Abstract The proliferation of actors in the business of making peace has led to an increase in the frequency of multiparty mediations, with both positive and negative consequences. The purpose of this article is to simplify the complexity that often accompanies multiparty mediations by applying the structuralist and social-psychological dichotomy of negotiations to a model of parallel mediation. I propose that coupling structuralist and social-psychological mediations together in a parallel mediation can leverage the respective strengths of each to more effectively find a negotiated solution. Given the fiscal and political realities facing peacemakers, finding ways to increase the frugality and simplicity of cooperation between mediators is essential. The limited cooperation needed in parallel mediations does just that. This article analyzes how the parallel mediation model has been applied to two conflicts, the intrastate Tajik civil war and the interstate Ecuador-Peru border dispute. This analysis identifies five characteristics that were observed in these two successful examples of parallel mediation, and serves as a starting point for additional research.

Purpose – The purpose of this paper is to obtain insight into court-referred mediation in the Israeli Labor Courts, by analyzing its processes and outcomes, as a function of tactics used by both the disputants and the mediator. Design/methodology/approach – Observation of 103 court-referred mediations, for each of which a detailed process and outcome were documented. Data on disputants' refusal to participate in the mediation was also collected. At the end of each mediation case, disputants were given a questionnaire in which they expressed their satisfaction with the outcome and their evaluation of the mediator's contribution. Findings – A low rate of refusal to participate in court-referred mediation was found. Also, the higher the ratio of soft tactics to pressure tactics employed (by all parties involved) during the process, the higher the rate of agreements. Mediators use significantly more soft tactics than disputants, and are more active in using tactics. The two significant variables that predict the mediation's agreement are the ratio between soft tactics to pressure tactics used by all parties, and mediator contribution to the process. Practical implications – The significant role of soft tactics in the process, outcome, and satisfaction of court-referred mediation may serve as a guideline for disputants and mediators. Originality/value – This unique research, which examines the impact of tactics on court-referred mediation, may provide added and significant theoretical insight into its process and outcome, as well as a better understanding of other “hybrid” (compulsory at the beginning, voluntary at the end) mediations.

Purpose This study aims to more deeply examine the various types of testing mediations and use the comparison test by using test-based mediation Sobel models and Bayesian approach. The purpose of this study are to apply the traditional (using indirect effect) and Sobel test, extend Yuan and MacKinnon (2009) work on Bayesian mediation analysis. Both analysis methods of mediation (Traditional, Sobel Test and Bayesian estimation) should apply in the research of management, by using structural equation modeling (SEM) in a structural model, with one mediation, one exogenous (independent) and one endogenous variable. The meta-analysis approximation has been used to investigate the job satisfaction as a mediation in the relationship between employee competence and performance (endogenous). Design/methodology/approach Data were collected from ten dissertations of students of the Management Doctoral Program at the Brawijaya University from 2009 until 2013; data were analyzed for the mediation variable of job satisfaction (M) in the relationship between employee competence (X) and employee performance (Y) (Muindi and Obonyo, 2015; Olcer, 2015; Sattar et al., 2015; Khan and Ahmed, 2015). A researcher can determine the mediating variable and whether it is complete or partial or if mediation exists in several ways. Findings The results of the above findings using meta-analysis showed that 60% of previous research states that job satisfaction is a partial mediation on relationship competence of the performance, 10% of previous research states that job satisfaction is a full mediation on relationship competence of the performance and 30% stated that job satisfaction is not pemediasi (pemediasi means Mediation variable) on the relationship between competence and performance. This research found that all three approaches provide similar conclusions for ten previous research. Research limitations/implications The findings showed that the Sobel approach and the Bayesian approach provide results that are more sensitive than the traditional approach. Practical implications In my opinion, the rule to investigate the mediation variable should be completed with the conditions (1) q (theta) is not statistically significant, (2) α (alpha) and β (beta) are significant, and (3) q’ (theta) is significant, and increase when M is include as an additional predictor. This condition called partial mediation. Social implications The traditional method is simpler and easy. The method is less sensitive and is not sufficient for investigating the mediating variables. In general, the method results in a mediation variable, but it cannot be used to determine either partial or complete mediation variables. So, investigation by Baron and Kenny Methods (in Hair et al., 2010), the rule or testing called Sobel Test and another approach such as Bayesian to determine the mediation variable is necessary. Originality/value Various methods for detecting mediating/intervening have been widely used in previous research as a method of measurement using indirect effect (Hair et al., 2010), and calculations have been performed using Sobel test (Baron and Kenny, 1986) and Bayesian approach (Enders, 2013). In this study, I wanted to more deeply examine the various types of testing mediations, and use the comparison test by using the test-based mediation Sobel models and Bayesian approach (Baron and Kenny, 1986; Enders, 2013). The statistical application should not be complicated and difficult, it but must rather be simple and easy, so that it is user-friendly. The traditional method is simpler and easier than the other methods, but how sensitive is it? This research is conducted to investigate this problem. The evaluation of mediating mechanisms has become a critical element of behavioral science research (Enders, 2013), especially in the field of management, not only to assess whether (and how) interventions achieve their effects but also, more, broadly, to understand the cause of behavioral change. Methodologists have developed mediation analysis techniques for a broad range of substantive applications. However, methods for estimating mediation mechanisms with various methods have been understudied. R provides a wide variety of statistical analyses such as SEM and Mediation test. R provides an open source route for participation in that activity. The Bayesian estimation approach provides an R function and a macro that applies the method of mediation analysis.

The aims of this research are 1) to analyze the existence of mediating judges in the process of civil dispute mediation based on the Supreme Court Regulation (Peraturan Mahkamah Agung/PERMA) No. 1 year 2016 regarding the mediation procedures in court; 2) to analyze the supporting and the inhibiting factors which influence the existence of mediating judges in the process of civil dispute mediation in court. This research is a normative juridical study with primary, secondary, and tertiary law materials. The manner and the instruments to collect the legal materials are using the method of documentation and document study. Data analysis is done by analyzing the research materials qualitatively. The research results and discussion show that the existence of mediating judges in the process of civil dispute mediation based on the Supreme CourtRegulation No. 1 year 2016 regarding the mediation procedures in court becomes the main choice of the parties who are in dispute. The supporting factors of the mediation by the mediating judges in a civil dispute are: human resources, economical budget, and infrastructure. The inhibiting factors of mediation by mediating judges in civil law disputes are: the parties are not present during the mediation, the number of certificated judges, and the society’s knowledge. Based on the research results and the discussion, it can be concluded that: 1) the mediation process by the mediating judges in the solving of civil law disputes becomes the main choice of the conflicting parties, 2) the supporting and the inhibiting factors which influence the existence of mediating judges in the processof mediating civil disputes are as follows: human resources, level of knowledge or the society’s understanding, facilities and infrastructure, work burden of the judges, also the regulations in the implementation of the mediation. Suggestions regarding the results of this research are: 1) increasing the service of the mediation process by the mediating judges in court, 2) increasing the quality of the human resources, increasing the facilities and the infrastructure regarding mediation, 3) and increasing the socialization to the people regarding mediation and also the issuing of regulations on mediation which are more complete and detailed.

The aim of the work is to contrast the model of voluntary mediation in Poland with obligatory mediations introduced in Italy. This thesis is an investigation of architecture in terms of its importance to individual and cultural understanding of context and belonging. Architecture should be viewed as more than a mark on the landscape; it is a critical element of identity enabled through a continuous process of discovery, learning, and growth as a function of sensory perception. The project used to illustrate this thesis is the Roanoke Catholic School at the crest of St. Andrew's Hill in Roanoke, Virginia. St. Andrew's Roman Catholic Church serves as an important landmark in the city; therefore, the new school must contribute to the site and enhance the presence of the church as viewed by the residents of Roanoke. Likewise, the design of a private school which accommodates grades pre-Kindergarten through 12, provided the opportunity to show how the built environment may reflect varying needs of students as they grow, intellectually and physically, and the development of a sense of community in the school. Architecture becomes an active participant in the lives of people both inside and outside of its specific content.

In this study fourteen child protection mediators responded to questions about their work through questionnaires, interviews, or both, and grounded theory methodology was used. The data was analyzed and the following four themes emerged: describing the process, explaining the process, strategies for managing the process, and evaluating success in managing the process. Key findings were that there are differences between the process issues that exist in the child protection context as compared to other types of mediation, successful process management strategies include having a pre-mediation orientation session and using non-party participants as a positive influence, and success is indicated by changes in the communication between the parties or personal empowerment as well as by whether an agreement is reached.

Scholars have debated whether mediator impartiality or mediator interest plays a more vital role in bringing about a successful outcome. This research develops a comprehensive model that accounts for mediation occurrence and medication outcome in terms of an additive model of both mediator impartiality and mediator interest. The two channels through which mediators influence the changes of mediation and occurrence and outcome are hypothesized to be two dimensions of trust, mediator fairness and mediator capacity. This research argues 1) that mediator impartiality contributes to successful mediation outcomes by improving disputants’ trust in mediators’ fairness and 2) that mediator interest increases the likelihood of successful mediation outcomes by improving disputants’ trust in mediators’ capacity. Therefore, this research hypothesizes that the levels of mediators’ impartiality and mediators’ interest do not have individual effects on mediation occurrence and outcome. It argues, rather, that the additive level of the two variables determines the likelihood of mediation occurrence and successful outcome. The hypotheses of this research are tested using quantitative analysis of 294 interstate mediation cases carried out by states between 1945 and 1999 and qualitative analyses of the Philippines’ mediation of the Borneo dispute between Malaya and Indonesia in 1964 and Syria’s mediation of the border dispute between North Yemen and South Yemen in 1979. Both sets of analyses support the researcher’s claim that it is the additive level of impartiality and interest, rather than the individual level of both variables, that affects the chance of mediation success being achieved.

The field of mediation within peace and conflict studies has remained almost entirely focused on state-based armed conflicts and traditional non-state armed groups (NSAG). This restricts our ability to address other actors and emerging forms of conflict in non-conflict and post-conflict settings. This includes a certain classification of gangs who display strong similarities to typical NSAGs. This study analyses gang mediation and its effects on levels of violence in gang conflicts in El Salvador through the lens of traditional mediation theory from the field of peace and conflict studies. It seeks to answer the question, how does mediation influence levels of violence within gang conflicts? More specifically, addressing the hypotheses that, mediation between gangs, and government support for mediation, will likely lead to lower levels of violence. Using a qualitative comparative case study method, employing a structured, focused comparison between three different time periods in El Salvador, I find support for both hypotheses, showing that gang mediation leads to a significant reduction in violence albeit conditional on government support. In addition, factors such as dialogue, information sharing, leverage, concessions and the signing of an agreement are essential in the process between mediation and lower levels of violence.

AbstractMediation occurs when a third variable, referred to as a mediator construct, intervenes between two other directly related constructs. More precisely, a change in the exogenous construct results in a change of the mediator construct, which in turn changes the endogenous construct. The mediator analysis evaluates the factors related to the cause–effect relationship between an exogenous construct and an endogenous construct. In the simplest form, the analysis considers only one mediator construct, but the path model can also include multiple mediating constructs simultaneously, as well as moderated mediation. We illustrate mediation analysis in PLS-SEM by using the SEMinR package and the corporate reputation model as an example.

In contemporary conflict resolution research, integrating diverse data sources and innovative methodologies is crucial for understanding mediation events and actors. This paper presents the Global Peace Actors Database (GLO-PAD), an event-based mediation database built through a pioneering and layered data collection process. Leveraging various sources such as the Barcelona Peace Talks in Focus Report, International Crisis Group's Crisis Watch, PA-X Peace Agreements Database, and reports from international organizations, GLO-PAD offers a nuanced view of mediation dynamics. Unlike previous datasets, GLO-PAD employs a large-scale web scraping approach, integrating the universe of potential mediation event sources to capture granular mediation event data worldwide from 1988 to present. It transcends political negotiations to encompass all conflict-related mediation, thus broadening temporal and spatial scope of previous mediation data attempts. GLO-PAD assesses mediator bias, identifies emerging actors, and utilizes semi-automated techniques for comprehensive data collection. This innovative approach addresses mediation's increasing fragmentation, providing valuable insights for conflict resolution scholarship and practice.

The process of overcoming a conflict in mediation using constructivist ideas is revealed in the study. A mediator’s roles in the frame of the constructivist approach represent the topicality of the study. The mediator’s role is analysed and the emphasis is on the constructivist frame. The mediator’s pedagogical role is in the centre of the study. In the process of the study, the aim was to find out theoretical explanations of the meaning of the constructivist approach in mediation, how it occurs and what is the role of mediator in the mediation process based on dialogue? The methodology of the study comprises a theoretical assessment of the role of the mediator based on a constructivist approach with a purposeful emphasis on a dialogue between parties. The mediator facilitates a dialogical mediation process being also a pedagogue who helps the parties to learn how to keep a dialogue. Analysis of the mediator’s role and the usage of D.A. Kolb’s learning types in the stages of mediation are the main results of the study. The significance of the study implies a substantiation of various roles of the mediator, constructivist approach with the emphasis on the dialogue and implementation of D.A. Kolb’s learning types in the stages of mediation.

The development of a constructive approach in the field of communication and education calls for the constructive approach to mediation as well. The problem is that the process of mediation is quite uniform and lacks a variety of stages and an opportunity to help clients to establish longitudinal dialogical relations. That is why the aim of the study is to reflect the basis of the Constructive mediation model (CMM) and describe its functioning. The methods of the study were theoretical analysis the model theories and five expert assessment of the model using Friedman test. The research was done investigating the findings on constructivism, conflict resolution, philosophy of dialogue, communication, pedagogy, psychology and testology with the purpose to establish CMM. The study reveals that the model functioning is provided by the following eight phases as signing a contract witha mediator, clarifying of the conflict and constructs, data processing, learning for mediation, mediation process, searching/finding the conflict resolution, repeated survey and data processing, and self-assessment of the mediator's action. The eight phases consist of such elements as setting of an aim, mediator's and mediants' roles, strategy, questionnaires, and achievable results. The definition of constructive mediation was substantiated. Five experts evaluated the usefulness of CMM in amediator’s practice according to eight criteria and their evaluations were unanimously positive. 64mediation participants and a mediator evaluated the process of mediation. The main conclusion is thatCMM provides successful conflict solving using constructive approach emphasizing the mediants' learning, self-assessment and dialogical techniques. The significance of the results is that it can be used successfully by the mediators who recognise constructivist approach in mediation taking into account the structure of the eight CMM phases and elements.

Mediation is one of the ADR proceedures, that is, instead of deepening the conflict, based on negotiation and open communication, that is focused first of all on the participants’ needs and whose primary aim of mediation is reaching a solution mutually acceptable for the parties. It is a convenient method for resolution of commercial disputes, especially in commercial disputes with foreign element since the mediation manifests significant advanteges over the procedure before the court. In Serbia, international mediation is regulated by the provisions of Mediation Act. In this paper, we adress some questions regarding the international mediation in resolution of commercial disputes, from the perspective of Serbian law (examining the mediability of a commercial dispute, settlement agreement and its enforcement, the role of the mediator, etc). Special attention is paid to the enforcement of settlement agreement in commercial disputes with foreign element, whereby different legal situations have been considered.

Practitioners and policymakers must clearly define what they mean when using the term “mediation”. This is necessary to help conflict parties understand what to expect from third parties, to establish coordination and communication, increase the acceptability of mediation for conflict parties, and enhance learning across contexts. This brief first explains why this topic is of importance, then examines potential challenges in the definition of mediation, focusing on three tenets of mediation practice that distinguish it from other peacemaking activities: (1) a third party assists negotiations; (2) the mediator provides some minimal level of control or structure over the overall process; and (3) the parties consent to the involvement of the third party and the outcome of the process.

This report presents the findings of preliminary research into the perceptions of overall stakeholder satisfaction of eight Auckland secondary schools of the Leadership through Peer Mediation (LtPM) programme, a core programme of the Foundation for Peace Studies Aotearoa New Zealand (the Peace Foundation). The research was commissioned by the Peace Foundation with funding assistance from the Metro ITP Voucher Scheme, and was conducted in the second half of 2015. A core aim of the LtPM programme is to empower students as ‘ambassadors of social justice’. The programme trains students in the mediation processes and leadership skills needed to assist peers to resolve personal conflicts in a peaceful manner.
