AbstractThe Rwandan genocide remains one of the most horrific atrocities of the twentieth century, resulting in the death of an estimated 500–800,000 human beings, massacred over a 100-day period. In the fourteen years since the genocide, attempts at justice and reconciliation in Rwanda have involved a delicate interplay between national legal systems and the international legal order. This article examines three fora in which Rwandans have been tried for involvement in the genocide: the International Criminal Tribunal for Rwanda, Rwandan courts including Gacaca tribunals, and French attempts to exercise universal jurisdiction. Using Rwanda as a case study, the article illustrates the issues, concerns, and difficulties that arise when multiple jurisdictions assert a right to exercise criminal jurisdiction over the perpetrators of serious atrocity crimes. Beginning with a discussion of the political context, this article considers what the competing narratives and litigation in various fora have meant for the project of international and transnational criminal justice. Cases involving the commission of atrocities pose unique challenges for the international legal order. As the normative structure of international criminal law has arguably been strengthened, political constraints increasingly come to the fore. As illustrated by Rwanda, universal jurisdiction or other bases of jurisdiction may remain necessary vehicles for justice and reconciliation, or, at the very least, they may serve as a catalyst for change in Rwanda itself.

This article discusses the role of the UN Security Council during the crisis in Rwanda in 1993/94. It focuses on the peacekeeping dimensions of the Council’s involvement. It is a perspective from a practitioner, rather than an academic. It also makes some observations about whether the Rwanda crisis has had an enduring influence on Security Council practice. It does not address the impact on practical aspects of peacekeeping or on the UN Department of Peacekeeping Operations.

Abstract:
In conflict situations, many people are displaced because of hostility and arms in the area. Displaced people are forced to leave behind their properties, and this in turn interrupts the relationship between people and their land. The emergency period in particular has been identified as a weak point in the humanitarian response to land issues in post-conflict situations. In addition, during this period of response, most post-conflict governments do not prioritize land administration as an emergency issue due to other social, economic, security, and political challenges, which countries face in the immediate aftermath of the conflict. In the longer run, this results in post-conflict illegal land occupation, secondary occupation, numerous disputes and claims over land, and dysfunctional government institutions that legalize these illegal and secondary occupations. This research explores the nexus between displacement and land administration in a post-conflict context. It uses empirical data from fieldwork in Rwanda, and discusses how government interventions in land administration in emergency and early recovery periods of post-conflict situations affect future land administration during the reconstruction phase. The post-conflict Rwandan government envisaged proper land administration as a contributor to sustainable peace and security as it enhances social equity and prevents conflicts. Thus, it embarked on a nationwide systematic land registration program to register land all over the country with the aim of easing land administration practices and reducing successive land-related claims and disputes. However, the program faced many challenges, among which were continuous land claims and disputes. Our research anticipates these continued land claims and disputes are due to how land issues were handled in the emergency and early recovery period of the post-conflict Rwanda, especially during land sharing initiatives and Imidugudu (collective settlement policy).

In its landmark November 24, 2017 judgment in Ingabire Victoire Umuhoza v. The Republic of Rwanda, the African Court on Human and Peoples’ Rights (ACtHPR) or Court) held that certain aspects of the right to a fair trial (presumption of innocence and illegal searches) and the right to freedom of expression under the African Charter on Human and Peoples’ Rights (Banjul Charter) and the International Covenant on Civil and Political Rights (ICCPR) had been violated by the Republic of Rwanda (Respondent State). In its final orders, however, the Court rejected the applicant's prayer for immediate release and deferred its decision on other forms of reparation. The judgment has broad implications on how African states protect and respect the rights to a fair trial and freedom of expression. The case also offers some vital lessons on state backlash towards human rights litigation and African states’ compliance with decisions of international courts (ICs).

Abstract:
The article reveals the basic theoretical principles of public administration. The stages of formation and development of public administration are studied. It was found that public administration, as a system of public administration in Ukraine, needs to be reformed in a market economy and democratization of society. The main problems of formation and development of the system of public administration in terms of compliance with the European political trend of integration of public and personal factors, expanding the sphere of state influence while maximizing rights and freedoms, absolutization of the administrative factor of social transformations are considered. It is established that public administration: provides implements the decisions of the authorities; applies democratic, public, liberal forms and methods of managing the social, social and economic development of the country. The main factors that influenced the emergence in many countries of the world of such a new form of government in the public sector as public administration. Based on the understanding of the peculiarities of the evolution of the management model in the public sector, the need to introduce the concept of "public administration" into scientific circulation is substantiated. Recommendations for decentralization of management in the context of domestic reforms to increase the efficiency of the system of public authorities on an innovative basis are offered. In this context, it is extremely important to implement initiatives on constitutional changes in the decentralization of power, the priorities of the Public Administration Reform Strategy of Ukraine for 2016-2020; development of a new version of the Law of Ukraine "On Civil Service", which regulates the basic principles, legal and organizational principles of public service.

Under the terms of a secret agreement reached between China and Portugal in 1979, Portugal was to continue administering Macao but sovereignty was transferred to China. Eight years later however, the Sino–Portuguese agreement on Macao's future was signed, which stipulated that it would become a Chinese Special Administrative Region on 20 December 1999. Whereas the transitional stage from Portuguese to Chinese administration began in 1987, political development started in 1976 when the principle of democracy was introduced into the colonial legislature (two years after a military coup had toppled the regime of Marcello Caetano in Portugal). This article will explore aspects of Macao's political development since the Portuguese revolution in 1974.

After the Rwandan genocide in 1994, vaccine coverage was close to zero. Several factors, including extreme poverty, rural populations and mountainous geography affect Rwandans’ access to immunizations. Post-conflict, various other factors were identified, including the lack of immunization program infrastructure, and lack of population-level knowledge and demand. In recent years, Rwanda is one of few countries that has demonstrated a sustained increase to near universal vaccination coverage, with a current rate of 98%. Our aim was to ask why and how Rwanda achieved this success so that it could potentially be replicated in other countries.Literature searches of scientific and grey literature, as well as other background research, was conducted from September 2016 through August 2017, including primary fieldwork in Rwanda. We determined that four factors have had a major influence on the Rwandan vaccine program, including strong central government leadership (political will), a culture of accountability, local ownership and a strong health value chain. Rwanda’s national immunization program is rooted in a political landscape shaped by unique aspects of Rwandan history and culture. Rwanda has a strong central government and a hierarchical chain of command supported by decentralized implementation bodies. A culture of accountability transcends the entire health system and there is local-level ownership of the immunization program, including the role of engaged community health workers and a strong health information system. Together, these four factors likely account for Rwanda’s vaccination coverage success.

This Special Thematic Section brings together eight papers that showcase different aspects of the contribution of psychology to the processes of recovery in Rwanda following the 1994 genocide. The Section is noteworthy in part because a majority of the papers have Rwandan authors. In summarizing the contributions I make six observations about the remarkable context of the genocide and its aftermath: a) it was distinctive from previous mass violence in its intensity and character; b) it has been characterized by bystander inaction and the problems of positioning outsiders to help; c) hundreds of thousands of accused or convicted perpetrators have lived alongside survivors; d) electronic media played a profound role not only in promoting violence but also in building peace; e) Rwanda has been the site of unprecedented societal interventions with political goals that have the character and content of social psychological experiments; and f) the role of memorialization in repairing or sustaining harm needs further examination. I conclude by noting that the study of recovery is clear proof that the genocide in Rwanda, as is the case with genocides of the past, failed to achieve its aims.

Background: Over 80% of children diagnosed with cancer survive in high-income countries (HICs). While the survival rate remains poor in low- and middle-income countries (LMICs) such as Rwanda, a growing number of children with cancer are surviving to adulthood. These children and young adults will face an increased risk of secondary cancers and late complications from their curative treatment. Cancer centers in HICs have established Long Term Survivorship (LTS) programs to cater for childhood cancer survivors and to capture these complications and/or recurrences at an early stage. They also address the more complex psychological and social aspects of surviving cancer in childhood. Aims: To develop an LTS program in Rwanda, initial training will take place in Botswana where a pediatric hematology-oncology (PHO) program was established at the national referral hospital, Princess Marina Hospital (PMH), in 2007. This training program will allow successful methods and lessons learned from the development of an LTS program in Botswana to establish a similar program in Rwanda with ongoing bidirectional collaboration. Methods: The Texas Children's Cancer and Hematology Centers (TXCH) Global Hematology-Oncology Pediatric Excellence (HOPE) program in Botswana is the only provider of PHO care in the country, provided at PMH, through a partnership with the Botswana government. The program has over 130 childhood cancer survivors in active follow-up. A one-month bench-marking visit will be conducted. During this period, Dr. Rubagumya will spend time with the medical director of the program learning how the LTS program was established and current operations. He will spend time with clinicians during consultations to understand the scope of tests requested, frequently asked questions across all parties: clinicians, survivors and/or caretakers and use of technology to aid in the management of LTS patients. Focused interviews of clinicians, patients, caregiver and administration will be conducted to further understand the challenges of the pediatric cancer survivors and the development of an LTS program in an LMIC face. Results: After this month visit, critical areas of knowledge transfer will include: how to set up a childhood cancer survivorship programs; methods for sustainable operation of a childhood cancer LTS program, and how to help childhood cancer survivors navigate health care systems. A similar model will be established in Rwanda. Long-term mentorship with Botswana colleagues will help to build Rwanda's first LTS. Conclusion: Survivors involved in dedicated LTS follow-up care have better health outcomes. This indicates the need for life long survivorship care. There is a dearth of data on how to establish and operate a childhood cancer LTS program in LMIC settings. Lessons learned through this program will guide us on how to set up such program in Rwanda.

But what might Rwandans be doing with that state narrativebesidesconforming to it out of fear of reprisal? I argue that to understand what sustains official narratives we must grasp not only their coercive aspects, but also how social actors put them to work for different reasons. I offer four possible forms of agency in which Rwandans engage when they reproduce official history to show how – while forcibly imposed – government narratives are nonetheless cultural resources that people can turn to personal and collective visions, projects and desires. The article aims to develop a more robust understanding of how people respond to imposed narratives of nationhood and history, since it is important to attend not only to resistance, but also conformity to them.

Introduction. In March 2022, the Home Office of the United Kingdom of Great Britain published the Statement on New Immigration Plan according to which persons having no right to reside on its territory would be removed to “safe third countries” according to the agreements with such states. On April 13th, 2022, a Memorandum of Understanding between Great Britain and Rwanda was signed prescribing that persons whose applications for asylum were not considered by Great Britain be removed to Rwanda for those applications to be considered by the latter. Incompatibility of the contemporary immigration policy of Great Britain with its international law obligations justifies the topicality of the assessment of its implications for codification and progressive development of international law. Materials and Methods. The assessment of the contemporary immigration policy of Great Britain from the standpoint of international law includes the matching of the provisions of the international and national acts adopted by Great Britain as well as official statements of its state bodies and officials and the provisions of universal treaties and “soft law” acts. The writings of the publicists studying international law aspects of forced migration, asylum and human rights served as theoretical framework of the present study. Research Results. The assessment of the Memorandum of Understanding reveals the incompatibility of its provisions with the international law norms on asylum and human rights. Such international law policy of the state should be regarded as an example of rejection of international law which is referred to as “international law nihilism” in Russian legal doctrine.Discussions and conclusions. The authors argue that further adoption of legal and political measures contrary to states’ obligations under treaties and international custom as well as the absence of expressed official positions of states with regards to such measures may have an impact on construction and application of international law norms governing legal status of forced migrants.

<p>The Council of National Defence, established on 1 July 1920, was to be a temporary governmental body having full legislative and executive power in all matters relating to the conduct and ending of the war, and also with the conclusion of peace with Bolshevik Russia. As regards the above matters, the Council of National Defence was to issue orders and regulations, which were immediately enforceable. Despite acquiring very broad powers, both legislative and executive, none of its regulations went beyond its competence scope. The Council of National Defence regulations had to be approved by the Legislative Sejm in order to be valid. During the three months’ period of its functioning, the Council of National Defense issued over 90 different legal acts aiming at strengthening of defense of the Polish State that was threatened with a loss of its independence. The Council of National Defense played a major role in holding back the Bolshevik invasion of Poland. It contributed to formation of a large army, and made the nation regain its faith in successful end of the military conflict with Soviet Russia.</p>

Abstract:
It has been argued that political entrepreneurship is playing an increased role for public organizations and play a vital role in local government organizations. Political entrepreneurship has previously been studied from the motivations and actions of the individual entrepreneur. We argue that in order to understand why political entrepreneurship occurs in local public administration, these aspects are not enough. Instead, we need to consider entrepreneurship as situated, and analyse contextual conditions which form institutional demands for political entrepreneurship. A tentative framework is presented, which distinguish conditions coming from reformed organizational setting and conditions coming from new policy challenges. Finally, we conclude that the character of the conditions and thus the institutional demands directs political entrepreneurship towards either value-generative or collaborative entrepreneurship.

The author is Professor Emeritus of Planning and of Geography & Regional Development as well as of Public Policy and Administration, University of Arizona and formerly Chair of the Planning Program. Previously, he was professor and chairman in these fields at Harvard University and Rutgers University. He has been Visiting Professor at five Latin American universities, in a faculty career that dates back to 1961. Since 1999 he has spent several months each year conducting research on Basque planning, from a base in Biarritz, France. His editorial experience includes ten years as Book Review Editor of the Journal of the American Institute of Planners, Journal of the American Planning Association and Compiling Editor of Ekistics. He has been active in professional planning practice, both in the United States and internationally and is former national Chairman of the American Institute of Certified Planners. He was elected Fellow of the American Institute of Certified Planners in 2001 and has been a member of the World Society for Ekistics since 1975. Mann is an extensively published scholar in Planning and related fields, including ten monographs, several times that many articles and chapters, and an even greater number of book reviews in the professional literature. He holds a doctorate in Planning (Harvard) and did postgraduate work at London School of Economics & Political Science. He is fluent in French and Spanish.

This article explores some aspects of the place of gender in educating public administrators for leadership, an important component of re-orienting women’s public sector role. While previous research has examined the place of gender in the Master of Public Administration (MPA) diversity and core courses, this study adds to our knowledge by analyzing gender in popular introductory MPA textbooks and in leadership courses. The aim is not only to see whether these offerings cover gender issues but whether they explore such issues only through a legal lens or supplement that approach with analysis of stereotypes in the gendered workplace—what management scholars call second-generation bias issues. The research finds that introductory textbooks and most leadership courses do not include material on second-generation bias issues. This tendency is unfortunate as some feminist theorists argue that adding education in second-generation bias issues to MPA education would help increase the role of women as leaders.

Resumo Este estudo tem por objetivo analisar a influência dos aspectos socioeconômicos, financeiro-orçamentários e político-eleitorais na transparência ativa e passiva dos governos locais brasileiros. A partir de 3.550 municípios brasileiros, realizou-se a reamostragem de 100.000 amostras e, utilizando o método de regressão linear múltipla com dados de seção transversal, obteve-se melhor robustez e confiabilidade dos dados. Os resultados indicam que em municípios maiores existe maior propensão a divulgar informações de modo ativo para diminuir os custos de agência. Uma população com renda per capita elevada exige mais informações, pois busca saber onde seus impostos são aplicados, o que exige uma sociedade mais bem-educada. Os investimentos de capital são de interesse da sociedade, por isso se espera que o nível de transparência seja maior onde houver mais gastos desse tipo. A competição eleitoral exige do gestor público uma postura mais transparente diante de seus adversários e da população para confirmar suas promessas pré-eleitorais.

BEFORE WE CAN BEGIN TO EXAMINE THE PROSPECTS FOR Europe's future, we must acknowledge that, for three years now, the European Community (or rather, the European Union) has been in a state of latent, but nonetheless profound, crisis. The problems surrounding the ratification of the Maastricht Treaty revealed this crisis but its roots go much deeper. We have all experienced its manifestations: 1) an economic and social crisis, in the form of the currency upheavals of 1992–93 and the rise in unemployment; 2) a political crisis, following the failures of the European Union in the former Yugoslavia and its complete absence from the scene in Rwanda; 3) an institutional crisis, given the uncertainties posed by the prospect of an enlarged (‘wider’) Europe for the present effective working of the Community, and even for its future in the absence of a clear political will.

In this paper I examine some of the properties of the speeches by former U.S. President George W. Bush framing the issue of terrorism as the most pressing menace humanity is facing and some of the consequences of the selective appropriation of the discourse on terrorism initially instantiated by Bush. The theoretical framework for the analysis is a multidisciplinary Critical Discourse Analysis approach relating discursive and socio-political aspects of U.S. presidential discourses on terrorism in the Bush era. Parallel to an analysis of common characteristics of political discourse, such as ‘us’ versus ‘other’ representations, the device of over/less characterisation, hyperboles and repetitions, attention is also directed towards the socio-political effects deriving from the ways in which ‘terrorism’ and ‘terrorists’ have been represented by the presidential discourse on terrorism that condition the contemporary life of individuals and groups all around the world.

The Spanish Constitution of 1978 introduced a dramatic change into the political organization by decentralizing the existing State into seventeen regional governments with a broad range of authority. This transformation involved a ‘services transfer process’ from the central government and a simultaneous evaluation of the financial resources needed by the regional governments. The paper contains an analysis of the main features of this process, focusing on the various problems that have arisen in the estimation of the cost of the services transferred. Finally, some recommendations are offered for the future multilevel public financial system, which are in accordance with the present Spanish regulations on this subject.

The purpose of this study is to study the research potential of the phenomenological approach in the social sciences, which emerged in the first half of the XX century as a critique of the dominant method of logical positivism at that time. The following scientific approaches and methods were used in the article: the method of analysis, description and comparison, as well as the phenomenological approach. The author has made an attempt to prove the significance of phenomenology in the social sciences by means of comparison as a way not only to describe facts, but also to explain motives and unobservable meanings. According to the results of the conducted research, the author comes to the conclusion that the solution of urgent problems of society through the practical application of the acquired knowledge about society is possible only if the phenomenological method is actively applied in such a scientific and practical discipline as public administration. This will help to overcome the bureaucratization of the civil service, the isolation of the state administrative apparatus from real social problems, as well as to involve the population itself in the process of public administration, establishing feedback.

Electronic government encompasses all government roles and activities, shaped by information and communications technologies (ICTs). Going well beyond analogies to e-commerce, it encompasses the four domains of governance and public administration: the state’s economic and social programs; its relationships with the citizen and the rule of law (e-democracy), its internal operations and its relationship with the international environment. E-government builds on three evolving forces: technology, management concepts and government itself. It has given rise to several phenomena that are redefining the public sector environment, including the International Institute of Administrative Sciences. Four aspects of e-government have lasting impacts on public administration: citizen-centered service, information as a public resource, new skills and working relationships, and accountability and management models. The challenges of e-government are even more acute in developing countries, although it also offers solutions. Public administration in all countries requires new thinking and leadership to ensure that e-government realizes its full potential.

In perfectly functioning democratic civil society, political decisions should be based on competence of elected officials and their knowledge of certain political issues where experts play an important role. The aim of this article is (1) to look at the role of elected officials (legislators) and public administration institutions in determining the governance of rule of law within defense policy in relation to engagement of the members of society in national defense, and (2) to analyse what factors affect sustainability of this policy and under what circumstances it transforms, and how this transformation is reflected in the public law. Methodologically theoretical / literature overview has been conducted, discussing the role of institutions in the political process and their interaction with legislator within the framework of new institutionalism. Empirically the case of Latvian defense policy towards societal engagement into national defense has been presented and analysed. An important aspect of the empirical study of this issue is interaction among the legislator, public administration institutions, non-governmental sector, and the public. Findings of this analysis leads to argument that Latvian ministry of defense plays a central role in sustainability and transformation of the national policy towards societal engagement into national defense. Legislator does not take necessary initiative in these policies, which is reflected in absence of needed amendments from the perspective of the public law, considering political ambition set by the Ministry of Defense of Latvia. Required political support of ministry’s political initiatives have been granted by the parliament, but as a consequence, this policy in its full extent is not currently properly reflected in the legal acts and regulations. The article examines the history of the formation and reform of the system of state and municipal administration in Ukraine. In the conditions when the socio-political space of Ukraine is characterized by pronounced regionalism, and the issue of transition to a federal state system is excluded from the real political agenda, the nature of the development of the system of state and municipal administration can serve as a reflection of the ratio of centrifugal and centripetal trends in the internal political development of Ukraine. The article presents an analysis of the factors of internal political development of Ukraine that most influenced the formation of a centralized system of territorial administration in the country in the post- Soviet period and predetermined the weakness of local self-government, as well as the reasons for the failure of several attempts at reforms. Special attention is paid to the implementation of the decentralization policy after 2014. The article reveals the connection of the concept of modern administrative-territorial reform in Ukraine with the settlement process in the Donbas, as well as with the approaches in Western political science, according to which decentralization is considered as a tool for neutralizing the political potential of regionalism and countering regional separatism. The results and political orientation of decentralization in the context of the acute socio- economic crisis in Ukraine are evaluated.

The education machine constructed by right wing politics and discourses has been of great concern for some time, especially during the Bush administration. However, actions by the Obama administration have further accelerated that reeducation machine by maintaining legislation like NCLB and support for educational corporations. This paper describes how this hypercapitalist conservative machine continues to use forms of signification and resource redistribution as mechanisms of power, masks cultural and intellectual diversity, co-opts identities, and corporatizes all aspects of education (including the ways we construct and understand learning) to interpret them as competition, privatization, and profiteering. Politicians from both (or all) political parties may be so attached to the tentacles of hypercaptialism that radical thought and actions are necessary to save and construct education that is socially just, equitable, and democratic.

Resumo Este artigo tem o objetivo de analisar a liderança dos governos estaduais brasileiros na implementação de políticas de distanciamento social para o enfrentamento da disseminação da COVID-19. Pressupõe-se que as políticas de distanciamento social são heterogêneas, apesar da liderança dos governos, ou seja, apresentam certo grau de assimetria nas restrições do funcionamento do comércio e de atividades com potencial de aglomeração de pessoas. Diante disso, foram combinados os debates sobre processo de produção de políticas públicas e sobre autonomia e federalismo, para investigar a influência dos fatores políticos ou técnico-administrativos nas políticas estaduais. Os seguintes procedimentos metodológicos foram utilizados: análise de conteúdo de 134 normativas estaduais; mapeamento do alinhamento político-partidário dos governadores estaduais ao presidente da República; análise dos recursos médico-hospitalares de cada unidade da federação baseada no Cadastro Nacional de Estabelecimentos de Saúde (CNES). O contexto emergencial revelou baixa coordenação interfederativa pelo governo federal, provocando uma competição entre entes federativos e forte liderança estadual na gestão da crise no âmbito local. A pesquisa mostra, por um lado, que as decisões sobre as políticas de distanciamento social não podem ser explicadas por fatores políticos; e por outro, a correspondência entre a capacidade do sistema de saúde local e o nível de rigor das políticas de distanciamento social. Conclui-se que, na atual situação de transtorno social intenso, preferiu-se a racionalidade técnica a barganhas políticas.

Abstract Can the Internet be redesigned to reduce future conflicts? The Internet's underlying architecture, Internet Protocol (IP), was introduced in 1974. Since then many ideas have been put forward about how to update and improve it. One branch of these is called “Information-Centric Networking” (ICN). Trossen and Kostopoulos note how ICN could improve the ability of the Internet to resolve conflicts between the various constellations of stakeholder interests, conflicts that they call “tussles.” Introducing a “tussle taxonomy,” they provide examples of how tussles might be resolved differently in ICN. They believe the ICN model would help rationalize pricing in a three-sided market; reduce congestion and transit costs; provide more transparency; offer more choices and possible outcomes with respect to issues such as privacy, intellectual property, and data protection; and better enable not just present but future business models that actors within the system might strive to establish.

The development of information and communication technologies leads to new technological phenomena, such as artificial intelligence, which makes it possible to increase the capacity of the human brain to process information and make decisions. Over the last twenty years, the information collection system has become more complex, its volume is growing exponentially, and new ways of processing information, such as neural networks and machine learning, are appearing. Technologies are rapidly changing and developing, and of course the public administration system takes them to improve the accuracy of forecasts and the quality of decision-making in various policy sectors. Algorithmic governance is referred to by the term algocracy. However, not all of the public administration system works with the use of machine learning algorithms remain areas where traditional decision-making methods persist. Despite the progressiveness of algorithmic governance there are still a number of problematic aspects that require ethical and legislative regulation of algorithmic governance. The purpose of this article is to analyze the essence of governance based on the use of big data algorithms and to present a classification of the advantages and risks of an automated data analysis system for public administration.
