This thesis is an investigation of architecture in terms of its importance to individual and cultural understanding of context and belonging. Architecture should be viewed as more than a mark on the landscape; it is a critical element of identity enabled through a continuous process of discovery, learning, and growth as a function of sensory perception. The project used to illustrate this thesis is the Roanoke Catholic School at the crest of St. Andrew's Hill in Roanoke, Virginia. St. Andrew's Roman Catholic Church serves as an important landmark in the city; therefore, the new school must contribute to the site and enhance the presence of the church as viewed by the residents of Roanoke. Likewise, the design of a private school which accommodates grades pre-Kindergarten through 12, provided the opportunity to show how the built environment may reflect varying needs of students as they grow, intellectually and physically, and the development of a sense of community in the school. Architecture becomes an active participant in the lives of people both inside and outside of its specific content.

In this study fourteen child protection mediators responded to questions about their work through questionnaires, interviews, or both, and grounded theory methodology was used. The data was analyzed and the following four themes emerged: describing the process, explaining the process, strategies for managing the process, and evaluating success in managing the process. Key findings were that there are differences between the process issues that exist in the child protection context as compared to other types of mediation, successful process management strategies include having a pre-mediation orientation session and using non-party participants as a positive influence, and success is indicated by changes in the communication between the parties or personal empowerment as well as by whether an agreement is reached.

Scholars have debated whether mediator impartiality or mediator interest plays a more vital role in bringing about a successful outcome. This research develops a comprehensive model that accounts for mediation occurrence and medication outcome in terms of an additive model of both mediator impartiality and mediator interest. The two channels through which mediators influence the changes of mediation and occurrence and outcome are hypothesized to be two dimensions of trust, mediator fairness and mediator capacity. This research argues 1) that mediator impartiality contributes to successful mediation outcomes by improving disputants’ trust in mediators’ fairness and 2) that mediator interest increases the likelihood of successful mediation outcomes by improving disputants’ trust in mediators’ capacity. Therefore, this research hypothesizes that the levels of mediators’ impartiality and mediators’ interest do not have individual effects on mediation occurrence and outcome. It argues, rather, that the additive level of the two variables determines the likelihood of mediation occurrence and successful outcome. The hypotheses of this research are tested using quantitative analysis of 294 interstate mediation cases carried out by states between 1945 and 1999 and qualitative analyses of the Philippines’ mediation of the Borneo dispute between Malaya and Indonesia in 1964 and Syria’s mediation of the border dispute between North Yemen and South Yemen in 1979. Both sets of analyses support the researcher’s claim that it is the additive level of impartiality and interest, rather than the individual level of both variables, that affects the chance of mediation success being achieved.

The field of mediation within peace and conflict studies has remained almost entirely focused on state-based armed conflicts and traditional non-state armed groups (NSAG). This restricts our ability to address other actors and emerging forms of conflict in non-conflict and post-conflict settings. This includes a certain classification of gangs who display strong similarities to typical NSAGs. This study analyses gang mediation and its effects on levels of violence in gang conflicts in El Salvador through the lens of traditional mediation theory from the field of peace and conflict studies. It seeks to answer the question, how does mediation influence levels of violence within gang conflicts? More specifically, addressing the hypotheses that, mediation between gangs, and government support for mediation, will likely lead to lower levels of violence. Using a qualitative comparative case study method, employing a structured, focused comparison between three different time periods in El Salvador, I find support for both hypotheses, showing that gang mediation leads to a significant reduction in violence albeit conditional on government support. In addition, factors such as dialogue, information sharing, leverage, concessions and the signing of an agreement are essential in the process between mediation and lower levels of violence.

The number of conflicts with religious dimensions has been steadily increasing over the last few decades. Previous research has found that religious conflicts are less likely to end by mediation whilst little research has been done as to what makes them initiate mediation. Building upon Ripeness Theory, this paper argues that the religious component makes religious parties less sensitive towards mutually hurting stalemates, but not immune to them, due to their heterogenous nature. This proposition is analysed by examining the empirical pattern of mediation onset in conflicts over religious incompatibilities using a logistic regression analysis. The findings suggest that higher numbers of average battle-related deaths, together with the duration of conflict and presence of crude oil reserves, increase the likelihood of mediation onset, whilst differentiations in centrality of a religious goal or religious identity divides have no statistically significant effect.

The objective of this bachelor thesis was to examine and analyse the psychological factors that were important in mediation processes on local, regional, national and international levels in Ethiopia. The research questions were what these psychological factors were and how they affected the mediation process. A qualitative, semi-structured method was used and six informants with experience as mediators have been interviewed in Ethiopia. The psychological factors identified were self-esteem, losing face, ability of letting go, and mirroring. The conclusion was that this research confirmed the findings of much of the previous research, in regards to the psychological factors active in the process. The research also revealed that the psychological factors needed to be considered in the light of the Ethiopian culture and it´s collective nature.

The field of mediation tend to shift as practitioners and theorists make new recommendations concerning how the mediation practice should be conducted. The United Nations play a crucial role in this, its work involves providing training and guidance for new mediators through various arms of their system. This thesis is analyzing the 2010 publication A Manual for UN Mediators: Advice from UN Representatives and Envoys to identify which skills and strategies they are recommending, through Braun and Clarke’s (2006) six step approach to thematic analysis, connecting to the social constructionist paradigm. According to social constructionism, all mediation practices are based on ideological or value premises. Therefore, the identified recommendations are analyzed and discussed at the level of underlying ideologies. In particular, through the lenses of a problem-solving and transformative approach to mediation. Resultingly, a total of 12 themes relating to recommended mediation strategies and skills are identified, with both approaches to mediation being identified in the themes relating to the strategies and discussed within this regard.

The study aims to discover the strategies and techniques used by community mediators in the People's Republic of China. Previous research argues that mediator legitimacy in China draws on state authorization and the mediator's community standing. In contrast to Western conceptions of the mediator's role as a neutral facilitator of dispute resolution, research suggests that Chinese mediators openly speak on behalf of community norms, calling on disputants to subordinate personal preferences in the interest of maintaining harmonious relationships and governmental policies and legal regulations. The legitimacy of the mediation process depends more on a persuasive articulation of community norms than an impression of mediator neutrality. However, this account of Chinese mediation has been based solely on interview and questionnaire data. How (and whether) this contrast between self-report measures and mediation techniques in practice actually manifests itself in mediator discourse, at what stages, and to what degree has not really been observed or analyzed. This study records and analyzes community mediation cases to better understand what features are prevalent in mediation discourse. Cases were selected in both rural and urban areas. Discourse analysis is applied to transcripts so as to provide direct and detailed picture of how mediation is conducted in reality. Strategies typical of Chinese mediation, relative to American mediation are identified and illustrated with excerpts from the transcripts. Neutrality and power distribution are discussed and compared with their roles in American mediation. Their implications for political, social and cultural aspects are drawn to provide a glimpse of contemporary Chinese society and how resolution is created. Future research directions are pointed out with regard to mediator's gender difference, the location where the mediation happens (urban and rural) and the socio-economic class of disputants (e.g., migrant workers) involved in the mediation.

Cyclodextrin mediation offers a unique mechanism with the potential for interesting control of reaction parameters. Cyclodextrin mediation of hydrophobic monomers may offer desirable kinetics over conventional free radical polymerizations, and it has been shown in this work that cyclodextrin mediation facilitates polymerization of hydrophobic monomers in aqueous solution and in ethylene glycol. It also may be a facile method for controlling relative reactivity of comonomer mixtures. In addition, complexation of cyclodextrin with guest molecules has been utilized in selective synthesis where the host cyclodextrin has been utilized to sterically hinder the attack of certain reactive sites contained within the host cavity. This aspect of inclusion complexation could also be utilized in free radical polymerizations of monomers with multiple reactive double bonds to preferentially reduce the reactivity of the hindered reactive sites. This thesis involves the use of methylated(1.8)-beta-cyclodextrin (MeCD) as a mediator for polymerizations in solvents that would not facilitate polymerization of the pure monomer in the absence of cyclodextrin. This study focuses on the carbohydrate mediation of a series of methacrylic monomers. t-Butyl methacrylate, n-butyl methacrylate, cyclohexyl methacrylate, and 2-ethylhexyl methacrylate were complexed with methylated(1.8)-beta-cyclodextrin and subsequently dissolved in either water or ethylene glycol. The complexes were studied by 1H and 13C NMR spectroscopy, thin layer chromatography, CPK modeling, and thermogravimetric analysis, and were found to have molar ratios of cyclodextrin to monomer as high as 1.0 to 0.72. These complexes were then free radically polymerized in either water or ethylene glycol and resulted in high molecular weight polymers that precipitated out of solution, allowing for facile polymer isolation through filtration. Isolated yields were found to be as high as 86 %. The majority of the cyclodextrin remained in solution after polymerization. It was also recovered and found to be recyclable. Heterogeneous polymerizations were also performed with 2-ethylhexyl methacrylate in which linear dextrin and methylated (1.8)-beta-cyclodextrin were used in emulsifier quantities. It was found that linear dextrin, at concentrations of 3.0 wt% produced a stable latex product with high molecular weight and an isolated yield of >90%. MeCD on the other hand failed to produce a stable emulsion at concentrations between 0.9-3.0 wt%, but remarkably MeCD at 3.0 wt% gave high molecular weight coagulated polymer with a yield of >90%. It is proposed that a heterogeneous mechanism inconsistent with the four major types discussed by Arshady is taking place. Unlike typical suspension or emulsion polymerizations, the cyclodextrin mediated polymerizations are completely homogeneous at the onset, making them more like a dispersion or precipitation polymerization. However, in dispersion and precipitation polymerizations the pure monomer is soluble in the reaction media. In the absence of cyclodextrin, the monomers utilized in this study possessed no appreciable solubility in the reaction media. Therefore, it is proposed that cyclodextrin acts as a phase transfer agent, effectively solublizing the hydrophobic monomer and allowing for the aqueous dispersion or precipitation type polymerization to occur, depending on the relative solubility of the components. Bulk polymerizations of t-butyl methacrylate, cyclohexyl methacrylate, and 2-ethylhexyl methacrylate and their subsequent use in the preparation of carbohydrate/poly(alkyl methacrylate) blends was also performed in this project. Bulk polymers were utilized as references for physical properties for the polymers produced through polymerization of the MeCD/monomer complexes in either aqueous solution or in ethylene glycol. 1H NMR analysis of the polymers from both the cyclodextrin mediation and bulk polymerizations indicated that the tacticity of the polymers produced in both cases were identical. The bulk polymers were also used in the preparation of carbohydrate/methacrylic blends with potential applications in the areas of selective barriers, biodegradable films. Inclusion of drug molecules or antioxidants into these cyclodextrin containing films also may have potential in drug delivery, or food packaging applications. In addition, the side chain liquid crystalline monomer, 6-(4-hexyloxy-biphenyl-4-yloxy)hexyl methacrylate was synthesized in high purity via a three-step procedure and confirmed by a combination of mass spectrometry, thin layer chromatography, and 1H and 13C NMR. This hydrophobic liquid crystalline monomer was subsequently complexed with 1.0-3.0 equivalents of methylated(1.8)-beta-cyclodextrin in an attempt to alter the water solubility of the monomer. Complexes of this side-chain liquid crystalline monomer have not been studied previously and it is proposed that complexation with cyclodextrin will lead not only to novel polymerizations routes for this monomer, but also to novel smectic phases for this thermotropic liquid crystalline polymer.

The mankind constantly seemed to walk around it, but for a long time did not dare to apply. The first ideas about mediation in the state in which we are accustomed to seeing it were voiced in 1976 in the United States, when a historic conference named after R. Pound entitled "Causes of public dissatisfaction with the administration of the US justice system", which made a real breakthrough in mediation. It was at the Pound Conference that two documents were published, which became the foundation for the most famous alternative way of resolving disputes.

The major goal of information integration is to provide efficient and easy-to-use access to multiple heterogeneous data sources with a single query. At the same time, one of the current trends is to use standard technologies for implementing solutions to complex software problems. In this dissertation, I used XML and XQuery as the standard technologies and have developed an extended projection algorithm to provide a solution to the information integration problem. In order to demonstrate my solution, I implemented a prototype mediation system called Omphalos based on XML related technologies. The dissertation describes the architecture of the system, its metadata, and the process it uses to answer queries. The system uses XQuery expressions (termed metaqueries) to capture complex mappings between global schemas and data source schemas. The system then applies these metaqueries in order to rewrite a user query on a virtual global database (representing the integrated view of the heterogeneous data sources) to a query (termed an outsourced query) on the real data sources. An extended XML document projection algorithm was developed to increase the efficiency of selecting the relevant subset of data from an individual data source to answer the user query. The system applies the projection algorithm to decompose an outsourced query into atomic queries which are each executed on a single data source. I also developed an algorithm to generate integrating queries, which the system uses to compose the answers from the atomic queries into a single answer to the original user query. I present a proof of both the extended XML document projection algorithm and the query integration algorithm. An analysis of the efficiency of the new extended algorithm is also presented. Finally I describe a collaborative schema-matching tool that was implemented to facilitate maintaining metadata.

This thesis addresses the question: how do individuals in a conflict society engage in peaceful dispute resolution through mediation? It provides a close look at Israeli society, in which people face daily conflicts. These include confrontations on many levels: the national, such as wars and terror attacks; the social, such as ethnic, religious and economic tensions; and the personal level, whereby the number of lawyers and legal claims per capita are among the highest in the world. The magnitude, pervasiveness, and often existential nature of these conflicts have led sociologists to label Israel a ‘conflict society’.   Mediation practice came into this society and challenged the existing ethos and norms by proposing a discourse of dialogue and cooperation. The thesis focuses on the meeting point that mediation engenders between narratives of conflict, which have developed in this environment, and the mediation processes, which set out to achieve a collaborative discourse and mutual recognition.   The fieldwork, forming the core of the thesis, consists of the observation of supervised mediation processes of civil disputes in two leading mediation centres, and interviews with professionals and key figures in the discipline. The wide variety of voices of a broad range of interviewees and many different parties provide for rich, qualitative data.   The use of the narrative‐ethnographic approach in observing mediation processes helps identify key themes in participantsʹ  narratives. The subsequent analysis leads to the insight that these mediation processes reflect, in a subtle way, the narratives, beliefs and needs of individuals in a conflict society. The findings from this study indicate that perceptions of life in a conflict society are clearly manifested through mediation processes. These place obstacles and inhibit the attainment of agreements. Yet, surprisingly, some of the findings also demonstrate an aversion to conflict and a well‐expressed desire to maintain communication and to achieve peaceful resolution.

This paper is written from the Standpoint of a participant observer and forms an exploratory case study examining the ethical dimension of commercial mediation in the context of its professionalisation. It brings together a series of papers written between April 2001 and June 2002. They are presented here in a revised form and different order as chapters oscillating between the changing context of commercial mediation and a discussion of particular sociological and ethical concepts. The paper attempts to identify the theoretical territory of the study of professions and professionalisation and the ethical perspectives and moral categories which describe the territory. It addresses the problems encountered in attempts to develop an abstract theory of professions which has generally been polarised between attribute and processual approaches. Issues which emerge include conflicts of professional roles arising from different understandings of what a profession is for, the duty of a profession to serve the public good, the legitimacy of professional authority and the accountability of Professionals. These issues are often expressed as a tension between the ideal of autonomy of a profession and consumer demand for accountability; a tension between the principles of service on which a profession is said to be ethically based and an ethics of responsibility demanded by the market. At the same time, the economic context in which professions emerge and develop gives rise to ethical considerations about the effects of the dominant economic System and the function of trust as an element of social capital. The approach in this paper is to take professionalisation as a dynamic and historical concept which involves both an ideological and ethical strategy in the development of an occupational group. It suggests that ethical perception in Professionals could develop more practically by freeing the conceptualisation of professions from making distinctions in ethical roles between professions and business based on the oppositions of shared and self interest. The relevant emphasis rests not in what Professionals do and how long they take to learn to do it but who Professionals are as persons; that is, the difference between being a professional and being professional. But clearly professional work does not lie in just 'being'. The degree to which a professional is required in commercial mediation is one that the concept of the trusted mediator must account for. Using this concept to develop an ethical framework, the paper finally discusses policy implications regarding the professionalisation of commercial mediation.

This dissertation focuses on the effects of a third-party mediator in protracted conflict settings. I primarily use formal models based on game theory and mechanism design, employing case studies and empirical work to further my analysis. The question of mediation effectiveness in the literature is still an open one, addressed empirically but with little theoretical support. While some work has emphasized the important role of enforcement, there is no consensus as to whether, how and why these tactics work. I use formal modeling to examine the mediator's enforcement ability and show the ways in which manipulative mediation can in fact improve upon bilateral results.

The first chapter examines the use of different types of enforcement in conflict mediation. This paper compares potential outcomes of bilateral negotiations with the outcomes achievable with the help of a mediator capable of various levels of enforcement, seeking to gain insight into how to end ongoing war using a signaling framework. I find that a mediator with sufficient enforcement capabilities can improve on the bilateral outcome, perhaps creating peace that would not have been possible bilaterally. However, while exhibiting enforcement capabilities can help a mediator to mandate peace in the short term, there can sometimes be a lower likelihood of lasting results, consistent with stylized facts about mediation.

The second chapter models conditions for efficiency gains from third-party conflict mediation when concessions are risky. Each party engaged in a conflict can indicate its interest in peace through costly signaling, or concessions. Through a formal model, I explore ways in which a mediator can act as a guarantor that promised concessions will be delivered, thereby reducing inefficiencies and increasing the potential for peace. In this process, I open up a rationale for mediation: to remove the inefficiencies of signaling in the pre-play round of negotiations.

The third chapter uses a game-theoretic framework to explain the persistence of de facto independent states that are not internationally recognized. This paper uses a four-player, game-theoretic framework to model the stalemates that often arise between the secessionist elite and home state central government and leverages this model to explore paths to settlement. We emphasize the pivotal role of an outside patron in sustaining unrecognized statehood as a stable equilibrium, but we also argue that the international community is capable of inducing peaceful settlement in these conflicts if it is sufficiently motivated to do so.

Many scholars have researched on the effects of individual mediation strategy following the categorization by Touval and Zartman (1985), and Bercovitch (1991). Despite the growing recognition of the potential synergetic effects among different strategies, not many systematic studies have been done on that aspect. This thesis contributes to this understudied aspect of mediation approach by asking What is the impact of mediation strategy on quality peace after civil war? The study adopts the method of structured, focused comparison along with the detailed process tracing on four cases of peace agreements and their mediation process from Northern Ireland, Mindanao, Bosnia and Herzegovina, and Niger. The study aims to test a theoretical argument linking combined-application of mediation strategies with high quality peace. The empirical findings provide a modest support to hypothesis and a weak support to the causal mechanism, as not all cases, having applied all three strategies, have achieved high quality peace and have promoted third-party guarantee and inclusivity. While the empirical findings point to other contextual factors that may affect the peace agreement implementation, the findings also indicate a potential promising mediation approach that combines directive strategy either with communicative-facilitative or procedural strategy putting more weight on the latter strategy.

This research project explores how photographs of an installation can recontextualise specific Brisbane sites to initiate dialogues about human interaction. The sites chosen are peripheral, located at the edges of significant human activity and largely disregarded. Through installing the reductive form of the cube, I aim to engage with the nature and geometry of the sites. The cube has a rich presence in art as a material object of mathematical form that can prompt a re-evaluation of the surrounding environment. Artists such as Tony Smith, Hans Haacke, Antony Gormley, and Ilkka Halso have used to the cube in installations to interrogate sites and to initiate dialogues. The cube as referenced by these artists has much to do with scale and human presence. Similarly, my use of the cube, encapsulated in my photographs, aims to mediate the selected sites by creating a sense of dislocation that could stimulate dialogues about places, history, and human impacts.

Because of the many problems associated with litigating family disputes, mediation has been proposed as an alternative. Its proponents, claiming wide-ranging benefits for both the litigants and the legal system, have had tremendous success in advancing mediation in social policy. Because of the significant growth in the use of mediation across the country, this dissertation critically assesses the validity of its claimed benefits. The dissertation first considers the role of pro se representation and its potential consequences for evaluating mediation because of the increased use of pro se representation in divorce cases. The dissertation then describes mediation and the range of mediation practices that exists in this country. Because mediation varies considerably program to program and jurisdiction to jurisdiction, it is difficult to draw definitive conclusions across programs or jurisdictions. Therefore, another approach is used to assess the rationality of mediation laws--namely, evaluating the validity of the behavioral assumptions (e.g., presumed benefits) underlying these laws (Sales, 1983). The dissertation then articulates the goals attributed to the mediation process, litigants, and the legal system, identifies the behavioral assumptions underlying those goals, and critically reviews the social science data and theory that have directly tested the validity of the goals and assumptions or are indirectly relevant to the analysis. It is argued that the goals of divorce mediation may have been and may be unrealistic. The dissertation concludes by discussing the limits of current findings and suggesting future research to address these concerns.

The community mediation movement has arisen in response to criticisms of the American judicial system. Advocates claim it can counter the role of law in reproducing ideologies that disadvantage subordinate groups, such as women. But this potential relies in part on the ideological positions of the mediators themselves. This study evaluates the counter-hegemonic potential of community mediation in regard to a gendered social power structure through an ideological analysis of sixteen male volunteer community mediators in Tucson, Arizona. Arguing against a narrow economic or gender reductionist analytical approach, this study relies on a neo-Gramscian perspective to uncover the multiple factors that determine this ideology. What emerges is a gender ideology that at once contains a "feminist" critique of social power structures yet is filled with contradictions. This implies that the community mediation movement must continue to struggle if it is to become a genuinely counter-hegemonic movement.

A swarm is a group of uninformed individuals that exhibit collective behaviors. Without any information about the external world, a swarm has limited ability to achieve complex goals. Prior work on human-swarm interaction methods allow a human to influence these uninformed individuals through either leadership or predation as informed agents that directly interact with humans. These methods of influence have two main limitations: (1) although leaders sustain influence over nominal agents for a long period of time, they tend to cause all collective structures to turn in to flocks (negating the benefit of other swarm formations) and (2) predators tend to cause collective structures to fragment. In this thesis, we present the use of mediators as a novel form for human-swarm influence and use mediators to shape the perimeter of a swarm. The mediator method uses special agents that operate from within the spatial center of a swarm. This approach allows a human operator to coordinate multiple mediators to modulate a rotating torus into various shapes while sustaining influence over the swarm, avoiding fragmentation, and maintaining the swarm's connectivity. The use of mediators allows a human to mold and adapt the torus' behavior and structure to a wide range of spatio-temporal tasks such as military protection and decontamination tasks. Results from an experiment that compares previous forms of human influence with mediator-based control indicate that mediator-based control is more amenable to human influence for certain types of problems.
