Full textThe regulation of international disputes arising out of group actions consists of safeguarding the functions underlying a domestic group action procedure in the context of international litigation (i.e. access to justice, economic efficiency and market regulation). It also aims to ensure the legal certainty, the predictability and harmony of solutions; the latters are objectives also pursued by the rules of private international law. Such regulation reveals difficult to achieve, in light of the competition arising between the legal systems in relation to the redress of global mass damages and the failure of private international law methods and instruments to address complex disputes putting at stake large number of parties and having a strong regulatory dimension. Thus, the globalisation of group actions disputes raises complex questions of conflicts of jurisdictions, conflicts of laws, coordination of procedures and enforcement of decisions.This PhD dissertation aims at addressing all these complex questions. The suggested solutions take into account the intertwined interests underlying disputes arising out of international group actions and aim essentially to prevent the current intoxication of international mass litigation resulting from the occurrence of situations of under-regulation and overregulation

Full textIn order to guide policy making in public health, it seems useful to confirm the effectiveness of malaria control interventions (MCI). To achieve this, one may evaluate the impact of a given MCI on the incidence of the disease, for example, but this approach won’t easily disentangle the effects of the intervention from those of other MCIs deployed simultaneously, and from influences of environmental and social factors. Mathematical modelling won’t be helpful in this purpose since it infers the impact from the efficacy measured in controlled trials. The direct estimation of the effectiveness of the intervention under fields conditions, i.e. under the influence of biological, environmental and human factors, is nevertheless possible. In particular, appropriate epidemiological surveys can estimate the association between exposure to MCIs and malaria.The present thesis describes the results of several studies conducted to evaluate the effectiveness of MCIs in Madagascar. This country has the advantage to include constrasted malaria transmission patterns, with areas earmarked for pre-elimination and others with intense and perennial malaria transmission. This legal proceeding is definable as actions by the nature are very similar to crime actions that are authorized by court or general prosecutor or deputy general prosecutor and have the purpose to solve the crime. The purpose of this master’s degree study is to reveal a legal framework of executing of criminal act simulating actions and possibilities to use results gained during this action in averment process. The studies of European Human Rights Court’s, Lithuania Constitutional Court’s and Lithuania Supreme Court’s cases showed up the main problems of usage of criminal act simulating actions. The European Human Rights Court position is based on Texeira de Castro case and exposes the main principles of legality: Usage of criminal act simulating actions could be only against person who is suspected and there is a procedural proceeding against him; Usage of criminal act simulating actions has to be passive. Initiator to commit a crime has to be suspected person; Authorization to use criminal act simulating actions should be the Court privilege. Full textContrary to what many scholars have traditionally contemplated, the main question that prompted this research centered on how the subordinate sectors expressed their political challenges during the period 1770 to 1830 in the former Gobernación de Popayán and how these actions marked the relations between the subordinate sectors and the other sectors of the society of the time (mainly composed of Criollo and Peninsular). The main purpose of this research was to characterize the political culture of the subordinate sectors, expressed through contentious collective actions during the period from 1770 to 1830 in the Gobernación de Popayán, taking into account the political transition that took place passed with the process of independence that took place at the beginning of the XIXth century. The main aim of this research was to understand exchanges, tensions between the subaltern sectors and the social groups represented by the Creole and Peninsular elites, and how through collective actions the subordinates could express notions or values as justice, freedom, and also to establish mechanisms of solidarity for joint action and collective mobilization throughout these turbulent years

Full textIn recent years main criminal legislation and laws on criminal procedure together with the relevant regulatory enactments were adopted in Lithuania. These laws are considered to determine forms, procedures and methods of state’s position towards crimes. Moreover, those forms, procedures and methods shall be used in the investigation of crimes or hearing of cases in courts for a long time. Investigation of crimes is one of the most significant state’s activity fields. The success in combat against crime and its good results shave a great influence on other spheres of social life. However, due to various factors, this state’s activity field requires much time, considerable expenses and enormous human and material resources. However, this activity does not provide satisfactory results. When a new law on criminal procedure was adopted, the focus was on establishment of effective procedural forms that would ensure implementation of justice in criminal cases with the least procedural expenses and precondition a more accelerated operation of ‘the mechanism of justice’. Seeking to simplify and accelerate criminal procedure and decrease its expenses, the main purpose of criminal procedure, namely, to solve crimes in detail and in the shortest possible time, to apply an appropriate law at the same time regarding human rights and freedoms and interests of society and state should be regarded.
