Abstract:
This study examines the development of the informal micro-business sector and how it is influenced by adat in the traditional village markets of Gianyar Regency on the island of Bali, Indonesia. Informal micro-business is an important element of the Indonesia domestic economy. The adat, commonly defined as customary ancestral laws and cultural traditions, refers specifically to customary laws, both oral and written, and is ingrained in the everyday lives of the Balinese, especially at the local village level. These "laws" act as codes of conduct that the citizens of the community must maintain and abide by. The traditional village is the place where the adat is firmly entrenched and inextricably linked to economic activities. The traditional village market is also the place where informal micro-businesses gather and perform daily economic transactions. Using ethnography and mental map research methods, this research seeks to further the knowledge and understanding of the informal micro-business sector in and near the traditional village markets of Gianyar Regency and how their development is influenced by the adat. The district markets of Payangan, Ubud and Sukawati, along with several random village markets, are selected as the research sites to demonstrate the commonalities, differences and tendencies in the traditional markets despite the presence of various economic forces. This research finds that the adat significantly influences the informal microbusiness sector and provides an opportunity for entrepreneurs to satisfy village customary and cultural needs. Further, the research finds that the traditional village, known as the Desa Adat, is the primary source of the adat's influence in the traditional market.

Abstract:
This thesis investigates the history and phenomenon of legal pluralism in Indonesia. The need to explore this topic has been urged by the revival there of Islamic law and adat law, the two greatest non-state normative orderings, in the last two decades. At the same time the ideal of modernity in Indonesia has been characterized by a state-driven effort in the post-colonial era to make the institution of law an inseparable part of national development. The result has been a conception of law as a homogenous system in which the ideology of legal positivism represents the basic tool for lawmaking. This, however, has led to an impasse, seeing that pluralism and multiculturalism are in fact self-evident phenomena in the society. The state has been obliged, therefore, to accommodate these non-state normative orderings.
The discussion of Indonesian legal pluralism in this thesis focuses on understanding the state's attitude and behavior towards the three largest legal traditions currently operative in the society, i.e., adat law, Islamic law and civil law. Socio-political factors are shown to have much influenced the relations between state and non-state laws. The state's strategy of accommodation of legal pluralism has in fact largely depended on the extent to which those legal traditions have been able to conform to national ideology. Certain "national legal postulates" have functioned as a yardstick by which the country's legislative and judicial institutions have measured the extent of their accommodation of legal pluralism, although they have had little choice but to do so.
Influenced by Masaji Chiba's theory of "three levels of law" (i.e., official law, unofficial law and legal postulates), this thesis analyzes two aspects of legal pluralism in Indonesia: the political and "conflictual" domains of legal pluralism. The analysis is thus generally based on the state policy of legal pluralism reflected in the legal and political strategies confronting the issue of unofficial laws as well as the conflicts arising from such situations. The first aspect is addressed by looking at a number of statutes and regulations promulgated specifically to deal with Islamic law and adat law, while the second is analyzed in terms of actual cases of private interpersonal law arising from conflict between state and non-state legal traditions, as reflected in legislation and court decisions. From a discussion of these two aspects, the thesis concludes that, although the form of the relations between official and unofficial laws may have changed in conjunction with the socio-political situation of the country, the logic behind legal pluralism has in fact never altered, i.e., to use law as a tool of state modernism. Thus conflicts arising from the encounter between different legal traditions will usually be resolved by means of "national legal postulates," making the unofficial laws more susceptible to the state's domination of legal interpretation and resolution.

Abstract:
This thesis is an ethnography of Bugis marriage. It is concerned with aspects of gender, sexuality and marriage in a bilateral, highly competitive, hierarchical society. ¶ I examine the fundamental concept of siri’ in relation to gender socialisation, courtship, the importance of kinship and status in marriage, how sexuality is regulated between the sexes, sex within marriage, and the dynamics of marriage, divorce, and reconciliation. The analysis considers how Islam combines with local custom (adat) in everyday practices, and how Bugis cultural specificities are affected within the national ideology of contemporary Indonesia. ¶ This ethnography explores an interpretation of Bugis social and sexual experience through examination of the construction of gender identities and how they are manifested in marriage. The thesis explores the complementarity of gender for the Bugis. Despite the ideal of feminine passivity, I demonstrate that women exercise agency in a number of circumstances, including how they manage the sexuality of their husbands, defending siri’, the arrangement of marriage, remarrying, money management, divorce, and violent situations. I also examine the practices of illegal marriage (kawin liar) and illegal divorce (cerai liar) at local and personal levels. I analyse local and national debates on the legitimation of what is popularly known in Indonesia as ‘marriage based on religion’ (nikah secara agama) as part of the examination of Bugis marriage and marital relations. ¶ My thesis contributes to the understanding of Bugis notions of sexuality, gender and social location, and how these interact with siri’. I explore how and why violence occurs within marriage. I use a combination of informal interviews, participant observation and focus group discussions as well textual analysis of traditional manuscripts and incorporation of oral traditions.

Abstract:
This thesis illustrates how love, legality, money, sex(uality) and sin direct Malays’ marital strategies in the face of various social, moral, religious and structural pressures. Passionate love (cinta) is cherished and celebrated by Malays – that is, if it is indulged within marriage. Marriage serves as a license to engage in (otherwise illicit) sexual desires by rendering them “halal” or lawful in the eyes of Islam and Malay adat (traditions). A vigilant State-led Islamic Bureaucracy, which polices and punishes pre- or extramarital sexual liaisons between unmarried couples through strict moral surveillance, further ensures that access to physical intimacy remains a conjugal privilege. However, hindered by complex bureaucratic procedures for marriage and pressured by escalating passions, many of my Malay informants are compelled to seek cheaper, quicker, and discreet alternatives in neighboring Southern Thailand to “halal-ize” pre- or extramarital romances, resulting in secret – and legally contentious – monogamous or polygamous cross-border marriages. Cross-border marriages – specifically polygamous ones – are subsequently explored here as a careful (and often failed) negotiation between discretion and disclosure: their stability decreases with increased exposure, rendering them highly precarious. Contrary to the dominant male-centric scholarship on polygamy, this study privileges the perspectives and experiences of polygamous wives by considering how their position within the marriage informs their capacity to engage in – or conversely, disengage from – this multi-marital arrangement. Polygamy is embraced by some women as a female choice that secures access to marriage and motherhood – both crucial towards achieving Malay womanhood. For others, polygamy is hardly a “choice” at all, and they must cope with the discomforting reality in which the husband’s money, time, and attention are now “halved” between his wives. Love in polygamy is experienced in visible and measurable terms, and the husband’s unequal distribution of his emotional and economic resources create discontent among wives that may culminate in divorce, or covertly confronted through sorcery. In Malay polygamy, more therefore means less.

A novel pipeline is presented for unsupervised trajectory prediction. As part of this research, numerous techniques are investigated for trajectory prediction of dynamic obstacles from an egocentric perspective (driver’s per- spective). The algorithm takes images from a calibrated stereo camera as input or data from a laser scanner and outputs a heat map that describes all possible future locations of that specific 3D object for the next few frames. This research has many applications, most notably for autonomous cars as it allows them to make better driving decisions if they are able to anticipate where another moving object is going to be in the future.

The object of this thesis is to present a reinterpretation of Adam Smith's philosophy. It works to show the pessimistic character of his thought that is so often overlooked by conventional analyses. The skepticism Smith holds for man can be seen in his theories on the accumulation of knowledge, morality, economics, and human progress. By emphasizing Smith's theory of man's subjugation to the natural order, an alternative interpretation is given of liberal economics. The role of God in Smith's philosophy will be shown to serve two purposes. God serves as Smith's final line of explanation, and it also provides humanity beneficial results through unintended outcomes.

The problem is access to recent research made on how Swedish companies adapt to Asian business cultures. Research Question: How do Swedish companies view cultural differences in Asia and adapt if necessary? Purpose:  The main purpose of this study is to identify how companies view cultural differences and adapt if necessary. The purpose is also to provide such good material that companies could benefit from reading it in order to prepare themselves to work in different Asian cultures. Methodology: This is a qualitative study, which is using interviews as the source to collect primary data. The study is done with an inductive approach and based on a case study design. Conclusion: The conclusion is that before having meetings with other cultures, it is always favourable to read and learn as much about the customers culture as possible and if necessary, take a course on how to interact with other cultures. However, interacting with individuals from other cultures face to face is always the best way to learn and it is favourable to travel as much as possible to other cultures in order to learn about them.     Key Words: Culture, relationship, code of conduct, cross-cultural learning.

Abstract:
This study is an intellectual biography of Sir George Adam Smith, biblical scholar and Vice-Chancellor of the University of Aberdeen. Smith trained for the ministry of the Free Church of Scotland under A.B. Davidson, who was influential in disseminating Higher Critical views of the Bible in Scotland. Smith inherited his teacher's penchant for Hebrew and Old Testament criticisms, and served as Hebrew tutor in Aberdeen's Free Church College following the deposition of William Robertson Smith, before becoming the first minister of Queen's Cross Free Church, Aberdeen (1882-92). During his ministry in Aberdeen Smith established a reputation as a preacher of note, and a leading biblical scholar. His preaching drew a large congregation around him, and his Old Testament commentaries secured him a place of note among students of the Old Testament prophets. The tensions between the developing biblical scholarship of the period and the confessional commitment of the Victorian Free Church of Scotland are evident in his years of ministry; and this thesis examines the relationship between the Church's theological position and the scholarship of the rising intellectuals. In 1892 Smith was appointed to the Chair of Hebrew and Old Testament Exegesis at the Free Church College, Glasgow, where he served until 1910. Smith's scholarly work focused on further critical studies of the prophets and the Historical Geography of Palestine. The tensions between academic study of the biblical text and the Church's confessional position came to a head with a near trial for heresy in 1902, the significance of which is examined here. Smith also embraced a social Gospel, and the relationship between his critical study of the Old Testament and his social work in the cities is worthy of study. Some historians view the emergence of a social gospel as evidence of a disappearing orthodox; but for Smith the social work of the church was integral to the ongoing ministry of the Church. Smith served as Principal of Aberdeen University from 1910 to 1935. His position as Vice Chancellor was akin to pastoring a large congregation without credal commitment. The growth of the University during his Principalship is interesting in its own right; not less so are his work as Moderator of the United Free Church of Scotland (1916) and his work in church and state during the First World War.

However, critics have neglected to address its similarities to nineteenth-century American literature, and specifically how it continues a celebrated tradition dedicated to penetrating considerations of American identity. This study attempts to re-focus the critical perspective to illustrate that Cane deserves recognition as a major work of American literature because it calls for an Adamic personality to combat the complexities of the enigmatic American scene. Moreover, the study suggests that Cane belongs among those famous American writings by Emerson, Hawthorne, Whitman, Twain, and Melville because it too investigates the tensions between individuality and social continuity that are so important to an ongoing American dialectic. Finally, the study explains that Cane is in fact worthy of acceptance into the exclusive forum of American writings because ( in Roger Rosenblatt's words) it “is not conceived of in terms of what an individual human being may strive to overcome or accomplish, but rather in terms of where that individual may be spiritually and culturally located.”

A presente tese é fundamentada na obra Tribulat Bonhomet, de Villiers de L'Isle-Adam (1838-1889). Obra composta de quatro contos e uma novela. Tanto a obra quanto o autor permitem muitas reflexões acerca da literatura, desde a literatura de humor até a de horror, mas sobretudo literatura fantástica. E é sobre esta que me detenho, especificamente na novela Claire Lenoir. Como Tribulat Bonhomet permanece inédito em português, apresento uma tradução e sobre essa tradução ? que se encontra ao fim, como anexo ? elaborei minha tese, sobre uma via dupla: tradução e teoria literária. Dedico o Capítulo 1 a essa duplicidade, separadamente, apresentando em 1.1 a literatura fantástica, fazendo o esboço de um tipo de literatura que provoca um exorcismo do real, um afastamento entre o leitor e a realidade. Na seqüência, em 1.2 abordo as perspectivas de tradução de um texto literário, a partir, principalmente, de Friedrich Schleiermacher (1768-1834) e Antoine Berman (1942-1991). Ambos os tópicos servirão de base para os dois capítulos subseqüentes. No Capítulo 2, dedico-me ao processo de tradução do romance, levando em conta as perspectivas abordadas no Capítulo 1.2, fazendo comentários acerca da tradução e comparando-a com outras traduções. Por último, no Capítulo 3, partindo da forma como Villiers de L'Isle-Adam mescla realidade e ficção ? e tomo aí como base o texto traduzido ? retomo os temas esboçados no Capítulo 1.1, da literatura fantástica, para especificar os elementos estranhos que geram o fantástico na obra e provocam um exorcismo do real. A conclusão, portanto, dá-se sobre uma duplicidade: há um exorcismo do real na literatura fantástica; e há um exorcismo do real em Villiers ? mediante a inserção de elementos fantásticos.
Cette thèse est basée sur l'oeuvre Tribulat Bonhomet, de Villiers de L'Isle-Adam (1838-1889). Oeuvre composée de quatre récits et une nouvelle. L'oeuvre et l'auteur permettent de nombreuses réflexions sur la littérature, de la littérature d'humour jusqu´à l'horreur, mais surtout sur la littérature fantastique. Et c'est sur cette dernière que je me pencherai spécifiquement avec la nouvelle Claire Lenoir. Comme Tribulat Bonhomet reste inédite en portugais, je présente une traduction, et c´est sur cette traduction ? qui se trouve en fin de volume en pièce jointe ? que j´ai élaboré ma thèse selon une double voie: la traduction et la théorie littéraire. Je consacre le Chapitre 1 à cette duplicité, séparément, en présentant en 1.1 la littérature fantastique, faisant le croquis d'un type de littérature qui provoque un exorcisme du réel, une distanciation entre le lecteur et la réalité. Ensuite, en 1.2 je discute sur les perspectives de la traduction d'un texte littéraire, à partir, principalement, de Friedrich Schleiermacher (1768-1834) et d'Antoine Berman (1942-1991). Les deux thèmes formeront la base des deux chapitres suivants. Dans le Chapitre 2, je me consacre au processus de traduction de l'oeuvre, en tenant compte des perspectives discutées dans la partie 1.2, en faisant des commentaires concernant la traduction et en la comparant à d'autres traductions. Enfin, au Chapitre 3, à partir de la manière dont Villiers de L'Isle-Adam mélange fiction et réalité ? et je me base ici à partir du texte traduit ? je reprends les thèmes mentionnés dans le Chapitre 1.1, sur la littérature fantastique, en précisant que des éléments étranges génèrent le fantastique dans l'oeuvre et provoquent un exorcisme du réel. La conclusion, donc, se fonde sur une duplicité: il est un exorcisme du réel dans la littérature fantastique, et il est un exorcisme du réel chez Villiers ? par l'inclusion d'éléments fantastiques.

Augusta Ada Byron was born 10 December 1815 as the only child of the poet Lord Byron and his wife Anne Isabella Byron. Byron did not have a relationship with his daughter.Ada was often ill, beginning in early childhood. At the age of eight, she experienced headaches that obscured her vision. In June 1829, she was paralyzed after a bout of measles. She was subjected to continuous bed rest for nearly a year. By 1831, she was able to walk with crutches. Despite being ill Ada developed her mathematical and technological skills. At age 12, this future "Lady Fairy", as Charles Babbage affectionately called her, decided she wanted to fly. The Americans with Disabilities Act (ADA) is something that has created both freedom and confusion. There are those who are affected by the law, have family members who are, or have a basic understanding of the law. These varying degrees of knowledge help play a part in the confusion surrounding the law. Add to that the fact that the ADA is constantly being amended and it is no wonder that misunderstanding ensues. This paper sets out to see where the disorientation of the ADA is taking place, why it is happening, and what can be done to change it. Interpreting this law can seem like an insurmountable feat but to comprehend the law, its history must first be understood. It is important to distinguish between the law and the people it protects. They are not mutually exclusive or inclusive.

In this thesis I argue that Adam Smith is committed to moral egalitarianism, which extends to his theory of political economy. While Smith’s work is often used to justify economic inequality in society, I show that his political theory is best understood as a kind of relational egalitarianism. Using Elizabeth Anderson’s Democratic Equality as a model, I examine Smith’s commitment to equality in the space of social relationships. In particular, I argue that Smith’s focus on eliminating inequalities that cause oppression in society in conjunction with his efforts to design a political and economic system that will yield social conditions of freedom for individuals make him a relational egalitarian.

Le roman adamien a une forme encyclopédique. Il exprime le désir du romancier de rendre compte de la totalité de ses croyances. Ecrivain et poéticien, Paul Adam a une envie de révolutionner les instances littéraires. Il apporte ainsi à la littérature de nouvelles valeurs qui vont à tout jamais la relier aux autres formes d'arts. En effet, le romancier emprunte les matériaux à toutes les connaissances de l'univers. Œuvre littéraire, œuvre scientifique, œuvre d'histoire, œuvre d'art, les notions se chevauchent dans les écrits adamiens, lui donnant ainsi une allure de " fourre-tout ". Sous le couvert du naturalisme, puis de la décadence et enfin du symbolisme, l'écrivain fait du discours littéraire un objet hermétique. Dès lors, un sentiment d'insatisfaction habite la critique littéraire qui se demande comment appréhender le discours adamien. C'est aussi le problème qui nous préoccupe. Il faut tout simplement rechercher dans les affres de l'écriture des noyaux qui montrent l'originalité de sa pensée
The novel from Adam has an encyclopaedic form. It conveys the writer desire to express his entire believes. Paul Adam is both a writer and a poet who is eager to revolutionize literary values. So, he brings to literature new elements which are linked for ever, to other forms of Art. Indeed, the writer takes material from all the know ledges of the worlds: from Art works, historical works literary or scientific ones, in other words, notions are lapping over in Adam's writings and they five themselves a figure of real jumble of ideas. Under the shelter of naturalism and of decadence and at last of symbolism, the writer makes of a literary speech something obscure. So that, a dissatisfaction feeling is in the literary criticism which wonders how to apprehend Adam's speech. It is also the problem we are worried about. We have only to look for the original aspects of his thought in the pangs of his writings

Pour Smith, le progrès de la société ne se résume pas à la croissance économique. La première partie s'intéresse au lien entre développement économique et progrès moral. Smith est, conscient des méfaits moraux du développement économique, en particulier de la corruption des travailleurs à cause de la division du travail. Néanmoins, on peut montrer que le commerce des biens, analogue dans sa forme au commerce d'opinions et de sentiments moraux, est favorable à la pratique des vertus de prudence, de justice et de maîtri se de soi. En outre, nous pensons qu'il existe une problématique morale de la Richesse des Nat ions, dans le sens où Smith écrit un plaidoyer pour la croissance économique parce que celle-ci permet à tous de se procurer les biens de nécessité vitale et sociale, et ainsi de mener une vie décente et digne. La seconde partie montre que les bienfaits économiques et moraux issus du développement économique sont dépendants du cadre politique. Contre le système mercantile, discours rhétorique, partiel et partial d'économie politique, Smith, spectateur impartial de l'économie, propose le système didactique et philosophique de la liberté nature dans lequel la croissance et le bien être des individus sont maximisés grâce à un gouvernement juste et impartial qui favorise les comportements moraux des individus. Dans ce cadre, le marché est à la fois efficace et juste à travers la gravitation des prix de marché vers les prix naturels. Au final, Smith apparaît comme un théoricien de la civilisation commerciale.
