This chapter begins with a discussion of the important role played by Justice Arthur Goldberg in one of the most famous decisions of the 20th-century Supreme Court, Griswold v. Connecticut. It then considers the New Deal Court's reversal of a broad spectrum of constitutional doctrines from roughly 1937 to 1941. The modern restoration of unenumerated rights is then discussed.

Abstract:
This chapter discusses the variety of mechanisms available to propose changes to state constitutions. Amendments or revisions of state constitutions can be accomplished through legislative proposal, constitutional convention proposal, constitutional commission proposal, and the initiative in states that permit it. In all states other than Delaware, the electors must approve changes to the state constitution. The chapter reviews the use of limited state constitutional conventions, and constitutional commissions. Constitutional revision processes in a variety of states during the 20th century are discussed, together with general lessons that can be derived from those experiences. The chapter describes difficulties faced in modern times with state constitutional amendment and revision, including popular distrust of constitutional conventions and other constitution-making processes. Several proposed improvements to the initiative process for state constitutional change also discussed.

The Right to Privacy: Rights and Liberties under the Lawmeasures the impact of what Louis Brandeis called, "The most comprehensive of rights and the most valued by civilized man." As the book shows, an individual's right to privacy is not a written-in-stone concept, but one that emerged from the "shadows" of a number of amendments and court decisions. Abstract:
The Declaration of Independence stated that all men are created equal, yet the long and continuing struggle for civil rights in the United States seems to indicate otherwise. This reference guide details the most critical civil rights laws in U.S. history, moving from the period of slavery, to the Civil War, to the Reconstruction, to the civil rights era of the mid- to late-20th century. An overview essay introduces each period, and 36 individual laws are examined in essays placing the bills in their historical contexts. Each law is then presented in an edited and, when appropriate, annotated form, so students can read and understand the actual words of the law. Many of the notable and notorious laws in U.S. legislative history have come in the area of civil rights. Among these are the Fugitive Slave Act, the Missouri Compromise, the Emancipation Proclamation, the 13th, 14th, and 15th Amendments, the Civil Rights Act of 1964, and the Voting Rights Acts of 1965.
