: Pearlitic steels could appear to be a simple and classic microstructure, with a rather simple eutectoid composition containing twophases (cementite and ferrite) in a lamellar distribution. However, they feature a hierarchical microstructure, which is composed of nodulesthat present the same crystallography and are grain-equivalent, then the nodules comprise the colonies that contain the parallel ferrite andcementite lamellas at a nanometric scale. As a result, pearlitic steels offer high strength and ductility at a reasonable cost, which fits verywell for various structural and reinforcement applications, e.g., steel core, bridge cables, wire ropes, springs…Although pearlitic steels areknown and vastly studied for over 150 years, it could appear outrageous to still propose manners of improving their mechanical properties.However, some options have not yet been considered such as the microstructural gradient or the control of the pearlite morphologies. Themicrostructural gradient concept has been widely explored in simple microstructure in steels, such as ferrite or austenite, but it is morecomplicated to export it in the pearlitic steel. The present Ph.D. aims to investigate the feasibility of producing a microstructural gradient infully pearlitic steels and of controlling the pearlite morphology. It is sought the understanding of the involved metallurgical mechanisms andthe impact on the mechanical properties, especially fatigue, considering the final application of this material. The control of themicrostructure and the gradient is based on the transformation of austenite into pearlite and, therefore, all the parameters that couldinfluence this transformation must be studied. It includes heat treatment parameters (heating rates, cooling rates, cooling modes,temperature of transformation…) and materials ones (initial interlamellar spacing, deformation state of pearlite…). The spacing between theferrite and cementite lamella, known to govern the mechanical properties of pearlitic steels, varies with the transformation temperature,which results in coarse and fine pearlite when transformed at high or low temperatures, respectively. It is found that a microstructuralgradient of interlamellar spacing is possible to be formed but is limited by the rod diameter. Using the dilatometer, it was successfullyprocessed in a 6 and 12 mm diameter rod. The gradient-containing wires were then drawn and the mechanical properties before and afterdrawing are compared to assure that the gradients formed during the heat treatment of the 6 mm diameter wires are still present on the2.25 mm final diameter wires. The morphology of pearlite has also been modified by control of heat treatments using continuous andisotherm cooling. Divorced, connected and well-aligned perfect pearlites with the same interlamellar distance have been processed. It turnsout that the morphology of the monolithic pearlite specimen has a higher impact on cyclic plasticity than the presence of a gradient. Theresults obtained in this Ph.D. gave rise to discussions on the pearlitic transformation under continuous and isotherm cooling, on themechanisms controlling the morphology of pearlite (mostly divorced or lamellar), on the phenomena happening during heating,(recrystallization, recovery, and spheroidization), and also on the mechanisms of plasticity of pearlite. Finally, the feasibility of the productionof the gradients by real cooling technologies is assessed by transforming the wires in a pilot line. It is of most interest that the gradients areproduced by alternative cooling technologies since the lead patenting technique is not the most environmentally friendly, although the mostwidely used

This study has the objective to analyze aspects relating to intellectual property of biotechnology in order to identify whether it is a monopoly or development for sustainability, starting with case analysis of application for biotechnology patent held by the company Integra. It is intended to also report brief evolutionary history of intellectual property in Brazil and the world; address aspects related to the constitutionalisation of intellectual property rights in Brazil; introduce the concept given by the doctrine to intellectual property; addressing aspects related to biodiversity and sustainability. The problem situation that if you want to answer is: the intellectual property of biotechnology can be considered a monopoly or development to sustainability? The type of research used as the means is the literature. As for the purpose, the research is exploratory. The problem approach is qualitative. For better presentation, the development is divided into chapters. In the first chapter, which takes care of addressing intellectual property in Brazilian law, seeks to report soon evolutionary history of intellectual property in Brazil and worldwide, as well as addressing issues concerning the constitutionalization of intellectual property rights in Brazil. Also in its bulge is intended to present the doctrinal concept of intellectual property. In the second chapter, the objective is to address issues related to biodiversity and sustainability. The third chapter aims to analyze aspects relating to intellectual property of biotechnology, to identify it comes to monopoly or development for sustainability.
Esse estudo tem por objetivo geral analisar aspectos referentes à propriedade intelectual de biotecnologias, visando identificar se trata-se de monopólio ou de desenvolvimento para a sustentabilidade, partindo-se de analise de caso concreto de pedido de patente biotecnológica realizado pela empresa Integra. Pretende-se, ainda, relatar breve histórico evolutivo da propriedade intelectual no Brasil e no mundo; abordar aspectos referentes à constitucionalização dos direitos intelectuais no Brasil; apresentar o conceito dado pela doutrina para propriedade intelectual; abordar aspectos referentes à biodiversidade e sustentabilidade. A situação-problema que se pretende responder é a seguinte: a propriedade intelectual de biotecnologias pode ser considerada um monopólio ou desenvolvimento para a sustentabilidade? O tipo de pesquisa utilizado, quanto aos meios, é a bibliográfica. Já quanto aos fins, a pesquisa é do tipo exploratória. A abordagem do problema é qualitativa. Para melhor apresentação, o desenvolvimento está dividido em capítulos. No primeiro capítulo, que cuida de abordar a propriedade intelectual no direito brasileiro, busca-se relatar breve histórico evolutivo da propriedade intelectual no Brasil e no mundo, bem como abordar aspectos referentes à constitucionalização dos direitos intelectuais no Brasil. Também em seu bojo se pretende apresentar o conceito doutrinário de propriedade intelectual. No segundo capítulo, objetiva-se abordar aspectos referentes à biodiversidade e sustentabilidade. No terceiro capítulo, propõe-se analisar aspectos referentes à propriedade intelectual de biotecnologias, visando identificar se trata de monopólio ou de desenvolvimento para a sustentabilidade.

Por medio del presente trabajo se presenta una investigación que tiene como objetivo zanjar la naturaleza jurídica del tributo de patente municipal que regulan los artículos 23 y siguientes del Decreto Ley N° 3.063 de 1979 “Sobre Rentas Municipales”1. En específico, el análisis pretende dar con la correcta calificación de la patente municipal dentro del género de los tributos, dilucidando si es que se trata de un impuesto, de una contribución especial o de una tasa. Con miras a este fin, el trabajo se estructura en dos partes. Una primera parte, en que se propone el marco teórico: se expone sobre el desarrollo doctrinario que en derecho comparado han tenido los distintos tipos de tributos, presentándose además la posición del autor para cada temática específica tratada. Y una segunda parte, en que se presenta un análisis particular del tributo de patente municipal, partiendo de la base del marco teórico propuesto.

The market economy today has evidenced the increasing importance of a structured and balanced patent system in view of the controversy that has arisen, creating a pendulum that swings between the stimulus for technological-scientific innovation and development on the one end, and the resulting social burden on the other. This is because the right to exclusivity of an invention which involves technological development based on preexisting knowledge - generates social costs since the society at large is impeded from enjoying technological advances during a certain period of time (the patent term), and moreover is submitted to prices and methods of economic exploitation determined by the patent holder. The patent system must be thoroughly restructured to deal with the patent holders benefits versus the demands of society. Within this context, the importance of two legal principles emerges: patenting exclusions (or prohibited patenting of certain items) and exceptions and limitations on the exercise of the right to exclusivity granted the patent holder (or limitation of the patent right). The purpose of this study is to analyze from the standpoint of Comparative Law (international treaties, regional treaties and foreign legislation) the principles of exclusions and exceptions and limitations on patent rights, mainly considering the new developments in areas such as genetic engineering, molecular biology and information technology to confirm whether there is international harmonization; whether there is a difference in the stands adopted according to the level of development in the country and regulation of these events in Brazil. Finally, based on Comparative Law it can be seen how foreign counties deal with new inventions, the different stands adopted in their laws or in construction of case law, all of which make any intention for attaining harmonization a long path to be tread; and to conclude the stand adopted in Brazil with proposals for interpretation.
