Abstract This essay considers the historical roots of contemporary sanctuary practices. It traces these roots in the protocols adopted by the 1951 United Nations High Commissioner for Refugees Convention, tracing the contradictory implementation of these protocols in US policy and practice. It argues that the UNHCR Convention created a distinction between refugees and migrants that met challenges from sanctuary activists responding to the depredations of the US-backed “dirty wars” in Central America during the 1980s. The sanctuary movement contested this distinction, as did the subsequent evolution of immigration and refugee policy. In the current period, the erosion of this distinction by ascendant xenophobia also creates space for the emergence of new definitions and practices of the right to sanctuary and freedom of movement.

Features of all fifty sanctuary incidents occurring in Canada from 1983 to early 2009 are described and recent trends identified.The duration of sanctuary incidents has increased dramatically, the success rate has declined, and no new incidents have commenced in more than one and a half years.Sanctuary’s apparent decline in its “exposure” form as an effective resistance strategy is likely related to several factors, including less interest among mass media, the federal government’s adoption of a more authoritar­ian approach toward immigration and refugee policy, and the rise of support for a merit-based legal appeal for failed refugee claimants evident in sanctuary discourse.

AbstractSignificant research indicates that attitude change is often a product of partisan learning. However, as the party system continues to rearrange around issues of race and immigration, and as new racial policy issues thrust onto the agenda, it is unclear whether voters learn to adopt racial policy attitudes more based on race/ethnicity or on party identification. We evaluate the partisan-learning model versus a racial-learning model with regards to public opinion on sanctuary cities/policies among survey respondents in CA and TX. Given President Trump's public antipathy toward sanctuary cities, we argue and show that negative partisanship is the most plausible vehicle for sanctuary city attitude change between 2015 and 2017. In this particular case, we find no support for a racial/ethnic-learning model.

In recent years, many local governments in the United States have declared themselves to be sanctuaries, welcoming jurisdictions, safe cities, or cities of refuge for immigrants. At the same time, federal rhetoric and associated national laws—which have legal precedence over local immigration policies—have shifted in anti-immigrant directions. These developments raise questions about whether and how local sanctuary policies affect immigrants’ lives, including their feelings of fear, their access to local services, and their interactions with law enforcement. This article draws on existing studies and new interview data from a pilot study of two sanctuary cities, Boston and Seattle, to evaluate the impacts of municipal sanctuary policies for immigrants, including their potential influences on immigrant and refugee integration. I also explore policy approaches that might enhance these policies’ effectiveness in achieving their supporters’ stated goals.

Rufus Browning, Dale Marshall, and David Tabb present some straightforward and convincing theses in their admirable workProtest Is Not Enough. Urban policy responsiveness to minority interests, they argue, depends not so much on the direct impact of protest as on the advent of a dominant liberal coalition in which blacks and Hispanics have some role. Where such coalitions have not succeeded, racial exclusion and policy resistance tend to hold sway. Where blacks or Hispanics have played a leading role in bringing such a coalition to power, or in Browning, Marshall and Tabb's terms where political incorporation has been greatest, then policy results favor minority interests. Political incorporation depends on protest and electoral mobilization among blacks and Hispanics combined with favorable white attitudes toward minority interests. The size of the minority community and its leadership capacity in turn explain minority political mobilization.By these propositions, New York City should be characterized by substantial black and Hispanic political incorporation and the resulting targeting of policy outputs on minority interests. In the 1980 Census, New York's population was 23.9% black and 19.9% Hispanic; these numbers may have been substantially undercounted. In any case, two-thirds of a decade later New York is clearly a majority minority city. Black political participation dates from Adam Clayton Powell and Benjamin Davis' election to the city council in 1941 and 1943. The first Puerto Rican assemblyman was elected on the Republican and American Labor Party lines in 1938. Subsequently, both groups have had a long and sophisticated history of political participation. From the 1960s onward, a new generation of leadership led both groups to assert their political demands more strongly. The Lindsay administration afforded a national model of how a new liberal coalition could experiment with new forms of political incorporation. Voting in state and national elections would suggest the city is on the liberal end of the urban political spectrum. In short, by Western lights New York should be a model of strong minority incorporation and the consequent targeting of city policies toward minority interests. The problem, however, is that New York City has not incorporated minorities and, depending on what indicators are chosen, has not produced policies that are especially aimed toward minorities.

AbstractThe legality of the Southern Ocean Sanctuary has been a matter of debate. This paper seeks to explain the Sanctuary as being both legal and illustrative of the development of international environmental law within a new, evolutionary framework. A teleological approach to statutory interpretation could construe the Convention in ways that are supportive of the non-lethal utilisation of cetaceans. Such an interpretation may be supported under the Vienna Convention, whereby if examples of previous practice demonstrating different interpretations of the language in question can be shown, then this practice is evidence that a different interpretation of the convention in question is legitimate. This has been the case with the International Whaling Commission. The paper concludes that the Southern Ocean Sanctuary may be regarded as being both a legal and authoritative example of the way in which the majority of the international community has viewed one area of global environmental concern.

This study investigates New York Times coverage of the Democratic and Republican general presidential campaigns from 1952–2000. Content analysis reveals that the most common topic of campaign coverage was horse race. Discussion of the candidates' character was more common than discussion of their policy positions (even though candidates discuss policy more than character in campaign messages). The statements in these stories were more often negative than positive (despite the fact that candidates' messages are more positive than negative). Reporters are the most common sources for the statements in these articles, followed by candidates, supporters, and others.
