It describes how cases proceed through litigation, discussing procedural junctures in a lawsuit that are likely to lead to a negative result for a worker claiming discrimination. It describes discrimination cases in which workers offered evidence suggesting that discrimination occurred and shows how judges dismissed those cases despite the workers’ evidence. Judges even dismissed cases after juries determined that the worker suffered discrimination in the workplace.

Tribal governments in the Southwest employ a number of individuals to help with the preservation of tribal values and places. In this chapter, Theresa Pasqual, former director of Acoma Pueblo’s Historic Preservation Office and an Acoma tribal member, talks about her professional pathway, how Acoma has worked with other tribes to protect traditional cultural properties (TCPs), the challenges that tribes face in implementing the National Environmental Policy Act (NEPA), and how tribal values can be incorporated into the preservation process. Based on her long experience, she emphasizes the importance of stewardship, listening, and collaboration—with the latter including collaboration between tribes as well as with archaeologists, anthropologists, and historians. She also provides insights into the process for the recent successful nomination of Mount Taylor to the New Mexico Register of Cultural Historic Properties, the largest such property currently on the register.

This book contributes to legal and labor history by reinterpreting the U.S. Supreme Court’s Hague v. CIO (1939) decision, which upheld a federal district court injunction prohibiting Jersey City boss Frank Hague from obstructing workers from the Committee for Industrial Organization (CIO) and allies in the American Civil Liberties Union (ACLU) from meeting in urban public places. The case involved speech and assembly freedoms, rights essential for CIO workers’ organizing efforts, but, as the book shows, these rights were submerged under municipal police powers to preserve public order until the court brought them under federal protection of the Fourteenth Amendment in Hague. Revising the conventional view, the book argues that Hague was more than simply a civil liberties victory for workers over a dictatorial, antilabor city boss. Drawing on new evidence in city archives, CIO records, trial transcripts, newspaper reports, and Jersey City court filings, as well as traditional sources in ACLU records and anti-Hague literature, the book demonstrates that the Hague-versus-CIO controversy emanated more from shifts in the labor movement from craft to industrial unionism, in municipal law, in urban police practices, in the politics of anticommunism and antifascism, and especially in the Supreme Court’s “civil liberties revolution.” With women and African Americans on the periphery, the book concludes, male CIO workers initiated the case, but Hague ultimately benefitted outdoor protests more than it benefitted labor speech.

This chapter examines the revenge scenario, arguing that, from an ethical perspective, screen storytellers should approach the scenario with caution and, when using it, complicate, nuance, and question it. The revenge scenario works because it is a reliable way to elicit the strong emotions that draw viewers. The pleasures of revenge scenarios depend upon Manichaean distinctions between good and evil—the good tribe and the bad tribe, the morally upright protagonist and the vile offender. If humans are tribal creatures, the typical revenge scenario exaggerates tribal feelings through narrative means and uses them to elicit strong and pleasurable emotional responses dependent on clear distinctions between us and them and simplified exaggerations of the Good and the Bad. The chapter examines the revenge scenario as it is employed in Django Unchained, Funny Games, and True Grit.

This one-volume reference collects important information about the current status of the indigenous peoples of Central and South America and offers a chronology of the conquest of the Amerindian tribes; a list of tribes by country; and an extensive bibliography of surviving American Indian groups. Historical as well as contemporary descriptions of approximately 500 existing tribes or groups of people are provided along with several bibliographic citations at the conclusion of each entry. The focus of the volume is on those Indian groups that still maintain a sense of tribal identity. For the vast majority of his entries, James S. Olson draws material from the Smithsonian Institution's seven-volume Handbook of South American Indians as well as other classic resources of a broad, general nature. Much attention is also focused on the complicated question of South American languages and on the definition of what constitutes an Indian. Olson's introduction cites dozens of valuable reference works relating to these topics. Following the introduction, this survey of surviving Amerindians is divided into sections that contain entries for each existing tribe or group; an appendix listing tribes by country; the Amerindian conquest chronology; and a bibliographical essay. This unique reference work should be an important item for most public, college, and university libraries.
