This article analyses the decisions on public policy contained in the Kluwer Arbitration database. The database includes more than 1,000 cases. Objections based on public policy have been raised in 44% of recognition and enforcement proceedings and in 38% of setting aside proceedings. The success rate of these objections was low, 19% and 21%, respectively. This article discusses the decisions in which these objections were successful, distinguishing between the three International Law Association categories: (i)‘violation of fundamental principles, procedural public policy, or substantive public policy’; (ii) ‘loi de police’; and (iii) ‘violation of international obligations’ (though there were no successful objections in this category). This study aims to analyze the acceptability of the implementation of teacher management transfer policies in South Sulawesi Province. This qualitative descriptive study describes and analyzes the acceptability of teacher management transfer education policies at the Education Office of South Sulawesi Province. The research method with a descriptive approach. Data was collected by interviewing teachers and implementers involved in implementing the transfer of management policy. The data analysis used is descriptive. The results of the study indicate that the acceptability of teachers and managers of SMA/SMK in South Sulawesi Province shows their acceptance of this policy. From the initial reaction, there were good expectations for the implementation of this policy, even though there were still some obstacles at the beginning of the management process, such as late salaries that occurred due to changes in administrative processes and coordination across districts geographically, South Sulawesi Province was quite extensive.

The article explores the legal institution of transnational public policy, which is unfamiliar in Russian judicial practice. This type of public policy is usually only mentioned in passing in studies dealing with the application of the public policy clause. Meanwhile, the transnational public policy is a quite complex legal phenomenon, on the legal nature and even application expediency of which, there are diametrically opposed opinions. The disputes concerning transnational public policy largely stem from the more global contradictions caused by the existence of various theories about the legal nature of international arbitration. At the same time, the transnational public policy is no longer exclusively a theoretical construction and is used by international commercial and investment arbitrations, although infrequently. The arbitrators’ concerns when using this legal institution are due to the uncertainty of its content, the lack of a stable practice of use, as well as an understandable reluctance to justify their own conclusions in their award by referring to a dubious (from the position of the national court, which will subsequently enforce such an award) legal concept. Meanwhile, rare cases when arbitrators nevertheless decided to resort to a reference to a transnational public policy become the object of close attention of foreign researchers as examples of a very progressive approach to dispute resolution and argumentation of decisions made. The article defines and compares the main theoretical views on the essence and content of the transnational public policy, examines the practice of its application by international commercial and investment arbitrations, and also examines the possible prospects for its application by national judicial authorities. The opinions of researchers, including negative ones, regarding the viability of the concept of transnational public policy itself are also presented. The major material for the study were foreign scientific articles, which set out various views on the legal nature of the transnational public policy, as well as a few examples from international arbitral practice. Based on the results of the study, conclusions are drawn about the prospects of transnational public policy application by state courts, as well as about the feasibility of its use by international commercial and investment arbitrations.

Purpose – Although there is great deal of research on export assistance programmes in developed countries, studies on developing countries in Africa has received scant attention in the literature. Lack of detailed information in many developing African countries makes it difficult to assess the effect of export promotion programmes (EPPs) on the firm’s export performance in foreign markets. The purpose of this paper is to explore entrepreneurial development in the value-added export sector of Ghana and screen EPPs provided by public policy makers to examine the impact of these programmes on export performance of Ghanaian firms in foreign markets. Design/methodology/approach – A conceptual/exploratory paper is developed with discussion. Findings – The paper suggests that the ability of exporters to enhance their performance is driven by the usage of outside market access, export development/training and information related export assistance programmes offered by public policy makers. Utilisation of EPPs builds experiential knowledge which serves as a source of competitive advantage for exporters to implement effective marketing mix strategies to enhance performance. Practical implications – The study underscores the specific EPPs export managers can utilise to enhance performance and improve their international marketing strategy in foreign markets. Public policy makers need to work together with exporters to incorporate and develop programmes to suit the idiosyncrasies of foreign markets and boost the growth of value-added exports. Originality/value – The study explores past literature to screen and evaluate the effect of EPPs and entrepreneurial development to boost export growth in Ghana – Sub-Sahara Africa.
