In the absence of general provisions on the topic, the research focused on understanding the relevance attributed to anonymous reports by italian public law, both substantive and procedural. Much has been written on the subject of anonymous documents in the field of criminal law, yet the topic was much less studied in administrative law. Recently, though, attention to this theme increased, as demonstrated both by the issuance of regulations concerning anonymous reporting by several independent authorities and the numerous court rulings about anonymous reporting and its effects on the initiation of administrative proceedings. Significant signs of the increasing importance of the phenomenon in administrative law can also be inferred from the specific legislation of certain sectors of the law. The dissertation analyzed the various and often contradictory occurrences of anonymous reports in administrative law, in order to understand the scope of the phenomenon of anonymous reporting and to evaluate its compatibility with the general principles of administrative action. Indeed, the question of whether the submission of an anonymous report can bind the administration to initiate administrative proceedings calls for a in-depth consideration of the compatibility of the use of these reports with the principles governing administrative action in a democracy.

Der volle Inhalt der QuelleThis piece of work wants to analyse some lines of development of the administrative law system in its current context. In particular, the author starts from the ascertainment that, since the Constitution entered into force, there has been a strengthening of the subjective legal positions and, in particular, of the legitimate interest. The basic question intended to be answered is whether the current administrative justice system is sufficient to ensure full protection to such subjective legal position and whether the answers that jurisprudence and doctrine have provided to the request for protection are consistent with the constitutional structure of the State. In particular, in the first chapter the history of the administrative justice system is retraced by analysing its fundamental points (from the 1865 Act up to the 2010 Code of Administrative Court Procedure) and by deepening the two aspects that even today are problematic, namely the nature of the legitimate interest and, consequently, the rule relating to the allotment between the administrative Courts and the civil Courts. In the second and in the third chapter, on the other hand, some institutions are analysed which, in the author’s opinion, can mark the overcoming of the jurisdiction of the administrative Courts as it has been known so far. More specifically, the second chapter is devoted to the deepening of the institutions which concern, even mediately, substantive law; the third chapter, instead, is devoted to the institutions of a procedural nature. Finally, the author in the conclusions indicates the possible lines of development and indicates the limits beyond which the protection system would be so far away from the idea of “administrative justice” as deducible from the Constitution, that an amendment of the Fundamental Charter would be needed to ensure its compatibility.

The first part is devoted to the conceptualization and identification of the normative and systematic framework of the subject Before turning to the digitalization of the administrative procedure, it is first necessary to identify an define the essential characteristics of the digitalization of public administration. Then, the automation of decision making is analyzed, which is the main object of the investigation. It is essential to consider the normative sources that govern the automation of public decisions, and also to understand the legal nature of the instruments that allow automation. The second part, on the other hand highlights the main legal problems posed by the introduction of automated public administrative decisions: a first hypothesis is that automation is not compatible with European principles an standards on public administration, as well as with national (Italian) sources of administrative procedure. After having abandoned this first hypothesis, the work focuses on the way of reconciling the principles and the traditional procedural institutes ( obligation of motivation, participation) wit automated decisions

Der volle Inhalt der QuelleProcedural automation is certainly not a new topic of investigation for scholars working on administrative law. It has been studied by doctrine, and practiced by administrations, since the 1980s. Within this long-standing debate, the relevance of the present dissertation lies in the fact that the exponential development of technologies for automation (with the advent of Artificial Intelligence) has substantially expanded the areas where automated decision-making can be successfully implemented. Until ten or fifteen years ago the type of administrative activities in which officials could be replaced by a software were limited (and necessarily bound, considering that only deterministic algorithms were used). Nowadays, the large number of data in possession of the administrations, as well as the way in which they can be stored and above all analyzed, has led to the multiplication of the activities in which they can be used and the advantages that can be derived from them. In this work, an attempt is made to identify the correct systematic collocation of automated administrative decisions and of all the elements that constitute them, and to highlight the problems that recourse to such decisions can entail. In doing so, a unified treatment of these decisions is advocated, hence independently from the level of complexity of the technology used. The first part of the dissertation is dedicated to conceptualizing and to elaborating the normative and systematic framework of the matter. In the first place, it is necessary to identify and define the essential features of the digitalization of the Public Administration. The focus then shifts to the digitalization of the administrative procedure, which is a privileged place of investigation. In this respect, two are the main points of relevance. Firstly, one should identify those regulatory sources that allow (and in some cases limit) the recourse to automated decisions by the administration. Secondly, further investigation must also be conducted into the legal nature of the tools that allow automation, because this has important consequences in terms of the legitimacy of acts and the liability of officials. The second part of the dissertation focuses on the main legal problems posed by the introduction of automated public administrative decisions. A first hypothesis is that automation is not compatible with European principles and rules on public administration and with national sources on the administrative procedure. As will be extensively discussed, this preliminary hypothesis proves unwarranted. Instead, it is proposed that a more viable solution is to reconcile traditional procedural principles and legal tools (duty to give state reasons, participation) with decision-making automation. The final part of the work investigates the complex relationship between the transparency of the administrative activity and the intelligibility of automated decision-making. Here, a new analysis is proposed of both classical legal tools such as the right of access, and the way in which they are interpreted in those cases by case law, and of new instruments of protection provided ad hoc by the Legislator. The research takes a comparative view between the Italian and French systems. The comparative perspective is required by the scope of the investigation. The automated administrative decisions and their legal status remains rather unexplored. The intervention of the Legislator and the pronouncements of the jurisprudence on the subject have just begun to acknowledge the problem. For this reason, limiting oneself to the Italian experience would probably not have been sufficient for a complete understanding of the issue. In addition, as will be seen in the course of the work, the intervention of the European Union in the field of the digitalization of the Public Administration and algorithmic decisions is quite pervasive. Here, the comparison of the role that the EU had in two different Member States seems rather significant. The choice of France, however, is not accidental. First of all, the French Legislator has proved very sensitive to the need for intervention with regards to the new IT tools. It follows, that the study of new legislative instruments developed in this context is of paramount importance. In addition, the multiple affinities between the Italian and the French legal systems have eased the comparison of the performance of classical legal tools of administrative law, such as participation and the right of access (in the face of automation).

Der volle Inhalt der QuelleThis work analyses the complex and evolving relationship between science and political power with the main aim of verifying under what aspects and in what terms this relationship can affect the protection of fundamental rights. Law, as an instrument through which the interactions between science and political power are disciplined and formalized, assumes central importance in this regard, so much so that the relations between science and law can be said to mirror the relations between science and political power. In particular, the latter is closely related to formal and procedural aspects - but with significant substantive implications - such as, first of all, the distribution of competence in the legal system for the performance of technical-scientific evaluations and the determination of how the performance of such evaluations is organized and disciplined. The study of such profiles is therefore crucial and necessary in order to identify solutions capable of guaranteeing the maximum protection of the fundamental rights that may be affected by the technical-scientific evaluation. To this end, the analysis of the Constitution and the search for principles that could be a point of reference for the discipline of technical-scientific questions assume great importance. The first part of this work is focused on the analysis of the concepts of technical standard, technical evaluation, technical discretion and scientific debatability, as well as the Constitutional provisions about science and their preceptive scope. The second part of the work explores the relationship between science and the legislature. In particular, we try to verify, also in the light of the constitutional jurisprudence on the subject, if and in what terms the characteristics of scientific knowledge and the need to protect the rights incised by the norms can lead to the conclusion that science constitutes a limit to the legislative discretion or, even, to exclude the opportunity and the constitutionality of a legislative intervention on technical-scientific issues. Finally, the third part of the work focuses on the public administration and the administrative procedure, in order to verify whether the scientific nature of the issues involved is capable of giving greater importance to the administrative procedure as the place where the technical evaluation is carried out and whether this can be considered in line with the Constitution and useful for the achievement of an optimal level of protection of the rights involved.
