provisions from the aforementioned legal sources regarding sexual morality were applied

On sait que l’éducation est un facteur-clé de mobilité sociale, mais une étude du CIRANO aborde la question sous un autre angle, celui de la mobilité géographique. Ses auteurs suivent le parcours de près de 1,4 million de jeunes et montrent que le phénomène affecte davantage les jeunes qui ont grandi hors des grandes villes, et particulièrement ceux qui y vivent encore à l’aube de la trentaine.

En 2012, le gouvernement du Québec a introduit le Crédit d’impôt pour la prolongation de carrière (CIPC), une mesure fiscale touchant les travailleurs de 65 ans et plus (60 ans et plus depuis 2019). Le crédit vise à éliminer l’impôt à payer sur une partie du revenu de travail des travailleurs expérimentés afin de les inciter à demeurer ou à retourner sur le marché du travail. Cette mesure a été bonifiée chaque année depuis 2015 de sorte que le coût de la mesure est passé d’un modeste 46 M$ en 2012 à plus de 342 M$ en 2019. En utilisant les microdonnées de panel de l’Étude longitudinale et internationale des adultes (ÉLIA) de 2012 à 2020, les auteurs proposent une série d’approches méthodologiques pour évaluer l’impact du crédit sur les comportements d’offre de travail. Les estimations fondées sur la méthode la plus efficiente d’un point de vue statistique suggèrent que le CIPC a eu un impact significatif sur les revenus d’emploi, en particulier pour les femmes. Toutefois, les effets ne surviennent qu’à partir de la quatrième ou cinquième année suivant de l’implantation du crédit, soit les années de forte bonification du crédit. Les auteurs soulignent qu’au-delà de son efficacité avérée, la question de l’efficience du crédit — soit l’impact réel d’une possible participation accrue au marché du travail sur les revenus imposables, et conséquemment sur les recettes fiscales du gouvernement — reste toutefois à démontrer.

Les mégatendances influant sur les familles sont étroitement liées. L’adaptation des familles à l’évolution des dynamiques sociale, économique, culturelle et environnementale entraîne des changements démographiques. Ces changements peuvent à leur tour provoquer une migration à l’intérieur et à l’extérieur des frontières nationales. La migration est liée à une urbanisation croissante, les familles cherchant à optimiser leur bien-être grâce aux ressources généralement concentrées dans les régions urbaines. Or, de nombreuses familles migrant vers ces régions ont du mal à se nourrir de façon adéquate et peinent à y trouver un logement approprié et abordable, un emploi convenable, des soins pour les enfants et les adultes à charge, ainsi que les soins de santé dont elles ont besoin. Ces défis nous incitent à réfléchir aux moyens déployés par les gouvernements et les organisations de la société civile pour favoriser le bien-être des familles dans un tel contexte de transition et d’incertitude. Le présent article s’intéresse aux liens entre trois mégatendances mises en relief par les Nations Unies1qui ont une incidence sur le bien-être des familles – les changements démographiques, la migration et l’urbanisation –, en tenant compte des répercussions que peuvent avoir les politiques sur les familles au Canada. Il met l’accent sur deux grandes tendances démographiques que l’on observe également dans d’autres pays à revenu élevé : la baisse du taux de fécondité et le vieillissement de la population. L’augmentation de la proportion d’immigrants au pays, une autre tendance démographique, est également examinée et une attention particulière est accordée aux conséquences pour le bien-être des familles.

Abstract:
Cette note stratégique présente des considérations sociales et politiques pour la conception et la mise en œuvre de stratégies de communication des risques et d’engagement communautaire (CREC) liées à la vaccination contre la mpox en République démocratique du Congo (RDC). Une flambée épidémique de mpox (clade I) à l’échelle nationale a été déclarée fin 2022 et touche désormais 23 de ses 26 provinces. En particulier, la flambée épidémique est caractérisée par une transmission interhumaine généralisée, contrairement aux précédentes, qui impliquaient principalement un contact animal-humain. Tandis que des foyers de mpox émergent dans tout le pays, cette note stratégique se concentre sur l’est de la RDC. Cette région est caractérisée par des défis importants, tels que des antécédents politiques complexes et un conflit armé en cours, – ainsi que par un manque d’infrastructures et par l’isolement rural de nombreuses communautés. Ces défis exigent des stratégies conçues et adaptées avec précaution. En outre, une souche du virus de la mpox mutée et plus virulente est également apparue dans la province orientale du Sud-Kivu. Bien que de manière générale, il reste peu de choses à savoir sur la dynamique de transmission de l’épidémie, la transmission par voie sexuelle de la nouvelle souche est préoccupante, et fait courir un risque aux populations stigmatisées telles que les travailleurs du sexe, ainsi qu’à d’autres groupes. Toutefois, dans l’ensemble, les enfants sont la population la plus touchée, la transmission étant associée à un contact physique étroit. Au même titre que les femmes enceintes et les personnes immunodéprimées (p. ex., les personnes atteintes du VIH/SIDA), les enfants sont également exposés à un risque accru de complications et de décès. L’Organisation mondiale de la Santé (OMS) recommande des approches de vaccination ciblées dans le contexte des flambées épidémiques de mpox, y compris en tant que prophylaxie post-exposition pour ces populations. Le ministère de la Santé publique de la RDC a annoncé son intention de vacciner les enfants et les adultes avec les vaccins contre la mpox LC16 et MVA-BN, respectivement, par le biais d’une autorisation d’utilisation d’urgence temporaire, étant donné que ces vaccins ne sont pas encore approuvés dans le pays. Actuellement, les efforts se mobilisent pour concevoir des vaccins et des interventions de CREC connexes. Cette note stratégique s’appuie sur une Table ronde de la SSHAP sur la mpox en RDC (mai 2024), une consultation avec des spécialistes des sciences sociales, des professionnels de la santé et des intervenants de l’aide humanitaire actifs au sein de la région, ou bien informés sur la région et la flambée épidémique, ainsi que sur des publications universitaires et la littérature grise.
