Abstract:
This chapter examines how individual members’ perceptions and responses to organizational identity threats drive (or not) an organizational threat response. We suggest that for an organizational identity threat to be recognized as such and to provoke a response from a member, the threat must put the members’ own identity at stake. Our central contention is that an organizational identity threat must translate into a threat to members’ own identity for them to respond to it. We also propose that individual members who perceive an organizational identity threat can only mobilize organizational action when there is a consensus—in other words, broad support—about the presence and significance of the threat. We highlight the role of consensus-building via bottom-up and top-down processes, and explore the role of political mechanisms that underpin and determine whether the two processes of consensus building are successful.

Abstract:
This chapter discusses Security Council authorization of member states to use force. There is now general agreement that the original scheme of Chapter VII of the UN Charter is not workable, and that the UN itself will not conduct enforcement operations. Instead, the Security Council may authorize member states to take enforcement action, even if the precise legal basis for this in the Charter is not clear. The Security Council has not again authorized member states to use force against an aggressor state in the same way as it did against Iraq after its invasion of Kuwait, but it has authorized action for a variety of other purposes. This chapter then discusses the controversy over claims of implied or revived authorization of the use of force by the Security Council.

Abstract:
As the epidemic of noncommunicable diseases (NCDs) continues to have its negative impact on lives, livelihoods, and economies across the globe, the Pan American Health Organization (PAHO), Regional Office for the Americas of the World Health Organization (WHO), has taken action to strengthen its technical cooperation with Member States in addressing these diseases, their risk factors, and related issues, through the development and implementation of the Regional Plan of Action for the Prevention and Control of NCDs. The establishment of national NCD plans is one of the four main global NCD commitments, however only a selected number of Caribbean countries have been able to establish such plans. In an effort to provide information and share knowledge of successful experiences and practices in establishing national NCD plans, this in-depth qualitative analysis was conducted in the selected countries. This report highlights the good practices and successes that can be replicated in other countries that have not yet established their NCD plans. It also identifies areas that can be strengthened for greater effectiveness in NCD prevention and control. PAHO/WHO anticipates the use of this report not only as a tool for countries, but also as a guide for enhanced technical cooperation and collaboration between PAHO and its Member States. As such, governments, civil society, the private sector, as well as other development organizations can use these plans to carry out comprehensive, effective, multisectoral interventions for NCD prevention and control throughout the Caribbean.

This chapter discusses articles in the Treaty on the Functioning of the European Union (TFEU) that provide for actions that are brought directly before the Court. Under Articles 258 and 259 TFEU (ex Articles 226 and 227 EC), respectively, the European Commission and Member States may bring enforcement proceedings against a Member State in breach of Treaty obligations. Article 260 TFEU (ex Article 228 EC) requires compliance with the Court’s judgment. Article 263 TFEU (ex Article 230 EC) concerns judicial review of EU acts. The outcome of a successful action is annulment. Article 265 TFEU (ex Article 232 EC) provides for actions against the EU institutions for failure to act.

Abstract:
The new institutional balance resulting from the Treaty of Lisbon is being tested nowhere as sharply as in the field of the exercise of the EU’s powers of external action. There is a wealth of recent litigation clarifying aspects of the procedural code, now set out in Article 218 TFEU, which governs the negotiation, conclusion, and implementation of international agreements concluded on behalf of the EU. This chapter explores issues connected with the adoption of acts within the framework of Article 218, including the designation of the Union negotiator, the choice of legal basis for decisions on the conclusion of agreements and the enhanced role of the European Parliament in such decisions. Also discussed are certain controversial developments in the procedure that applies for determining the Union’s position in a decision-making body established under an international agreement, and other issues including the legality of so-called ‘hybrid acts’.
