This sociological approach of “action” tries to explain how people justify their actions and what they say about why they engage.From these frames of reference, we propose a model that reflects the empirical practices of professionals in fundraising and organisations involved in building an agreement around philanthropy.This model highlights the devices and equipment being used to build the agreement. It illuminates on what is a “fair and legitimate” action for the general interest. It offer a mechanism to explain how these actions are judged by the stakeholders of organizations involved in a patronage.Our research has two applications in management:1. Identify actions for non-profit organisations to raise funds from organizations who wish to involve in public good.2. Understand of business engagement for the public good. Full textThe thesis is a study of the Mizoram conflict (1966-86) and its subsequent resolution by a Peace Accord. It examines how the fight for self-determination by an ethno-nationalist tribal group unfolded, how the might of the State was used to stem one of the most violent and bloody insurgencies of the country and how governmental and societal efforts ensured a conflict resolution, the first of its kind in post-colonial independent India. It examines the efforts made within Mizo society itself to work out an agenda for peace. This research also compares the different trajectory of the Mizo Peace Accord of 30 June 1986 with the accords inked by the Indian State around the same time with armed dissident groups in two other states of the Indian Union, Punjab and Assam - the Punjab Accord of 24 July 1985 and the Assam Accord of 15 August 1985. Though these peace accords were heralded as conflict erasers, in each case the results were different - either outright collapse as in Punjab, or a succession of years of stalemate and struggle as in Assam or lasting peace as in Mizoram. For one, why did the accords fail and, more importantly, why did they succeed? Secondly, in the case of Mizoram, was there a paradigm shift away from the traditional ways of resolution? Thirdly, how was peace built and sustained in a deeply divided Mizo society based on ethnic identities? Fourthly, how did the local society organically churn out the resolution paradigm to bring in peace and also to sustain it? And finally, what lessons does this hold out for the Indian polity? The thesis lays out arguments and constructs to try and answer these questions

Full textThe aim of this report is to list the implications of the TRIPS Agreement for the protection of industrial property in sixteen African states, parties to the Agreement establishing the WTO and members of the African intellectual protection organization (OAPI). Due to the requirements of conforming their legislation to the TRIPS Agreement, these countries have had to carry out an in-depth revision of the Bangui Agreement of 2 March 1977, relating to the creation of OAPI. This text, the Code on intellectual property of the above States, has undergone significant changes due to this revision. The effect of the TRIPS Agreement on OAPI has also changed the internal legal structure of these states, particularly their institutions and their administrative and legal practices. Moreover, some of the dispositions of the TRIPS Agreement, strongly contested by developing countries with considerable social problems, are facing increasingly hostile reactions from the populations and governments of the States. The requested demands in this respect by theses last have led to the Doha Declaration (Qatar) on the TRIPS Agreement in its relations on public health, of November 2001. The contents of this Declaration and the decisions which it brought about may lead to a renegotiation of the revised Bangui Agreement or the adoption of internal measures by Member states

Full textThe interaction of an intense laser pulse of short duration with a rare gas induces a highly non-linear polarization in the XUV spectral range: the high order harmonics. Due to the specific properties of the harmonic radiation and its applications, this issue is particularly rich and fertile. The efficient production of high order harmonics is based both on the non-linear response of the single atom and on collective behavior.The principle of the research presented in this thesis is the understanding and control of phase matching or quasi-phase matching in the presence of substantial ionization in the generating gas. In this context, we show the importance of the coherence length on the phase matching in High harmonic generation. We study its dependence on laser focusing, pressure but also its time dependence related to ionization. Moreover, experiments and simulations aim at extending harmonic spectra towards shorter wavelengths, a spectral range for which the X Ray Laser is emitted. This will give access to a source with complementary characteristics as regards to X-ray lasers. This source shall be developed in parallel on the LASERIX station or injected in soft X-ray laser amplifiers

Full textInitially relinquished, mutual agreement is now at the heart of the process of terminating the employment contract. There has been an evolution tending to the shift from suspicion towards mutual agreement as a termination device to the trust in such means. This acquired trust is best illustrated by the recognition of employment termination via mutual agreement by the Act dated June, 25th 2008. The reform introduced by this Act transformed the legal regime applicable to the termination of employment contracts. Despite the fact that Article 1134 of the French Civil Code has long granted parties the possibility to terminate the contract binding them by mutually agreeing to do so, such mode of termination has only been resorted to on a fairly limited basis. This phenomenon can notably be explained by both the lack of clear legal framework applicable to this device, and the restrictions imposed on its ambit. The recognition of termination of the employment contract via mutual agreement as a device specifically applied in the field of labor law, as well as the definition of a specific and independent regime would be likely to give rise to ending the resort to Article 1134, whose scope is only general and not specifically tailored to labor relations. The implementation of this specific regime could put an end to the monopoly held by unilateral terminations of the employment contract, particularly the method of dismissal. A broad consideration of termination of the employment contract via mutual agreement can also contribute to the appeasement and balance in labor relations

Full textReconciliation is the process of providing a consistent view of the data imported from different sources. Despite some efforts reported in the literature for providing data reconciliation solutions with asynchronous collaboration, the challenge of reconciling data when multiple users work asynchronously over local copies of the same imported data has received less attention. In this thesis we investigate this challenge. We propose AcCORD, an asynchronous collaborative data reconciliation model. It stores users integration decision in logs, called repositories. Repositories keep data provenance, that is, the operations applied to the data sources that led to the current state of the data. Each user has her own repository for storing the provenance. That is, whenever inconsistencies among imported sources are detected, the user may autonomously take decisions to solve them, and integration decisions that are locally executed are registered in her repository. Integration decisions are shared among collaborators by importing each others repositories. Since users may have different points of view, repositories may also be inconsistent. Therefore, AcCORD also introduces several policies that can be applied by different users in order to solve conflicts among repositories and reconcile their integration decisions. Depending on the applied policy, the final view of the imported sources may either be the same for all users, that is, a single integrated view, or result in distinct local views for each of them. Furthermore, AcCORD encompasses a decision integration propagation method, which is aimed to avoid that a user take inconsistent decisions over the same data conflict present in different sources, thus guaranteeing a more effective reconciliation process. AcCORD was validated through performance tests that investigated the proposed policies and through users interviews that investigated not only the proposed policies but also the quality of the multiuser reconciliation. The results demonstrated the efficiency and efficacy of AcCORD, and highlighted its flexibility to generate a single integrated view or different local views. The interviews demonstrated different perceptions of the users with regard to the quality of the result provided by AcCORD, including aspects related to consistency, acceptability, correctness, time-saving and satisfaction.

Full textMid-infrared tunable sources are becoming of considerable interest for applications in environmental monitoring. Semiconductors of the technological mainstream (such as gallium arsenide or zinc selenide) are excellent candidates for optical conversion of near-infrared waves into the mid-infrared range. However, these materials are isotropic, so that quasiphase-matching scenarios are needed to get an efficient conversion. Reflection quasiphase-matching techniques are studied here. We make use of the Fresnel birefringence at total internal reflection to reach the phase-matching conditions in a plane parallel plate. It is shown that this technique is very similar in its principle to the natural birefringence phase-matching : we thus call it Fresnel phase-matching. Two schematic situations are explored. First, a model of classical resonant quasi-phase matching scenario is presented; the agreement between theoretical predictions and experimental results is convincing. Second, the Fresnel birefringence allows a new non-resonant quasiphase-matching scenario: this appears to greatly alleviates the phase-matching conditions and provides a high tenability. The impact of restricting factors is also quantified. So, the Goos-Hänchen shift is similar, in terms of conversion yield, to the classical walk-off. This actually limits the dimensions of the plate. However, the most inhibiting parameter appears to be the surface roughness : indeed, this sole factor is enough to determine the conversion efficiency of the whole structure. Optical parametric oscillation threshold calculations based on the Brosnan and Byer formula are finally presented. Parametric fluorescence is measured in a Fresnel phase-matched plate. The first estimations of the oscillation threshold are promising

Full textThe thesis brings into light the manner in which Descartes considers the relationship between his philosophy and Christianity through showing that the Cartesian articulation of reason and faith finds its meaning in a non-contradictory separation which leads to an agreement. When analysing his work, Descartes appears as a philosopher who looks after to establish new concepts which conciliate with Christianity.The thesis focuses two fields of investigation to study the meaning of such an agreement and the relationship to Christianity that it involves. On one hand, there is the Cartesian Eucharistic theory: Descartes elaborates, in the light of his own physical principles, two explanations of the central sacrament of the Christian faith. The thesis points out the original purpose of the explanations. In brief, they are not only intended to supplant the scholastic model based on the Aristotelian principles but also to conform to the decrees of the Magisterium (the Council of Trent), amid protecting the Catholic dogma from Protestant attacks, bringing it a gain of rationality. On the other hand, there is the Cartesian morality, which is considered traditionally as absent of the Cartesian corpus. The thesis reconstructs the Cartesian moral theory using the Correspondence and Passions of the soul. Described as a "moral of contentment", due to the Philosophical research of “the happy life” here below, the Cartesian moral theory is divided into two axes. The first being the Sovereign Good, which consists in the right use of free will, and the second being the mastery of passions, where the keystone is the passion-virtue of generosity. The Cartesian moral theory manifests an effort to articulate with Christianity, which is illustrated in particular in several strong points which are analysed by the thesis: the Cartesian conception of providence in its general and particular dimension, and how it implies the free and joyful submission of the subject; the extent of the universe, which revokes anthropocentrism while celebrating the glory of God; the topic of the immortality of the soul, which opens up another life while valorising the current life; the image of God, which shines in the right use of free will, only source of the self-esteem; the passion of generosity, which incites one to prefer other people rather than the self in a love of friendship and can be a philosophical transposition of Christian charity.Thus Eucharist and moral translate two great meanings of the agreement, reflecting two modalitiesof articulation between Cartesian philosophy and Christianity. From one side, the search for conformity with dogma. From the other, philosophy, becoming more ambitious over time, gives an understanding of Christianity based on its own interpretation of some elements shared by reason and faith (God and his attributes, immortality of soul, relationship to other). For this reason, the thesis intends to renew the studies on the Descartes' religious thought: the great merit of Cartesian thought is to institute, on the basis of a prior separation between reason and faith, an agreement which has a variable meaning, while taking care not to go beyond his domain, Descartes giving up the salvation and the grace to theology

Full textThe objective of this thesis is to analyze the benefits of Tunisia's economic opening and the creation of a free trade zone with the EU on the development and industrialization of the country. This economic opening toward Europe could anchor policies, thus reducing the risk of reversing Tunisia's economic opening hence strengthening the credibility of structural and institutional reforms. This in turn makes the country more attractive to foreign capital. To achieve this, the government has put in place an "upgrading" program which includes a set of economic measures to enable the national production system to adapt to the new context. The most dynamic national sectors in industry are now facing tough competition in international markets. This is the case of the Clothing Textile Manufacturers following the abolition of the Multifiber Arrangement in 2005. The industrialization and development of the country depend on both endogenous and exogenous factors. Endogenous factors include the pace of institutional and structural reforms, the development of physical and social infrastructure, and good governance. Exogenous factors include efficient integration of the Tunisian national economy into the world economy through market penetration of promising economic sectors, sectors with high added value as well as sectors with high demand in international markets

Full textAgreement error disturbs the understanding of the information in the written language and makes it difficult to do automatic analysis. Through a syntactic description and a typology, we try to understand the basis of the agreement error and to explain their mechanisms, in order to propose some assistance to automatic processing. We present in the first part: the agreement rules, a corpus of sentences, the morph syntactic labels (abbreviations) of a machine dictionary which are used to encode the sentences, and the variables which compose the set of descriptive attributes. In the second part, we expose and explain the contingency tables (between some selected variables) and the classifications. We give the results of four kind of classification, on one hand three relational methods, on the other hand a factorial method. In the third part, we expose the typology given by those analysis, namely representative types of the most salient and regular characteristics of the agreement error phenomenon. Some types do not prove to be very homogeneous but they bring significant elements to the elaboration of an automated processes that could help to select and maybe to correct the agreement errors. Finally we make some proposals that might be helpful to teaching: according to the classifications, it seems that the agreement rules and their learning need to be improved

Full textThe agreement in the french seems very simple from the principle of concomitancy of marks and from that of categorical correspondence between a ruling word and a ruled word. But it is divided between the automaticity in application of rules and the predominance of meaning or the deliberate will of speech actor, when he can choose from them. This study discriminates what is imputable to strictly morphological facts and we often bring unduly into existence under the head of agreement, from what belongs to syntactic facts, in which formal marks, trans-gressing confines of word, come to cooperate to define a syntagm; it presupposes at the same time that the agreement is a morphosyntactical phenomenon between at least two words, the 'word' in the sense of glossological word. In all syntagms but the last one: nominal-verbal syntagm, nominal-nominal one, verbal-nominal one, verbal-verbal one, there are three types of agreement: morphological (or grammatical) agreement, semantic agreement, elimenation of agreement (or invariability). The confrontation of a lenient attitude with a enactment of ad hoc rules which fall under jurisprudential casuistry is examined in the aspects of sociolinguistics

Full textThe decision expressed by the legislator to strengthen conventional norm’s position in labor law, shows the importance of collective bargaining agreement from their conclusion through their application to their extinction. This PhD work aims to study the extinction phase and more precisely various mechanisms which lead to the end of collective bargaining agreements. There should be a clear distinction according to the origin of the operative event. Extinction will be shouldered when it will be the direct result of the choice made by the contracting parties to put an end to collective bargaining agreement. This choice will require the use of specific mechanisms such as denunciation or fixed term collective bargaining agreement. In contrast, extinction can be induced. Extinction should be binding on the parties because of a determinate event occurrence. In such cases different mechanisms have to be used such as caducity or « mise en cause ». These several situations show their relevance and interest. Therefore, beyond their definition a comprehensive scheme for each extinction mechanism will be suggested in this study
