The advisory opinion is one of the relatively few cases that have required the International Court of Justice to consider directly issues related to the immunity of an international organization (in this case the UN). It provides important guidance on how to delineate between activities that are pursued by the UN and its officials in an official capacity, which are therefore entitled to immunity, and activities which are pursued in some other capacity and therefore are subject to national jurisdiction. At a procedural level the case is significant as the first occasion on which the process of so-called ‘binding advisory opinions’ under art. VIII, Section 30 of the 1946 Convention on the Privileges and Immunities of the United Nations has been invoked, leading in itself to some interesting questions about the adaptation of the Court’s advisory jurisdiction to a more formal mode of dispute settlement.

The drafting history of the Second Optional Protocol (1989) to the International Covenant on Civil and Political Rights, aiming at the abolition of the death penalty, is explained by the Special Rapporteur of the UN Sub-Commission on Human Rights entrusted with an analysis of the proposal to elaborate such a protocol. Special attention is given to the adoption of the text successively by the Sub-Commission and the Commission on Human Rights, the Economic and Social Council, the Third Committee, and the General Assembly. Explanations are given on the possible reservation allowing an exception for ‘a most serious crime of a military nature committed during wartime’. The Second Optional Protocol is also compared with regional instruments on the abolition of the death penalty, such as the 6th (1983) and 13th (2002) Protocol to the European Convention on Human Rights and the American Protocol aiming at the same abolition (1990).

The duty not to interfere in the internal affairs of the receiving State was not included in the original draft by the ILC’s Special Rapporteur, but was introduced through a later amendment. Given the significance which incidents of (alleged) interference had attained even then, this is a somewhat surprising development. In contemporary diplomatic relations, such charges play an important role and affect a wide variety of fields, ranging from criticism of the receiving State, human rights monitoring, support given to factions in that State, etc. This chapter explores the concept of interference, but it also reflects on legitimate interests on the side of the sending State which may allow (and even compel) a diplomatic agent to take measures which his hosts may consider interference. The chapter also suggests mechanisms, including the employment of proportionality, which are capable of mediating between the interests advanced on both sides of the divide.

Sie sind jedoch in Deutschland den Praktikerinnen und Praktikern in Verwaltung, Gerichten und Anwaltschaft nur wenig bekannt, was wesentlich damit zusammenhängt, dass sie nur vereinzelt in deutscher Übersetzung vorliegen. Der vorliegende Band schließt diese Lücke.
