Abstract. In a repeated-measures experimental study, we examined how evidence type influences police investigators’ beliefs about (a) suspect’s culpability and (b) reliability of incriminating evidence. South Korean detectives ( N = 202) read four crime reports including general information about a crime and a suspect. In the general case information, one piece of critical and several pieces of noncritical evidence collected during the investigation were presented. Officers read four simulated reports of crimes, and in each report, they were given one piece of evidence linking the suspect to the crime. We manipulated the critical evidence identifying the suspect with four evidence types: CCTV, DNA, fingerprint, and eyewitness testimony. We found that evidence type influenced detectives’ judgments about suspect’s culpability and evidence reliability, such that when eyewitness (vs. CCTV, DNA, fingerprint) evidence was given as critical evidence, officers were more likely to think that the suspect was less culpable and that the evidence was less reliable. Theoretical and legal implications of these results are discussed.

Abstract. In sequential diagnostic reasoning, observed pieces of evidence activate hypotheses in memory and are integrated to reach a final diagnosis. The order of evidence can influence diagnostic reasoning. This article examines the processing of ambiguous evidence underlying order effects if multiple hypotheses are activated. In five experiments with a quasi-medical scenario, participants dealt with symptom sequences supporting multiple diagnoses. The symptom order, the response mode (end-of-sequence, step-by-step), and the consistency of evidence were manipulated. A primacy order effect occurred with both response modes suggesting that ambiguous pieces of evidence were distorted toward the hypothesis that strongly corresponded with the first piece. The primacy effect was partially counteracted by stepwise belief ratings, which strengthened the weight of recent evidence and promoted switching to an alternative diagnosis. We conclude that once hypotheses are generated, the interplay of coherence-oriented information distortion and memory-dependent analytic processes propagates into distinct order effects in diagnoses.

Abstract The alignment between the boundaries of protein domains and the boundaries of exons could provide evidence for the evolution of proteins via domain shuffling, but literature in the field has so far struggled to conclusively show this. Here, on larger data sets than previously possible, we do finally show that this phenomenon is indisputably found widely across the eukaryotic tree. In contrast, the alignment between exons and the boundaries of intrinsically disordered regions of proteins is not a general property of eukaryotes. Most interesting of all is the discovery that domain–exon alignment is much more common in recently evolved protein sequences than older ones.

We present a statistical analysis of music scores from different composers using detrended fluctuation analysis (DFA). We find different fluctuation profiles that correspond to distinct autocorrelation structures of the musical pieces. Further, we reveal evidence for the presence of nonlinear autocorrelations by estimating the DFA of the magnitude series, a result validated by a corresponding study of appropriate surrogate data. The amount and the character of nonlinear correlations vary from one composer to another. Finally, we performed a simple experiment in order to evaluate the pleasantness of the musical surrogate pieces in comparison with the original music and find that nonlinear correlations could play an important role in the aesthetic perception of a musical piece.

Objectives: To describe a methodology used to keep practice guidelines up to date and to summarize data collected during the first year of implementing this plan with a cancer practice guidelines program.Methods: The updating strategy includes regular searches of peer-reviewed literature and meeting proceedings, review and interpretation of new evidence, review and revision of clinical recommendations, and notification to practitioners and policy makers about new evidence and its impact on recommendations.Results: Eighty pieces of new evidence were found relating to seventeen of the twenty guidelines included in this study. On average, four pieces of new evidence were found per guideline, but there was considerable variation across the guidelines. Of the eighty pieces, nineteen contributed to modifications of clinical recommendations in six practice guidelines, whereas the remaining evidence served to support the original recommendations. None of the modifications led to changes that advised against original recommendations. MEDLINE, the Cochrane Library, and meeting proceedings yielded many pieces of evidence, whereas CancerLit and HealthStar did not contribute significantly to the overall yield. Furthermore, key pieces of evidence that led to modifications to the recommendations were often identified by members of the disease site groups before appearing in electronic databases.Conclusions: The updating process is resource intensive but yields important findings. In response to this evaluation, the updating protocol has been revised such that literature searches are conducted quarterly and the scope of sources searched routinely is restricted to MEDLINE, the Cochrane Library, and meeting proceedings.

Seal-cutter's trial-pieces present a rarity among Mesopotamian artifacts. To my knowledge the only example apart from the trial-pieces found by C. L. Woolley at Diqdiqqeh and Ur was for decades in a Swiss private collection and is now in the Vorderasiatisches Museum in Berlin (Figs. 4b and 5).Though trial-pieces are, like moulds, engraved in intaglio they exhibit three distinct features: form, material and a lack of proficiency of many engravings (Figs. 1–5). Most have irregular contours and uneven surfaces; of the fourteen trial-pieces twelve are limestone or calcite and two potsherds. Although some surfaces are smoothed or polished, they show scratches and indentures, and one piece has a drill-hole on the roughly hewn back. The pieces look like leftovers from or parts of broken objects. Thus material for trial-pieces was only available in, or in proximity to workshops where leftovers from larger stone objects would be available to seal-cutters. Many figures on the trial-pieces demonstrate that the seal-cutter was not very accomplished (Figs. 1f, 2b, 3), two are skillfully executed by a master (Figs. 2a, 4a); most, however, are of average quality (Figs, 1a–d, 2c, 5), evidence for a workshop with masters and apprentices. The rarity of trial-pieces suggests that most seal-cutters trained on cylinders.Of the provenanced trial-pieces all but one, which comes from the Gipar in Ur, were found at Diqdiqqeh. According to the excavators Diqdiqqeh, situated one mile south-east of the city wall of Ur, developed into an artisans' quarter starting with the Ur III period. The surface of this suburb was scattered with ruins of houses and numerous seals, terracottas, amulets and beads. Proportionally these were more numerous than at Ur, which could only be explained by the location of workshops in this area.

In the possesion of the Zsolnay Museum in Pécs one could find an unusual porcelain set with Egyptian figures and motifs. This treasure is one piece of the evidence which suggests that Egyptianising tendencies might have had a great influence even on Hungarian arts and culture. Although many pieces of Egyptianising Zsolnay ceramics can be found in our museums, and also in online auction houses, we have very little information about the circumstances under which these pieces were created. There are important research papers about the Orientalism in Hungarian handicrafts and arts by Orsolya Kovács and Ibolya Gerelyes, and of course we have many books about the Zsolnay products and the factory in general. Most of these studies mention some ceramics with Egyptian motifs and even Miklós Zsolnay’s journey to the Near-East, but they do not focus on Egyptomania and its role in the Zsolnay heritage. The present paper is trying to serve as a preliminary report about this goldmine of Egyptomania, which consists not only of ceramics, but sketches, letters and diaries as well. We do not have the full picture yet, but this paper will shed some light upon those important, new pieces of evidence of Egyptomania in Hungary in the 19th century.

Splicing broken files played an important role in judicial evidence reconstruction, historical documents repair and military information obtainment and other fields. In this paper, we analyzed the reconstruction of broken pieces, which was modeled as an optimal matching problem. The Hamming distance was used as the matching degree of edge splicing. Firstly, we use the iterative threshold selection method to determine the gray scale threshold. Secondly, we chose the minimum summation of and as objective function. Then we use clustering analysis to classify the pieces into different lines, and selected the top and bottom position of the first line on each piece as decision variables. Finally, we took word width and column spacing into consideration and used row matching algorithm to splice lines into a complete image.

Research on musical preference has been dominated by two approaches emphasizing, respectively, the arousal-evoking qualities of a piece or its typicality of the individual’s overall musical experience. There is a dearth of evidence concerning whether either can explain preference in conditions of high ecological validity. To address this, the present research investigated the association between sales of 143,353 pieces of music, representing all the music that has enjoyed any degree of commercial success in the United Kingdom, and measures of both the energy of each piece (as a proxy for arousal) and the extent to which each piece was typical of the corpus. The relationship concerning popularity and energy was U-shaped, which can be reconciled with earlier findings, and there was a positive relationship between the typicality of the pieces and the amount of time they featured on sales charts. The population-level popularity of an entire corpus of music across several decades can be predicted by existing aesthetic theories, albeit with modifications to account for market conditions.

Abstract Some proponents of the higher-order thought (HOT) theory of consciousness defend the view that higher-order misrepresentation is possible. In support of this view they have proposed various pieces of empirical evidence. This paper examines one such piece of proposed empirical evidence; Change blindness (CB). CB occurs when a subject fails to detect salient changes in visual scenes. I propose an alternative interpretation of the CB phenomenon on which misrepresentation does not occur. Finally, I examine three lines of reply that might be pursued to defend the claim that CB is evidence of misrepresentation against my interpretation. I conclude that none of the lines of reply succeed in preserving CB as evidence of misrepresentation. The upshot is that, pending further evidence, CB cannot be deployed as empirical evidence in the debate on misrepresentation.

A study was initiated to collect and collate evidence to resolve the long-standing question of whether free-ranging Cougars (Puma concolor) exist on the Ontario landscape. A total of 497 pieces of evidence confirmed that Cougars were present in Ontario during the period 1991 to 2010. That evidence included 21 pieces of class 1 evidence (scat, hair, DNA, tracks, photographs of a Cougar), 13 class 2 sightings (by qualified observers such as biologists), and 463 class 3 sightings (credible sightings by unqualified observers). The evidence presented in this paper indicates the presence in Ontario of free-ranging Cougars of unknown origin.

Syst. 8 (1993) 711–725] we established within Dempster-Shafer theory a criterion function called the metaconflict function. With this criterion we can partition into subsets a set of several pieces of evidence with propositions that are weakly specified in the sense that it may be uncertain to which event a proposition is referring. In a second article [J. Schubert, “Specifying nonspecific evidence”, in “Cluster-based specification techniques in Dempster-Shafer theory for an evidential intelligence analysis of multiple target tracks”, Ph.D. Thesis, TRITA-NA-9410, Royal Institute of Technology, Stockholm, 1994, ISBN 91–7170–801–4] we not only found the most plausible subset for each piece of evidence, we also found the plausibility for every subset that this piece of evidence belongs to the subset. In this article we aim to find a posterior probability distribution regarding the number of subsets. We use the idea that each piece of evidence in a subset supports the existence of that subset to the degree that this piece of evidence supports anything at all. From this we can derive a bpa that is concerned with the question of how many subsets we have. That bpa can then be combined with a given prior domain probability distribution in order to obtain the sought-after posterior domain distribution.

Many Middle Stone Age (MSA) sites have evidence of the regular collection and use of ochre. Sibudu (KwaZulu- Natal, South Africa) has a large MSA ochre assemblage of over 9000 pieces from layers dating between ~77 ka and ~38 ka. There are 682 pieces with signs of use. All usetraces were examined and activity categories were defined based on published ochre experiments. The most frequent markings on ochre pieces are grinding striations that are smoothed by subsequent rubbing. Grinding and rubbing also occur independently on many pieces. Scored pieces are rare, but are more common in the pre-Still Bay (~77 ka) industry than elsewhere in the sequence. Some scored pieces may represent deliberate engravings. Markings acquired during powder-production are most numerous in the assemblage. Powder was mostly produced from bright-red pieces, but scoring was mainly performed on brown-red pieces. Pieces with mica inclusions are not common, but were favoured for powder production. Ochre powder was used as an aggregate in hafting adhesives, but other possible applications are as paint or as a substance to aid hide tanning.

The rich earlier Mid Upper Palaeolithic (Pavlovian) sites of Dolní Vĕstonice I and II and Pavlov I (∼32,000–∼30,000 cal BP) in southern Moravia (Czech Republic) have yielded a series of human burials, isolated pairs of extremities and isolated bones and teeth. The burials occurred within and adjacent to the remains of structures (‘huts’), among domestic debris. Two of them were adjacent to mammoth bone dumps, but none of them was directly associated with areas of apparent discard (or garbage). The isolated pairs and bones/teeth were haphazardly scattered through the occupation areas, many of them mixed with the small to medium-sized faunal remains, from which many were identified post-excavation. It is therefore difficult to establish a pattern of disposal of the human remains with respect to the abundant evidence for site structure at these Upper Palaeolithic sites. At the same time, each form of human preservation raises questions about the differential mortuary behaviours, and hence social dynamics, of these foraging populations and how we interpret them through an archaeological lens.

Specifically, we examine whether individual differences in working memory predict the scope and efficiency of advance planning. In our task, speakers described picture arrays to partners in a matching game. The arrays sometimes required speakers to note a contrast between a sentence-initial object (e.g., a four-legged cat) and a sentence-final object (e.g., a three-legged cat). Based on prior screening, we selected participants who differed on verbal working memory span. Eye-movement measures revealed that high-span speakers were more likely to gaze at the contrasting pictures prior to articulation than were low-span speakers. As a result, high-span speakers were also more likely to reference the contrast early in speech. We conclude that working memory plays a substantial role in the flexibility of incremental speech planning.

ABSTRACTEver since Jeremy Bentham wrote his scathing critique of the law of evidence, both philosophers and legal scholars have criticized the exclusionary rules of evidence, arguing that formal rules excluding entire classes of evidence for alleged unreliability violate basic epistemological maxims mandating that all relevant evidence be considered. Although particular pieces of evidence might be excluded as unreliable, they argue, it is a mistake to make such judgments for entire categories, as opposed to making them only in the context of particular pieces of evidence offered for specific purposes. This paper challenges these claims, arguing that rule-based exclusions serve similar purposes to those served by rules in rule-consequentialist moral theories, and that, even more importantly, they are entirely consistent with the exclusionary nature of legal rules in general. Indeed, once we see the role that exclusionary rules might serve in legal epistemology, we can see that they might have a role to play in epistemic appraisal more generally.

Previous studies have shown that diverse pieces of evidence, rather than similar pieces of evidence, are considered to have greater strength in adults' inductive reasoning. However, this diversity effect is inconsistently recognized by children. Three experiments using the same materials but different tasks examined whether young children consider the diversity principle in their reasoning. Although Experiment 1 applied a data selection task showed five-year-old children in both China and Korea were not sensitive to the diversity of evidence, Experiments 2 and 3 employed an identification task and demonstrated that children as young as five years were sensitive to diverse evidence. These findings indicated that young children, less than nine years of age, may have diversity effect. Methodological and cultural differences were discussed.

Nyulnyulan is a fairly closeknit language family of northwestern Australia. It has been suggested that the family may be an old dialect continuum. While most classifications have recognized two branches, the languages in the middle were all but unattested. It has therefore proven difficult to judge whether the two branches are a result of a tree?like split, or a consequence of missing data. I show from previously missing data that Nyulnyulan is not a dialect chain; there is a clear split even when considering data from the middle languages. This is further evidence that Australian languages are not outside the methods of traditional historical linguistics.

The figurative and schematic designs on two pieces of decorated bone from Creswell, Derbyshire are related to motifs used in later Magdalenian portable art in south-western and northern France, and are assigned to a period between 11,000–12,000 years ago on grounds of design and environmental evidence. One piece, that from Robin Hood's Cave, which is carefully engraved with complex motifs on both sides, shows handling traces indicating carriage over a period of time by one or more individuals. As the late Glacial Hunters at Creswell are thought to be nomadic, and the cave to have been inhabited only in the Summer months, the piece may have been made elsewhere and carried to Derbyshire, possibly from the continent.

In the effective combination of conflicting evidences using the Dempster-Shafer evidence theory, the first step is to reasonably measure the conflict between evidences, but there are limitations in the existing conflict measurement methods. Two new conflict measurement methods based on conjunctive combination rule are put forword, which overcome the limitations of the existing measurement methods. They have four satisfactory properties. Firstly, new methods can measure the total conflict between any pieces of evidence simultaneously, which can satisfy the interchangeability and combinability. Secondly, they overcome the operational problem of the existing binary conflict measurement methods. Thirdly, they are more suitable for people's intuitive logic reasoning. Another, their moderate complexity are easy for project implementation. So new methods have better comprehensive effect under different evidence conditions.

This article focuses on sequences of Romance clitics wherein a pronominal form is replaced by another clitic exponent, which is prima facie morphologically unmotivated. Bonet (1991) and Harris (1994) among others have argued that these synthetic clusters can be due to the insertion of an elsewhere clitic: a default, nonspecified item that is inserted as a last resort whenever the insertion of other clitics is ruled out. In this article, independent pieces of evidence gathered from Italian and Italian dialects are shown to support this hypothesis.

Corpus Dionysiacum’s allegiance to the Origenist camp is a new research track in the unceasing effort of the scholars to discover its mysterious author. This approach has already provoked a heated debate between its supporters and appellants, each party claiming to possess indisputable evidence on its side. Unfortunately, this is nothing unusual in our times to see Corpus Dionysiacum associated with the nonChristian philosophy or with heresies, although the Fathers of the Church have reiterated constantly the Orthodoxy of these pieces of writings. For a long time ago (since the Reformation) it has been suggested that ‘Dionysius the Areopagite’ is a pseudonym used with obscure aims to deceive the uninformed readers, through an apostolic authority. The author was suspected of either covering elements from the Neoplatonic Tradition in his Corpus or of promoting a non-Chalcedonian Christology. The present article evaluates the divine name of ‘peace’ as convincing evidence for the Christian view of the Corpus, a quasi-anti-Origenist attitude, to call it so.

With critical social design put into practice, this study described and investigated transformative teaching and emancipation pieces of evidence from 21 Music, Arts, Physical Education and Health (MAPEH) pre-service teachers. The participants’ reflection logs were analyzed, with Butin’s technical lens framework as a guide. Findings revealed that the pre-service teachers encountered challenges with the students, parents, cooperating teachers and principals, which turned out to be opportunities for pre-service teachers to exercise their decision-making skills. These participants’ springboard to transformative learning and emancipation, henceforth, were the teaching strategies, principles and learning activities they acquired from their instructors. Pre-service teachers realized they could explore epistemic change as a result of reflection and contemplation.

The type and quantity of evidence in a case is a critical factor for deciding guilt but should have little or no influence on the sentencing determinations of judges post conviction; this is because case evidence goes to guilt decisions by triers of fact, whereas sentences are imposed upon those already convicted. This study examines the effects of evidentiary type and the total quantity of physical evidence in a case on length of custodial sentence. The results demonstrate that violent felony cases with forensic evidence and those cases with more varied pieces of physical evidence result in longer custodial sentences for convicted defendants. Thus, the findings indicate that inculpatory evidence in criminal trials has enduring effects post conviction and, more broadly, suggest that judicial discretion at sentencing is, at least in part, influenced by the judge’s confidence in the defendant’s guilt.

We report on the archaeometallurgical analysis of eight pieces of copper recovered from the Villa JMC-1 cemetery (Pitren Complex, Early Ceramic period) in the locality of Labranza, La Araucania. These artifacts provide the earliest evidence of metal use in southern Chile. They are also the southernmost prehispanic metal artifacts ever found in South America. These contextualized results complement those obtained from the analysis of an earring from Kilómetro 0—Enlace Temuco (El Vergel Complex, Late Ceramic period), an archaeological residential site dated to almost 500 years after the Labranza cemetery. Particle Induced X-ray Emission, X-ray radiography, and stereomicroscopy analyses allow us to offer an elemental characterization of the pieces, an assessment of their manufacturing process, and a comparison between the metals and alloys discovered. We follow with a discussion of proposals regarding cultural relations in the Araucania region during different time periods.

In this discussion and opinion paper, the Bureau members of the European Pathway Association present five challenges for the future of care pathways. Pathways will have to be based on the latest available evidence and international databases, and tools will have to be available. If pathways have a future, the organisations should focus on disease-specific oriented care. Evidence-based pathways, which are organised in a disease-specific oriented organisation, can lead to improvement of quality and efficiency but only if we invest in real teamwork. As a fourth challenge, the need for technical support of pathways is presented. The last piece of the future pathway puzzle is the need for patient involvement. Pathways will only lead to continuous improvement if we finally see patients as real partners in care organisation.

This study examines whether global tempo and expressive timing microstructure are independent in the aesthetic judgment of music performance. Measurements of tone interonset intervals in pianists' performances of pieces by Schumann ("Traumerei") and Debussy ("La fille aux cheveux de lin") at three different tempi show a tendency toward reduced relative variation in expressive timing at both faster and slower tempi, relative to the pianist's original tempo. However, this could reflect merely the pianists' discomfort when playing at an unfamiliar tempo. Therefore, a perceptual approach was taken here. Experimental stimuli were created artificially by independently manipulating global tempo (three levels) and "relative modulation depth" of expressive timing (RMD, five levels) in MIDI-recorded complete performances of the Schumann and Debussy pieces. Skilled pianists rated the quality of the resulting two sets of 15 performances on a 10-point scale. The question was whether the same RMD would receive the highest rating at all three tempi, or whether an interaction would emerge, such that different RMDs are preferred at different tempi. A small but significant interaction was obtained for both pieces, indicating that the listeners preferred a reduced RMD when the tempo was increased, but the same or a larger RMD when the tempo was decreased. Thus, they associated an increase in tempo with a decrease in (relative) expressive timing variation, which, in general agreement with the performance data, suggests that the two temporal dimensions are not independent.

Anterior regeneration of the annelid polychaete, Myxicola infundibulum (Montagu, 1808) is described from histological and SEM perspectives. This article provides additional evidence that anterior and posterior regeneration of isolated worm pieces does occur in this species, but that regenerative ability is restricted to abdominal pieces obtained from small individuals (less than 5 mm in thorax diameter and 10–20 mm in length). New cartilage tissue forms within the regenerating crown, but thoracic regeneration is limited to three segments. Anterior and posterior regeneration occurred within isolated pieces excised from the abdomen, resulting in the formation of 13 clones, with up to five individuals per clone.

In 1989, it was proved that thunder is not caused by the thermal expansion of the lightning channel. The present paper suggests that it is the result of an air explosion driven by the liberation of chemical bond energy from the N2 and O2 molecules. This has been confirmed by laboratory experiments with air arcs of lightning strength. These arcs are short pieces of lightning strokes and their formation is accompanied by thunder-like sonic booms.

Total knee arthroplasty (TKA) is expounded to intense postoperative pain with a desire for early ambulation and reduce postoperative complications. Adductor canal blockade (ACB) blocks primarily the pain sensation while preserving the quadriceps strength facilitating early rehabilitation after knee surgery. ACB has been gaining popularity over femoral nerve block (FNB), continuous epidural analgesia (CEA), and psoas compartment block (PCB). Studies show that use of ultrasound alone reduced the possibilities of vascular and multiple skin punctures. Though there's emerging evidence proving the efficacy of ACB, there's limited literature on safe use of continuous ACB catheters. We report 2 cases of catheter fracture with USG guided ACB employed in TKA.
