Abstract:
Since the new dispensation, all stakeholders in the school are expected to play an active role in the governance of schools. It is not the responsibility of government alone to see that schools are up and running. Parents, educators, non-teaching staff, learners (in Secondary Schools) and the community must also share their ideas on how the school is to be administered. This study has focused on the knowledge that the School Governing Bodies (SGB's) should posses in relation to legislations and the application of the knowledge make an impact in the administration and management of the school in the Klerksdorp-area. For schools to function effectively, the School Governing Bodies need to know that the Constitution (Act 108 of 1996) is the supreme law that has an impact in all education legislations, policies and regulations. Therefore, whatever school policy is to be developed should take cognizance of the Constitution. Central to the study is the SGBs' understanding of their roles and functions as stipulated in the Schools Act, (Act 84 of 1996) to avoid conflict of interest and administer the school efficiently and effectively. It is expected that the SGBs should transfer their knowledge into action by formulating policies that govern the school. By formulating school policies the SGB will then be able to have an influence since clear directions will be stipulated in the school policy on how the school is to be managed and administered. School Governing Bodies, as governors of the school are also accountable to people that elected them. It is their responsibility to provide feedback to their constituency and to inform them on the progress made.

Abstract:
This study examines how first year principals learn their roles and provides the picture through their eyes. As there is no formal preparation requirement to become a principal in Victorian government schools, new principals must seek out and direct their own learning for the role. The study describes the informal and formal sources of learning that are sought by beginning principals to help them learn about their new role. The focus is on identifying what sources of learning were used through different phases of the study and how some became more critical than others in shaping and developing the role of a principal in the school. This thesis is a story of continuous professional socialization and learning of a group of seven beginning principals using case studies and interviews over four phases of learning in their first year in the role as they proceed from appointment, entry, establishment through to consolidation of the role. The process of socialization underpins the study and is conceived as a process of learning in which the participants actively direct and participate in their own socialization. However, greater emphasis is placed on the developing nature and reliance on learning in role development. Previous studies of professional socialization of beginning principals have identified licensure programs as significant in the preparation and ongoing development process, whereas this is not the case in Victoria where no such requirements exist. This study adds to existing studies through the finding that there are similarities in the stages of professional socialization process in the Australian context, but also explores new aspects about professional learning by identifying various phases and sources of learning for Victorian principals. These ranged from dependence upon an apprenticeship arrangement, through self-directed task learning, to that of becoming an independent learner within a professional community of equals. Some of the themes identified and explored in this study included examining phases of learning, sources of learning, and their effect on role development. The study was initially based on identifying and exploring some of the key issues and the significance of learning experiences suggested by the beginning principals rather than researching predetermined hypotheses. This grounded and qualitative approach involved data collection over four different time phases in the first year in the role and allowed flexibility in the construction of case studies and the cumulative development of data through the study. The greater part of the data were collected through interviews in each of the four phases of the study along with the collection of survey data for comparison and contrast in the first and final study phases. The research raises many issues that can serve as a basis for further exploration of the complexity of the role of learning within professional socialization for beginning principals. As well, it suggests a number of implications for the organization of professional learning and socialization in beginning principal socialization for the first year in the role.

Abstract:
Conflict of interest allegations became a prominent part of the political and public sector in the 1980s and 1990s in Australia and elsewhere. The arena of policing was not immune, and in Victoria, the Ombudsman drew particular attention to the problem and expressed concern about the rise in public complaints relating to alleged conflicts of interest on the part of police officers. Against this background, permission was granted by Victoria Police for a major study of conflict of interest complaints against police officers within their jurisdiction. Access was granted to all public complaint case files where conflict of interest was the focus of the allegations, from the period 1988???1998. A total of 377 usable complaints files were examined, involving 539 police officers. Through extensive examination and analysis of these complaint case files, a comprehensive map of the particular kinds of interest involved, the nature of the conflicts with official police duties, and the particular contexts within which conflicts of interest emerged, was developed. Analysis of the case files identified 25 different types of problems related to conflict of interest. These were spread across the private and public realms of police officers??? involvements. Previous studies of conflict of interest have focused largely on the opportunities for misconduct arising in the public realm of police work and police duty, largely neglecting attention to the private realm of the relationships and involvements of a police officer that give rise to conflicts of interest. In this study, the specific private interests that gave rise to problems were able to be identified in 35 percent of all cases. Three broad problem areas were identified: (i) outside employment, private business interests, political, social, and sporting interests and involvements; (ii) family-based involvements, especially those involving family law problems; and (iii) problematic personal relationships, including relationships with criminals, informers, and persons of ill repute. These conflicts of interest were related to a range of breaches of official police duty, including the misuse of police authority for personal or family benefit, the use of police position to facilitate personal relationships, and inappropriate disclosure of confidential police information. When the conflict of interest identified related specifically to a police officer???s official or public role as a member of the police force, the main types of misconduct identified included three broad areas: (i) the use and abuse of police powers and authority; (ii) the use and abuse of police resources, including information; and (iii) the receipt of gratuities and breaches of the law. These problems were shown to play out in a range of ways, encompassing such behaviours as misuse of the police identity, inappropriate accessing of police information, involvement in investigations where the police officer concerned has a personal interest in the matter, failing to take appropriate police action against friends, family, or associates, the exercise of improper influence in civil matters, and engagement in harassment and discrimination. This study offers some important conceptual developments in relation to the notion of conflict of interest, focusing on the importance of the distinction between a conflict of interest and an associated breach of duty. The study noted that it is often erroneously assumed by police that if there is no breach of duty evidenced, then there is no problem of conflict of interest. The study also offers an important insight into the oversight and accountability processes involved in Victoria Police, emphasising the importance and effectiveness of the oversight role of the office of the Victorian Ombudsman. Evidence also suggests that the internal review processes within Victoria Police are by-and-large stringent, and that senior police management are genuinely interested in making police officers more accountable for their actions. However, it is concluded that both front-line operational police officer and police management often have a limited understanding of conflict of interest, and problems attendant to conflicts of interest. The study???s insights into the problem of conflict of interest are significant insofar as this problem is related to police misconduct???ranging from minor to serious???of various kinds. Attention to the problem of conflict of interest may be an important element in preventing ???upstream??? police misconduct and corruption.

The release of Better Schools in Western Australia: A Programme for Improvement (1987), in line with other public sector agency reforms; contained a prescription for the restructuring of the Education Department of Western Australia from 11 bureaucratic to a corporate management system of school administration. These changes were intended to render the education system, and especially schools more flexible, responsive and accountable. Among the proposals for educational restructuring was a new opportunity for community participation through ''school based decision making groups." Contemporaneously, the education systems in Victoria and New Zealand were undergoing similar reforms. The research agenda for this thesis is based on two questions. The first research question is: In what ways did the reforms conducted by the governments in Western Australia, Victoria and New Zealand change the participation of the school community in school decision making in state schools during the period 1985-1993? The extent to which the new organisational structures, based upon corporate management, facilitated the admission of the school community into the school decision making process is investigated. In order to facilitate the analysis of policy, this thesis develops a conceptualisation of the notion of controversy. The controversy framework involves the investigation of a number of elements of a controversy - stimulus, context, events, issues, arguments, protagonists, constraints, consequences and closure. The use of this framework is intended to assist in educational policy analysis by highlighting and elaborating upon the interdependent elements, including power relationships, involved in educational policy formulation and implementation. The second research question is: How effective is controversy as a framing device for educational policy analysis? The adequacy of “controversy” as a framing device is evaluated at the conclusion of the thesis. In order to investigate the research problems a variety of data was gathered and analysed. Scrutiny of the major Government and Education Department policy documents us well as a review of literature such as journals, books, newspapers, and documents produced by organisations such as teacher unions, was undertaken. In the case of Western Australia face-to-face interviews were conducted. A series of video-taped interviews with major actors in the controversy in Western Australia was also used in the data gathering process. The data was then systematically ordered using the controversy framework which enabled comparison of the controversies in Western Australia, Victoria and New Zealand. The conclusions drawn focus upon the manner in which corporate management and genuine democratic community participation are antipathetic. Despite rhetoric to the contrary, the school community was unable to exert meaningful influence upon the direction being charted for government schools. As a framing device for educational policy analysis it is concluded that controversy, at this preliminary stage, appears to have merit end further use and refinement of this framework is recommended.

Abstract:
This study explored change in six Victorian secondary colleges some four years into the major school-system change program known as ?????Schools of the Future?????. The purpose of the study was to identify successful models and practices for positive school change by exploring school change from the school level perspective. A focus of the investigation was an organizational development program designed by a North American professor of organization and management in which Victorian school principals were trained as their schools entered the ?????Schools of the Future????? program. The project was guided initially by four major research questions to which six additional research questions were added as the research progressed. The research methodology was qualitative. The data for this investigation were collected in 1997. The main means of gathering them was the in-depth interview of the principals of the six schools in the study and of the four members of staff they nominated as knowledgeable about their school?????s change processes. A follow-up questionnaire to the interview, a telephone questionnaire that asked principals for background information about their schools, and a study of school documents were also sources of data. The analysis and interpretation of the data related to charge in the schools was presented in the forms of six case studies and a multisite study. Eleven variables and eighteen insights identified the aspects associated with successful change across the sites. The study?????s three major findings identified the critical importance in the success of change of the school?????s organizational culture and individual participants in change processes, its relationship to elements in its external environment and the nature of its planning for change. A theoretical framework for positive school change environments was developed. It combined the elements associated with successful change in the study. This framework may prove useful as a basis for further research on systemic change in schools and as a point of reference for those actually engaged in leading the change process in schools and school systems.

This thesis is set out with the purpose to investigate the potential shifts in how victory is presented in the duration of contemporary conflicts. The argumentation is focused on how democratic states, involved in wars, seem to announce different statements regarding victory in its outreach to its inhabitants. This paper will study the case of the American administration of George W. Bush, who initiated and ruled during the first years in the Global War on Terror. By investigating the seven annual State of the Union speeches in a combined quantitative–qualitative method, with Martel’s theoretical framework on victory, the analysis searched after such potential shifts or static usage of the linguistics approach to victory. The answer to the stated research question according to the study conducted by this author is that the publicly announced implications of victory have been subjected to an ongoing shift during the examined time period.

Actualmente el uso de la tecnología es parte del día a día de todas las personas, sociedades, y por ende de todas las organizaciones, pues juega un papel importante en la realización de variadas actividades. Las presiones en un entorno tan cambiante como es el actual, exigen que las tareas sean realizadas con la mayor exactitud y eficiencia posible, en este contexto resulta necesario para las empresas diseñar las estrategias que les permitan dar respuesta a tales demandas. Entre dichas estrategias se encuentra el desarrollo o la adquisición de tecnología que facilite y haga más eficiente la realización de las tareas y cumplir con sus objetivos. El Instituto de Salud del Estado de México (ISEM) es un ejemplo de lo que las empresas vienen haciendo desde hace algunos años, en cuanto a implementar estrategias que les permitan ser más eficientes. Esta institución se ha dado cuenta de que los procesos administrativos que utiliza para la atención de los pacientes son hasta cierto punto ineficientes, y que es necesario que los modernice en beneficio del público usuario.

Objetivo: Analizar el nivel de servicio óptimo y los estándares de calidad de atención del personal administrativo hacia los pacientes del Hospital de la Solidaridad de La Victoria. Metodología: La investigación es de tipo cualitativo. En esta, se utilizó la teoría fundamentada, debido a que se parte de datos recopilados y analizados por medio de un proceso de investigación (entrevistas a profundidad). Asimismo, no se partió de una teoría preconcebida; por el contrario, se permite que la teoría emerja a partir de los datos. En precisión, se realizaron 17 entrevistas a profundidad, las cuales fueron semiestructuradas. Ello permitió que los entrevistadores profundicen sobre el tema. Conclusión principal: Según lo respondido en la entrevista por los pacientes que acuden al SISOL de La Victoria, se obtuvo que estos se encuentran satisfechos, debido a la rápida atención y al buen trato que reciben durante el proceso de atención por parte del personal administrativo. Con ello, se valida la hipótesis según la cual existe una relación directa entre el nivel de satisfacción y el proceso de atención del personal administrativo.
Objective: To analyze the level of optimal service and standards of quality of care of the administrative staff toward the patients of the Hospital de la Solidaridad de La Victoria. Methodology: The research is the type qualitative. In this, we used the grounded theory, because it is part of data collected and analyzed by means of a research process (in- depth interviews). Also, it did not start from a preconceived theory; on the contrary, it allows the theory to emerge from the data. In accuracy, there were conducted 17 in- depth interviews, which were semi-structured interviews. This allowed the interviewers to deepen on the subject. Main Conclusion: As responded in the interview by the patients who come to the SISOL de la Victoria, it was found that they are satisfied, due to the quick attention and the good treatment they receive during the process of care on the part of the administrative staff. It validates the hypothesis according to which there is a direct relationship between the level of satisfaction and the process of attention of the administrative staff.

En droit administratif français, il existe un mythe persistant forgé au début du XXéme siècle notamment par le doyen Hauriou selon lequel la période qui venait de s'achever n'avait connu aucune véritable théorie juridique. Pourtant, la lecture des travaux du doyen Foucart, premier titulaire de la chaire pictave de droit administratif, démontre qu'il a été (sinon le) l'un des plus importants théoriciens de cette science en formation et qui comptait pendant les deux premiers tiers du XIXéme siécle, bien plus d'auteurs qu'on ne l'aurait cru et bien moins d'exégètes ultra-posititivistes qu'on voudrait bien nous le faire croire (Partie I, Titre II). Parmi ces primo-théories du doyen Foucart, plusieurs méritent d'être retenues: ses propositions de réforme du système d'enseignement du droit (Partie I, Titre I); sa volonté de lier les droit public et administratif par la mise en lumière de bases constitutionnelles; sa mise en avant des libertés publiques et sa défense libérale citoyenne des droits individuels face à une administration qu'il voulait enfermer dans un Etat de droit (en formation); ses conceptions novatrices et d'une étonnante modernité en matière de fonction publique, de personnalité morale, d'actes et de contrats administratifs; s'agissant de la domanialité publique et concernant ses réflexions militantes en faveur de l'affermissement d'une juridiction administrative indépendante comprenant même les prodromes du futur recours pour excès de pouvoir (Partie II, Titres I et II). The last decade has seen numerous proposals to reform existing tribunal systems in jurisdictions throughout the common law world. Across the board, there have been proposals to adopt generalist tribunal models in preference to smaller, specialist tribunal systems, and to achieve these changes through the process of amalgamation. The most significant recent developments to occur in Australia have taken place in Victoria and NSW during the past five years. Legislators in these States have chosen to amalgamate a number of smaller, specialist tribunals into larger, generalist bodies. In 1997 the NSW Parliament passed legislation amalgamating a number of specialist tribunals to create the Administrative Decisions Tribunal (ADT); comparable legislation was passed in Victoria in 1998 to create the Victorian Civil and Administrative Tribunal (VCAT). There were concurrent attempts to implement similar reforms at federal level. In 1998 the Commonwealth government announced its intention to amalgamate four Commonwealth merits review tribunals to form one �super Tribunal� � the Administrative Review Tribunal (ART). The Bills containing these proposals were ultimately defeated in the Senate, however the Australian Government remains convinced of the benefits of amalgamation at federal level. Similar reforms have been proposed in Western Australia, Tasmania and the United Kingdom. This thesis argues that these reforms are taking place in the absence of data about their likely implications, and without a thorough understanding of the objectives that generalist versus specialist tribunal systems can realistically achieve. This ill-considered or �over-hasty� trend towards amalgamation raises a number of questions which have not previously been addressed in academic or policy-making circles. An obvious question is whether or not an amalgamated tribunal model is more effective than a series of smaller, specialised tribunals in delivering administrative justice, in other words, whether there is any net gain to be had from a government�s decision to amalgamate. The less explored, but equally important, question addressed in this thesis is how the process of amalgamation should be approached in order to realise the maximum potential benefits that an amalgamated tribunal can bring. That is, to ask what are the ingredients of an optimal amalgamation. This is not a question about whether government decisions to pursue amalgamation are intrinsically worthwhile or beneficial for stakeholders. Rather, it is about how government decisions to amalgamate should best be implemented. This thesis proposes a way of differentiating between good and bad amalgamations, that is grounded in theory and informed by experience to date. The proposed approach is to assess the effectiveness of amalgamation processes using relevant measures drawn from an analysis of organisational theory literature: � Legislation � the legislation establishing an amalgamated tribunal needs to ensure the tribunal will have appropriate independence, powers, processes, membership and structure. � Political commitment � those responsible for proposing and planning an amalgamation need to provide appropriate funding and support for the process and for the establishment of an autonomous, self-directed tribunal. � Organisational structure � the structures put in place need to be appropriate, integrated and flexible, and should promote cohesion and interaction. � Process and procedure � the processes and procedures adopted in an amalgamated tribunal need to capitalise upon the opportunities provided by amalgamation, as well as being appropriate, efficient and able to balance the needs of a range of stakeholders. � Organisational culture � an organisational culture which counters natural tendencies towards disjunction will assist members and staff to identify with a newly amalgamated tribunal and to implement initiatives that will improve its performance. � Leadership � effective leadership plays an important role in ensuring a smooth transition from specialist to amalgamated tribunal, and engendering commitment from members and staff. Broadly speaking, these factors fall into the four categories of law, context, organisation and people. It is argued that attention must be paid to all four of these ingredients in order to achieve optimal tribunal reform. The thesis tests this proposition by examining the three most advanced tribunal amalgamations so far, namely, the Commonwealth ART, the NSW ADT and VCAT in Victoria. It is argued that the fate of the Commonwealth ART proposal proves the importance of a solid, generally endorsed legislative foundation in creating a viable amalgamated tribunal. The importance of context, organisation and people is borne out by qualitative research into the amalgamation experiences in NSW and Victoria. The fact that the NSW and Victorian governments decided to pursue policies of amalgamation at the same time provided a unique opportunity to compare the success or otherwise of two concurrent attempts at amalgamation in different jurisdictions. This thesis finds that the unfavourable political context in NSW prevented the ADT from realising its potential. In contrast, the VCAT experience highlights the benefits of paying careful attention to the wide range of factors that can contribute to a successful amalgamation. Of most relevance are the initial scale of an amalgamation, the political �will� behind its implementation, the appointment of a core of full-time members, and the creation of an open institutional culture which facilitates the sharing of information. In short, the thesis concludes that the successful construction and consolidation of a tribunal post-amalgamation requires that the necessary ingredients of optimal tribunal reform � legislation, context, organisation and people � are thoughtfully addressed.

A l'occasion des guerres de la ligue d'Augsbourg et de la succession d'Espagne, Louis XIV se rend, par deux fois, maître du comté de Nice, possession du duc de Savoie. Cette acquisition s'effectue en réaction à la politique versatile de Victor-Amédée II, qui au commencement de chaque conflit, rompt promptement son alliance avec la France pour rejoindre le camp ennemi. En raison des rétrocessions officielles des traités de Turin (1696) et d'Utrecht (1713), ces périodes sont, le plus souvent, qualifiées " d'occupations ". Mais l'emploi de ce mot n'est pas sans conséquence : il implique que le " roi-soleil " s'est emparé momentanément de Nice, avec l'intention de se substituer que pour le temps des conflits à l'autorité de la Maison de Savoie. Enfermée dans cette définition, la présence française ne présente aucun impact politique réel, car elle n'a pas pour objectif de perdurer. Or différents éléments attestent de la volonté du souverain français d'y exercer définitivement son autorité. Après consultation des généalogistes de la cour, chargés de prouver la légitimité de l'annexion, Louis XIV se proclame à deux reprises " comte de Nice ". Après chaque invasion, le roi de France utilise les techniques éprouvées par le passé pour assimiler une province étrangère. Pour ce faire, les Niçois doivent se soumettre à différentes obligations : l'accueil de commissaires du roi, l'organisation et la prestation d'un serment de fidélité, l'installation et l'entretien des troupes aux frais de la population. Par l'établissement d'une autorité d'ailleurs modérée, Louis XIV réussit surtout à rattacher au niveau judiciaire et fiscal le comté de Nice au royaume de France, sans susciter pour autant l'hostilité des habitants. Mais les deux fois, le souverain français est finalement contraint à une rétrocession en faveur de Victor-Amédée II. Les négociations de paix mettent un terme à cette tentative d'assimilation politique, judiciaire et administrative, en permettant le retour des Niçois sous domination de la Maison de Savoie. A l'issue du premier conflit, et plus encore du second, la France n'a plus les moyens humains et financiers pour se faire reconnaître l'annexion du comté de Nice par le concert des nations européennes.

Este estudo busca analisar as formulações disseminadas pela revista Nova Escola Gestão Escolar-NEGE da Fundação Victor Civita-FVC publicadas no período de 2009 a 2014. As questões norteadoras do estudo são as seguintes: em que consiste o projeto de educação veiculado pela FVC através da NEGE? Nesse projeto, qual a função social da escola, da administração educacional e do trabalho do diretor escolar e coordenadores? O objetivo geral foi assim descrito: analisar as formulações da FVC veiculadas pela revista Nova Escola- Gestão Escolar para a educação brasileira, considerando especialmente as formulações sobre o tema “gestão escolar”. Para alcançar os objetivos, foi realizada uma pesquisa documental referenciada no método dialético. O corpus documental foi constituído pelas primeiras vinte e nove edições da revista. As categorias de análise da pesquisa foram: finalidade da educação escolar, administração educacional e trabalho educativo. A pesquisa está organizada em quatro capítulos e as considerações finais. No capítulo 1, além da delimitação das categorias de análise, é apresentado o mapeamento da produção bibliográfica sobre a FVC e suas publicações. No capítulo 2, são analisados aspectos da realidade brasileira que permitem localizar a trajetória da Fundação Victor Civita no período ditatorial até 2002 com o objetivo de revelar como esse grupo empresarial foi formado e como se deu o envolvimento com a educação. No capítulo 3, são examinados os aspectos da configuração da política educacional brasileira no contexto dos governos Lula da Silva (2003-2006; 2007-2010) e governo Dilma Rousseff (2011-2014) para ampliar a compreensão sobre a atuação da FVC nesse período. O capítulo 4 é dedicado à análise do corpus documental. Em síntese, a pesquisa revela que as formulações contidas na revista Nova Escola Gestão Escolar estão alinhadas à perspectiva das teorias não-críticas da educação. A concepção difundida de “gestão escolar” é afirmada pelo modelo de “gestão eficaz” cujos pressupostos se vinculam a perspectiva gerencialista na educação. Ao aproximar a escola da lógica de funcionamento do “mundo dos negócios”, a revista Nova Escola Gestão Escolar reafirma a divisão técnica do trabalho e qualifica os diretores, coordenadores e supervisores escolares como líderes de uma engrenagem. Espera-se que as análises contidas no estudo possam contribuir para a reflexão crítica sobre o significado das formulações da Nova Escola Gestão Escolar e sobre a função da Fundação Victor Civita.
This study seeks to analyse the formulations disseminated by Victor Civita Foundation's magazine Nova Escola Gestão Escolar-NEGE published from 2009 to 2014. The guiding questions to this study are the following: what is the education project released by FVC through NEGE? In this project, which are the social roles of the school, the educacional administration and the work done by the school director and coordinators? The general objective was described as follows: to analyze the FVC's formulations disseminated through Nova Escola Gestão Escolar for the Brazilian education, in special those about "school management". To achieve the goals, a documentary research based on the dialectical method was performed. The documentary corpus was constituted by the first twenty-nine issues of the magazine. The research's categories of analysis were the following: purpose of school education, educational administration and educative work. The research is organized in four chapters and the closing remarks. In the first chapter, in addition to defining the categories of analysis, the mapping of the bibliographic production on FVC and its publications is presented. In the second chapter, the aspects of the Brazilian reality which allow to understand Fundação Victor Civita's trajectory from the dictatorial period until 2002 are analyzed with the objective of revealing how this business group was formed and how was its involvement with education. In chapter three, the aspects of the configuration of Brazilian educational policy between Lula da Silva government (2003-2006; 2007-2010) and Dilma Rousseff government (2011-2014) are examined to broaden the understanding of FVC's operation in this period. The fourth chapter is dedicated to the analysis of the documentary corpus. In summary, the research reveals that the formulations contained in the Nova Escola Gestão Escolar magazine are aligned with the perspective of non-critical theories of education. The widespread conception of "scholar management" is affirmed by the "effective management" model whose assumptions are linked to managerial perspective in education. In bringing the school closer the logic of the "business world", the Nova Escola Gestão Escolar magazine reaffirms the technical division of labor and qualifies directors, coordinators and school supervisors as leaders. It is expected that the analysis contained in this study may contribute to the critical reflection about the meaning of the formulations of Nova Escola Gestão Escolar and about the role of Victor Civita Foundation.

Victor Schœlcher (1804-1893) consacra son œuvre écrite et son activité d'homme politique, à partir de 1830, à l'analyse des questions coloniales et de l'esclavage. Il fut le seul abolitionniste européen à vivre les trois phases du processus de destruction du système esclavagiste aux Caraïbes : 1) la période de campagne pour l'abolition de l'esclavage, 2) la phase d'abolition elle-même, en tant que sous-secrétaire d'état aux colonies et auteur du décret d'émancipation du 27 avril 1848, et 3) la longue période des transformations socio-économiques et politiques post-esclavagistes. Il exerça une influence déterminante sur les orientations de la politique française aux caraïbes pendant toute la seconde moitié du XIXe siècle et même au-delà. L'analyse de son œuvre permet une perception comparative de cette phase fondamentale de l'histoire des Caraïbes. Victor Schœlcher 's written work and political action, from the years 1830s, were concerned with colonial questions and slavery. He has been the only European abolitionist living the three stages of the process of destruction of the slavery system in the Caribbean: 1) the abolitionist campaign, 2) the abolition itself, as sous-secretaire d'etat for the colonies and author 0f the abolition bill of April 27, 1848, and 3) the long period of post-slavery social-economic and political transformations. He had a conclusive influence on the French policy in the Caribbean during the second half of the XIXth century and even afterwards. The analysis of his work does allow a comparative perspective on that fundamental period of Caribbean history. This thesis is built around four main axes: the elaboration of Schœlcher's colonial reform project, V. Schœlcher coming into power in 1848 and the first post-slavery transformations (1848-1854), the application of the social and political "model" of Schœlcher and his political influence, as a republican parliament deputy for the colonies, between 1871 and the end of the XIXth. Scholars interested in the popular Victorian periodical Temple Bar have primarily focused on the editorship of George Augustus Sala, under whom the journal paradoxically began delivering controversial content to conservative middle-class readers. But while the Temple Bar's sensation fiction and social realism have already been considered, critics have not yet examined Temple Bar's New Woman fiction, which was published during the last decade of the 19th century and George Bentley's reign as editor-in-chief. While functioning as editor-in-chief, Bentley sought to adhere to the dictates found in the 1860 prospectus, to "inculcate thoroughly English sentiment: respect for authority, attachment to the Church, and loyalty to the Queen." The Temple Bar seems an odd publication venue for the audacious New Woman writer Sarah Grand. And yet, Grand published several short stories in Temple Bar under the editorship of Bentley. Knowing Bentley's infamous editorial hatchet work, we might assume that he would cut from Grand's writing any unsavory bits of traditional New Woman content. Instead, a comparison of Grand's Temple Bar stories, "Kane, A Soldier Servant" and "Janey, A Humble Administrator," with their later unedited, republished versions (found in Grand's Our Manifold Nature) suggests that Bentley had a different editorial agenda. This analysis of Grand's fiction demonstrates that it was not New Woman subjects that Bentley found objectionable but the culpability her texts placed on the upper-middle class for their failure to act on behalf of the lower classes. Examining Bentley's removal of this material thus sheds new light on the dangers of New Woman literature as perceived by its Victorian audiences.

The concept of genocide is probably the most debated subject in Holocaust and genocide studies. The political implications to its usage, or resistance to do so, have also been lengthily discussed. Yet, when it came to the legal sphere of the concept it has been mostly descriptive, without much theorizing on the politicization of the convictions of genocide. This study investigates the relation between the International Criminal Tribunals for the former Yugoslavia and Rwanda application of the crime of genocide and how these judgements were informed. Through the court’s transcripts of a number of selected cases, the research will analyze the application qualitatively, identifying the key factors that determined its usage. The analyses rest on the legal and political aspects that influenced the chambers, evaluating which one explains best. The results indicate that there is no single explanation and that both legal and political reasonings merge in the international legal arena. The courts’ decisions have many inconsistencies that cannot be accounted by a solo description. Thus, matters of law interpretation, conflict’s ending, postcolonialism, and legitimacy all take a tool when convicting or acquitting someone for the crime of genocide.

This thesis evaluates transparency in the context of water utilities’ regulation by comparing legal frameworks in three jurisdictions: Victoria (Australia), England (United Kingdom) and Jakarta (Indonesia). Each of these jurisdictions is selected because of their particular ownership and regulatory model. The thesis analyses whether specific ownership or regulatory models will have implications for transparency. The terms “transparency” and “water utilities’ regulation” are first defined and form the thesis’ analytical framework. This is then applied against the three jurisdictions compared. By evaluating each of the three jurisdictions, the thesis expects to provide explanation on how transparency is enabled or inhibited by the legal frameworks. The thesis recommends a solution by comparing the three jurisdictions and generating “lessons learned”.

Abstract:
This study looks at the ailing Zimbabwean tourism industry and efforts to reverse the negative trend in tourist arrivals. Despite this sector of the economy enjoying positive growth both globally and at a regional level, the local industry had been adversely affected by negative perceptions about the country. The Zimbabwe Tourism Authority (ZTA), whose mission is to professionally market Zimbabwe as a leading tourist destination, has embarked on various initiatives. Unfortunately however, the organisation has enjoyed limited success in recapturing the demand experienced in the years prior to 1999. In order to investigate other avenues to pursue, this study sought the perspectives of two major stakeholders of the local tourism industry. These were namely "buyers" comprising the international tourist, who were probed for their motivations in selecting a holiday destination. In addition, local "suppliers" to the sector who interface directly with the international traveller, were asked to give their perspective on the performance of the ZTA in fulfilling its mission. Personal interviews were conducted in the resort town of Victoria Falls. This area was chosen over other attractions in Zimbabwe because our neighbouring competitors, South Africa and Zambia have promoted the resort for their own benefit, at the expense of the local industry. Another reason is the worldwide recognition and appeal of the attraction, owing to its historical significance. The study established that the resort still enjoys immense popularity, with international visitors opting to return several times in order to gaze at the scenic wonder. However, since the falls lack a truly Zimbabwean identity or image, travel agents and tour operators have either channeled tourist to the Zambian side or flown them in via South Africa as day visitors. The resultant effect has been minimal financial benefit to Zimbabwe by way of receipts from tourist expenditure. Adopting a co-operative strategic orientation with these neighbouring countries is recommended. At a local level the study found that the local tourism industry lacked a unified approach in tackling the challenges facing sector.

Abstract:
The sport industry makes important economic and social contributions to Australia. Within the sport industry there is a range of venues that are used by not-forprofit sport associations for training and competitions. This research addresses the need to understand how sport venues and sport associations manage their relationships so more positive relationships can be developed. The aims of the research were to i) understand the constructs that underpin these sport relationships, and ii) identify the mutually beneficial outcomes achieved from these relationships. Literature from relationship marketing, education partnerships, and health and community service partnerships were used to guide the research because these three bodies of literature contribute perspectives that include commercial, community and not-for-profit relationships. Initially, a qualitative study explored the relevance of 27 relationship constructs identified in the literature. The outcomes of the qualitative study were used to inform a survey of Victorian sport associations and indoor sport venues to identify the constructs that influenced their relationships and to identify the outcomes associated with these relationships. The main findings of the research identified that, although the relationships were viewed by all respondents as being important, little effort was put into the management of the relationships. Sport venues and associations that were communicating effectively, had established trust, had appropriate facility and equipment, practiced leadership, had shared goals / values, were cooperative, were committed to the relationship and provided quality services were able to achieve positive outcomes. These outcomes contributed to better internal operations such as solving problems and increasing usage, as well as external outcomes such as building a sense of community ownership and pride, and improving communication networks. Sport venues and sport associations that are better at managing the key relationship constructs are better able to meet the needs of their sporting community as well as, address wider community goals. A focus on collaborative relationships and the key relationship constructs assists sport venues and sport associations to generate positive outcomes. The research results provide impetus for state and local governments, and community sport associations to consider how sport venues work with sport associations.

This thesis sets out to investigate the meaning, understanding and application of corporate governance in a public sector health service provider in Victoria, Australia. The methodological and analytical approach is based on an adaptation of the Glaser and Strauss’ grounded theory, using ethnographic and survey techniques to collect and describe data so as to capture a broad interpretation of how governance as a process is interpreted, understood and practiced in this organisation. Most studies of governance focus on economic compliance and performance, and questions concerning less obvious human elements of governance involving decision-making are left largely unaddressed and unresolved. In this thesis, these less tangible elements of governance are explored. The perspective presented here is that corporate governance is a socio-cultural phenomenon that requires not only an examination of the governance structures and processes in place, but also the direct observations of social and cultural elements including individual and organisational decision-making. There is a dearth of corporate governance research in the public sector, which has in the past decade adopted a system of governance more aligned to a private sector model. This thesis starts to address this lack. It combines a study of the Board and its accountabilities in the face of rapid change (analogous to the private sector model) with evidence from stakeholders to assess the impact of the governance in the public sector. From the analysis of the data collected and from the researcher’s observations, the health provider studied here can be described as having an effective Board. It appears to have integrated decision-making, with the Board strategically setting the direction of the service and supporting the actions of management to meet the key performance targets and measures as prescribed by the Department of Human Services (DHS). This research explores how governance as a process is interpreted, understood and practiced in the context of a public sector organisation. It offers a unique insight into the complex concept of corporate governance and offers a constructionist conceptual paradigm for further governance inquiry.

This thesis addresses the issue of possible corruption and misconduct in local government, with particular reference to the role of the audit committee. The primary research question is: ‘Do audit committees in Victorian local government function effectively?’ The secondary research question is: ‘Do the investigations into local government maladministration and malfeasance enhance governance and the audit committee’s effectiveness?’ Qualitative and quantitative data were collected to develop a model of audit committee effectiveness through a pilot survey, research questionnaire and interviews.

Abstract:
The research aims to provide an understanding of local governance in an outer metropolitan area of Melbourne. Through the examination of the policy framework that has established and maintained community governance in Victoria by the State Government from the period of local government amalgamations in 1994 to the present day and the use of a case study, Hume City Council, the thesis has descriptive and analytical elements drawing on empirical inquiry using case study methodology. The case study method has been chosen because it is most suitable for discovering how the community participants perceive their level of governance and their desires for future governance structures. Since the dramatic reforms of local government in Victoria, there have only been two governance reviews; at Hume City Council in 2000 and at Delatite Shire in 2002. In addition, minor boundary realignments were made to the Cities of Melbourne and Moonee Valley in 2007. These are the only attempts at a review of the structure of local Understanding Outer-Urban Governance: A case study of local government in Victoria since the Kennett Government reforms. This thesis reaches the conclusion that the concept of wicked problems is applicable to the management of the case study and other complex problems created as a result of amalgamation. The wicked problem context of this thesis cites decision making as the major focus. Through decisions about authority, governance, identity and community consultation the key concept of trust is questioned which has led to the inherent unsatisfactory resolution of the selected local government wicked problems.

The World Health Organization and the United Nations state that people normally access water through their place of residence. However, in North America people regularly need access to water services, such as toilets, fountains, or bathing facilities, when not in a private residence. The purpose of this thesis is to explore the current situation of access to water for personal uses for people outside a place of residence as an emergent research topic. To accomplish this, I conducted a literature review and a thematic analysis of nine key-informant interviews with stakeholders in Victoria. Findings from the research reveal that access to water for personal uses is limited in Victoria when outside a place of residence. Furthermore, the consequences and implications of this limitation directly and indirectly influence both individuals and the broader community. Finally, policy recommendations, action responses, and future research directions inform possible responses to address this issue.

At a time of rapid change in the political involvement of young people, the creation of structures to facilitate the participation of young people in decision-making processes has been on the rise globally (Badham & Wade 2010; Farrow 2015). Youth councils are often created with the aim of representing the interests of young people in the community through advocacy, lobbying and provision of advice to decision-making bodies. At the same time the landscape of youth councils, particularly at a local government level, is varied and often lacking the evidence of best practice, an enabling environment and coordination. This mixed-methods comparative case study research analysed the current environment and context in which youth councils are operating, and the experiences of former and current members of youth councils and the professionals that support their work, in the Australian state of Victoria and in Estonia. Semi-structured interviews and an online survey across the two countries and in two languages were employed from 2016 until 2017 to map the experiences and identify youth councils’ successes, gaps and potential for improvement. Qualtrics software was used to collect, analyse and code the survey data; data from semi- structured interviews was coded manually. The coding process identified key nodes and sub- nodes. The results revealed that local level youth councils in Victoria and Estonia share many similarities, particularly in their aims, commonly undertaken activities and aspirations; however, there are also noticeable differences which can largely be attributed to the relevant legislative framework, policies, coordination mechanisms and resourcing for youth councils that exist in Estonia but not in Victoria. Through the results of this study, a framework for an enabling environment for youth councils was identified and conceptualised, using the Enabling Environment Index developed by CIVICUS (2013), the World Alliance for Citizen Participation, as a guide. The findings of this research also sought to provide an understanding of how the work of local level youth councils can be better supported and organised by policy, organisational and legislative measures to increase the effectiveness and benefits of these structures for young people and the community.

This thesis argues that certain strategic interventions in the delivery of services to Indigenous Australians employ rationalities congruent with colonial-settler governance. The Koori Services Improvement Strategy in the Australian State of Victoria is a case in point. Detailed examination of this strategy - understood as a set of specific technologies of power - raises questions about practical issues in Aboriginal governance, tensions within liberalism, the actual implications of neo-liberal techniques employed in human services, and the bearing these have on Aboriginal wellbeing. Following Michel Foucault's 'governmentality' approach, tools of discourse analysis and genealogy are used to address these questions and to investigate the limits and possibilities of such an approach to understanding Aboriginal governance.

Abstract:
This study examines the impact of social capital on the export success of domestic SMEs in Vietnam, looking at both export propensity (whether they export at all) and export performance (how much they export). Two stylized facts inspire the research. The first is the relatively modest performance of Vietnamese SMEs in export activities to date, despite their potential and increasing importance in the economy. The second is the widespread perception within Vietnam about the power of social relationships of firms in the Vietnamese business environment. This study uses a mixed methods approach, combining a qualitative thematic analysis of semi-structured interviews of SME owners/managers with quantitative testing of hypotheses on a secondary panel dataset from 2007 to 2015. Logistic regression models were employed to test hypotheses related to export propensity and multiple linear regressions were used to test those related to export performance. The results indicate that social capital is positively related to export propensity of domestic SMEs, but that its impacts on their export performance are not consistent. Each type of network impacts differently on export performance indicators of the studied SMEs (positive, negative and sometimes non-significant). Similarly, the qualitative study provides evidence that social capital supports SMEs in the initial stage of their export venture, but not their continuous export sustainability. One of the significant findings to emerge from the qualitative study is that the impact channels of social capital on SMEs’ export success may have changed from relying on rent-seeking opportunities provided by close connections with authorities towards being a tool for improving credibility and building capability for SMEs. This study highlights the importance of establishing an appropriate networking strategy for SMEs who wish to pursue export ventures. It suggests that, if SMEs aim at long-term export success, they may need to diversify their networks, including business networks and social networks, both domestically and internationally, rather than focus on connections with politicians and authorities. This is because the expected benefits from rent appropriation in export activities will eventually diminish as a more transparent system is put in place. Hence, SMEs should utilize their networks to improve their knowledge, credibility and capability, which help in enhancing their long-term competitiveness. The present study also implies that the government and relevant trade associations, in supporting SMEs to participate successfully in the international market, may need to focus on long-term network building and capacity-building activities.

Abstract:
The crime of incest is rendered invisible in the 1990's under the all-embracing label of "child abuse", where the public eye is alerted to grave cases of physical abuse, by a media hungry for sensationalism. Likewise, incest is effaced amid the current outrage over the deviant outsider - typically perceived as the paedophile. It is the very nature of the sphere in which incest is committed, which makes the crime 'hermetic'. The view that the patriarchal family is somehow sacrosanct, and the debate over the public/private dichotomy relating to child protection, adjoin to further obscure this iniquity. In addition to this, the perpetrators of incest frequently deny, minimise or rationalise their crime, hence making the legal sphere the only legitimate area of redress for victims. However, the law attempts to deal with these private moral perplexities in the objective and constrained manner representative of the court system. This may not be reconcilable with just outcomes. Social policy's footing in this arena appears to be equivocal, due to the inherent confines of the legal system. But the legal system, and in particular the court arena, can be made more equitable, by being flexible and amenable to innovation, through the embodiment of other areas of expertise. Instead of being self-referential, the legal system should be more accommodating of other esteemed knowledges, in the name of justice.

Early childhood education and care in Australia is recognised as playing an important role in determining the long term educational benefits and outcomes for children across their life span. A key determinant of a quality early childhood program is the quality of relationships that educators develop with parents and families as equal partners in the education and care of young children. In 2010 the State of Victoria, Australia, launched a framework for educators working in early childhood settings. This framework identified family centred practice (FCP) as the approach to be implemented by educators in their work with families. FCP has been widely used in early childhood intervention programs since the latter part of the 20th century; however, this approach had not previously been adopted in mainstream early childhood education and care contexts.

This thesis examines emerging issues in the governance of non-profit sport and recreation organisations. Firstly, the thesis examines definitions of non-profit organisations and the contribution that non-profit organisations make to society, especially, the contribution to aspects of the civil society. The thesis then explores current theory relating to social capital formation, non-profit organisation governance and public sector reform and establishes a broader framework for considering issues relating to non-profit organisation governance. This framework is titled 'An enabling governance for social capital formation.' The thesis provides analysis of a self-assessment survey of government funded sport and recreation organisations in Victoria. The survey tested the level of satisfaction with organisation governance in the funded sport and recreation organisations. The survey elicited satisfaction ratings from Chairs, CEOs and non-executive board members against the elements of an enabling governance for social capital formation. The analysis identifies areas where there are low levels of satisfaction with governance performance. The thesis concludes, that it is by supporting improvement in these areas that government, and other supporters of non-profit organisations, could maximise the outcomes of governance improvement support programs.

This thesis was written to address a problem with ambulance service delivery times in Victoria, Australia. For a number of years, ambulance response times have been increasing to unacceptable levels. As a result of the ever-increasing problem it was appropriate to see if the are other alternative solutions producing better results. There are a number of different service delivery models for Emergency Medical Services (EMS) around the world. The main two are the Anglo/American model (also known as scoop and run) and the Franco/German model (also known a stay and play). There are also two major delivery agencies; the British model of a separate third party public sector service as used in UK, Australia and New Zealand or the fire service model where the fire service is the main delivery agency such as most of Asia, Europe and North America. Which model provides the best outcome for the patient? Such research has not been done in the past. The research will also examine if the Metropolitan Fire brigade has capacity to undertake possible EMS roles. A number of case studies were undertaken and explored with key issues of response times, patient outcomes, skills and new technologies compared. The results, particularly of response time show that in Victoria the response time for fire EMS (8.3 minutes) to medical emergencies is similar to that provided by fire services delivering EMS in North America. The MFB in Victoria is providing the equivalent of first responder; the American and Canadian fire services are delivering Advanced Life Support (ALS). The response times for Basic Life Support (BLS) in Victoria provided by ambulance service are over twice as long (8.3 minutes for fire compared to 18.2 minutes for Victorian Ambulance at the 90%). The US and Canadian Fire Services provide EMS response time considerably lower than Ambulance Victoria, some as low as 7.43 minutes. UK Ambulance (on which the Victorian model is based) also provides response time considerably less than Ambulance Victoria. The issue of whether the fire service in Victoria has capacity to undertake further EMS delivery was explored and whilst it has the capacity it is doubtful it could be delivered in the current industrial environment with the union having the capability of vetoing managerial decisions. The research raised fundamental questions regarding the effective use of scarce public sector resources and agencies working across organisational boundaries in the interests of serving the public. Data analysis involved pattern matching, explanation building and time series analysis to identify trends and commonalities across the cases. A number of themes emerged including continued increases in call volumes, challenges meeting response times and the development of proactive programs to reduce the impact of these trends.

This thesis sets out to investigate the meaning, understanding and application of corporate governance in a public sector health service provider in Victoria, Australia. The methodological and analytical approach is based on an adaptation of the Glaser and Strauss’ grounded theory, using ethnographic and survey techniques to collect and describe data so as to capture a broad interpretation of how governance as a process is interpreted, understood and practiced in this organisation. Most studies of governance focus on economic compliance and performance, and questions concerning less obvious human elements of governance involving decision-making are left largely unaddressed and unresolved. In this thesis, these less tangible elements of governance are explored.
