From the first laws establishing a state-funded educational apparatus(1875) to the first occurrence of the nation as one of public school’s objectives (1927-1928), this study analyses the laws, speeches, school books and activity reports of the Public Instruction Secretary to examine their ideological significance and grasp the progressive construction of a complex national identity.After studying the foundation of the system and its declared objectives in the late 19 century, this analysis focuses on the “Indian issue”, then the “Central-americanism” mirrored by school, then the educational policy of Estrada Cabrera, and finally the reforms of 1927-1 928, which made the establishment of a national identity one of public school’s official objectives

Full textThis PhD dissertation studies the sexual practices between males, specially the sodomy crime in Chile from 1875 to 1928. The novelty of the research is based on the analysis of the sources linked to medicine and criminal law, and those stemming from sodomy’s criminal procedures. The first part of this research studies a history of sodomy’s crime- sin, through legislation, treaties, and commentaries in the Chilean criminal law, as well as from discussions when writing the Criminal Code in 1874. In Chile, from 1541 until 1875, it was used a legislation from the Spanish Monarchy, sanctioning sodomy. Later, after coming into force the Criminal Code from 1874, the crime of sodomy was still valid until 1999. The second part of this research analyses the knowledge’s, used by Chilean doctors and lawyers, to condemn the sexual practices between males from different approaches in life sciences, circulating in the academic world and popular opinion from the époque: the French Legal Medicine, the theory of degeneration, the Italian criminology, the criminology from Lyon, and the psychopathology. These medical approaches were not only used in the medical area, but also in the criminal law to explain “scientifically” the article 365 of the Chilean Law Code, which condemned the defendants during three years in jail. I analyze how French Legal Medicine was received through the Legal Medicine compendium, published by the Chilean doctor Federico Puga Borne, who pathologizes sodomy according to the criteria of Ambroise Tardieu. The theory of degeneration points out the “depraved” and “hereditary imperfections” in the writings of the lawyers Tomás Ramírez, Enrique Broghamer and an anonymous writer. In this research, it is studied the concept of “homosexuality” through the first Chilean writing of the thesis student Salvador Nechochea. In the third part of the research, it is studied the crime of sodomy in Chile from 1875 to 1928, throughout ninety-three criminal procedures, corresponding to judicial records, found in fondos judiciales del crimen from the Archivo Nacional Histórico, based in Santiago de Chile. In this part, it is analysed different sexual practices of the sodomy, including agreed sodomy, rape between adults and violation to minors. It was studied the importance and role of different medical approaches, as well as their application in the criminal procedures selected. Additionally, it was described the roles of different actors involved in the criminal procedures: defendants, prosecutor, children’s parents, judges, police officers, witnesses, attorneys, public prosecutor, and informant doctors.

Full textBetween 1916 and 1928, some American silent films are in search of putting together one or several stories set in the past (historical, ancient, biblical) and one story set in the modern times, thus displaying complex cinematic forms conspicuously articulated. We called this assembling the « Spectacle of the Ages », according to the advertising formula encountered on the poster of one of these films, Noah’s Ark (M. Curtiz, 1928). The films of the Spectacle of the Ages are not to be confused with biblical or historical films – also produced in silent cinema – which assume a single action and a diegesis focused on the reenacted period. The films we are to sudy here confront the past with the present, by telling multiple ages, sets, actions and characters. Beyond the variety of these stories, this research aims to highlight the various assembling solutions created by the filmmakers to achieve a coherent and harmoniously shaped work of art. These cinematic forms show various passages, translations, metamorphosis of the parallels between the past and the present, the old and the new, thus revealing something of their Age and of a promising future. We perceive in the Spectacle of the Ages a short-lived moment in the history of American silent cinema
