Abstract:
This chapter gives an overview of the instruments that are used to harmonise commercial law at an international level as well as of the international institutions that are most active in commercial law harmonisation. It opens with an introduction on the reasons and advantages of harmonisation and on the difference between substantive law and conflicts rule harmonisation. As regards the instruments, it highlights their variety and different nature and effects (ranging from the traditional treaties or conventions to facultative instruments such as model laws, other non-binding rules and principles, guides) and their respective advantages and drawbacks. As to the institutions, it focuses particularly on the mandate and achievements of the three most important global agencies in this field, that is the Hague Conference, UNIDROIT, UNCITRAL, as well as the International Chamber of Commerce, concluding with the issue of coordination of legislative activities at international level.

Abstract:
This chapter argues that the Filipino Community Center represents a “class project” that not only reveals a repertoire of Filipino identities but also an active confrontation with the group's ethnoracially assigned identity and its political, economic, and social consequences. It analyzes the grand opening ceremonies of the Filipino Community Center and suggests that as a middle class project (with the Filipino Chamber of Commerce a central stakeholder), it emphasizes self-help entrepreneurship and the elevation of business-related “ethnic heroes” as part of the never-ending pursuit of the “American Dream” in a “Land of Immigrants.” The chapter investigates several interrelated issues, namely how those in the middle class shape subjectivity in a community that has been defined and defined itself as impoverished and subaltern, and the various ways Filipinos think about and perform class (via the images, symbols, and ideologies they use) to construct competing visions of “Filipino.”

Abstract:
This chapter discusses ways in which an awareness of topics might influence performance behaviors. It contrasts topics as understood respectively by Aristotle (abstract concepts) and Vico (potential for action). Through case studies taken from Mozart’s chamber music with piano (specifically in a “period-instrument” context), it investigates subtle interactions between different dance topics (sarabande, gavotte, bourrée), which emerge only through careful consideration of notational features such as beat hierarchy and other aspects of historically informed performance practice hinted at in the notation. Awareness of these interactions, and recognition of their invitations to engage in certain performance gestures, offers the potential to create performance narratives that counterpoint the formal design mapped out in the notated score.

Abstract:
This chapter comments on Article 56 of the Rome Statute of the International Criminal Court. Article 56 provides an exceptional mechanism by which evidence may be collected under judicial oversight and then made available at trial. It authorizes the Pre-Trial Chamber to ‘take such measures as may be necessary to ensure the efficiency and integrity of the proceedings and, in particular, to protect the rights of the defence’. Thus, the focus is on ensuring that the interests of the defence are protected at a stage that may arise even before a defendant has been identified. However, the benefits of article 56 are not reserved to evidence helpful to the defence. The special function of article 56 can be invoked by the Prosecutor or by the Pre-Trial Chamber itself, acting on its own initiative.
