This chapter presents Cavell’s Emersonian perfectionism as a response to and interpretation of Kant. For Cavell, receptivity is the key to Emerson’s inheritance of Kant’s theoretical philosophy, as partiality is the key to his inheritance of Kant’s practical philosophy. Partiality for Emerson names both the individual agent’s inherent lack and its want for change and growth. The shameful experience of lack is the precondition for the transformative encounter with an exemplary other who enables the self’s conversion of the nihilistic conformity of everyday life as it is now lived. The chapter argues that Cavell’s insistence that Emersonian perfectionism sets itself against any idea of ultimate perfection does not condemn Cavell’s agents to an endless and hence nihilistic pursuit of an unrealizable telos, as it might seem, but instead furnishes the basis for democratic hope.

By means of an analysis of Hegelian and Hegelian-inspired notions of aspects of communal ethical life, this chapter aims to demonstrate that, far from requiring a non-metaphysical (version of) Hegel, his concept of an ethical community rests on his concepts of consciousness and self-consciousness from the beginnings of his system. It begins by describing the Hegelian account of intersubjectivity that demonstrates the incomplete, changing, and vulnerable nature of Hegelian personhood. It goes on to discuss the Hegelian view of autonomy as seen in the account of civil society in the Philosophy of Right. Finally, it examines further the tension between these accounts and how they interact with the relationship between Hegel’s method and its practical corollaries.

Personal autonomy is often lauded as a key value in contemporary Western bioethics, and the claim that there is an important relationship between autonomy and rationality is often treated as an uncontroversial claim in this sphere. Yet, there is also considerable disagreement about how we should cash out the relationship between rationality and autonomy. In particular, it is unclear whether a rationalist view of autonomy can be compatible with legal judgments that enshrine a patient’s right to refuse medical treatment, regardless of whether ‘… the reasons for making the choice are rational, irrational, unknown or even non-existent’. This book brings recent philosophical work on the nature of rationality to bear on the question of how we should understand autonomy in contemporary bioethics. In doing so, the author develops a new framework for thinking about the concept, one that is grounded in an understanding of the different roles that rational beliefs and rational desires have to play in personal autonomy. Furthermore, the account outlined here allows for a deeper understanding of different forms of controlling influence, and the relationship between our freedom to act, and our capacity to decide autonomously. The author contrasts his rationalist account with other prominent accounts of autonomy in bioethics, and outlines the revisionary implications it has for various practical questions in bioethics in which autonomy is a salient concern, including questions about the nature of informed consent and decision-making capacity.

This chapter aims to address two related challenges the phenomenon of depression raises for theories which present autonomy as an agency concept and an independent source of justification. The first challenge is directed at an intuitive conception of intentional agency as implying a robust though not always direct link between evaluation and motivation, for in depression what appears to be choice-worthy does not get chosen. The second challenge targets the feasibility of a reliable distinction between autonomous and non-autonomous choices, for both value-neutral and value-laden accounts of depressive agency seem open to decisive objections. Drawing on Freud's interpretation of melancholia and Korsgaard's notion of practical identity, the chapter develops a conception of paradoxical identification which helps address the two challenges described and supports a revised value-neutral account of depressive agency as being non-autonomous.

Chapter 4 (Oath, Profession, and Autonomy) investigates the connections between medicine as incorporating an oath, being a profession, and possessing autonomy. It argues that professional medical practice cannot amount solely to a technique. Rather, it necessarily incorporates an internal medical ethic, to which practitioners swear. It argues that the most basic indisputable norm internal to medicine approximates the aphorism “as to diseases, practice two: help or do not harm”—primum, non nocere (or, “first, do no harm”). It details the implications of medical promising—including self-regulation, education of the public concerning the profession’s commitments, and societal respect for professional conscientious objection. Chapter 4 concludes by noting that the enduring legacy of the Oath—as seen in the renaissance of medical oath-taking in the White Coat Ceremony, for example,—consists in the conception and establishment of doctoring as a profession, a practice incorporating its own publicly avowed ethic.

The central claim of this chapter is that worldviews that embrace traditional dictates, and even ones that take certain traditional dictates to be beyond question, can be genuinely feminist. Feminism is opposition to sexist oppression, and since this form of oppressiveness is a function of the effects of practices rather than their inheritedness, it is possible to oppose sexist oppression on traditionalist grounds. This is good news for anti-imperialist feminist projects, since wanton destruction of the traditions of “others” has often been understood as required for feminist change. The forms of freedom, autonomy, and the secular to which Western feminists appeal when justifying cultural damage is neither necessary for feminism nor central to its status as a normative doctrine. The chapter includes a discussion of the moral epistemologies of Islamic feminisms and a criticism of the normative conclusions of Saba Mahmood’s work.

Though rights of self-medication needn’t change medical decision-making for most patients, rights of self-medication have the potential to transform other aspects of healthcare as it is currently practiced. For example, if public officials respected patient’s authority to make medical decisions without authorization from a regulator or a physician, then they should also respect patient’s authority to choose to use unauthorized medical devices and medical providers. And many of the same reasons in favor of rights of self-medication and against prohibitive regulations are also reasons to support patient’s rights to access information about pharmaceuticals, including pharmaceutical advertisements. Rights of self-medication may also call for revisions to existing standards of product liability and prompt officials to rethink justifications for the public provision of healthcare.

Contemporary forms of Kantian constitutivism generally begin with a conception of agency on which the constitutive aim of agency is some form of autonomy or self-unification. This chapter argues for a re-orientation of the Kantian constitutivist project towards views that begin with a conception of rationality on which both theoretical and practical rationality aim at forms of understanding. In a slogan, then, understanding-first as opposed to autonomy-first constitutivism. Such a view gives the constitutivist new resources for explaining many classes of reasons, while also offering a new way of understanding the unity of theoretical and practical reason. The chapter concludes by arguing that the resulting view is best understood, not so much as an alternative to autonomy-first constitutivism, but as a complement to it.

This book explores Mississippian communities in the 14th–15th century northern Yazoo Basin through an archaeological case study of Parchman Place, located in present day Coahoma County, Mississippi. Drawing on archaeological evidence for foodways, mound building, and the organization of community space, the book takes the position that community-building by Mississippian people was a process of placemaking that involved repeated re-creations of a distinct worldview in a particular place (or places). Much evidence points toward the tendency for Mississippian social relations to be strongly hierarchical. And yet, archaeological data from Parchman Place and elsewhere suggest that different Mississippian people practiced placemaking and world creation in different ways, through different media, and to achieve different goals. Despite the very visible outcomes of actions taken by powerful people (mound-top residences, palisades, community spatial organization, feasting refuse), community-building was decidedly not the exclusive purview of elite members of Mississippian communities. Rather, spatial and depositional practices indicate that leadership was routinely checked by those who wished to emphasize kin group autonomy and those who valued the maintenance of balance among distinct social groups.
