Annotation:

The advisory opinion is one of the relatively few cases that have required the International Court of Justice to consider directly issues related to the immunity of an international organization (in this case the UN). It provides important guidance on how to delineate between activities that are pursued by the UN and its officials in an official capacity, which are therefore entitled to immunity, and activities which are pursued in some other capacity and therefore are subject to national jurisdiction. At a procedural level the case is significant as the first occasion on which the process of so-called ‘binding advisory opinions’ under art. VIII, Section 30 of the 1946 Convention on the Privileges and Immunities of the United Nations has been invoked, leading in itself to some interesting questions about the adaptation of the Court’s advisory jurisdiction to a more formal mode of dispute settlement.

North Korea ranks among the least free societies in the world. The human rights situation inside the country has been described by the first UN Special Rapporteur on the Situation of Human Rights in the Democratic People’s Republic of Korea, Vitit Muntarbhorn as sui generis (in its own category). In 2014, the United Nations Commission of Inquiry on Human Rights in the Democratic People’s Republic of Korea released a landmark report. In its detailed and well-written report, the Commission found that North Korea commits crimes against humanity. This chapter discusses the report from the perspective of the responsibility to protect (R2P).

Chapter 7 focuses on how AU judicial organs with human rights mandates have engaged with refugee issues. Four institutions are addressed: the African Commission, the African Court, and the not-yet-established Merged Court and New Merged Court. Section B focuses on the African Commission’s promotional and protective mandates and its refugee work within each. In relation to the promotional mandate, particular attention is paid to the African Commission’s collaboration with UNHCR, its role in supervising the 1969 Convention and the Special Rapporteur mandate. The drafting history of the Second Optional Protocol (1989) to the International Covenant on Civil and Political Rights, aiming at the abolition of the death penalty, is explained by the Special Rapporteur of the UN Sub-Commission on Human Rights entrusted with an analysis of the proposal to elaborate such a protocol. Special attention is given to the adoption of the text successively by the Sub-Commission and the Commission on Human Rights, the Economic and Social Council, the Third Committee, and the General Assembly. Explanations are given on the possible reservation allowing an exception for ‘a most serious crime of a military nature committed during wartime’. The Second Optional Protocol is also compared with regional instruments on the abolition of the death penalty, such as the 6th (1983) and 13th (2002) Protocol to the European Convention on Human Rights and the American Protocol aiming at the same abolition (1990).

The Preamble of the Principles is based on the premise that the Principles will provide guidance to States and other entities in developing effective measures for combating impunity. A leading normative component of the Preamble is the trilogy of the core rights to know, to justice and to reparation, including guarantees of non-recurrence. This chapter first describes the functions and characteristics of a Preamble and provides an overview of the report of Special Rapporteur Louis Joinet before discussing the Updated Set of Principles and the evolving notion of ‘transitional justice’; the campaign against impunity; and the orientation and scope of the Principles, including the Preamble, in the broader settings of restoring peace and democracy. Issues concerning broad participatory involvement of victims, human rights defenders and other sectors of civil society are also considered.

The duty not to interfere in the internal affairs of the receiving State was not included in the original draft by the ILC’s Special Rapporteur, but was introduced through a later amendment. Given the significance which incidents of (alleged) interference had attained even then, this is a somewhat surprising development. In contemporary diplomatic relations, such charges play an important role and affect a wide variety of fields, ranging from criticism of the receiving State, human rights monitoring, support given to factions in that State, etc. This chapter explores the concept of interference, but it also reflects on legitimate interests on the side of the sending State which may allow (and even compel) a diplomatic agent to take measures which his hosts may consider interference. The chapter also suggests mechanisms, including the employment of proportionality, which are capable of mediating between the interests advanced on both sides of the divide.

Die Allgemeinen Bemerkungen (General Comments) der VN-Vertragsorgane sind Quellen des völkerrechtlichen Soft Law, welche die in den Verträgen gewährleisteten Rechte auslegen und konkretisieren. Sie sind jedoch in Deutschland den Praktikerinnen und Praktikern in Verwaltung, Gerichten und Anwaltschaft nur wenig bekannt, was wesentlich damit zusammenhängt, dass sie nur vereinzelt in deutscher Übersetzung vorliegen. Der vorliegende Band schließt diese Lücke. Neben der Übersetzung der Allgemeinen Bemerkungen zu den sechs VN-Menschenrechtsverträgen werden die einzelnen Verträge von renommierten Expertinnen und Experten mit Kurzkommentaren versehen.
