This article offers a normative framework for affirmative action. It argues that affirmative action is not about diversity, but correcting historical injustice. The theory’s presumption is that racial groups would perform equally if not for history, because talent and hard work do not vary by race. The article explores the implications of that premise in answering the most provocative criticisms of affirmative action. Should white students pay for historical wrongs? Should African immigrants benefit from affirmative action? Are Asian Americans unfairly disadvantaged? The article proposes proportional representation as a limiting principle of affirmative action, because preferential treatment beyond proportionality contradicts the theory’s presumption of equal performance. The article proceeds to argue that some groups, like Asian Americans, rebut the presumption by fairly outperforming others and should not be penalized. Finally, the article argues that groups should not be classified on race per se, rather on a shared experience of injustice.

Abstract Mediation is mandatory for all separating and divorcing parents in Norway with children under 16 years. The participation of children is voluntary. Living arrangement preferences presented by children attending child-inclusive family mediation in Norway (n = 346, aged 4–18 years) have been examined. 47.1 per cent of children gave a living arrangement preference, and older children were more likely to express a preference for living primarily with the mother compared to an equal time-sharing arrangement. Children very often gave reasoned explanations for their wishes. Children’s utilisation of the potential in their participation supports future inclusion of children in mediation processes. The best interests of the child needs to be examined on an individual basis as children present various preferences that is not in line with a presumption of fixed time-sharing following parental break-up.

Annotation:
Shared residence, legalized in France in 2002, is a minority practice that affects all categories of the population of separated parents. It is strictly understood as an arrangement in which the residence times of children is equally shared between their two parents. According to the principle of coparental symmetry, the parents’ experience of time is bichronic, marked by the repeated succession of periods of time of equal length, some with children and others without. We explore the temporal experience of this alternate parenthood using a mixed method that combines the analysis of 55 interviews and 5,103 questionnaires sent to French Family Allowance Fund who have children in shared residence. The first part contextualizes the question of shared residence in contemporary France. The thesis maps the controversies it raises, specifies the legal developments and judicial modalities of its implementation, before noting that existing studies on this subject are few and often partial. While the social and economic determinants of the choice of shared residence are fairly well known, the concrete functioning of alternating residence is not well studied. Our research adopts a temporalistic perspective that consists in questioning the differentiated times of human experience. In the second part we characterize the general economy of the temporal framework of alternate residence, showing that the equal sharing of residence times cannot escape the dominant calendar time. The two spaces created in these conditions are constituted into temporal territories over which each parent exercises relative sovereignty according to rules that are built incrementally. We propose a topology of the territories of alternation, attentive to their structure and plasticity. In the third part, we consider the parental experience of time sequences with and without children by first specifying the differences in temporal texture, before describing the modalities of time harmonization. We conclude by looking at the issue from a long term perspective to question the evolution of the parental experience of alternation over time, when it is confronted with events such as family reconstitution or professional mobility. Throughout the thesis, we are attentive to variations in the organization and temporal experience of shared residence according to major sociological variables, gender, age, social background or parents' place of residence

Annotation:
Shared residence was previously viewed with suspicion by the judiciary, but following D v D [2001] a line of cases has developed, where this order is said to benefit children, firstly, by helping them feel cherished, and, secondly, by improving parental cooperation and thus protect children from the harmful effects of exposure to their conflicts. This thesis reviews available research to conclude that shared residence is so unlikely to achieve either objective where it is ordered against a parent's wishes, that the order should be restricted to families where both parents agree. Autopoietic theory is combined with feminist critique to explain the selfreferential nature of law, its tendency to prioritise children's abstract need for fathers and its inability to fully understand parents' complex disputes. The thesis compares the preconditions for, and use of, shared residence in England and in Sweden, concluding that despite better preconditions, Swedish court-imposed shared residence arrangements are unlikely to last, and can harm children by increasing their exposure to conflict. There is also, in contested cases, a worrying focus on equal rights for parents, with children who have grown up in these arrangements complaining of feeling objectified. This, combined with a growing emphasis in English case law on sending symbolic messages about status, is a strong argument against a shared residence presumption. It seems naïve to assume that new, collaborative co-parenting patterns can develop after separation merely because law coerces the adults into a particular kind of formal arrangement. The suspicion is therefore raised that law's agenda is in fact something very different: to mask familial and societal change by making post-separation families conform to a binuclear pattern which resembles the nuclear ideal not only in membership but also in its hierarchical structure.

Annotation:
The present thesis examines the themes of ‘shared history,' ‘place-making,' and ‘reconciliation' to assess how these come together in the establishment of an Aboriginal identity in Perth, Western Australia. Focusing on individuals who do not represent the common stereotypes associated with Aboriginal Australians, it will be demonstrated that these individuals are forced into an in-between place where they have to continually negotiate what Aboriginality means in the twenty-first century. Taking on this responsibility they become mediators, stressing a ‘shared history' in order to create a place for themselves in the non-Aboriginal landscape and to advance reconciliation between Aboriginal and non-Aboriginal Australia by fighting the dominant discourse from within. Beginning with the State and Government's Native Title appeal premiss that Nyungar never existed, this thesis will examine this claim by first presenting an account of the history of southwest Western Australia to establish the place Aboriginal people have been forced into by the colonists during early settlement, and the processes of which extend into the present day. From there on in the focus will be on individual Aboriginal people and their careers and businesses, examining how they attempt to redefine what is perceived and accepted as Aboriginality through different interaction and mediation ‘tactics' with non-Aboriginal Australians. Finally, this thesis will take a closer look at the reconciliation movement in Australia and the people involved in it. It will determine different approaches to reconciliation and assess their possibility and meaning for the construction of a twenty-first century Aboriginal identity. The thesis will conclude that although Nyungar are forced into the dominant discourse, their resistance from within credits a new kind of Aboriginality that is just as valid as the ‘traditional' and ‘authentic' Aboriginality imagined by non-Aboriginal Australia.

According to modernization theory social relationships in second modernity are no longer a given quantity but are subject to negotiation processes. Guiding social knowledge is eroding and the nuclear family model is increasingly confronted with sociocultural legitimate alternatives. There are numerous transformations of the family observable – among these increasing numbers of families after separation and divorce, and in consequence the dissolution of the monolocal household family in favour of multi-local family arrangements. These dynamics raise the question of Doing and Displaying Family practices, addressed within the framework of a practice turn within family sociology. Main aim of this paper is (1) to discuss existing empirical findings and theoretical/conceptual considerations of relevant research fields, and (2) by employing a praxeological approach, to focus on identity politics as a means to establish and stabilize family identity and belonging within shared residence arrangements where children regularly shuttle between their separated parent’s households. Data suggest that passive multi-locally living parents and their partners oscillate between referring to the other household on behalf of the active multi-locally living children to create a cross-spatial sense of commonness and belonging and at the same time applying territorialisation practices to promote a place-bound social order and family identity. This includes processes of communicative, spatial, personal, material, and habitual closure. Moreover, in a way between material and habitual closure, the olfactory was identified as a medium of identification and distinction. However, children face the challenge to merge both residential places and family nuclei into a coherent whole and simultaneously need to distinguish between different family sociotopes. Moreover, the empirical material provides insights into the normalization strategies of parents and children in dealing with externally applied difference markers, deviance attributions and the normalization power of the nuclear family model. The basis of the empirical research is a multiple methods comprising qualitative research design. Narrative interviews, group discussions and visual methods were employed. Data are analysed by means of the documentary method for text and picture interpretation within a qualitative reconstructive approach

Abstract, key words Title of the thesis: Shared residence in Czech and German law The aim of this thesis is to compare the approach to shared residence in the legal order of the Czech Republic and the Federal Republic of Germany, i.e. to find out to what extent the approaches of these countries to shared residence differ. This is examined in relation to selected issues which courts had to deal with when deciding on the shared residence, i.e. the influence of the child's wishes, the parents' will, their ability to communicate and long distance between the parents' households on the suitability of shared residence. Special attention is paid to the presumption of shared residence, or shared residence as a rule. The thesis focuses on the effective regulations. The thesis is divided into three parts. The first part deals with the Czech regulation of the shared residence. The individual chapters explain basic terminology, sources of law, legal regulation of shared residence, case law on the selected issues, including the presumption of shared residence, and some of the specifics of maintenance obligation. The second part of the thesis follows the same structure as the first part. However, there is a special chapter regarding drafts on shared residence as a rule. The third part compares the findings made in the...

The cases of divorce and separation are an evident reality, in our current society. Before these situations or before a situation in where the child's progenitors decide not to share a marital life or when a situation of union is verified, it becomes imperative to determine how the exercise of the parental responsibilities will be regulated. The increase of those cases of divorce and of the progenitors' separation it was echoed in an increment of the requests of regulation of the parental responsibilities, that can happen by an agreement among the progenitors, foreseen in the article 1905.º, n.º 1 of the Civil Code, assisting the needs of all involved them.In the extent of the exercise of the parental responsibilities, present in the goods 1905.º to 1912.º of the Civil Code, inherent subjects are regulated the child's relationship with the progenitors. One of the subjects had in consideration is the fixation of the child's residence, the focus of this dissertation. The determination of the son's residence, influences other points of the regulation of the exercise of the parental responsibilities. The present investigation has as starting point the study of situations in that the Court, third impartial, that is called to decide about the fixation of a child's residence, in the extent of a process of regulation of the exercise of the parental responsibilities. Intends to analyse which is the dominant position in the jurisprudence of the Portuguese courts, verifying the established regime for the same, as well as the several doctrinal positions on the theme.

Purpose The purpose of this thesis is to develop a conceptualized model, which identifies the significant variables of perceived risk for current Airbnb users towards becoming a host of their own residence on Airbnb’s platform. There is a lack of information concerning the host’s risk perception to cross the trust barrier in order to become a host on Airbnb (Ter Huurne, et al., 2017). For Airbnb it is of significant importance to provide new residences since it contributes to the growth of its platform. Likewise, it applies to managing potential risks in order to generate a positive vicious circle with the absence of trusted authorities or third parties (Wu, et al., 2017). Methods A new applicable model was constructed that served as the conceptual framework for this thesis. The model consists of twelve variables, where each variable has a possible influence on the overall perceived risk for Airbnb users to become a host of their own residence on Airbnb’s platform. The survey embodied the perceived risk variables and applied a predetermined set of answers. A prerequisite was that the respondents were familiar with the platform Airbnb by having a registered account. Findings There was found to be a discrepancy between millennials’ and non-millennials’ perception of risk. Millennials found financial risk, privacy risk (payment), social risk (neighbours), physical risk, and lack of control risk to be significant. Non-millennials found performance risk, privacy risk (in-house), and lack of control risk to be significant. Both models showed that the variable ‘lack of control’ was the biggest influencer on overall perceived risk. The results also indicate that millennials are more susceptible to let financial benefits outweigh their perceived risk in comparison to non-millennials, whereas social benefits are perceived similarly. On a last note, non-millennials’ overall risk perception was found to be considerably higher than for millennials. Implications The results present a conceptual model that is based on perceived risk for e-commerce (Featherman & Pavlou, 2003). Moreover, this conceptual model added the components physical risk (Jacoby & Kaplan, 1972) and lack of control risk (Das & Teng, 2004) in order to identify overall perceived risk for Airbnb users to become a host of their own residence on Airbnb’s platform.

The purpose of this study was to develop comparative studies between the Portuguese and Brazilian legal systems concerning the practice of shared residence (shared physical custody) of the child after divorce or separation, in order to assess whether there is legal feasibility for its application, as well as whether such institute has an effective impact on the processes in which parental responsibilities are regulated and under what circumstances. For this purpose, we examined the origins of this dynamics of post-divorce family organization that goes back to the United States of America, in the figure of the joint physical custody, addressing its approaching and main attributes, after this it was inserted in the legal context of countries as Spain and France, where the institute already enjoys more social and legal acceptance, through the doctrinal and jurisprudential comparison. Next, a chapter was devoted to the study of the Brazilian legal system with a focus on parental responsibility, discussing the modalities of custody allowed by civil law, and examining how the Brazilian courts currently stand on dual residence of the child after divorce, in the context of shared custody, and, finally, the inapplicability of the institute were exposed. The last chapter is devoted to the study of the Portuguese legal system, in which legislative brief was developed from the exclusive exercise of parental responsibility to the joint exercise of parental responsibilities as of the Law under n. 61/2008, as well as evaluating the main repercussions of this legislative reform on the child's residence in the light of Article 1.906 of the Civil Code. In addition, the doctrinal positions unfavorable to the application of the institute were highlighted, as well as the positioning of the Portuguese jurisprudence regarding the shared residence of the post-divorce child. The present study aimed to show that both countries have a legal basis for the implementation of the child's shared residence after divorce, but there is a strong need to broaden the debate on this topic, considering that there is still great resistance, especially in Brazil, in applying this modality of family arrangement, which both favors co-parenting and meets the needs of the child of affective attachment with both parents.

Data are analysed by means of the documentary method for text and picture interpretation within a qualitative reconstructive approach.

The Protection of Women from Domestic Violence Act, 2005 (PWDVA) was enacted following a concerted campaign by the Indian women’s movement. The Lawyers Collective authored the law in consultation with women’s groups from across the country. Contributors to this volume address critical and hitherto less addressed areas pertaining to domestic violence and the law in India. The volume is divided into three parts. Part I includes chapters that cover the nature of structural inequality that perpetuates and condones domestic violence as a lesser ‘wrong’ or ‘crime’ and present the historical background to the fight against domestic violence in India, focusing on legislative developments. Part II presents essays around critical issues such as ‘right to residence’, marital rape, rights of cohabitees or ‘relationship in the nature of marriage’, secular nature of the PWDVA and its harmonious existence with personal law and criminal law. Analyses in this section reflect international standards in addressing domestic violence and present in-depth debates. Research studies in Part III engage with the expectations from the PWDVA and its enforcement through analysis of court orders that indicate the nature of relief sought by women, forms of domestic violence complained against, orders passed by courts and the multiagency response system created under the PWDVA, indicating the nature of services available to the domestic violence survivors. Areas where the PWDVA has been successful in providing protection and relief from domestic violence have been presented alongside challenges yet to be overcome, such as response mechanisms and budgetary constraints in its implementation.

Through an analysis of prominent transboundary natural resource management negotiation cases, Winning Together outlines how government, industry, and NGOs can effectively overcome past grievances, break the status quo, resolve conflicts, and create mutual gains in high-stakes water, energy, and environmental disputes. The book examines two landmark international negotiations between the United States and Mexico, both with agreements signed in 2012 after several decades of deadlock. The first case involves the conflict over the shared hydrocarbon reservoirs in the Gulf of Mexico, containing significant oil and natural gas resources. The second analyzes the dispute, amidst severe drought and increased climate risks, over the environmental resources and shared waters of the Colorado River, providing irrigation and water supply to more than 40 million people. For the first time, the two countries established a binational framework to co-develop and jointly manage these transboundary natural resources, as partners. Through unprecedented interviews with over 70 negotiators on both sides of the border, the book underscores strategies by which resource management practitioners can effectively increase river basin supply, re-think irrigation and storage infrastructure, restore ecosystems and habitats, enhance coordination between private and state owned companies, improve energy transition and planning, and re-define the scope and impact of diplomatic partnerships. Winning Together shows how developed and developing countries can move beyond hard-bargaining tactics and avoid the ultimatums that accompany the presumption that there are not enough resources to go around, and that one side must win and the other must inevitably lose.

The vestibular system contains semicircular canals that respond to angular acceleration and otoconial organs that respond to linear acceleration of the head. Information is sent to the motor system and, under normal circumstances, does not lead to conscious perception. Yet damage to the vestibular system can result in disequilibrium or vertigo, disturbing perceptions that dominate conscious experience. The shared residence of the cochlear and vestibular end organs in the inner ear can give rise to inner ear disorders such as Ménière’s disease. The effect of gravity on the otoconial masses in the sacculus and utriculus enable detection of static head tilt. Age-related disequilibrium, benign paroxysmal positional vertigo, motion sickness, and alcohol intoxication–induced vertigo are explained. How natural head movements elicit combined canal and otoconial organ responses is described. Finally, the dependence of posture and gaze on vestibular inputs is introduced as a segue to the next chapter.

AbstractMultilocal, dual residence or shared parenting arrangements after parental separation are increasingly discussed in many countries because they seem best suited to allow for more equally shared parental roles and children’s equal access to both (biological) parents. So far, there is little information about shared physical custody in Germany. The present research uses the second wave from a large German survey “Growing up in Germany” (2013–2015) to investigate the prevalence, preconditions, as well as possible outcomes of shared physical custody after separation. The sample comprises 1042 children (below age 18) with separated parents (maternal report). Measured by children’s overnight stays with each parent, less than 5% of these children lived in a dual residence arrangement (50:50 up to 60:40% of time with either parent). Shared physical custody was more likely if maternal and paternal residence were in close proximity, and if the mother had higher levels of education. As expected, shared physical custody was more likely if the parents had a positive cooperative (co-parenting) relationship while co-parenting problems did not seem to have independent effects. The findings are discussed with respect to other research addressing issues of self-selection into different parenting arrangements and the still limited role of shared physical custody in Germany in facilitating more equal gender roles.

AbstractThe purpose of this chapter is to explore how the humane Norwegian policy principles and values may impact the prison-based practices and the implications of these for the collaborative work undertaken by front-line personnel. Humane traditions are considered a substantial focus of the Norwegian prison system and its policies. The approach in Norway is supported by increasing empirical evidence that shows the system to centralise the welfare of inmates. It emphasises offender rehabilitation and reintegration rather than merely punishment as a fundamental means to reduce reoffending. However, the collaborative practice that may arise as a consequence of these traditional values is underexplored. Two case studies were undertaken with front-line staff working in a Norwegian prison transitional residence (Overgangsbolig). This is the final phase of an inmate’s sentence while being reintegrated back into society. The study found that staff in their collaborative working practices adhered either to the aim of normalising the lives of their inmates after long periods of incarceration (normalisation ideals) or reparative ideals that reflected the system’s humane focus on rehabilitation and reintegration takes precedence over punishment. We conclude that irrespective of differing professional disciplines, there seems to be compatibility between the overarching principles and values of penal policy and front-line ideals to promote collaborative practices at the reintegrative phase of the Norwegian prison system. The shared application of these humane ideals promoted collaborative practice among the front-line workforce while focusing upon the provision of welfare to inmates and their impending reintegration back into society.

The chapter presents the underlying idea behind this volume and serves as an introduction to domestic violence and the law in India. Tracing the history of laws addressing domestic violence both as a crime and a civil wrong, the author explains how the collection of essays in this volume evaluate some of the essential concepts that shaped the framing of the PWDVA and its treatment in the hands of judges. Providing insights into the challenges faced in drafting and enforcement of the PWDVA, such as inclusion of women in ‘relationships in the nature of marriage’ and unique provisions such as the ‘right to residence’, the author discusses the extent to which PWDVA has succeeded in fulfilling its purpose and areas of enforcement that remain a challenge even after a decade.

The chapter deals with women’s unequal rights to housing and draws on the related concepts of security of tenure and ownership rights, to explores the interlink between housing rights and domestic violence to show that protection of right to housing enhances and positively impacts women’s negotiating capacity in dealing with domestic violence. Locating domestic violence within the right to housing under international law the author demonstrates that domestic violence in the absence of security of tenure in the form of ownership or tenancy rights for women is a major cause of forced eviction and homelessness. The PWDVA provides security of tenure through Right to Reside and Residence Orders, in some situations barring the violent household member from remaining on the premises. Analysis of jurisprudence under ‘right to reside’ unmasks the complex nature of the Indian household and the nuances in the way the right has been interpreted and enforced by courts.

This chapter describes the trends and patterns of usage of the PWDVA and examines judicial approaches towards adjudication under the Act. This chapter is based on an empirical analysis of approximately 7,000 Magistrate Court orders from 14 states between 2012 and 2013. The objective behind the analysis is to assess the implementation of the PWDVA in a manner true to its objectives. The analysis includes pattern of usage, profile of users, nature of DV, reliefs sought and granted, reasons for refusal to grant relief such as protection orders, compensation, residence orders, custody of children, maintenance orders. Judicial attitudes and adjudicatory practices indicate that courts tend to locate their maintenance decisions on a male ‘moral duty’ to maintain the wife or mother, rather than on her entitlement to economic support for the services she performs and that the judicial process mostly lacks the multi-agency approach envisaged under the PWDVA.

Since the first manifestations of what was agreed to be called civilization, humanity has been considering cities and urbanity relations the main centers for socialization and political interaction in people’s lives and daily activities. The birth of cities allowed the formation of cooperation groups, which despite being created from shared work and urban social duties, got together for the same objectives in their communities and were interdependent. Nevertheless, many times such groups were under tension and conflict as contingent residence places and shared geographic centers were rarely based on interests in social interaction, or sharing projects and affectivity. Therefore, cities were consolidated as centers for socialization, and manifestations of interests and collective interrelations, as well as privileged stages for social constructions, disputes, conflicts and witnesses of social histories.

According to its geological age, geographic features, monotony and diversity of natural (land, mineral, energy, aquatic, biological) resources, climatic conditions, the territory of Post-Soviet Central Asia (in Soviet times called Central Asia, including Kazakhstan) is a single geographic area that has become territorial base of residence of certain peoples and their civilizational development and the formation of their statehood. Today, Post-Soviet Central Asia is not just a natural geographic but an integrated and used geo-economic space, divided into the Kazakh, Kyrgyz, Tajik, Turkmen, Uzbek state-legal and socio-economic structures of human existence. And the welfare of each independent state (as represented by Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan and Uzbekistan) and the geo-economic space in general depends on coordinated, solidarity and shared solutions to major economic, social, environmental problems of common interest to the geo-economic space and from ensuring security of peaceful coexistence in a given geospace. The article identifies these problems and determines the ways to solve them.
