This paper seeks to understand policy in the City of New York which limits cooperation with federal authorities for purposes of immigration control. It does so by qualitatively analyzing a set of legal-administrative documents. The key, policy features are identified along with the interests and forces which shaped those features over time. An arsenal of supplemental, legal material as well as the findings of legal scholars are consulted for interpretation in hermeneutic fashion. Using a theoretical framework consisting of the structure of the legal system of the United States and it norms, plus certain immigration-related, national trends, this research concludes this policy is the legacy of an unbroken, bi-partisan lineage of administrations dating back to the 1980s – an evolving product of the tensions between the legal norms and the national trends. The policy reinforces sovereignty from the federal government, and it does so largely for purposes of constitutionality, administrative functionality and civil rights.

This research will examine graduation rates from the 1999-2000 school year until the 2012-13 school year, which will shed light on the long-term impact of neoliberal policy on inequality. I begin with a discussion of the history of school reform in NYC, starting with the Brown v. BOE verdict and finishing at the current neoliberal reform era, to understand how various reform strategies have aimed to reduce segregation and inequality. I then use a dissimilarity index to examine changes in racial segregation by performance between 2000 and 2013, using high school graduation rate quartiles to measure performance. In the last empirical chapter, I use growth curve modeling to understand the factors that are associated with changes in graduation rates. I model the impact of several factors that measure the presence of neoliberal reform and inequality on graduation. These measures include: racial and socioeconomic composition, the impact of mandatory regents, being a small school and failing on NYC school accountability report. This research finds that policies aimed at desegregation have been unaggressive and poorly implemented, and this has resulted in persistent segregation. Neoliberal policies assume that by increasing individual choices and accountability, that all students will make the choices that are in their best interest, and inequality will be reduced. This indirect strategy proves to be ineffective. White students have experienced increased access and isolation amongst the best performing schools, while Black students have become increasingly segregated in the worst performing schools. Growth curve modeling shows a consistent increase in graduation rates over this time. This increase is lessened for schools that serve above average black, Hispanic, and free-lunch eligible students. These schools have the lowest graduation rate.

Nigerian women face numerous cultural difficulties in their quest to attain leadership positions in Nigeria, a developing country. They are often overlooked in favor of men due to politics, religious beliefs, education, and bias in gender roles. When Nigerian women emigrate to a new country, the challenges are even greater. Although several United States policies impact the ability of a female immigrant to attain a leadership position 'the Equal Pay Act, Affirmative Action, and the Equal Employment Opportunity Act' little research has examined the challenges that affect their quest to attain leadership positions in the United States. This study explored the experiences of immigrant Nigerian women currently in leadership positions in New York City. Data for this study included interviews with 12 Nigerian female immigrants who responded to flyers placed throughout New York City; participants were also recruited via snowball sampling. Interview data were inductively coded, and then subjected to a modified Van Kaam method of analysis that revealed emergent themes. Many of the respondents reported the needed to change career paths because organizations in New York City did not recognize the equivalent of their careers, work experience, and education from their home country. As a result of this research, new information will be available to policymakers, which may be used to revise existing policies that directly impact immigrant women's career goals. The results may also provide new and useful information to leaders of local organizations that help female immigrants gain meaningful employment.

Despite growing attention to the issue of urban 'sustainability' and steady increases in the overall use of different renewable power technologies around the world, cities tend to have very low levels of 'green' power use or renewables technology deployment within their borders. Through field interviews and literature reviews, this thesis examines the factors that both help and hinder this situation, using New York City and London as case studies. New institutionalism and urban regime theories provide the analytical lenses through which the empirical research is viewed. Each theory examines this issue from a different perspective, with new institutionalism particularly adept at identifying explanations linked to the electric power sector's highly regulated policy environment. Urban regime theory (URT) emphasizes understanding who is involved in the policy-making and implementation process, and how their involvement influences any outcomes. Originally, URT was developed to analyze urban growth coalitions and other urban economic development activities, although researchers have more recently posited its applicability to a wide range of fields, including urban environmental policy-making. When examining energy policy-making in both London and New York, however, a traditional URT approach falls short because it does not easily accommodate the influence of formal regulatory mechanisms in shaping outcomes. By modifying URT, however, so it adopts aspects of a new institutionalist approach, highly compelling and comprehensive explanations for local energy policy and program decisions can be obtained. This thesis concludes by detailing circumstances under which this type of "Constrained" regime analysis is appropriate, and how its methodology differs from that of traditional urban regime theory.

This exploratory study compares organizational configurations of principal autonomy in Finland and New York State. Evidence from Finnish school site visits and surveys distributed to principals in New York State and Finland is utilized to compare principal autonomy in two distinct educational settings.

The distinguishing feature of the U.S. school system is local control by school boards, which dates back to the colonial era (Wong & Langevin, 2005). This organizational setting contrasts from the educational system in Finland where the central government still holds statutory responsibility for education, but has decided to delegate decisions affecting the daily processes of a school to the principal and staff of each individual schools (Caldwell & Harris, 2006; Sabel, Saxenian, Miettinen, Kristensen, & Hautamäki, 2010). Finland was chosen for this study because of its recent success on PISA and the attention Finland has received from U.S. policymakers, reformers, professors, and the media. If the Finnish school system is a “miracle” as some proclaim (Darling-Hammond, 2010), then what can we learn from this organizational setting?

The hypothesis of this study is that principals in devolved and radically decentralized settings (e.g. New York State) possess less autonomy compared to principals in settings with a distinct educational center that allows decentralized decision-making at the local level (e.g. Finland). The research questions this study proposes to consider are: 1) To what extent do principals in devolved school systems (such as New York State) exercise autonomy when making decisions compared to principals in an educational system where authority is delegated by the central government (such as Finland)? 2) Is there a relationship between principal autonomy and the type of decentralization? 3) How does the type of decentralization affect a principal’s ability to act autonomously in making decisions?

To examine the validity of the hypothesis and to answer these research questions, principals from New York State and Finland were selected to answer an electronically administered survey similar to the School and Staffing Survey distributed by the U.S. Department of Education. An analysis of the survey results was utilized to help understand if a relationship exists between different organizational configurations and principal autonomy. I also went to visit schools in Finland and had the opportunity to meet with school principals and representatives of the OAJ (Trade Union of Education).

Principals were asked about their autonomy in making decisions related to personnel and instruction. My findings indicate that in almost all instances, principals in Finland enjoy a higher degree of autonomy than their counterparts in New York State. Principals in New York State, which operate in an educational atmosphere where different levels of government and bureaucratic entities ratify laws, pass policies, and make decisions that affect instruction and personnel, experience a lower degree of autonomy. In contrast, principals that work in a system, such as Finland’s, where the central government delegates authority to local educational agencies and allows the administration and staff of each school to make decisions indicate a higher degree of autonomy.

Street vending remains one of the most highly regulated and least understood activities in New York City. The current regulatory framework is overly confusing and complex, leaving policy decisions about who gets to vend and where to the discretion of private interests represented by Business Improvement Districts. There is an estimated ten to twelve thousand street vendors today of which half operate outside any regulatory framework. A historical analysis of street vending policies in New York City reveals a legacy of political and social biases that have influenced contemporary regulatory framework toward vending. Exploratory case studies in Sunset Park and Midtown Community Court illustrate new strategies that are being used today by a Business Improvement District and a criminal justice institution to address vending problem at its root causes. Such strategies break away from traditional prescriptions that focused largely on punitive enforcement measures. A new policy framework for regulating street vending should break the legacy of bias and create a transparent decision making environment that recognizes street vending a right to economic livelihood. Such vending policies should also remain flexible to the nuance of neighborhood scale and need.

Homelessness has been a problem in New York City (NYC) for decades. Part of the problem is children who grew up in the shelter system and then returned as adults, a phenomenon known as 2nd-generation homelessness. Literature indicates that no researchers have interviewed second-generation homeless adults about their experiences. The purpose of this study was to explore the experience of 2nd-generation homelessness from the perspective of homeless adults returning to the shelter system. The sample included 1 second-generation homeless adult and 10 case managers at Tier II homeless shelters. Interviews were conducted and data were analyzed using hand coding to uncover themes amongst the interviews. The themes found were: lack of information and resources, generational homelessness is passed down, people should learn from their parents' mistakes, comfort in the homeless shelter system, money, parental abuse and neglect, the role of the case manager, taking advantage of the shelter system, and mental health. The other topics that were discussed on multiple occasions but did not fit into larger categories are: education, drugs and alcohol, lack of family assistance, and activities of daily living. Findings from this study inform social change by indicating a clear need for input from homeless families and case managers when developing interventions to address second-generation homelessness. Future policymakers should include staff and clients when developing ways to address homelessness in New York City. The views and opinions expressed in this manuscript reflect the personal views of the researcher and interviewees; they do not represent the views of NYC Department of Homeless Services or its providers.

The reliance upon and depletion of fossil fuels as an energy source puts pressure on individuals, communities, energy companies, and policy-makers. Hydraulic fracturing – known colloquially as fracking – as a method of drilling for oil and natural gas temporarily alleviates this pressure since it allows for the extraction previously inaccessible fossil fuels in shale rock deposits deep beneath the Earth’s surface. This has resulted in a nationwide “fracking boom,” which has come with its share of economic benefits. However, the process of fracking can be detrimental to human and environmental health. In reaction to the increasing development of this practice, many communities across the country are mobilizing against fracking. This thesis will focus on the grassroots activism against fracking in New York, where fracking was banned in December 2014, and in California, which is largely slated as the next frontier for the expansion of fracking and thus battleground for the fight against fracking. Using grassroots academic literature, media coverage of fracking and activism in each state, and interviews from organizers working in each state, this thesis will examine the motivations, frameworks, strategies, and tactics used in each grassroots campaign in order to offer lessons in successes and opportunities for improvement within these anti-fracking efforts and others across the country.

This thesis presents qualitative research conducted in summer 2017 at the Finger Lakes Free Clinic, which provides free medical and holistic care to people without insurance in upstate New York. The primary goal of this research was to strengthen the relationship between a free clinic and its donors by gathering donor concerns and perceptions regarding federal healthcare policy. Data from 32 interviews with donors, staff, board members, and volunteers, along with 100 hours of participant observation revealed that donors to this clinic were concerned about the potential impact of Congressional healthcare reform yet did not consider federal policy a strong influence on their donations. Rather, donors cited dedication to local giving and personal connections with the clinic as their primary motivations. These motivations suggest the value of viewing the clinic-donor relationship as a relationship of reciprocity. From this framework, the research identifies opportunities for the clinic to reciprocate donor generosity while expanding services in response to a growing need. Insights from the research will guide the clinic's response to federal policy changes and support the clinic's vision of becoming a national model for integrative care.

The goal of this dissertation is to address three areas in the policy process literature that require clarification. First, it examines how a policy actor’s deep and policy core beliefs translate into secondary beliefs. To do so, the research models the effect of an individual’s view of government in daily life and their policy belief towards fracking on their secondary belief of which level of government should regulate an issue. Second, the research examines how a policy actor’s policy core beliefs affect a behavior called venue shopping. The research asks how policy actors’ belief towards the policy status quo affects their shopping activity level, and how their beliefs toward decision makers influence venue selection. Third, the research examines local governmental representatives as policy actors in a state-level policy subsystem. Policy process research identifies local government representatives within advocacy coalitions, but little is known about how local governmental actors compare to other advocates in the coalitions. The research uses the Advocacy Coalition Framework (ACF) as an analytical and theoretical foundation and applies other policy process and organizational theories to inform its hypotheses. I use multiple quantitative data modeling techniques to explore each question. Data for the research is from original surveys of policy actors in state-level hydraulic fracturing subsystems in Colorado, Texas, and New York. Findings indicate policy actors’ deep core and policy core beliefs significantly influence their secondary beliefs. However, deep core beliefs have a greater effect on secondary beliefs related to more abstract issues, such as air quality, and less on more concrete issues, such as the distance a well should be from other structures. The venue shopping models indicate policy actors who oppose the policy status quo shop more venues than those who align with the status quo. Additionally, the strongest indicator of which venue a policy actor shops is not their beliefs toward the decision makers, but their other shopping choices. Finally, analyses show local governments are a unique group within and across coalitions because of their network relationships and they align with one another on a set of policy core beliefs, but are also divided among pro and anti-fracking coalitions on other policy core beliefs. Overall, this dissertation shows the ACF provides a theoretical and analytical frame to examine policy actor beliefs and behavior, but additional theories and sub-groupings of policy actors are needed to explain nuances in policy actor dynamics.

Néanmoins, la politique linguistique des États-Unis demeure lacunaire. La politique linguistique de l’État de New York, étudiée dans le deuxième chapitre, complète en partie cette politique en intervenant principalement dans les domaines de l’éducation et du droit de vote. La politique linguistique de l’État du New York est déterminée, d’une part, par un antagonisme structurel Ville-État et, d’autre part, par la lutte des Portoricains pour le respect de leurs droits linguistiques. In a first part, this study analyzes the institutional framework in which American language policies are elaborated; the Constitution of the United States and its amendments appear to play a major role in their elaboration. Since the adoption of national language policies in the 1960’s, federal influence has grown further. However, the language policy of the United States remains incomplete. The language policy of the State of New York, which is studied in the second chapter, supplements it by intervening in the fields of education and voting rights mainly. The language policy of New York is determined by, on the one hand, a structural City-State antagonism, and on the other hand, by the activism of Puerto Ricans who mobilized to assert their language rights. The last chapter of this study consists of a case-study; forty semi- conducted interviews were carried out with Russian-speaking immigrants. As a whole, they stress the importance of retraining in the language acquisition process

tolerance of their activities; governments often allow street vendors in certain areas of the city, while relocating street vendors from sidewalks in others. In the absence of meaningful, in-depth datasets on urban informality, studies investigating this variation have had to rely on case studies, anecdotal material and qualitative neighborhood comparisons. As a result, there have been no large-scale empirical studies undertaking city-wide analysis of the policing of urban informality. This thesis overcomes such limitations by using a mix of administrative data, mobile sensing, GIS mapping and qualitative methods to uncover informality's relationship with the state and the larger urban fabric in New York City. Through visualization and empirical analysis of the enforcement landscape vis-à-vis socioeconomic variables in New York, this project highlights the underlying impulses that lead to uneven regulatory outcomes: disparate claims on urban citizenship and a city's move towards more privatized urbanism. At the same time, my methodology allows this thesis to display the unique interactions street vending has with each neighborhood's socio-spatial environment, resulting in the creation of diverse vending cultures. By recognizing this vibrancy and detangling the determinants of the spatial landscape of vending rule enforcement, this thesis advocates for a fairer regulatory schema for informal commerce.

This thesis is an exploration into how New York City can incorporate local food system planning into their existing sustainability program by capitalizing on recent energy and grassroots initiatives. I argue for the importance of local and regionally produced food as a part of food system sustainability, and propose that food issues be addressed at the local level. In order to learn how food planning transforms from a social and advocacy movement and into policy, I compare food policy initiatives in Chicago, San Francisco, and Vancouver. My analysis of each city's food program reveals their shared aspiration to provide affordable, accessible, and fresh food with few adverse environmental impacts. Each city's strategies are the product of local conditions, interests, and political culture. I recommend that as the New York City government looks towards coordinating food policy, these precedents illustrate the necessity of tailoring urban food policy practices to suit local conditions, community culture, and needs. This paper evaluates the effectiveness of nascent food policy efforts while suggesting roles for policy makers, community groups, and citizens in New York City.

Although many Americans assume that the education provided by public schools will prepare them for higher learning and/ or the workforce, recent studies have shown that American students' test scores lag behind their counterparts around the world and a growing number are not prepared for graduation. School choice, in the form of publicly funded vouchers for low-income students, has caused significant debate as a form of education reform. Proponents argue that vouchers will induce competition between schools, help low-income students obtain a better education, and increase parental satisfaction. Opponents of school vouchers argue that publicly funded vouchers will drain public schools of much needed resources, leave the most difficult to educate students in public schools, and violate the constitution by funding sectarian institutions. School voucher programs have been implemented in New York, Florida, Cleveland and Milwaukee yet there is no consensus in terms of the effect of vouchers on achievement scores. This thesis looks at four school choice programs, evaluates and compares the design/ methodologies of the program evaluations, and draws conclusion about which results are the most reliable and why.
(cont.) Once the methodologies and findings of the evaluations were analyzed, I found that most programs did not have a significant effect on achievement test scores of voucher recipients and did not induce competition between public and private schools.

Many people recognize inequity in educational resource allocation as a problem. It has been suggested this inequity stems from the consolidation of experienced teachers in low-poverty schools and higher teacher turnover rates at high-poverty schools. This paper uses an ordinary least-squares (OLS) regression to examine the relationship between school-level expenditures excluding teacher salary, and teacher turnover in New York City. The results of the analysis suggest that these expenditures have a statistically significant association with teacher turnover, and that, for the majority of them, increased spending is associated with less teacher turnover. The results also suggest that increased spending is associated with a higher level of teacher satisfaction, though the significance of this association is less consistent. These results could have policy implications for education researchers and practitioners concerned with improving fiscal equity through decreased turnover in high-poverty schools.

The New York State politicians, notably members of Congress such as Irving Ives, Herbert Lehman, Samuel Dickstein, Emanuel Celler and Jacob Javits, were very involved in the immigration debates for the period from 1945 to 1953. By their interventions, they emerged as fiery supporters of a liberalization of American immigration policy. A willingness to satisfy a multiethnic electorate largely explains their position. But these individuals, mostly defenders of President Truman's foreign policy, also believed in this cold war context that an attenuation of restrictionism in immigration would provide numerous advantages to the nation. If their attitude seems dictated by considerations that were both pragmatic and idealistic, it generated non-negligible results. Thus, the granting of a quota to India in 1946, the act on the war brides in 1945, as well as the legislation affecting the refugees in 1950, were among the measures mainly ascribable to the activities of these politicians.

The permitting process to determine whether high volume hydraulic fracturing (HVHF) should be allowed in New York State has been controversial and protracted. There have been intense disputes between those who see HVHF as an economic benefit and those who assert it will jeopardize health and the environment. Using the case study research method, perceptions of directly affected stakeholders regarding the issues, benefits and limitations associated with the public participation process were explored. Purposive sampling yielded participants from the natural gas industry, municipal governments, local landowners and residents. Data collection methods involved in-depth interviews, focus groups and document analysis. Since the HVHF conflict concerned a future possibility of environmental degradation, theoretical foundations included complex systems and green ideology, the enactment of power and social dominance, environmental conflict resolution, and principles of collaborative management. Findings demonstrate that the public participation process was embedded in a traditional top-down policy development approach that did not accommodate conditions of high uncertainty, nor did it allow for the broader and deeper discourse needed when development involves socio-economic and environmental justice issues. Implications include the potential to apply principles and methods of collaborative management typically used for natural resource management. In particular, the adaptive co-management approach provides a framework for managing issues that require problem solving over time, an essential missing element of the current HVHF stakeholder engagement process where diverse stakeholders identified issues of trust, empowerment, rights and fairness.

Against the background of a proliferation of large non-English-speaking ethnic linguistic communities in Britain and the United States, this thesis examines the provision of English as a Second Language (ESL) and bilingual education policies in London and New York City respectively. The thesis is divided into three parts. Part I traces the transformation of English into an international linguistic phenomenon and the significance acquired by ESL and bilingual education policies. In particular, attention is focused on the educational challenges faced by English-speaking nations that are home to sizeable non-English-speaking communities. After this introductory overview, the interpretive theoretical framework, in which the thesis is based, is then presented. Drawing from the works of Yanow, Hajer and others, both ESL and bilingual education are understood as taking place within a multi-organisational context, where different players attribute different meanings to this policy. Part II goes on to explore the contrasting ways in which ESL and bilingual education policies have been framed both in Britain and in the United States. While in the UK ESL tuition has evolved as a by-product of immigration and racc-relations policies, in the USA bilingual education has however been construed as a linguistic right. Part III then introduces an empirical analysis of the provision of ESL and bilingual programmes in the context of London and New York City. This section specifically deals with the educational needs of two non-English-speaking groups: the Bangladeshi community in Tower Hamlets and the Hispanic community in Manhattan. Following from these players' language experiences, the fieldwork is used to - identify three distinctive ESL/bilingual, education discourse coalitions, namely the assimilationists, exclusivists and social integrationists. Based on different value-systems, each of these 'policy frames' represents their advocates' particular understanding of ESL and bilingual education policies. Having finally ascertained the impact of multiple meanings on the second language education policy process, the thesis concludes by advocating further interpretive research in the analysis of public policy.

While current accountability regimes in U.S. public education focus on the job performance of individual school professionals, research in industrial/organizational psychology has established the importance of system-wide factors for organizational outcomes. The purpose of this study was to identify school-wide factors that predict guidance program readiness in New York State high schools. This nonexperimental, quantitative study was based on a survey sample of 97 guidance counselors in New York State. Multivariariate analyses of variance showed that two school-wide independent variables-urbanization of school location and counselor-student ratio-predict scores on guidance program readiness, measured using the American School Counselor Association Readiness Survey. This instrument assesses program readiness on seven subscales-community support, leadership, guidance curriculum, staff/time use, counselor's beliefs and attitudes, counselor's skills, district resources-and overall program readiness. Because prior research shows that this instrument predicts guidance program effectiveness, the findings of the present research have important implications for school reform debates. Specifically, it would appear that school-wide factors significantly influence guidance program outcomes, calling into question the adequacy of accountability systems based on the job performance of individual guidance counselors and other education professionals. This research contributes to a growing body of evidence in support of the whole system paradigm of school reform, which seeks to improve both individual and system outcomes through system transformation.

Analyserna har också visat att klimatförändringarna framställs i de båda tidningarna utifrån nationella identiteter och en ”vi” och ”dem” diskurs återges konsekvent i artiklarna. När det kommer till vetenskaplig säkerhet och osäkerhet ställer sig både DN och NYT säkert till klimatförändringarna och detta görs genom citat från vetenskapsmän och statistik. Säkerheten präglas också av medvetenhet och god inblick i klimatförändringarna. Ansvarsutkrävandet i DN och NYT läggs till stor del på politikerna, dock utkräver NYT ett globalt ansvar och DN utkräver ett ansvar mot USA och Europa som Sverige i denna kontext står utanför. Between 1824 and 1876, almost ten million immigrants came to the United States. The onset of mass immigration posed a logistical problem: how to process, aid, and regulate a large influx of newcomers. State and federal governments, caught up in conflicts over state sovereignty and slavery, proved ill-equipped to manage the influx of migrants. The states enacted their own individual policies to control mobility, but there was no national immigration policy before the Civil War. Where state and federal governments failed to come up with a comprehensive solution, an ad hoc group of shipping merchants, passenger agents, aid organizations, runners and swindlers responded to the onset of mass migration by turning migration into a commercial enterprise. Taken together, these various actors, which I term the “migration business,” formulated an institutional response to the problem of mass immigration in the US. The passenger trade was a side business for many merchants in 1824, when the Supreme Court ruled that Congress had power over interstate commerce. But by 1876, the migration business had become a vast commercial enterprise, according to the Supreme Court, that was so important to the national interest as to require federal regulation. This dissertation explains how the migration business became a commercial enterprise worthy of federal regulation and how it influenced immigration policy on the local, state, and federal level. Through its control of transportation costs, charitable aid, and state and federal immigrant organizations, the migration business held regulatory power over immigrants, as well. By regulating immigration, the migration business formed its own kind of immigration policy—one that was led by merchants and entrepreneurs, and one that exploited foreign-born people in the US

Refugee resettlement to the United States has decreased tremendously since 2017. This study investigates whether, and how, resettlement and health organization in New York are facilitating the distribution of health resources and how they are integrating refugees into becoming self-sufficient in the United States. Refugees have a right to many resources upon arrival in the United Stated especially health resources. Through case studies, this thesis examines two organizations contribution to changing the health status of refugees and the strategies that they implement to help refugees. Findings show that both organizations examined contribute to assist refugees to improve access to the health care. Findings also reveal many strategies for the facilitation of integration, the most prominent factor being interaction between organizations and refugees upon resettlement.

This research study examines the policy formation of post-9/11 government led community engagement and partnerships with Muslim communities in London and New York City between 2001 and 2014 situated within the macro political economic context of neoliberalism and related socio-political phenomena that have shaped post-9/11 United Kingdom and United States counterterrorism strategy. This research study has two research questions: 1. Can a clear difference in the strategies used in approaches to countering post-9/11 Al Qaeda inspired terrorism measures targeting Muslim communities be identified in London and New York? 2. How can situating this examination in the context of neoliberalism as illustrated by the breaking down of a number of traditional binaries in the larger social context, specifically the theoretical debates of the state of exception, the convergence of internal and external security and multiculturalism, provide clearer understanding of similarities or differences between London and New York? This study compares the policy formation and evolution of government initiated community engagement and partnerships with Muslim communities strategies used to counter post-9/11 Al Qaeda inspired terrorism in Muslim communities by the London Metropolitan Police Service (London Met) and the New York City Police Department (NYPD). To thoroughly understand these policy approaches, this research study has situated the research within the larger socio-political contexts in which these programmes were formed. Using a mixed methods research methodology comprised of documentary analysis of official United Kingdom and United States documents, discourse analysis of key terrorism and counterterrorism speeches by political elites in the United Kingdom and United States, and semi-structured interviews with elite police and policymaking officials involved in counterterrorism, this study found that neoliberalism, and specifically the significant breakdowns in traditional social binaries have impacted post-9/11 counterterrorism policing in London and New York City. This study concludes that understanding the effects of neoliberalism in this policy area through the blurring of traditional binaries including distinctions between the state of exception and non-state of exception, internal and external security, and United Kingdom and United States approaches to multiculturalism have made historical distinctions between London Met and NYPD approaches to counterterrorism much less significant in the post-9/11 era, although some distinctions remain in their respective approaches to government-led community engagement and partnerships with Muslim communities.

An elementary school principal writes an historical analysis of a thirty-year period of growing immigration and changing education policy in Chelsea, Massachusetts, a city located near Boston. The history examines the years 1890-1920 and the transformation of an urban public school system, including its policies and practices regarding the education of immigrant, non-English-speaking children. Comparisons are made with immigration and the New York City public schools during the same years. A literature review of language policies and the schooling of immigrant children in New York one hundred years ago sheds light on past and present experiences of language-minority students. Attention is given to changing notions of assimilation and Americanization in U.S. society; to the teaching of English and the role of native-language maintenance in defining an ethnic-American identity; and to educational achievement and mobility rates among Russian Jewish and Southern Italian immigrants and their descendants a century ago, and among Hispanic immigrants today. Related questions include: What was the response ofthe New York City and Chelsea public schools to the task of educating immigrant children and how did this change over time? What educational options were available to the increasing immigrant populations? What attitudes and expectations did immigrants and educators have of one another in terms of public school education? How does the historical and sociological evidence confirm or deny the perception of "academic success" and "educational attainment" of immigrants in New York City and the Chelsea Public Schools at the turn of the 20th century? Earlier developments in education policy petiaining to immigration in Chelsea are compared with recent trends, including English literacy, bilingual education, teacher quality, curriculum, school facilities, class size, testing and standards, and graduation rates. The researcher used a mixed-method study of both quantitative and qualitative sources. As an extended reflection and interpretive synthesis, the paper draws from the vast literature on past and present immigration. Sources are varied, from historical accounts of immigrants, to census and school department reports, newspaper reports, statistical surveys, student essays and speeches, and several novels, memoirs, and biographies.

This research study explores the effectiveness of the urban gardening program Gardens for Healthy Communities (GHC) as a public health strategy intended to reverse obesity trends in New York City. The GHC program originated from the Obesity Task Force, a multi-agency work group commissioned by Mayor Bloomberg in 2013 charged identifying innovative policies to prevent as well as reduce obesity. 18 in-depth interviews with garden advocates and GHC garden members reveal that the driving motivation for participating in the selected GHC gardens was less about obesity, specifically, and more about the public health and community development benefits including: a meeting place for civic engagement and environmental awareness, a space for community and health-oriented partnership, and a social bridge to build community cohesion. Through the community right to public space and gardens, the GHC gardens reveal the power of engaging anti-obesity objectives in driving community development and urban agriculture forward.

Relying on framing theory, this study used The New York Times to explore how Chinese news was depicted before, during and after the Beijing Summer Olympics. The research regarding how the Chinese government tried to leverage the Olympics to enhance its image is often deliberated. However, there have only been a 3 few studies on the evaluation of the effects the 2008 Beijing Summer Olympic Games had on the image of China, as depicted by The New York Times. This study generated an understanding of the impact the presentations of The New York Times had on the soft power used by China through the Beijing Summer Olympic Games. The study examined how the 2008 Beijing Summer Olympics were associated with the depiction of Chinese news in The New York Times during the pre-, mid-, and post-Olympics years. Specifically, world and business sections within The New York Times were mainly influenced by the effects of the 2008 Beijing Summer Olympics. In addition, there were no direct associations found between the 2008 Beijing Summer Olympics and how China was depicted photographically in The New York Times. In terms of the above factors; this study showed that China's national image did not improve in the New York Times after the 2008 Bejing Summer Olympic Games.

My critical discourse analysis (CDA) of the New York Times' front-page and editorial articles, within the framework of Herman and Chomsky's (1988) propaganda model, shows that the newspaper constructed the intervention in Rwanda as suicidal for the United States and beyond the capacity of the international community. On the other hand, U.S. and NATO intervention and military airstrikes against Serbia were represented as surgical and the only options available to save ethnic Albanian lives in Kosovo. My analysis finds that the New York Times' constructions of the two conflicts, conflict actors and victims of the conflicts heavily favored the official U.S. policy of nonintervention in Rwanda and intervention in Kosovo. In particular, the analysis of the Kosovo conflict discourse in the New York Times found strong support for the dichotomization hypothesis of the propaganda model. I further analyzed U.S. policy papers or the official propaganda discourses alongside news media discourses, and also reviewed my CDA findings alongside key historical episodes related to the two conflicts. My analysis shows, while the New York Times showcased and regurgitated arguments that were in favor of U.S. policy of intervention in Kosovo and nonintervention in Rwanda, the newspaper--deliberately or otherwise--omitted and distorted key details that could potentially and fundamentally reshape perceptions of the need or lack of need for U.S. interventions in each of the two conflicts. Lastly, my analysis finds that there was high degree of similarity between the official propaganda discourses and the discourses in the New York Times.

This thesis seeks to understand how rental housing market dynamics-particularly landlord behavior, and the policies and players that shape it-contribute to the spatial clustering of households that participate in the Housing Choice Voucher (HCV) Program in New York City. Scholars have long been interested in understanding the reproduction of HCV holders into higher poverty, racially segregated neighborhoods in cities across the U.S. Most of the research to date has focused on the ways demand-side factors influence locational outcomes of voucher holders, specifically why they move, where and under what circumstances. However, to fully understand the residential patterns we see among voucher holders, we need to look beyond the demand-side barriers to understand the structural problems of the rental housing market and the voucher program itself. This thesis draws on in-depth interviews with landlords who participate and do not participate in the HCV program in New York City to better understand their experiences with the program and what drives their decision-making practices. Interviews were also conducted with realtors, public agency officials, landlord associations and a legal advocacy organization to better understand the role that intermediaries, public policies and city agencies play in influencing these decisions. Findings provide detailed accounts of the policies and agency practices landlords and realtors are responding to; they begin to explain how the structure of the rental housing market and voucher program itself lends to the reproduction of HCV clustering into high poverty neighborhoods. Ultimately, these findings indicate how deeply embedded our housing problems are within our economic system and the need to question the adequacy of market-driven housing policies. If we hope to realize a more socially just city, a rethinking of our rental housing policies is in order.

A Dissertação trata da influência da Ordem Pública na arbitrabilidade das disputas comerciais internacionais, na perspectiva brasileira. Na sua primeira parte, traçam-se as bases teóricas da noção de Ordem Pública e as suas repercussões no ordenamento brasileiro. Na segunda parte, examina-se a Convenção de Nova York de 1958 e, especialmente, o papel que a noção de Ordem Pública desempenha no seu regime. A partir daí, aborda-se a questão da arbitrabilidade e do dever dos árbitros de proferir uma sentenças exequível para se concluir que a observância da Ordem Pública é um requisito de arbitrabilidade, nos termos da Convenção de Nova York de 1958.
The thesis regards the influence of Public Policy in the arbitrability of international commercial disputes, in the Brazilian perspective. In its first part, it sets the theoretical basis of the Public Pulicy notion and its repercussion in the Brazilian legal system. In its second part, it examines the 1958 New York Convention and, especially, the role of Public Policy in the Convention’s regimen. From that point, it analyzes the issue of arbitrability and the arbitrators’ duty to render an enforceable award, to conclude that compliance with Public Policy is a requirement of arbitrability under the 1958 New York Convention.

Given the current political environment in the US, there is great doubt about the future of American policy on climate change. Still, the optimistic future of American climate policy relies on the new group of leaders that have emerged from municipal government. Although local government is traditionally ignored in favor of the publicity of international negotiations between countries, cities have established a role at the forefront of climate policy over the past ten years. These local governments serve half of the world’s population and often are extremely vulnerable to the impacts of climate change, making their contributions more important than ever. Although they face a unique set of difficulties, cities are able to take a range of actions impossible at higher levels of government, reaching communities in unprecedented ways and innovating new policies. This project aims to analyze how local governments fit into the global political regime on climate change, testing the theoretical framework of multilevel governance against reallife examples in Boston and New York City. Further, this paper finds that cities compensate for their relatively small size and limited jurisdiction through a unique set of actions and collaborative relationships, enabling these local actors to become international leaders on this complex global issue

A presente tese tem por objetivo investigar a relação entre o Direito Penal e a prevenção criminal, especialmente, no que se refere à possibilidade de construção de uma Política Criminal, fundada em conhecimentos produzidos pela Criminologia, que seja consentânea com os princípios e garantias do Direito Penal. No primeiro capítulo é apresentada a premissa de que a missão única e exclusiva do Direito Penal em um Estado Democrático de Direito deve ser a de proteger bens jurídicos que sejam valiosos para a preservação de uma determinada sociedade. Essa missão atribuída ao Direito Penal deve considerar os relevantes argumentos apresentados durante os debates realizados no âmbito das teorias da pena. Neste sentido, em que pese a existência de relevantes posicionamentos agnósticos e retributivos em relação à sanção e ao próprio Direito Penal, o conceito de prevenção criminal limitada ainda se apresenta como o mais apto a equacionar os desafios inerentes ao ius puniendi, assim como fundamentálo. Mais do que um sistema teórico complexo, no segundo capítulo visa-se demonstrar como este conceito pode ser viabilizado a partir da construção de uma Política Criminal que, não limitada às respostas jurídico-penais, resulte da relação dialética entre os conhecimentos produzidos no âmbito da Criminologia Crítica e da Criminologia Tradicional. Sob esta perspectiva, a ideia apresentada por Winfried Hassemer de substituição de uma prevenção normativa por uma prevenção organizacional pode subsidiar a construção dessa Política Criminal. Para exemplificar esta hipótese teórica, no terceiro capítulo analisam-se medidas implementadas na cidade de Nova Iorque com a finalidade de enfrentar o problema do Motor Vehicle Theft e que tiveram resultados positivos e consentâneos com o conceito de prevenção organizacional em contraposição com as ações de prevenção criminal desenvolvidas no âmbito dos furtos e roubos de veículos na cidade de São Paulo os quais, por sua vez, focaram em simples alterações de normas, exclusivamente, sob o aspecto de uma prevenção normativa. A distinção de resultados confirma a hipótese de que estudos criminológicos, fundados no conceito de prevenção organizacional, podem subsidiar a construção de uma Política Criminal que previna crimes sem desconsiderar os princípios informadores de um Direito Penal Mínimo.
This doctoral thesis aims to investigate the relationship between Criminal Law and crime prevention, especially with regard to the possibility of building a Criminal Policy founded on knowledge produced in the context of Criminology, which is consistent with the principles and guarantees of Criminal Law. The premise that the sole and exclusive mission of the Criminal Law in a Democratic State of Law must be to protect the legal interests which are valuable for the preservation of a given society is presented in the first chapter. This mission, assigned to Criminal Law, should consider the relevant arguments presented during the discussions held with respect to the \"theories of punishment\". Accordingly, despite the existence of relevant agnostic and retributive positions in relation to sanction and Criminal Law itself, the concept of \"limited crime prevention\" is still presented as the most apt to equate the challenges of ius puniendi, as well as ground it. More than a complex theoretical system, in the second chapter, we aim to demonstrate how this concept may be made possible through the construction of a Criminal Policy which, not limited to legal and criminal responses, results from the dialectical relationship between the knowledge produced within Critical Criminology and Traditional Criminology. From this perspective, the idea presented by Winfried Hassemer of replacing a \"normative prevention\" by an \"organizational prevention\" may subsidize the construction of Criminal Policy. To illustrate this theoretical hypothesis, in the third chapter, we analyze measures implemented in the City of New York in order to address the problem of Motor Vehicle Theft and which had positive results, consistent with the concept of \"organizational prevention\", as opposed to the actions developed under the crime prevention of thefts and motor vehicle thefts in the City of São Paulo, which focused on simple changes in rules and only under the aspect of a \"normative prevention\". The distinction of results confirms the hypothesis that criminological studies, based on the concept of \"organizational prevention\", may support the construction of a Criminal Policy that prevents crimes without disregarding the informing principles of Minimum Criminal Law.

Este projeto tem como objetivo central analisar a formação da coleção latino-americana do Museu de Arte Moderna de Nova York (MoMA), entre 1931 e 1943, buscando entender as relações entre política e cultura. Essas balizas cronológicas se abrem com a primeira exposição do pintor mexicano, Diego Rivera, ocorrida em 1931, e se fecham com a primeira exposição coletiva de artistas da América Latina no MoMA, em 1943. Por meio da análise do extenso catálogo publicado sobre a coleção, pretendemos acompanhar a sua criação e os principais atores envolvidos nesse empreendimento. Pensamos que o texto tinha a finalidade de justificar artisticamente a formação da coleção e de mostrar uma determinada visão sobre a arte da América Latina. Entendemos que a coleção está conectada com as perspectivas da chamada Política da Boa Vizinhança, que marcou as relações entre os Estados Unidos e os países da América Latina nesse período.
This dissertation aims to analyze the making of the Latin American Collection of the Museum of Modern Art (MoMA) in New York, between 1931 and 1943, emphasizing the relationship between politics and culture. It begins with the first exhibition of a Mexican artist, Diego Rivera, at the Museum, which took place in 1931, and it ends with the first exhibition of Latin America artists in 1943. Our main source is the extensive catalog of the collection that presents the actors and the ideas involved in the project. The relevance of the collection is connected to the so called Good Neighbor Policy, which designed the international relations between the United States and the countries of Latin America in the period between 1933 and 1945.

Objetivo: Este estudo teve por objetivo descrever e analisar as políticas e estratégias de controle da poluição do ar no meio urbano, com vistas a melhorar a qualidade do ar e apto a servir como referência para outras cidades em face de problemas críticos de poluição do ar. Usando os casos de Nova Iorque, São Paulo e Paris, este estudo destaca as diferentes políticas e tendências de gestão previstas nas três cidades, fornecendo uma caracterização destes três centros, descrevendo o período global e legal de desenvolvimento das principais políticas e destacando as principais estratégias implementadas ao longo dos últimos vinte anos. Metodologia: Tendo como abordagem um estudo múltiplo de caso, um primeiro componente fundamental da pesquisa consistiu na caracterização das três cidades, fornecendo dados sobre tendências das médias anuais da poluição do ar no que se refere a níveis de NO2, PM10, PM2.5, Ozônio e SO2 ao longo dos últimos quinze anos, apresentando uma visão geral dos meios de transporte e das frotas de veículos, e descrevendo as principais políticas desenvolvidas nas três cidades. Em seguida, a pesquisa propõe uma categorização das principais estratégias aplicadas, usando as abordagens de gestão da poluição do ar (regulatório, incentivos econômicos e outros) da OECD (Organização para a Cooperação e Desenvolvimento Econômico) para visualizar as escolhas estratégicas empregadas. Então, os resultados são condensados na matriz de análise SWOT e complementada a análise com sugestões de uma abordagem da qualidade do ar com maior inclinação para os direitos humanos. Resultado: Se prazos e contexto local variaram de uma cidade para outra, as três cidades têm um percurso histórico geral semelhante no desenvolvimento de certas políticas em oposição a outras. Níveis totais de poluição atmosférica têm diminuído ao longo dos últimos quinze anos, mas os níveis de poluição do ar continuam acima do que é recomendado nas diretrizes da OMS (Organização Mundial da Saúde). As cidades diferem no desenvolvimento de estratégias. De acordo com os critérios da OECD, se as abordagens reguladoras são uma tendência comum às cidades na redução dos níveis de poluição do ar, elas diferem na forma e até na extensão de seu investimento em mobilidade e transportes públicos e na matriz energética escolhida. Outra descoberta incluiu o desenvolvimento de incentivos econômicos, dados disponíveis e inclusão da indústria automobilística em questões ambientais. Elas têm em comum a capacidade tecnológica para desenvolver combustíveis de energia mais limpa e fomentar meios de transporte não-motorizados. No entanto, as disparidades em opções de transporte, infraestrutura e na distância entre trabalho e residência pareceu ter impacto sobre o uso de veículos privados, em parte devido à dificuldade de acesso da residência a transportes públicos disponíveis, além de opções políticas dos governos locais. Isto é particularmente verdadeiro no que tange a população de renda média, que constitui a grande parcela que faz uso de automóveis próprios, e população de baixa renda. Conclusão: abordagens regulatórias são estratégias historicamente preferidas no controle da poluição do ar, especificamente no caso de episódios de poluição do ar a níveis críticos, mesmo quando a cidade já fomenta sua rede de transporte público. Há melhorias a serem feitas em prol da qualidade dos índices relativos à poluição do ar em cada cidade e também pela melhor compreensão da contribuição e dos impactos das emissões veiculares na qualidade do ar. O foco na tecnologia veicular é uma escolha que só pode ser complementada se mais estratégias de transporte limpo atingirem um número maior de habitantes. Além disso, se é importante o compartilhamento de tecnologia e know-how entre as cidades, isso só pode ser feito se estudos prévios forem realizados localmente e se os moradores estiverem envolvidos no processo de tomada de decisão. Caso contrário, conforme as políticas de poluição do ar forem sendo desenvolvidas, elas correm o risco de fracassar. Para este fim, a abordagem da poluição do ar baseada nos direitos humanos poderia ser uma opção para o progresso das estratégias mais inclusivas no tratamento da qualidade do ar e de seu compartilhamento.
Objective: The objective of this study was to describe and analyze urban air pollution control policies and strategies, with the goal of improving air quality and serving as a reference for other cities facing critical air pollution issues. Using the cases of New York City, São Paulo and Paris, this study highlights the different policies and management tendencies practiced in the three cities, by providing a characterization of the three centers, describing the global and legal timeframe of the development of main policies and highlighting major strategies implemented over the last twenty years. Methodology: Using a multi-case study approach, the first component of the research consisted of characterizing the three cities, providing data on air pollution yearly average level trends of NO2, PM10, PM2.5, Ozone and SO2 over the last fifteen years, giving an overview of modes of travel and the local vehicle fleet, and describing the main policies undertaken in the three cities. Then, the study proposed a categorization of the main strategies applied using OECD air pollution management approaches (regulatory, economic incentives and others) to foresee strategic choices employed. Finally, the results were synthesized with a SWOT analysis matrix and complemented with suggestions based on a human-rights approach to air quality. Results: While the timeframe and local context differed from one city to another, in general the three cities followed a similar historical pathway to developing certain policies as opposed to others. Overall levels of atmospheric pollution have decreased over the last fifteen years but air pollution levels continue above WHO recommended guidelines. The cities differ in the development of strategies used. According to OECD criteria, if regulatory approaches to air pollution are commonly used to lower air pollution levels, cities differ in the way and extent to which they have invested in mobility and public transportation and the chosen energy matrix. Another finding included the development of economic incentives, available data and inclusion of the automobile industry into environmental issues. While the three cities do have technological capacity to develop cleaner energy fuels and foster non-motorized modes of transports in common, disparities in transportation options, infrastructure and distance to and from work appeared to have an impact on the use of privately owned vehicles. This is partly due to the lack of available public transportation in residential neighborhoods and local governments political choices. In particular, this impacted low- and middle-income populations the most as they constitute the majority of car owners. Conclusion: Regulatory approaches have historically been the primary tool used to control air pollution. This is especially true when pollution has reached critical levels even when there is widely-used, reliable public transportation. There are some improvements to be made to advance the quality of the data related to air pollution in each city and to better comprehend the effects and long-lasting impacts of vehicular emissions on air quality. Focusing on vehicle technology is a choice that can only be complemented if more integrated clean transportation strategies reach a greater number of city inhabitants. Furthermore, technology and know-how are important factors which must be transferred from one city to another and must take into account past local studies as well as input from local communities. If not, as air pollution policies are being developed, they run the risk of failing. To this end, human-rights based approach to air pollution must be an option to progress towards more inclusive strategies and their replication.
