In 2018-2022, a series of studies was conducted in the experimental plots of the Novocherkassk branch of Potapenko All-Russian Scientific Research Institute of Viticulture and Winemaking (Novocherkassk, Rostov Oblast) using conventional viticulture methods and GOSTs. A comparative study of the Joy grape, a new promising resistant seedless cultivar of the University of Arkansas (USA), and the Venus grape, one of the first seedless cultivars of the same institution, was carried out. The growing characteristics included the following: uncovered, unwatered, grafted, Berlandieri×Riparia Kober 5B rootstock, 3.0×1.5 m planting scheme, fan-shape formation on the middle stem. Agrobiological indicators, phenological observations, productivity, chemical and technological data, as well as tasting evaluations of fresh and dried grapes, are presented. During the study period, the preservation of buds in the Joy and Venus plants was 78.3 % and 80.1 %, respectively. Although the indicators of shoot fruitfulness and fruiting ratio were high in both cultivars, Joy showed a higher average weight of bunches and berries compared to Venus (311 and 282 g; 3.1 and 1.6 g, respectively). The yield was 13.8 t/ha and 12.4 t/ha, respectively. Both cultivars proved to be highly resistant to major grape diseases; in 2021, Joy grape bunches were slightly affected by mildew at the level of 2.5 points. The mass concentration (average for the study period) of sugars in Joy and Venus plants comprised 20.2 g/100 cm3 under the titratable acidity of 6.8 g/dm3 and 19.3 g/100 cm3 under the titratable acidity of 7.3 g/dm3, respectively. The conclusion is made that the studied cultivars present interest for cultivation as table wine and raisin varieties in areas with sufficiently moderate climate due to their high yield and seedless characteristics. These cultivars are recommended for possible expansion of vine plantations and further use in breeding.

Regarding the accelerated innovation in the 21st century, the article suggests modifying the spatial principles of Research Institutes as isolated institutions. The 21st century Research Institute should reflect the increasing levels of openness and security in modern information exchange methods. Thus, the Institute reveals invisible information processes in the physical urban environment, becoming the urban centre of innovation, a new workplace and leisure centre, as well as a catalyst for enhancing the city’s sustainability. The article analyses the historical paradigm of effective methods for introducing innovation to the urban environment, as well as modern socio-economic needs of innovative research institutes in the city. As a result, a unique organizational structure and functional programme of a new Research Institute are suggested. The Institute directly participates in enhancing the urban environment and forming a new lifestyle of the city dwellers. New spatial principles of such buildings are also proposed, updating the architectural typology of Research Institutes in the 21st century. Due to the increased interaction with the urban environment, the Research Institute and the city are mutually transformed. This contributes both to increasing the Institute’s efficiency and raising the city’s economic potential and life quality.

The objective of this study was to investigate the social representations of students from the Tecnologia em Gest?o Ambiental do Instituto Federal Goiano ? Campus Uruta?, on concepts related to the Cerrado and what is its importance to the environment in general and contrast the speech of these representations with scientific knowledge, considering that this biome has become the main alternative for expanding agriculture and cattle raising frontier in Brasil, because it has a mainly flat with ease to the possibility of mechanization and irrigation water availability in the region. The research is a qualitative approach, where we designed a semistructured questionnaire with questions related to the Cerrado and their forms of preservation. The methodology is based on analysis of the collective subject discourse (DSC) according to Moscovici's theory of social representations. The target audience were nineteen students from the sixth grade of the second half of 2010 and twenty-two students from the first grade of the first half of 2011, of the Course Tecnologia em Gest?o Ambiental of the Instituto Federal Goiano ? Campus Uruta?, to make a comparison of students when they start the course and when they finish, watching if the students in the DSC of the sixth period, there have been advances in scientific knowledge regarding the Cerrado, when compared with the DSC students of the first period. Participation in the survey was voluntary, and participants had to submit a term of informed consent, because it is a study in humans, according to the National Council of Ethics. The results found that the DSCs was both the first and sixth periods are very similar, and the cerrado objectification appears with the presentation of the State of Goi?s, suggest agriculture and cattle raising as the best option for investment in productive arrangements for the cerrado, and still, emphasize the richness of biodiversity in the Cerrado. But the responses of students in the sixth period had more coherent texts in relation to scientific knowledge, proving that there was increase in knowledge, some even suggesting alternatives to mitigate the conflict between agriculture and cattle raising production and environmental conservation

The proposal of the present work is the presentation of a case study of fund raising with alumni from two Brazilian Higher Education Institutions, the FGV-EAESP and the Mackenzie; analyzed through the lens of relationship marketing. The referenced presentation resulted from the practical experience of these two institutions, making it possible to prove the importance of the relationship of these institutions to their alumni, representing much more than a source of sustainability. It signifies the continuity of the institutions, since the main purpose of the relationship is to keep strong the bonds of the alumni with their alma mater. For that, interviews with the leaders and fundraisers of the two institutions have been performed, with the intention to elucidate how the fundraising process with the alumni started, the techniques of making solicitations, and the results. The problem of the research follows from the question: how can relationship marketing contribute to fundraising with alumni of these institutions? Starting from the analysis of the fund raising developed by the two institutions with their alumni, it arrives at the central point of work, which is the analysis of the influence and the interposition of the relationship in relation to the results obtained from the fund raising. The approach of Relationship Marketing is appropriated to fund raising in non profit institutions and its relevance is essential in this research to understand the cases described and explain the successes realized. It is concluded that the tools of relationship marketing have been partially applied in the two institutions and resulted in success in fund raising, as can be confirmed in the respective financial results. The most important aspect is the commitment to keeping the relationship, by means of communication, information technology, and involvement. However, the alternation of power in the governing body of both institutions interrupts the leadership of fund raising, a fundamental factor for the success of this type of action with alumni. Without the maintenance and the continuity of the relationship with the alumni, the fund raising sector loses position in strategic planning, becoming weakened or completely abandoned

Background: The National Institutes of Health Stroke Scale (NIHSS) is a widely used tool for quantification of stroke severity. However, prior studies suggest that this scale does not equitably assess the 2 hemispheres, reporting that the volume of right hemisphere (RH) lesions is underestimated. This is probably due to the fact that NIHSS attributes 2 points for neglect and 7 for language. While empirical assessment could suggest better functional outcomes for patients with neglect than for those with aphasia, some authors have reported that neglect is associated with worse functional outcomes. Objectives: The aims were: a) to compare the correlations between the lesion volume of RH stroke and the NIHSS score from patients with neglect and without neglect and b) to study if a modification of the neglect scoring rules would increase the predictive capacity of the lesion volume. Methods: Patients with right middle cerebral artery ischemic stroke were divided in two groups: patients with neglect and patients without neglect at admission. We correlated NIHSS scores and lesion volume in both groups and calculated the partial correlation between lesion volume, NIHSS and the variable group. Finally, we applied different modifications in the neglect scoring rules and repeated the statistical analysis. Results: The correlation between lesion volume and NIHSS was lower in patients with neglect and neglect was a statistically significant covariate in the partial correlation analysis between NIHSS and lesion volume. With the neglect score tripled and with the sum of all neglect modalities doubled and tripled, the correlation between lesion volume and NIHSS was significantly higher than the correlation with the standard NIHSS and the partial correlation between lesion volume and the variable group, controlling for NIHSS, became no longer a statistically significant factor.

The current training report comes up in the field of a Master’s Degree in Education, in the area of a specialization in Adult Education and Communitarian Intervention. This professional training took place at M.P.V. Institute, aiming at promoting, sensitizing and developing chain partnerships with public or private entities and individual’s from the Póvoa community to constantly carry out the mission and goals of this institution. The Portuguese society still undergoes economic disparities, which generates situations of social and economic vulnerability in many families’ life. The M.P.V. Institute’s job is to fulfill those needs through the support in children and young people’s education and formation, from the 3 (three) years old to the conclusion of compulsory schooling, and other aspects of first need such as food and hygiene. To achieve this job and these goals it is necessary to raise funds and goods that make them possible, since the subsidies provided by the Portuguese government are not enough to face the monthly expenses and commitments. Besides, the monthly value paid by each child or young person is trifling, being merely of a responsible nature. For that reason the M.P.V. Institute needs to resort to initiatives that may generate funds and appeal to public and private entities, asking for contributions and donations. Therefore, to make the local community aware of this premise, the project was developed in an investigation-action plan, related to the areas of Adult Education and Communitarian Intervention, through activities according to the needs and difficulties of the M.P.V.I., so that these could be minimized and allow a major action towards an inclusive society.

Thesis (Master's Degree in Technology: Entrepreneurship), Durban Institute of Technology, 2003.
Over the last decade computer technology has impacted tremendously on the survival and productivity of organisations. In today's technologically advanced business environment, much emphasis is being placed on obtaining a competitive advantage through the use of computers - a commodity that has become available to almost everyone in an organisation. Increasing global competition and pressing social needs have impacted with such vigo~ that even tertiary institutions are now facing major financial constraints, thus forcing them to investigate alternative sources of income to maintain sustainability. Through the use of computer technology - searching, retrieving, sorting, producing and organising data efficiently and accurately - the belief is that many departments at the M L Sultan Campus of the Durban Institute of Technology can be converted into income-generating units that can be self-sustaining. There are many departments at the M L Sultan Campus with the relevant infrastructure and person-power to establish business units. These departments vary in the services that they provide, thus relevant information systems need to be aligned to future business units within these departments. This study focuses on a) investigating the impact of information technology and its systems on businesses; b) ensuring that information technology and its systems is looked at a~ a cost effective resource for maintaining a competitive edge and promoting business value. The interaction of business processes, people and technology will ensure successful planning and implementation of strategies within the potential business units; and c) recommending to selected departments the expected fmdings whereby they could choose to adopt these recommendations to transform themselves into business units in order to maintain a competitive edge for financial sustainability.

Body dissatisfaction is a significant concern with severe and persistent consequences. Thus, there is a need for effective prevention and early intervention strategies that can be delivered in a timely and efficient manner, such as within the context of schools by teachers. There have been calls within the field for researchers to evaluate existing interventions under diverse conditions prior to global dissemination, and adopt an ecological approach by extending interventions to include parents. The project included two consequative studies conducted two-years apart. The first study aimed to identify effective intervention strategies for improving body image outcomes in Year 8 girls. Heeding calls for rigorous and independent evaluation of existing programs under varied conditions, Study 1 aimed to replicate the UK school-based body image program Dove Confident Me (DCM) among a selective population of adolescent girls in Australia. Expanding on Study 1, Study 2 aimed to improve body image outcomes for both Year 8 girls and their mothers. The second study evaluated a modified version of DCM alongside an investigation of Raising Confident Girls (RCG), a school- based 3-session seminar delivered to mothers. Further, the thesis aimed to understand factors contributing to improved parental uptake in body image programs and to examine whether extending classroom-based interventions to include mothers enhances the effectiveness of outcomes in daughters. Study 1, involving teacher delivery of DCM to Year 8 students (n=198) attending an independent girls’ school in Australia, hypothesized that compared to the control group (n=208), girls receiving DCM would report significant improvements in body image and psychosocial outcomes, alongside reduced severity of known eating disorder risk factors and behaviours. Multilevel mixed modeling analyses revealed significant intervention effects for social comparison and sociocultural pressure, but not in the direction hypothesized. A lack of teacher confidence with delivery, limited student engagement with the UK version of the program, and poor student-teacher relationship due to a timetable issue were highlighted as areas for improvement. Study 2, answered calls within the body image field to develop both etiological and ecological programs by conducting a second replication of a modified version of DCM and the addition of a parental intervention Raising Confident Girls (RCG) delivered to mothers. The modified DCM program was delivered to Year 8 students (n=242) and outcomes were compared with a control group (n=354). Despite significant improvements in acceptability and engagement ratings, the modified DCM program did not improve body image outcomes for participants. Interestingly, the intervention group reported a significant increase in both internalization of the thin-ideal and perceived sociocultural pressure following participation in the intervention. Raising Confident Girls (RCG), was delivered to Year 8 mothers (n=69) and outcomes were compared with a control group (n=51). Multilevel mixed modelling analyses revealed that mothers who participated in RCG reported significantly greater body esteem and body appreciation compared to the control group. Further, as predicted, participation in RCG improved a mother’s knowledge, confidence and skills parenting an adolescent girl, and improved her positive role modeling for her daughter with respect to body image. Receiving high acceptability ratings, strong engagement and low attrition rates, the RCG program appeared successful in overcoming long held difficulties with engaging parents in body image interventions. Finally, Study 2 examined whether students completing DCM benefited from having their mother attend RCG. Students whose mothers participated in RCG demonstrated a significant change in appearance-based talk at 3-month follow-up compared to students whose mothers were not involved in RCG. Additionally, there were noticeable improvements in a number of body image outcomes from pre-test to post-test for the group of students whose mothers attended RCG, however none of these findings reached significance. The study offered valuable insights towards increasing our understanding of transfer of parent intervention outcomes to daughters. The findings of the thesis contribute knowledge to the field of research regarding body-image intervention for adolescent girls and their mothers, in addition to providing practical insights for schools intending to implement body image interventions. Specifically, the study draws attention to the complexities of global dissemination and the limitations of using selective and universal programs interchangeably. The thesis highlights that while researchers are experts in etiological theory, school personnel are experts regarding their community. Cognizant of this, researchers are encouraged to work together with school personnel to develop school-based resources malleable in content and design, but robust enough to sustain effectiveness when adapted to suit diverse school environments. While the findings add to the growing body of research supporting task-shifting facilitation of body image programs to teachers, findings suggest that a strong student-teacher relationship and perceived credibility and competence of facilitator can be as essential as content of program. The thesis provides deeper insight into improving parental engagement in body image interventions delivered within the school context. Specifically, the findings emphasize the importance of tailoring the intervention to suit the needs of the parent group and suggest that the process of delivering a parent program is as important as the content of the intervention. Finally, the study reveals that providing an intervention to mothers alongside a classroom-based intervention for students enhances outcomes for daughters. Overall, the thesis supports the premise of extending classroom-based body image interventions to include parents, and identifies a number of recommendations for further research.

Annotation:
For over a decade this study followed designs for emissions trading schemes (ETS) that have emerged in response to global warming. An ETS is considered a cost-effective instrument to mitigate pollution (UNFCCC, 2006). Early in this study indications were that several operational ETSs struggled to achieve their emission reduction goals. Considering this problem, the study looks at the competing constraints of acceptance, effectiveness, and emissions reduction. The parameters of an ETS can be adjusted in relation to these constraints and the study also considers the alignment of nine design factors to these constraints. The design factors considered are legislation, governance, compliance, rules, compensation, targets, phasing-in, coverage and the distribution of allowances. It emerges that adjustments in terms of factor alignment may affect a schemes ability to reduce emissions. Other important factors sit outside the scope of this study, i.e. variations in greenhouse gas emissions as a result of the GFC and later COVID-19, also alternative mitigation policies, human adaptation, and innovative technologies. Viewed in a comparative manner the main case studies are the antecedent US Acid Rain Program (US ARP), the European Union Emission Trading System (EU ETS) and the US Regional Greenhouse Gas Initiative (RGGI). Other ETS designs that provide data for the study include the UK Emissions Trading Scheme (UK ETS), the Carbon Pollution Reduction Scheme (CRPS), which later became known as the Australian Carbon Tax, and the Californian Cap and Trade Program (CCTP). An effective ETS may perform adequately in relation to its’ goals for governance and compliance, although it can be shown that if the design leans too far toward acceptance the capacity for emissions reduction is diminished. According to the conceptual framework developed early in the study, over time the relationship between the constraints and the design factors should be revised toward reducing emissions.

AbstractThe availability of clean planting materials and functional seed regulatory systems is indispensable for fostering a sustainable seed yam system. The Yam Improvement for Income and Food Security in West Africa (YIIFSWA) project of the International Institute of Tropical Agriculture (IITA) developed the capacity of National Agricultural Research Institutes (NARIs) in their use of standardized Temporary Immersion Bioreactor (TIB) and Vivipak (VP) systems for high-ratio propagation and post-flask handling of yam breeder seed plantlets. Foundation seed was enhanced by supporting five private seed companies in Nigeria and three in Ghana. They were equipped with aeroponic and hydroponic technologies for foundation seed tuber production using single-node vine seedlings. For certified seed, seed yam out-growers were trained in good agronomic practices and entrepreneurship for certified seed tuber production using the adaptive yam minisett technique (AYMT). New certification standards were established for various classes of seed produced using different propagation methods and quality assurance procedures in Ghana and Nigeria. The capacity of the national regulatory organizations in both countries was enhanced to implement seed quality control and certification. Increased public sensitization and advocacy were done to raise awareness among relevant stakeholders to enhance the uptake of the seed propagation technologies and ensure a smooth interaction between the public and private sectors. This chapter summarizes the accomplishments of YIIFSWA in Ghana and Nigeria and the spillover impact on the yam belt of West Africa and beyond. The key lessons could inform the design and implementation of more effective seed projects, especially for vegetatively propagated crops.

AbstractHigher education in refugee contexts has, in recent years, emerged as a key humanitarian response and development imperative within the international forced migration management space (ECRE 2016). Humanitarian organizations and authorities active in the global forced migration management system have, to varying degrees, instituted and facilitated access to higher education opportunities for many refugees within the confines of refugee camps or the close proximity of host communities (Ferede 2018). Under the broad, sometimes vague, guidance of global development initiatives such as the sustainable development goals (Sawadogo 2016), the raison d’etre of higher education has been positioned as an enabling tool for the economic, social and emotional empowerment of refugees (Brugha and Hollow 2017).

AbstractGender equality in research and innovation (R&I) has improved over the past two decades, although not without its ups and downs. The literature has pointed out the obstacles and difficulties in making gender equality effective in R&I while providing a wide range of strategies, methods and tools to achieve it. Responsible Research and Innovation (RRI) is a new approach that has made gender equality one of its six keys, raising a new challenge for gender mainstreaming. The Horizon Europe Framework Program 2021–2027 represents a step forward, with the Gender Equality Plan as a reference tool for mainstreaming gender in R&I organizations. However, there are more comprehensive proposals, such as the European Institute for Gender Equality’s Gender Mainstreaming Platform. This chapter presents the platform’s content and shows its usefulness in helping prepare Gender Equality Plans and promoting the institutional transformation of R&I organizations.

Тhe notary public institution is one of the most important institutes of modern law which contributes to a greater degree of legal certainty, prevention of disputes, and relief of the courts. With the adoption of the Notaries Act in 2011, public notaries have been introduced into Serbian law. Therefore, this profession gains increasing importance in contemporary legal transactions, and raises a number of controversial issues, since it is a about a new institute in Serbian legal system). One of these issues concerns the legal position of notaries. The legal position of a notary public depends on the type of notary form adopted in a single legal system, on the specificities of that legal system and its legal tradition, as well. In order to answer this question, the paper provides a comparative overview of the forms of organizing the notary service, represented in comparative legal systems and their dominant legal nature, as well as social function, which significantly defines the legal position of notaries.

The main aim of this article is to outline the findings of a grid-based review process (Caputi et al., 2012; Fransella et al., 2004) directed at literacy and numeracy (LN) practices documented by the literacy team in the institute’s evidence-based LN compliance reports for a four-year period (2017–2020). Outlined is the author-reviewer’s use of a repertory grid to address two research questions: How could a repertory grid be used to explore his constructs (as a reviewer) and show how these constructs were interconnected? How could the repertory grid findings raise his and his team’s awareness of hidden meanings in his construing? Hence, the focus of convenience of the grid was defined as follows: Reviewing LNembedding practices at a tertiary institute in Aotearoa from a business strategy perspective. The ten most recent institutional LN compliance reports and a selection of six schools of business strategy served as sources for identifying 12 elements to be used in constructs elicitation. The so-called difference method was applied in formulating 12 bipolar constructs for the review. The author then donned the reviewer’s hat, rating each element on a 7-point rating scale for the 12 constructs – this yielded a 12 x 12 matrix of data for analysis. The Statistical Package for the Social Sciences (Version 27) (IBM Corp, 2020) was used to perform a principal components analysis (PCA). Five components, explaining 81.25% of the variance in the grid ratings, were identified. These components highlighted the underlying structure and connectedness of the constructs elicited for the review, uncovering five themes: deliberate innovative practices, solution-centred transformation, deliberate evidence-based tracking, contesting contentious LN practices, and flexibility and responsiveness to unintended events in the educational setting. The conclusion was that anyone performing a review or reflective activity could profitably use repertory grids to raise their awareness of hidden meanings in their construing.

The introduction of class actions as a typical common law institute into the Czech legal environment raises a number of doubts among theorists and practitioners of the legal community, a certain wave of criticism, but also a lot of conceptual questions. The contribution deals with the most important question, whether this procedural tool originating from a different legal environment, has its place in our legal system, and especially whether it can be effectively used in practice. Its goal is to give an unconventional view of this question and to answer it through the theoretical-legal definition of the very possibility of the transfer of a given institute from one legal system to another, i.e. with the help of the so-called theory of legal transplants. Although class actions are an institute of the civil procedural law (within the continental legal system), the following contribution is on the border between comparative law and procedural law. For while the reception of Roman law in Europe has been a subject of scientific studies for more than a century, the question of legal transplants or reception as a general phenomenon has only been in the sights of scientific projects since the 1970s, while this topic is mostly the subject of comparative law.

<div class="section abstract"><div class="htmlview paragraph">Mechanical drawing plays an important role in managing, designing and implementing engineering projects, especially in the field of the automotive industry. The need for accuracy in element design and manufacturing is greater now than ever before in engineering industries. In order to increase accuracy, the part design and function must be clearly communicated between the design engineer and the manufacturing technicians, especially in automotive industry and feeder industries projects. Geometric Dimensions and Tolerances (GD&amp;T) system of elements determines the quality, importance and price of the designed product. The standard used in the United States to define GD&amp;T methodology is ASME Y14.5-2009 while the standard used in Europe is ISO 1101-2017. This article discussed the importance of using GD&amp;T system including the types of geometrical features, limitations and accuracy, datum references frame and feature control frame to handle these symbols seamlessly. Moreover, the paper included a proposal to draw and design a drive shaft as a mechanical element to become a prototype when manufactured, with the aim of distributing it to achieve the highest possible quality. The performance evaluation was verified by distributing closed-ended questionnaires with a Likert scale of five answer choices. The sample size of students who provided answers was 33 students from the mechatronics engineering program. The results showed that more than 86% of mechanical drawing students showed great interest in the GD&amp;T system lecture on the proposed drawing-sheet. While more than 83% were very satisfied with the inclusion of the GD&amp;T system in the proposed mechanical drawing-sheet. In addition, the drawing and design took into account that the project operations are carried out with the least amount of waste of raw materials and reduce project risk. This is for the purpose of raising the educational and skill level of students in engineering colleges and higher institutes and technicians in automobile companies and their feeding industries.</div></div>

Rapid development of modern technology and its increasing complexity make high demands to the quality of training of its users. Among others, an important class is vehicles, both civil and military. In the teaching of associated subjects, the accepted hierarchy of teaching aids includes common visual aids (posters, videos, scale models etc.) on the first stage, followed by simulators ranging in complexity, and finished at real vehicles. It allows achieving some balance between cost and efficiency by partial replacement of more expensive and elaborated aids with the less expensive ones. However, the analysis of teaching experience in the Military Institute of Armored Forces of National Technical University “Kharkiv Polytechnic Institute” (Institute) reveals that the balance is still suboptimal, and the present teaching aids are still not enough to allow efficient teaching. This fact raises the problem of extending the range of available teaching aids for vehicle-related subjects, which is the aim of the work. Benefiting from the modern information and visualization technologies, we present a new teaching aid that constitutes a spherical (360° or 3D) photographic panorama and a Virtual Reality (VR) device. The nature of the aid, its potential applications, limitations and benefits in comparison to the common aids are discussed. The proposed aid is shown to be cost-effective and is proved to increase efficiency of training, according to the results of a teaching experiment that was carried out in the Institute. For the implementation, a tight collaboration between the Institute and an IT company “Innovative Distance Learning Systems Limited” was established. A series of panoramas, which are already available, and its planned expansions are presented. The authors conclude that the proposed aid may significantly improve the cost-efficiency balance of teaching a range of technology subjects.

Education is a lifelong process where a learner is constantly raising their bar. Life itself is a journey of personal growth and development and therefore the classroom curriculum should reflect the world around us. It should help the learner understand what’s going on around her. Education should be about studying to learn and not learning to study. The role of a teacher is to help a learner understand the process of learning to learn. This takes more precedence now than ever before as we move into a decade that does not resemble anything that we have witnessed in the past. Education, just like us, needs to be Wholistic – one that is dynamic, responsive, and open to new ideas and change. HundrED and Druk Gyalpo’s Institute, Bhutan collaborated to identify and showcase innovations in the South and South East Asia region that focus on holistic education.

Lewis, Dustin, Naz Modirzadeh und Jessics Burniske. The Counter-Terrorism Committee Executive Directorate and International Humanitarian Law: Preliminary Considerations for States. Harvard Law School Program on International Law and Armed Conflict, März 2020. http://dx.doi.org/10.54813/qiaf4598.

Annotation:
In developing international humanitarian law (IHL), States have aimed in part to lay down the primary normative and operational framework pertaining to principled humanitarian action in situations of armed conflict. The possibility that certain counterterrorism measures may be instituted in a manner that intentionally or unintentionally impedes such action has been recognized by an increasingly wide array of States and entities, including the United Nations Security Council and the U.N. Secretary-General. At least two aspects of the contemporary international discourse on intersections between principled humanitarian action and counterterrorism measures warrant more sustained attention. The first concerns who is, and who ought to be, in a position to authentically and authoritatively interpret and apply IHL in this area. The second concerns the relationships between IHL and other possibly relevant regulatory frameworks, including counterterrorism mandates flowing from decisions of the U.N. Security Council. Partly in relation to those two axes of the broader international discourse, a debate has emerged regarding whether the U.N. Security Council may authorize one particular counterterrorism entity — namely, the Counter-Terrorism Committee Executive Directorate (CTED) — to interpret and assess compliance with IHL pertaining to humanitarian action in relation to certain counterterrorism contexts. In a new legal briefing for the Harvard Law School Program on International Law and Armed Conflict (HLS PILAC), Dustin A. Lewis, Naz K. Modirzadeh, and Jessica S. Burniske seek to help inform that debate by raising some preliminary considerations regarding that possibility. The authors focus on the possible implications of States and other relevant actors pursuing various responses or not responding to this debate. One of the authors’ goals is to help raise awareness of this area with a focus on perspectives drawn from international law. Another is to invite a broader engagement with the question of the preservation of the humanitarian commitments laid down in IHL in a period marked by a growing number — and a deepening — of the intersections between situations of armed conflict and measures to suppress terrorism.

La recherche était basée au Firoz Lalji Institute for Africa, London School of Economics.
