Through summarizing the characteristics of network intellectual properties and information network sharing under the network environment, the contradictory and unified relationship between network sharing and intellectual property protection is made in-depth analysis. This paper attempts to think the rationality of the existence of intellectual property rights under the network environment, and research the legitimacy of Internet intellectual property rights and Internet environment protection of intellectual property rights interests balance theory and incentive theory problems.

The article presents an urgent scientific problem, which is the need to establish the impact of reliable protection of intellectualproperty rights on software and its individual elements on the Europeanization of public administration in Ukraine, improving theinvestment climate, saving labor, accelerating public and private enterprises, institutions, organizations and boosting economic growth.Intellectual property rights underlie all the software industry. This term refers to a number of intangible property rights to an assetsuch as software. Each «right» to intellectual property is itself an asset, part of the overall property system. The law provides differentmethods of protecting these property rights depending on their type.There are essentially four types of intellectual property rights related to software: patents, copyrights, trade secrets, and trademarks.Each provides a different type of legal protection. Patents, copyrights, and trade secrets can be used to protect the technologyitself. Trademarks do not protect the technology, but the names or symbols used to distinguish the product on the market.Software can take the form of a computer program, a website, a mobile application, a distribution, and so on. Each of these formsmust consist of program code and personalization tools.In the current realities of digitalization of state and business review processes, intellectual property plays a role in shaping the economicstability of the state. The rapid pace of emergence and growth of technology, the spread of difficult foreign terminology in the fieldof software leaves room for research, creating new challenges and conditions for the synthesis of social sciences and engineering.Studying technologies, mastering and systematizing the principles of software – this is the main task facing lawyers-scientists inthe field of intellectual property.The lack of the combination in a single scientific work practical knowledge of programming and legal theories and practices ofsoftware protection creates a field for reflection and research on this topic.Because of the lack of scientific base and clear terminology in the field of software, problematic in Ukraine are the taxation ofoperations for the creation and implementation of software, legalization of relations between developers, and as a consequence – thelack of a unified policy for auditing and monetary evaluation of implemented computer programs.

The article is dedicated to a comprehensive study of theoretical and practical issues of administrative and legal regulation of Intellectual Property (IP) as the main element of innovative activity. A particular research has been conducted into the scientific background of administrative and legal regulation of intellectual property. The role definition of intellectual property in the innovative development of the state economy and Ukrainian society is highlighted. The mode of formation, i.e. genesis of administrative and legal regulation of intellectual property is outlined as well as expansion of legislation in this particular sphere is analyzed. The administrative and legal aspects of regulating the activities of intellectual property protection entities are specified. The research denotes some growing tendencies of intellectual property law and a number of directions in its further progress which is expressed in globalization of the law and in transition from protection of material property rights to information protection. It is stated in the article that existing intellectual property model or paradigm as well as administrative and legal regulation establishment do not reflect the characteristic, concrete public relations in a modern information society. The priority of the principle of full control of the right holder over the use of the object of intellectual rights leads to the fact that the development of legislation in the field of intellectual property is carried out in the form of strengthening the protection of intellectual rights, i.e. without adapting to the needs of the information society and innovative activity. It is emphasized that formation of conceptually unified single legal space for administrative and legal regulation of intellectual property directly determines efficiency of the process of an innovative development itself. Compliance to conceptually unified approach at developing strategy will definitely determine the outcome.

The paper investigates the problems of protecting intellectual property rights when goods crossing the customs border of Ukraine. The necessity of reforming the national system for the protection of intellectual property rights and bringing it into line with international legislation has been proved. The proposed projects of changes in domestic legislation, contributing to the implementation of the EU mechanisms for the protection of intellectual property rights at customs, and will allow to strengthen the fight against counterfeit and pirated products during their movement across the customs border of Ukraine are considered. Analyzed the main normative legal acts on the research problem, and developed a methodology for customs control and customs clearance of goods containing intellectual property. The paper describes the most common violations in the field of intellectual property rights, among the main authors highlighted the problems of parallel import and patent trolling. It is noted that an important step towards the protection of intellectual property rights was the creation of an appropriate customs register of objects of intellectual property rights as part of the Unified Automated System of the State Customs Service. The specified system includes the established procedure for online registration of the corresponding objects of intellectual property rights, which makes it possible to reduce the time for consideration of applications and their placement. It is indicated that the protection of intellectual property rights provides for an increase in the level of prevention and counteraction to the movement across the customs border of Ukraine of goods that violate such rights, and helps to cleanse the domestic market from counterfeit products. Today, a new Customs Register of Intellectual Property Objects is being formed and a center for operational expertise is being created.

This Journal's previous piece on current developments in EC intellectual property noted that this area of law is dominated by the drive towards harmonisation.1 This drive continues, and its success has been such that it can now begin to be seen in an overarching context of globalisation. The idea of a unified global system for the protection of intellectual property now seems at least conceivable, even if not immediately achievable. It is even possible to state that some stages have been achieved on the journey, most notably the TRIPs Agreement. Since adherence to this is a requirement of World Trade Organization (WTO) membership, the arguments in its favour have suddenly become “persuasive”. It represents a tremendous achievement in terms of the protection and enforcement of intellectual property rights throughout the world. The World Intellectual Property Organisation's contribution here and elsewhere has been immense.

The encouragement of creative, scientific, inventive activity and business competition largely depends on the solid protection of intellectual property and related rights on the internet. The problem of such protection lies in the transnational nature of the internet, the absence of a unified centralized management, the difficulty of proving infringements, as well as in the insufficient regulation of this issue. This article analyses the protection of intellectual property rights on the internet in Ukraine, the potential and real threats to them in the cybernetic domain, and the key areas of related activity of state bodies and individuals. The research uses a method of synthesis and analysis, comparative legal analysis, and systemic and formal-logical methods. This article analyses the normative legal documents of Ukraine on intellectual property and rights on the internet, points out their shortcomings, and provides advice on their use. Recommendations are given on how to ensure the protection of intellectual rights through preventive measures and subsequent judicial and extrajudicial proceedings, indicating ways to ensure cybersecurity in relation the intellectual property of individuals.

The paper is devoted to the problem of the exhaustion of international companies' trademarks and other intellectual property objects rights in the foreign trade practices of Russia and other countries of the Eurasian Economic Union (EEU). The paper focuses on the problems of trade integration through the intellectual property market, since any free movement of goods should always be correlated with respect for the interests of the trademark rights owners. The aim of this paper is to explore the process of parallel importing in the aspect of international companies trademarks intellectual property rights in the Russian Federation and EEU countries and the opportunities and challenges it provides for both manufacturers and importers. The problem of importing products labeled with trademarks through parallel import channels to Russia is being considered using the schemes for the importation of counterfeit goods into Russia through EEU countries. The analysis shows that there are the problems with the application of the mechanisms of trademarks customs protection in practice. The main problem is the lack of unified legislation for intellectual property protection in EEU members.

A condition for the effective integration of Eurasian Economic Union member states economies is creating a set of mechanisms for the use of intellectual property objects in modern circumstances. With significant intellectual potential existing in the EAEU countries, the process of commercialization and use of intellectual property objects is not carried out sufficiently. Considering the main purpose of the Union's functioning, this problem has to be solved comprehensively and consistently. The article presents the main results of study of customs regulation system of goods containing intellectual property objects crossborder movement in the context of Eurasian integration. It is noted that the violation of intellectual property rights occurs not only among competing companies as a plagiarism or industrial espionage, but also within framework of agreements concluded between copyright holders and users of intellectual property rights. The EAEU countries cooperate and organize interaction of authorized bodies also to form a unified system of intellectual property rights protection within the EAEU, SCO, BRICS, as well as the WTO. In order to improve the system of customs control of goods containing intellectual property objects, constant adjustments and modernization of methods for controlling the intellectual property objects movement across the customs border of the EAEU are required to ensure the maximum possible protection of intellectual property holders from illegal actions of third parties. No. 34-FZ «On Amendments to Parts One, Two and Article 1124 of Part Three of the Civil Code of the Russian Federation”, etc., discusses the problems of using digital technologies, including digital assets, digital platforms in relation to the turnover of intellectual property rights to the results of intellectual activity and equated means of individualization of goods, works, services, enterprises and their protection, in particular, the problems of creating a register of intellectual property objects based on the blockchain system, features of the activities of individual participants in relations in the field of the Internet, as well as the relationship between the right to information in modern conditions and the rights of authors and other copyright holders to protected results of intellectual activity. Particular attention is paid to the problems of terminology in the digital environment, the concept and types of digital rights, including utilitarian digital rights, in relation to the results of intellectual activity, as well as the importance of the blockchain system and artificial intelligence in the creation of intellectual activity results, their turnover and protection, including objects, created at the expense of budgetary funds on the basis of Federal Law No. 456-FZ dated 22.12.2020 “On Amendments to Parts Two and Four of the Civil Code of the Russian Federation and Invalidation of Legislative Acts (Certain Provisions of Legislative Acts) of the Russian Federation”. The main problems that the use of digital technologies and the creation of unified registers of intellectual property rights objects are aimed at solving are highlighted. Among them are the problems of determining the rightholder, making accelerated transactions for the disposal of rights to protected objects and some mechanisms for their solution are proposed, in particular, the conclusion that it is necessary to use the blockchain system to form a register of intellectual property objects primarily for the individualization of rightholders, the disposal of exclusive rights and their protection.

The following thesis is a qualitative study about intellectual property protection and intended for Ukrainian companies and for students as information paper because there is differences between the old system in former Soviet and the European/US systems that has to be understood and business in Ukraine as well as researchers/inventors has to adjust to this different situations in order for companies to exploit the full potential of their innovations, part of this is by IP protection.

L’idée selon laquelle l’uniformisation du droit de la propriété intellectuelle écarte le problème des conflits de lois semble profondément ancrée dans l’opinion des observateurs qui se sont intéressés au droit de l’OAPI. Du moins, les études qui se rapportent à la propriété intellectuelle dans cet espace n’abordent pas spécifiquement la question du conflit de lois. Lorsqu’elles l’évoquent ponctuellement, elles se limitent essentiellement à constater que ses rapports avec le droit uniforme se résument à sa disparition pure et simple. Ce constat commun méritait néanmoins d’être vérifié. C’est donc à une telle vérification, opérée au moyen d’une confrontation des effets de l’uniformisation du droit de propriété intellectuelle et des causes du problème des conflits de lois, qu’est consacrée la première partie de la présente thèse. Les résultats de cette confrontation conduisent à constater la persistance du problème des conflits de lois au sein de l’espace OAPI, même si le droit uniforme ne manque pas d’en influencer la configuration. Ainsi, la seconde partie de la thèse est consacrée à la recherche de solutions adaptées à la configuration particulière du problème dans l’OAPI. Cette recherche des solutions prend en compte les objectifs de l’entreprise d’uniformisation du droit de propriété intellectuelle, les engagements internationaux des États membres ainsi que les intérêts spécifiques que l’identification de la loi applicable cherche à servir. Elle aboutit, d’une part, à la proposition de solutions positive concernant la coordination institutionnelle nécessaire à une réalisation uniforme des droits de propriété intellectuelle ; d’autre part, à l’élaboration de règles destinées à l’identification de la loi applicable aux différents aspects de la propriété intellectuelle
The idea that the uniformization of intellectual property law eliminates the problem of conflict of laws seems to be deeply rooted in the opinion of observers who have taken an interest in OAPI law. At least, the studies that relate to intellectual property in this space do not specifically address the issue of conflict of laws. When they mention it occasionally, they essentially limit themselves to asserting that the uniform law eliminates the problem of conflicts of laws. This common observation nevertheless deserved to be verified. The first part of this thesis is devoted to such a verification. This verification was carried out by means of a comparison between the effects of the uniform intellectual property law and the causes of the problem of conflicts of laws. The results of this confrontation show the persistence of the problem of conflicts of laws within the OAPI area, even if uniform law does not fail to influence its configuration. The second part of the thesis is devoted to the search for solutions adapted to the configuration of the problem within the OAPI area. This search for solutions considers the objectives of the uniformization of intellectual property law, the international commitments of the member states as well as the specific interests that the identification of the applicable law seeks to serve. It leads, on the one hand, to the proposal of positive solutions concerning the jurisdictional coordination necessary for a uniform realization of intellectual property rights; on the other hand, to the development of rules intended to identify the law applicable to different aspects of intellectual property

ENGLISH ABSTRACT: This study analyses the extent to which the current intellectual property system is suited to the protection of traditional knowledge in the Western Cape. Employing a multidisciplinary approach that incorporates economic and legal theory as well as legal philosophy, this study argues that although advances in the fields of biotechnology has brought with it the need for greater intellectual property rights protection, the protection of traditional knowledge has largely been ignored. Traditional ethnobotanical knowledge holds immense economic value for both commercial entities seeking to develop products based on traditional knowledge as well as for the communities that possess such knowledge. Protecting traditional knowledge is necessary to ensure that the communities contributing their knowledge are recognized and compensated for such contributions. In order for a system to provide adequate protection for traditional knowledge it has to be consistent with and suited to the needs of traditional knowledge holders. This study therefore evaluates the prevailing system of knowledge protection as embodied in the intellectual property rights regime as a means of protecting traditional knowledge. The analysis reveals that the dominant justification for the existence ofIPRs is based on utilitarian considerations that promote IPRs as a necessary incentive encouraging innovative activity. This utilitarian justification also provides the basis for an economic justification for the existence of IPRs that suggests that the conferring of exclusive rights (in the form of IPRs) to innovators ensure that such innovators are able to recover their research costs and realize profits from their inventions. The IPR system as it exists is underpinned by these considerations and embedded in principles of individualism and private property. The WTO reinforces and promotes this approach to intellectual property in the TRIPs agreement by recognizing intellectual property as a 'trade related' issue. The inclusion of IPRs as a 'trade related' issue in the multilateral framework of the WTO reflects the interests of multinational corporations and developed nations who rely extensively on these mechanisms to maintain their power and wealth in an increasingly knowledge driven global economy. The exclusion of traditional knowledge within the TRIPs, coupled with the desire to extend patents to cover life forms is also indicative of this bias inherent in the system. South African intellectual property legislation is then applied to the traditional knowledge of an indigenous medicinal plant to test whether IPRs are able to provide adequate protection to traditional knowledge. In this regard it is found that patent protection, which could potentially provide the greatest form of protection for traditional knowledge is. not suited to the needs of traditional knowledge holders. Problems of identifying owners, determining inventors and novelty, time limited rights and costs all limits the potential of patents as a tool for protecting traditional knowledge. Similar constraints limit the potential of other categories of IPRs to provide protection for traditional knowledge. However, it was found that IPRs do provide a certain measure of defensive protection. The study therefore concludes that the IPR system as it exists, both in the international trade environment as well as at the national level, fails to adequately address the threat of appropriation and the concerns of traditional knowledge holders. Amending the IPR system and/or developing sui generis systems of protection are therefore necessary to ensure that the knowledge of communities are protected and such communities are able to benefit from the exploitation oftheir knowledge and resources.
AFRIKAANSE OPSOMMING: Die doel van hierdie studie is om vas te stel in hoe 'n mate die huidige sisteem vir die beskerming van intellektuele eiendom geskik is vir die beskerming van tradisionele kennis in die Wes-Kaap. 'n Multidissiplinêre benadering, wat uit elemente van ekonomiese- en regsteorie sowel as regsfilosofie haal, is gevolg om te wys dat die beskerming van tradisionele kennis grootliks geïgnoreer is, alhoewel nuwe deurbrake in biotegnologie die behoefte skep vir groter bekerming van intellektuele eiendom. Tradisionele etnobotaniese kennis het geweldige ekonomiese waarde vir beide die kommersiële entiteite wat produkte uit sodanige kennis wil produseer sowel as vir tradisionele gemeenskappe aan wie die kennis behoort. Dus, indien sulke gemeenskappe voordeel wil trek uit hierdie kennis, is dit nodig dat hul bydraes erken moet word, en dat hulle daarvoor vergoed moet word. Sulke beskerming sal net doeltreffend wees indien dit aangepas is by die behoeftes van hierdie gemeenskappe. Dus word die huidige sisteem vir die beskerming van tradisionele kennis geevalueer in hierdie studie. Die ondersoek wys dat die sisteem vir die beskerming van intellektuele eiendom berus op die teoretiese basis van nutsmaksimering, waar die hoofdoel te vinde is in die bydrae wat dit kan maak tot ekonomiese welvaart deur middel van innovasie. In hierdie opsig word beskerming van intellektuele eiendom beskou as 'n manier waardeur die innoveerder sy navorsings- en ontwikkelingskostes kan delg en wins kan maak. Hierdie benadering word onderskryf deur die WTO in die TRIPS Ooreenkoms. In hierdie opsig word die belange van veral die ryk lande en die multinasionale maatskappye bevorder, 'n sleutelvoordeel in 'n wêreld waar kennis gepaardgaan met mag in die mark. Hierdie verskynsel word versterk deur die uitsluiting van tradisionele kennis van die TRIPS Ooreenkoms en die behoefte daaraan om patentregte uit te brei. Suid-Afrikaanse wetgewing oor intellektuele eiendom word vervolgens toegepas op die geval van tradisionele kennis oor 'n inheemse medisinale plant om te toets of intellektuele eiendomsreg genoegsame beskerming aan tradisionele kennis bied. Daar is gevind dat patentregte, wat potensieël die grootste mate van beskerming sou kon bied, nie gepas is in die geval van houers van tradisionele kennis nie. Probleme wat voorkom sluit in die identifisering van eienaars, innoveerders en innoverings, die tydsbeperking op regte, asook kosteoorwegings. Ander vorms van beskerming is aan soortgelyke kritiek onderhewig, alhoewel bevind is dat intellektuele eiendomsreg wel 'n mate van defensiewe beskerming bied. Die gevolgtrekking word dus gemaak dat die huidige vorms van beskerming vir intellektuele eiendomsreg, beide internasionaal sowel as in Suid-Afrika, nie die belange van die houers van tradisionele kennis beskerm nie. Dit is dus nodig om die huidige vorms aan te spreek, of om sui generis beskerming te ontwikkel om hiervoor te sorg.

In a world in which the means of spreading information are more and more advanced and data distribution is done exponentially, the need to protect the originality of the papers becomes of great importance. In the XXI century, intellectual property will play an increasingly important role on the international scene. Works of the mind, such as inventions, concepts, brands, books, music and films are now used and consumed with pleasure in every corner of the world. With the dramatic rise in the use of the Internet, specifically for e-commerce and exchange of information and knowledge, the system of intellectual property protection is crucial for the development of digital society. Intellectual property information may now be found easily. Search for patents, for example, is made much easier with the potential of the internet registration is required by the new patent by the institutions concerned. Intellectual property is the most effective tool for fostering and propagation of innovation and creativity, which modern society is becoming more dependent, in particular by patents, industrial design, copyright and related rights, trademarks, geographical indications etc. This is the surest way to prevent and combat the unfair competition, to order the products and services and to obtain positive results in the fight for respect of exclusive rights, against counterfeiting and piracy. This paper wants to approach the intellectual property right in knowledge society. The theme presents international interest and because of a growing interest for combating all forms of illegal use of the material that is part of the intellectual property sphere.After a brief introduction in the matter of intellectual property rights, we will focus on methods to protect these rights. The final part of the paper is dedicated to an analysis of this phenomenon, stating the importance of it in the XXI century.

When we think on initiatives on access to and reuse of data, we must consider both the European Intellectual Property Law and the General Data Protection Regulation (GDPR). The first one provides a special intellectual property (IP) right – the sui generis right – for those makers that made a substantial investment when creating the database, whether it contains personal or non-personal data. That substantial investment can be made by just one person, but, in many cases, it is the result of the activities of many people and/or some undertakings processing and aggregating data. In the modern digital economy, data are being dubbed the ‘new oil’ and the sui generis right might be con- sidered a right to control any access to the database, thus having an undeniable relevance. Besides, there are still important inconsistences between IP Law and the GDPR, which must be removed by the European legislator. The genuine and free consent of the data subject for the use of his/her data must remain the first step of the legal analysis.

The protection of intellectual property has been a subject of great contention between developed and developing countries in recent years. Although the Agreement on TRIPs was signed by the members of the World Trade Organization (WTO) during the Uruguay Round of trade negotiations, its provisions are still viewed with animosity by many developing countries. A complete evaluation of the net effects of the TRIPs agreement in developing countries would require a broad assessment of all the costs and benefits described above. This is a formidable task that goes beyond the scope of this paper. Here, we concentrate on a rather small task and analyze the effects of IPRs over the flows of international trade flows, particularly to Latin America. As stated above, trade flows, and especially, flows of high-technology goods can be a source of technology diffusion. In that sense, exploring whether the international flows of high-technology goods are sensitive to IPRs protection in Latin America can be useful if one would like to consider the appropriateness of using intellectual property as a tool to promote technology diffusion throughout the region. Section II presents a brief theoretical background on the relationship between IPRs and trade flows. After a brief review of the empirical literature, Section III describes the data, the econometric model and the results. This section also provides some insights and potential implications of the main findings. Finally, Section IV concludes.

This document analyzes the perceptions of small innovative enterprises (SIE) in Latin America of the effectiveness of the legal protection afforded by intellectual property rights (IPR). To analyze the costs of using IPR, the study surveyed 352 SIEs from Chile, Colombia, Costa Rica, Ecuador, Mexico, and Peru. It found evidence that SIEs do not know how the IP system works, and that most SIEs consider that knowing how it works is not important for business performance. The study finds large differences among countries with respect to the need to hire legal services to apply for IPR. There are also differences in perceptions of the efficiency of the IP system, unrelated to the countries' IPR enforcement (Park, 2008). The study also finds differences in the perception of the disadvantage in protect their IPR when innovations are imitated by a large firm. This difference is related to the countries' IPR enforcement.
