<p>Tirania e o direito administrativo</p><p> </p><p><em>The Federalist Papers </em>define “tyranny” as “[t]he accumulation of all powers, legislative, executive, and judiciary, in the same hands, whether of one, a few, or many.” This definition would seem to include the modern administrative agency, which exercises all three powers. To avoid tyrannical agencies and their illegitimate exercise of power, judges and academics look to administrative law. Its procedures and requirements, such as public comment, judicial review, agency reason-giving and deliberation, and executive oversight, saddle agencies with checks and balances and, therefore, legitimacy. Yet unease with the administrative state continues; indeed, it seems to be in a constant crisis of legitimacy, suggesting that administrative law’s quest for legitimacy has not succeeded. This Article argues that this crisis of legitimacy stems from the inherent conflict between the assumptions underlying those of administrative law and the Constitution. These sets of assumptions differ profoundly over political actors’ motivations and human nature, rationality in political and administrative decision-making, and the role of executive lawmaking in a democracy. This Article compares <em>The Federalist Papers </em>and administrative law and scholarship to uncover those differences. But this Article does not engage in an “originalist” critique of administrative law. Instead, it shows that administrative law’s crisis of legitimacy inevitably proceeds from its jarring discontinuity with deep assumptions underlying our constitutional structure.</p><p> </p><p>A obra <em>O federalista </em>define “tirania” como “a acumulação de todos os poderes, legislativo, executivo e judiciário, nas mesmas mãos, seja na de um, alguns ou vários”. Essa definição pareceria incluir a agência administrativa moderna, que exerce todos os três poderes. Para evitar agências tiranas e seu exercício ilegítimo do poder, juízes e acadêmicos procuram o direito administrativo. Seus procedimentos e requerimentos, como comentários públicos, revisão judicial, agência de razão e deliberação e supervisão executiva, selam agências com verificações e balanços e, portanto, legitimação. Ainda assim, o desconforto com o Estado administrativo continua; inclusive, parece ser uma constante crise de legitimidade, sugerindo que a busca do direito administrativo por legitimidade não prosperou. Este artigo argumenta que essa crise de legitimidade se origina do conflito inerente entre hipóteses subjacentes às do direito administrativo e a Constituição. Esse conjunto de hipóteses difere profundamente das motivações de atores políticos e da natureza humana, da racionalidade na tomada de decisões políticas e administrativas, e em toda a legislação executiva na democracia. Este artigo compara a obra <em>O federalista</em>, as leis administrativas e a escolaridade para revelar aquelas diferenças. Mas este artigo não se engaja em uma crítica “original” do direito administrativo. Pelo contrário, mostra que a crise de legitimidade do direito administrativo inevitavelmente provém de chocante descontinuidade com premissas subjacentes à estrutura constitucional.</p>

Desde esta perspectiva, el Ordenamiento administrativo portugués puede considerarse un referente tanto en el diseño de una auténtica política de simplificación administrativa, como en la positivación de sus técnicas a través del procedimiento administrativo, poniendo de manifiesto la idoneidad de esta Institución para reflejar cambios fundamentales del Derecho Administrativo. ABSTRACT: Administrative simplification is one of the keys of the process of modernization of Administrative Law nowadays. The simplification techniques and instruments are taking place in administrative procedure because of the International Organizations’ interest and the resultant implementation process is different from one country to another. Therefore, this Paper aims to present a comparative study of the Portuguese Administrative Law regarding the bases and instruments of administrative simplification, so that Portugal can be considered as a reference in order to design a public policy of simplification and to incorporate its techniques in administrative procedure. From this point of view, we should remark how administrative procedure is a basic institution to reflect the changes of Administrative Law with regard to the principle of administrative simplification.

Abstract: Since 1935, general principles of law have represented an important feature in the face of Dutch administrative law and its development. Dutch administrative courts have played and still play an important role in the development of these principles and in bringing them to life. Although the evolution of legal principles has, in the past, depended mainly on the decision-making of national administrative courts, today we can see a shift from national courts to the European ones. European influence whether it is influence of the Court of Justice of the European Union or of the European Court of Human Rights (ECtHR) cannot be overlooked and has today a deep and indisputable impact on changes in the content of several national principles. In the last decade, we have also noted the emergence of a new type of normative standards - principles of good administration. All these changes are often reflected in existing national legal principles and the general principles of administrative law in the Netherlands are not an exception. Because of these reasons, we will discuss in the following article the essential features of the development of general principles of law in Dutch administrative law, while pinpointing the importance of European influences and the possible future of the principles. Résumé: Depuis 1935, les principes généraux du droit ont représenté une caractéristique importante de l'aspect du droit administratif néerlandais et de son évolution.Les tribunaux administratifs néerlandais ont joué et jouent encore un role important dans le développement de ces principes et dans leur création. Quoique l´évolution des principes légaux dépendait autrefois principalement des décisions des cours administratives nationales, on peut voir aujourd´hui un changement de direction partant des tribunaux nationaux vers les tribunaux européens. L´influence européenne, que ce soit l´influence de la Cour de Justice de l´Union européenne ou de la Cour européenne des Droits de l´Homme, ne peut être ignoréeet elle a aujourd´hui un impact profond et incontestable sur les changements du contenu de plusieurs principes nationaux. Durant la dernière décennie, on a pu également remarquer l´émergence d´un nouveau type de modèle normatif - les principes de bonne administration. Tous ces changements se reflètent souvent dans les principes légaux nationaux existants, et les principes généraux de droit administratif aux Pays-Bas ne font pas figure d'exception. Pour ces raisons, nous discuterons dans cet article des aspects essentiels de l´évolution de principes généraux de droit en droit administratif néerlandais, tout en mettant l´accent sur l´importance des influences européennes et sur l´avenir possible de ces principes.

The link between Administrative Law and Constitutional Law, branches of Public Law, is undeniable. It is even more patent currently with the phenomenon of the constitutionalization of Law.In this article, the author analyses this phenomenon in the field of Administrative Law, the administrative-constitutional principles, and examines how various institutions of Administrative Law have been constitutionally configurated,outlined and controlled in Peru, for which he goes over the most important jurisprudence of the Peruvian Constitutional Court regarding the matter.
La vinculación entre el Derecho Administrativo y el Derecho Constitucional, ramas del Derecho Público, es incuestionable. Ello es incluso más notorio actualmente con el fenómeno de la constitucionalización del Derecho.  En el presente artículo, el autor analiza este fenómeno en el campo del Derecho Administrativo, los principios constitucionales administrativos, y examina cómo distintas instituciones propias del Derecho Administrativo han sido configuradas, delineadas y controladas constitucionalmente en el Perú, para lo cual repasa la más importante jurisprudencia.

O Direito Administrativo vem passando por notáveis mudanças. Dentre elas destaca-se o incremento da regulação. Embora não se apresente como uma novidade completa, a regulação é noção que - sintetizando matrizes da noção de poder de polícia e do conceito de serviço público - tem se insinuado como o modo de atuação do Estado Regulador. O presente trabalho visa a buscar compreender melhor esse fenômeno. Para tanto, primeiramente, analisar-se-ão diversos modelos de Estado e o modo de atuação da Administração neles. Posteriormente, buscou-se conceituar a regulação enquanto instituto, destacando sua previsão constitucional. Por fim, proceder-se-á a análise das finalidades, dos meios de atuação e do controle do exercício da função de regulação.
The administrative law is going through sensible changes. Among them the increment of the regulation is distinguished. Even though it doesn\'t shows itself as something completely new, the regulation is the notion that synthesizes matrixes of the notion of police power and the public service concept showing itself as the Regulatory State\'s way of acting. The following paper will search the comprehension of this phenomenon. In order to achieve that, firstly, various models of State and the way their administration acts will be analyzed. After, the regulation, as an institution, will be explained giving focus to its constitutional predictions. In the end an analysis of purposes, means of acting and the army control of the regulatory function will be conducted.

Abstract:
Competition law has been defined as the rules or provisions which aim to ensure and sustain a market where vigorous, but fair competition will result in the most efficient allocation of economic resources and production of goods and services at the lowest price. The goal, which competition law wishes to attain, is to level the playing field where both small and large firms can compete with one another, fairly and competitively, which in turn leads to a greater benefit for the consumer. South African competition authorities consider cartels as the most egregious of all competition law contraventions because of their harmful impact upon consumers, economic development and the market. Cartel activities are formed in secret and this renders these activities more dangerous, because it is difficult for competition authorities to detect and prosecute them. In South Africa, cartels are regulated in terms of section 4(1)(b) of the Competition Act 89 of 1998, which practices are per se prohibited. Section 4(1)(b) specifically lists the following activities as cartel practices: price fixing, bid rigging and market allocation. Administrative penalties are a common retributive and preventative tool in numerous jurisdictions, including South Africa, which are imposed on firms which participate in cartel activities. Section 59 of the Competition Act postulates that an administrative penalty may be imposed by the Tribunal on a contravening firm, should it be found that such firm has engaged in such prohibited practices. The penalty may be determined and enforced in one of two ways, either unilaterally by the Competition Tribunal in terms of section 59 of the Competition Act, or in terms of a consent agreement concluded between the contravening firms and the Competition Commission, which agreement needs to be approved and enforced by the Tribunal in terms of Section 58 of the Competition Act. The primary objective of the imposition of administrative penalties on cartelists is to both prevent and deter cartel behaviour. It is not a perfect system and has faced its challenges over time. The issues which the competition authorities have had with the imposition of administrative penalties relates to, inter alia, the quantification thereof, the enforcement thereof and the economic and social impact that such penalties have on the contravening firms, its employees and the consumers in general. This dissertation will interrogate the manner in which the competition authorities have approached the imposition of administrative fines. The focus will be on fines imposed for cartel conduct as set out in section 4(1)(b) of the Competition Act. The objective is to determine whether South Africa’s approach to the imposition of administrative fines is in need of reform, and if so, to make suitable recommendations.

Abstract:
An issue that has always caused controversy, both in the theory and in the practice, is the application of the law over time, which becomes more complex in terms of its non-retroactivity or retroactivity. In the present article, the author develops theretroactivity of the most favorable rule principle. First, the author describes the concept and fundamentals of retroactivity. Then, he reports its normative support and its delimitation. Finally, the author exposes the most discussed and controversial assumptions on its application and non-application, making parallels with its regulation in Spain.
Un tema que siempre ha causado controversia, tanto en la teoría como en la práctica, es la aplicación de la norma jurídica en el tiempo, la cual se complejiza en cuanto a su irretroactividad o retroactividad. En el presente artículo, el autor desarrolla el principio de la retroactividad de la norma más favorable. En primer lugar, describe el concepto y fundamentos de la retroactividad. A continuación, informa sobre su sustento normativo y su delimitación. Finalmente, expone los supuestos discutidos sobre su aplicación e inaplicación, haciendo un paralelismo con su regulación en España.

В данной статье рассматривается сущность административной деликтоспособности, которая является правовой категорией довольно сложной по содержанию, несмотря на то, что она является самостоятельным свойством, входящим в состав правосубъектности. Кроме того, теоретики права неоднозначно подходят к выявлению её правовых признаков, поэтому в данной статье предпринята попытка обозначить и проанализировать различные подходы к признакам деликтоспособности с целью дать полное и точное выявление её правовых элементов. Деликтоспособность имеет свои признаки, в соответствии с которыми определяется, во-первых, её наличие и, во-вторых, её объём. This article examines the essence of administrative delictworthiness, which is a complex legal category in terms of content, despite the fact that it is an independent property that is part of legal personality, legal theorists ambiguously approach the identification of its legal features, therefore, this article attempts to identify and analyze various approaches to the signs of delictworthiness in order to give full and accurate identification of its legal elements. Delinquency has its own characteristics, according to which, firstly, its presence is determined and, secondly, its volume.

Abstract:
n the paper, the author deals with the topic of administration contacts, as the broadest category of contracts concluded by the state. In this sense, the term "administrative contracts" is narrower than the term "administration contracts". By the way, the administrative contract became a legal category with the adoption of the Law on General Administrative Procedure from 2016. Based on this Law, the administrative contract is concluded only when it is determined by a special law. The author expresses his opinion that the domestic legislator has not characterized any management contract as an administrative contract. The paper compares administration contracts - public procurement contracts, public service entrustment contracts and public-private partnership contracts with administrative contracts, analyzes their legal nature, but nevertheless concludes that despite the similarity of these administration contracts with administrative contracts, they are not administrative contracts

Abstract:
Terrorism in Western nations has changed significantly over the past years, putting security services to the test and prompting necessary adaptations in counter-terrorism strategies. In this context, states may be tempted to resort to more flexible and swiftly implemented tools such as administrative measures. However, this Policy Brief argues that the known risks associated with administrative measures may be magnified today by a combination of factors and pose new challenges. First, the broadening of the perceived terrorist threat, as it coincides with escalating social and political tensions in many democracies, contributes to obscuring the boundaries between activism, disorder, extremism (violent or not), and terrorism, increasing the risk of misuse as part of attempts to protect the public order. Second, the increasingly tense political climate displaying growing polarisation and escalating populist rhetoric raises additional risks of intentional abuse. Finally, it appears that the overreliance on administrative measures, even when prima facie compliant with the law, may also contribute to an erosion of some human rights and rule of law principles. In addition to causing harm to specific individuals or groups, the accumulation of these circumstances may also affect entire societies and undermine democracy altogether. This Policy Brief argues that the current backdrop calls for renewed caution in the use of administrative measures and a dramatic strengthening of existing safeguards and protections against arbitrary or unlawful uses.

Literature shows that IDPs struggle to access services, which has an impact on their ability to live healthy and fulfilling lives. In the field of health, IDPs frequently have worse outcomes than both host community and refugees. This rapid literature review finds evidence of a number of policy and administrative barriers to access of services for internally displaced persons (IDPs). IDPs remain citizens of the countries in which they are displaced, and the national authorities retain responsibility for meeting their basic rights. However, their displacement, loss of livelihoods and assets, lack of documentation, as well as discrimination against them, lack of protection under international law, lack of policy to address their needs, poor services and conflict or disaster conditions, can all make it more difficult for IDPs to access basic services than non-displaced citizens. There is relatively little literature systematically addressing the issue of administrative and policy barriers to service access among IDPs. Much of the literature discusses IDPs alongside refugees (who have a different legal status and access to different national and international support), or discusses the whole range of difficulties facing IDPs but does not focus on administrative or policy barriers. The literature frequently does not compare IDPs and other citizens and service users. Nevertheless, policy and administrative barriers are discussed, ranging from analysis of international instruments on IDPs to documentation procedures in particular countries. Much of the literature shows the prevalence of disease, lack of school attendance, limited provision of services etc. faced by IDPs, but does not discuss the policy and administrative barriers in detail.

Putting migrants and asylum seekers into detention for administrative reasons is a common practice in Greece, despite this policy contravening human rights. Greek authorities are using detention and the new EU-funded closed compounds as a way to discourage people from seeking asylum in Europe. Detention, as outlined in Greek law, should only be used as a final resort and only then in specific instances. Detention carries with it not only a financial cost, but also a considerable moral cost. Detention without just cause violates basic human rights, such as freedom of movement, the right to health and the right to family life. Alternatives to detention exist and must be prioritized.

We conducted an experiment in quota-eligible firms to study if firms can be nudged to include individuals with disabilities (PwD) with different information letters. The intervention was conducted in the first year of implementing a quota law for PwD in Chile. Firms were randomly assigned to receive an informational email, benefits of inclusion email or information, and fines information. We use anonymized administrative data on monthly employer-employee linkages and disability certification records. We find that the pure information treatment increased the number of PwD working in the firms, and that most of this impact is explained by an increase in the reclassification of incumbent workers.

In War-Algorithm Accountability (August 2016), we introduce a new concept—war algorithms—that elevates algorithmically-derived “choices” and “decisions” to a, and perhaps the, central concern regarding technical autonomy in war. We thereby aim to shed light on and recast the discussion regarding “autonomous weapon systems” (AWS). We define “war algorithm” as any algorithm that is expressed in computer code, that is effectuated through a constructed system, and that is capable of operating in relation to armed conflict. In introducing this concept, our foundational technological concern is the capability of a constructed system, without further human intervention, to help make and effectuate a “decision” or “choice” of a war algorithm. Distilled, the two core ingredients are an algorithm expressed in computer code and a suitably capable constructed system. Through that lens, we link international law and related accountability architectures to relevant technologies. We sketch a three-part (non-exhaustive) approach that highlights traditional and unconventional accountability avenues. We focus largely on international law because it is the only normative regime that purports—in key respects but with important caveats—to be both universal and uniform. In this way, international law is different from the myriad domestic legal systems, administrative rules, or industry codes that govern the development and use of technology in all other spheres. By not limiting our inquiry only to weapon systems, we take an expansive view, showing how the broad concept of war algorithms might be susceptible to regulation—and how those algorithms might already fit within the existing regulatory system established by international law.

En este estudio se analizan los efectos de la autonomía escolar sobre los resultados educativos en Argentina, Brasil, Bolivia, Chile, El Salvador, Nicaragua, Paraguay y Uruguay. Las dos estrategias utilizadas en estos países son la Autonomía Administrativa (AA), en la cual el gobierno delega la contratación de docentes y el control sobre el uso de los recursos, y la Autonomía Pedagógica (AP), en la que se otorga un margen más focalizado de autonomía al exigir a la escuela rendición de cuentas sobre el uso de los recursos asignados competitivamente en función de pequeños proyectos pedagógicos. Los resultados muestran que ambas estrategias inciden positivamente sobre los resultados educativos, y que las variables administrativas afectan más fuertemente los resultados que las variables pedagógicas. La variable que hace la diferencia en la AA es la contratación de docentes y el seguimiento de su desempeño. En la AP, la variable que hace la diferencia es la participación de los padres cuando pueden observar el desempeño docente, lo que contribuye a hacer a los profesores más "accountable." Los resultados sugieren que el gran nudo ciego que se interpone entre la escuela y su eficiencia está en el divorcio entre la gestión y la pedagogía que existe en las escuelas de administración más tradicional, y resaltan la importancia de fortalecer el vínculo entre las decisiones de tipo administrativo, en particular la administración de recursos humanos, y lo que sucede en el ámbito pedagógico.

La ley 617 del año 2000 obliga a los municipios al cumplimiento de los límites de gastos de funcionamiento con los ingresos corrientes de libre destinación, estos se incrementan año a año con el propósito de confrontar los gastos y el riesgo de incumplir. El objeto de este artículo busca determinar si la ley 617 contribuyó al mejoramiento de los ingresos y a la austeridad de los gastos de funcionamiento en los municipios de Antioquia en las vigencias 2017 a 2021, de acuerdo con el reporte de ingresos y egresos y a la evaluación realizada por la Contraloría General de Antioquia y el Departamento Administrativo de Planeación de la Gobernación de Antioquia. De igual manera, se analizó a la ley 617 considerando el aumento de los ingresos de los municipios, debido a que la mayoría ha incrementado los recursos del “Sistema General de Participaciones” (SGP) por eficiencia fiscal y eficiencia administrativa. La investigación se ejecutó con información de la Gobernación de Antioquia y se enfocó en temas de ingresos corrientes de libre destinación. Los gastos de funcionamiento se deflactaron a la vigencia 2017; se analizaron los incrementos y depreciaciones de los ingresos y gastos de funcionamiento; y se identificó cuáles incumplieron la ley 617 con el fin de determinar si han implementado estrategias. A partir de los resultados obtenidos, se logró evidenciar que la ley 617 efectivamente alcanzó su cometido en garantizar que los municipios incrementaron sus ingresos corrientes de libre destinación.
