Since 9/11, private litigants have been important players in the “fight” against terrorism. Using several federal tort statutes, these plaintiffs have sued foreign states as well as other parties, like non-governmental charities, financial institutions, and social media companies, for terrorism-related activities. While these private suits are meant to address injuries suffered by plaintiffs or their loved ones, they often reinforce and reflect the U.S. government’s terrorism-related policies, including the racial and religious discrimination endemic to them. Indeed, much like the U.S. government’s criminal prosecutions for terrorism-related activities, private terrorism suits disproportionately implicate Muslim and/or Arab individuals and entities while reinforcing the belief that those groups are predisposed to engage in or support terrorism. This short Article provides a brief overview of the world of private terrorism litigation. It begins by describing the various federal tort statutes on terrorism—including their fraught relationship with foundational tort law norms. It explains the connection between those laws and the U.S. government’s terrorism prosecutions, as well as its other terrorism-related priorities. It ends by demonstrating how private terrorism suits reinforce discrimination and prejudice against Arabs and Muslims that are reflected in criminal terrorism prosecutions. In focusing on private terrorism litigation, this Article highlights how private parties are furthering the government’s counterterrorism work, as well as how private terrorism suits reinforce the state’s endemic discrimination against Arabs and Muslims in the counterterrorism realm.

The year 2020 marks the twentieth anniversary of the passage of United Nations Security Council Resolution (“UNSCR”) 1325, the most important moment in the United Nations’ efforts to achieve world peace through gender equality. Over the past several decades, the international community has strengthened its focus on gender, including the relationship between gender and international peace and security. National governments and the United Nations have taken historic steps to elevate the role of women in governance and peacebuilding. The passage of UNSCR 1325 in 2000 foreshadowed what many hoped would be a transformational shift in international law and politics. However, the promise of gender equality has gone largely unrealized, despite the uncontroverted connection between treatment of women and the peacefulness of a nation. This Article argues for the first time that to achieve international peace and security through gender equality, the United Nations Security Council should transition its approach from making recommendations and suggestions to issuing mandatory requirements under Chapter VII of the U.N. Charter. If the Security Council and the international community believe gender equality is the best indicator of sustainable peace, then the Security Council could make a finding under Article 39 with respect to ‘a threat to the peace’—States who continue to mistreat women and girls pose a threat to international peace and security. Such a finding would trigger the Security Council’s mandatory authority to direct States to take specific actions. In exercising its mandatory authority, the Security Council should organize, support, and train grassroots organizations and require States to do the same. It should further require States to produce a reviewable National Action Plan, detailing how each State will implement its responsibilities to achieve gender equality. The Security Council should also provide culturally sensitive oversight on domestic laws which may act as a restraint on true gender equality.

Rakshasa marriages, and Paisacha marriages are all attested to in the Vedas. One of the eight types of Hindu marriages, Gandharva marriage, involves events that are strikingly comparable to those in a live-in relationship . The Gandharva form of marriage was the most common during the Vedic era. A type of marriage known as a "Gandharva marriage" allows the couple to live together because of love and consent, finally becoming married consensually. Shakuntala and Dushyanta are a well-known couple that chose this type of union. Gandharva marriage is a type of union in which the woman selects her own spouse. According to Apastamba Grhyasutra, an ancient Hindu literature, Gandharva marriage is the method of marriage where the girl selects her own husband. They meet each other of their own accord, consensually agree to live together, and their relationship is consummated in copulation born of passion. This form of marriage did not require consent of parents and The Gandharva marriage method is defined by the ancient Hindu text Apastamba Grhyasutra as the marriage when the girl chooses her own husband. They meet on their own, decide to live together amicably, and then consummate their relationship through passionate copulation. The consent of the parents and anyone else was not necessary for this type of marriage. This was one of the earliest and most common type of marriage during the Rig Vedic period, according to Vedic records. In the Mahabharata, one of the two great Hindu epics, Rishi Kanva, Shakuntala's foster father, suggests the Gandharva union, saying that it is the best union possible between a desiring woman and a desirous man, without the use of rituals.

Global problems are very different. The division of global problems into three big groups: Inter-social global problems usually included the problems like the problem of diverting world wars, nuclear, eventually other conflicts connected to the problematic of armament (the problem of war and peace). At present, there gains in importance also the fight towards terrorism. The problem of the social and economic backwardness of developing countries, eventually the whole North-South relationship also belong there, as well as the problem of solving global debts, the relationship of the indebted and creditors. The problem of the international relationships (namely economic) changes under the new conditions formed namely by the scientific and technological progress. Into the second group of natural-social global problems, there are most often included the following problems: environmental problem, raw material and energy problem, population problem, food, respectively nutrition problem. Lastly, the third group of anthropo-social problems includes the general human problems of the social, cultural and humanitarian-ethical nature. Sometimes, they are ranked as one great complex problem (so-called problem of the future of man), sometimes this group is divided into a number (10–15) of partial “sub-global” problems the common denominator of which are the shortcomings of the development of man in the relationship to the life and social conditions created by himself. Here belong different kinds of the unequal approach to education, health care, housing, culture, human rights, eventually also serious defects in their securing or a disharmonic and uncontrolled development (e.g. accelerated urbanisation) etc.

The creation and growth of new enterprises and, on the other hand, their decline and market exit are crucial factors of business dynamism and economic growth. Thus, business dynamism is an important aspect in the market chain and productivity of an economy, as well as a trigger for market reforms. The aim is to analyze business dynamism using Global Competitiveness Index 4.0 and its variables worldwide and to verify the relationship between business dynamism in the EU states and economic characteristics such as Valued added at factor cost, Enterprise Birth Rate and Enterprise Death Rate. Data were collected from the 2019 Global Competitiveness Report and from the EUROSTAT database, using the most recently updated source for each indicator. The 11th pillar of the Global Competitiveness Index, focused on business dynamics, and a set of indicators were analyzed using PCA to verify if all the variables are effective representatives of the concept. It was found out that the pillar does not effectively represent the concept of business dynamism in case of the EU countries; therefore the new pillar was constructed. A strong and statistically significant correlation between business dynamism and Value Added was confirmed. A relationship between business dynamism and other economic indicators was not proven. From a territorial point of view, Oceania achieved the best overall result in the analyzed field. The process of starting a new business is the most challenging in terms of start-up costs in South America. By contrast, the EU has reached the best result in this process.

As one of 44 countries, India prepared the agenda for the Bretton Woods Conference in June 1944. However, India with a population of 1.3 billion shows 5% of its population living in extreme poverty. In June 2018, India ran a current account deficit of USD 15.8 billion, marking the highest deficit in the last five years. India exported USD 261 billion in 2016, making it the 17th largest exporter in the world. However, India's export structure is still not really diversified and focuses primarily on commodities and primary products. The object of analytical research is focused on the geopolitical conflicts between the states in the Eurasian region in the XIV century. The development of processes in international relations is based on the content of Amir Temur's 1395 letter to Yildirim Boyazid in Shervan. As a source, this letter clarifies the common goals of the two great leaders, and they are different, sometimes conflicting views on their relationship. The statusand influence of the two Muslim states, which in their time aimed to change the landscape of the political world, are given scientific conclusions about the balance of power in the region, the causes of conflict, conflicts of interest, subsequent events and their outcome.

At the time when Japan was experiencing robust economic growth and Europe was accelerating its integration, a number of researchers noticed the importance of investing in their bilateral economic relationship, which was formerly obscured by their respective „special‟ relationships with the United States. When their trade frictions came to the surface, their trade relationship began to attract more attention. In the meantime, world trade entered a new phase with the creation of the World Trade Organisation (WTO) in 1995. As the successor of the General Agreement on Tariffs and Trade (GATT), the WTO became a new arena for member countries to make trade agreements and solve trade frictions with their trade partners. In this thesis, we will investigate the relationship between the EU and Japan in the WTO. The thesis will look closely at social forces and investigate how various social forces have influenced the position of the EU and Japan, as well as the WTO. On top of that, we will also analyse how the function of the WTO has influenced the EU and Japan, and their relationship in the multilateral trading system. Trade conflicts have often been seen as trade tensions between national states. In fact, the WTO deals only with member countries (with the exception of the EU). However, trade tensions may well break out not between national states but between individual sectors, such as agriculture and steel, which sectoral interests then turn to their national states for support. This indicates that even trade friction is not simply antagonism between national states, but between national and transnational fractions of classes. States have been utilised by transnationally oriented dominant groups which intend to integrate their countries into emergent global capitalist structures. This thesis therefore raises questions about liberal trade theory concerning its serious gap between theory and actual practices, and suggests an alternative approach to structural issues of the state-centric approach to world politics. While we consult neo-liberal institutionalist theory to investigate the role of the WTO and its influence upon the EU-Japan relationship, we will analyse the interaction of various social forces within the EU and Japan from a neo-Gramscian perspective. In this way, we will try to direct attention to relations between social interests in the struggle for consensual leadership rather than concentrating solely on state dominance. Focusing on the role of international organisations and social forces, the aim of this thesis is to investigate how the EU and Japan have developed „coordinated action‟ and „joint negotiating stances‟ on particular trade issues, notably on agriculture and steel trade. Furthermore, as our central research iii questions, this thesis investigates what has been the overall effect of the WTO on the development of the EU-Japan trade relationship, as well as how the WTO has provided an impetus to promote certain patterns in EU-Japan relations. Through this thesis, I aim to contribute to the understanding of the roles of social forces in the interaction in international organisations.

This thesis examines the contribution of a guided discovery learning approach within a simulated real world context to learning. In order to consider the potential of this approach, a database design task is chosen (Storey & Goldstein, 1993) which requires the learner to capture the semantics of the domain application in a real world situation and then translate this into a data model for the database management system. This approach to learning has advantages since simulating a real world system in a classroom can be a very difficult and time-consuming activity. The aims of the thesis is, therefore, to investigate the possibility of simulating real world situation for gathering database requirements and a teaching strategy that is suitable for this real world situation context. In order to reach the research goal, two main research questions need to be answered. Firstly, to what extent can a simulation of a real world situation improve the quality of learning in the database design area? Secondly, the extent to which a guided discovery teaching strategy can enhance the learning of database design within such a (simulated) real world context? A framework for simulating the real world situation and guided discovery strategies had been designed in order to implement four versions of a prototype systems called GERM for evaluation in order to answer the research questions. The main results obtained from a small group of learners and lecturers indicates that the potential of guided discovery learning within a real world context can improve the quality of learning in database design - in particular entity relationship modelling. Amongst other advantages, it can help students to change their basic misconceptions. Furthermore, it also can improve students' skills in a real world situation. The promising results suggest further lines of research.

This thesis investigates the nature of post-conflict behaviour and relationships among individuals in two captive groups of pigtail macaques, Macaca nemestrina, and one wild troop of olive baboons, Papio anubis. Data were collected during periods of seven and twelve months respectively. In both pigtail groups, conflicts were more frequently reconciled between opponents with strong affiliative ties. However, reconciliation was twice as common in the well-established group where individuals' social networks were more compact. It is argued that the more intense ties produced by restricted networks increased the likelihood of reconciliation. Reconciliation was demonstrated among wild olive baboons, occurring at a rate consistent with a relatively intolerant dominance style. Opponents who were close kin or of similar rank reconciled relatively frequently, but reconciliation rarely followed conflicts associated with food. Olive baboons did not 'console' each other, consistent with the hypothesis that consolation requires an ability to empathise with victim distress. Initiation of post-conflict attacks on third parties was not elevated in victims of aggression. Among the baboons, both victims and initiators of aggression exhibited elevated rates of post-conflict self-directed behaviour (a combined measure of scratching, autogrooming, body-shaking and yawning). Reconciliation reduced both SDB and the incidence of further aggression. However, reconciliation only reduced SDB among individuals involved in conflicts in which they had both received and delivered aggression. Female baboons showed significantly higher rates of SDB when their nearest neighbour (within 5 m) was a dominant conspecific than when he or she was a subordinate individual, supporting the hypothesis that SDB indexes stress in primates. This result suggests that SDB can be used to index relationship security in primates.

Background The emergence of the Internet, and in particular social network sites, has led to the appearance of new powerful actors, i.e. Social Media Influencers, with the power to persuade their audience. This introduced a middleman in the company-consumer relationship and a new stakeholder to build relationships with. Small and medium-sized enterprises’ (SMEs) marketing activities differ from traditional practices. SMEs need to be more creative when engaging in Influencer Marketing given their resource constraints. The presence of a relationship can help SMEs to increase and improve their brand image, support the launch of new products and most essentially avoid large investments of Influencer Marketing. Purpose The purpose of this study is to explore the methods Swedish SMEs use in their relationship building activities with influencers, as well as the underlying dimensions related to those methods. Method An inductive research approach is utilized, with the aim to extend the current knowledge available about relationship building with influencers. The use of a qualitative approach with semi-structured interviews allowed the exploration of how SMEs build relationships with influencers from a management perspective. Conclusion This thesis indicates that Swedish SMEs’ relationship building activities are influenced by certain underlying dimensions. These are adherence to brand values, timeline of the collaboration, nature of the product, paid and earned forms of collaborations and the types of relationships SMEs establish: formal and informal. The means used by SMEs when building relationship with influencers were identified as communication, events, feedback and gifts. Further, resource constraints did not appear to influence how SMEs build relationships with influencers but instead the type and number of influencers they work with.

The construction industry is seeking ways to reduce waste (material and productionrelated process waste) to improve productivity and efficiency. Building Information Modelling (BIM) and Lean are two vital innovations for the Architecture, Engineering, Construction and Operation (AECO) industry used in the industry to improve aspects of productivity and efficiency. BIM has been used to generate and compare designs to ensure optimum use of resources, reduce design time, improve collaboration between stakeholders, and reduce errors in design and construction. On the other hand, the main agenda of Lean is to reduce (both material and production process) waste, increase value, and thrive for continuous improvement. In the construction industry, BIM and Lean have been mostly used in isolation. However, studies suggest that BIM and Lean have mutual relationships and are complementary to achieve each other’s objectives. To do so, it is very crucial to understand the mechanism behind the relationship and the interaction between BIM and Lean. Informed analysis and understanding of the mutual relationship would help construction management decision-makers to achieve the utmost benefits from the implementation of these two drivers. However, previous studies have explored BIM and Lean relationships, but limited studies were done to support construction management decision-makers in identifying relevant BIM functions to enable Lean or to identify relevant Lean principles to support BIM. Therefore, this paper aims to represent a conceptual BIM-Lean relationship assessment framework by using Design Science Research methodology to identify and measure the relationship between BIM and Lean to support construction management decision-makers.

The World Tourism Organization (UNWTO) was founded in 1924 under the United Nations and it has been continuing its activities in Madrid, Spain since 1970. The World Tourism Organization (UNWTO) takes all necessary measures with tourism in order to achieve its goals. The UNWTO pays strict attention to the interests of developing countries in the field of tourism. For this reason, the UNWTO has a close relationship in the tourism field with the United Nations’ authorities and specialized institutions. It deals with the tourism problems of all countries and supports their contributions to tourism by international agreements. On the other hand, the UNWTO is cooperating with the United Nations Development Program and tries to contribute to the activities of this program. All countries are expected to be a member of the UNWTO and adopt its principles, because tourism will make it possible for them to increase National Income and Development. Macedonia hasn’t applied to be a member of this organization yet, but it is important to start the attempts immediately.

We study the relationship between corporate debt, corporate risk and firm-level investment, using a sample of 25,000 listed companies across 47 countries over the last two decades. We find higher leverage reduces investment but show the effect varies with risk, as measured by firm time-varying distance to default. Firms with higher market valuations and lower volatility do not suffer a debt overhang at all, while the effect is exacerbated for riskier firms. Debt overhang effects worsen significantly in economic crises, and the effects may persist for two to three years after the shock. Given the rise in corporate leverage observed during the last decade and as a result of the Covid-19 pandemic, physical investment is expected to remain at low levels for some years to come, with impacts varying considerably depending on the economic sector and other risk determinants.

Do differences in port performance explain differences in maritime transport costs? How much would improvements in port performance reduce maritime transport costs in developing countries? To answer this question, we use a widely used transport cost model, but we provide a new measure of port efficiency, estimated through a non-parametric approach. Relying on data from the early 2000s, this paper shows that for a sample of 115 container ports in 39 developing countries, becoming as efficient as the country with the most efficient port sector would reduce average maritime transport costs by 5 percent. For the most inefficient country, the reduction in transport costs could reach 15 percent. These findings point out the potential gains that can be achieved from the combination of betterquality investment and more efficient service provision in the port sector. The estimates in this paper cannot be updated because the databases were discontinued and it therefore highlights the need to generate data to evaluate the effectiveness of public policies that are key to competitiveness.

In the Integrated Review of Security, Defence, Development and Foreign Policy, published in March 2021, the UK government set out four strategic objectives for ‘Global Britain’. A year later, Russia’s invasion of Ukraine and the shift to a more divided world have put the vision of the UK as a ‘problem-solving and burden-sharing nation with global perspectives’ to an urgent and severe test. This research paper finds that the UK has made clear contributions to its objectives of upholding the values and security of the liberal democracies. But it has undercut its commitments to support global resilience, and its international economic agenda remains very much a work in progress. The government must now prioritize rebuilding its relationship with the EU; leverage the G7 to avoid being sidelined by closer US–EU cooperation; and give greater strategic purpose to its trade agenda. It also needs to follow through on its commitments to support the resilience of the international community, or it will fail to live up to its goal of launching a truly global Britain.

Using the 2006 Gallup World Survey of life satisfaction in 130 countries, this paper finds a very solid relationship between satisfaction and income (both across and within countries) and uncovers the unhappy growth paradox, whereby faster growth rates are accompanied by lower levels of satisfaction. The losses of satisfaction associated with growth are more pronounced in the material domains of life and are greater in richer and more urban societies. At the individual level, although higher incomes tend to be reflected in greater satisfaction, an increase in the income of the social group to which an individual belongs has the opposite effect. The conflictive relationship between satisfaction and income has implications for political economy and may help explain various characteristics of economic and social populism.

This paper draws from interviews with more than 50 participants in the private equity world in emerging and developed markets playing different roles in the industry. It also refers to a number of cases, white papers, and other studies. We are deeply grateful to those experts who shared their insights with us. The paper is organized as follows. First, we briefly set out the current fund-raising environment. We then consider the dynamics of the LP-GP relationship over time and explore current trends in developed and emerging markets (mostly LAC). Finally, we conclude with guidelines for effective LP-GP relationships in emerging markets and our reflections on what may happen in the future.
