This paper uses the 9741 internationally-operated Chinese companies and their matched companies in Shanghai and Shenzhen A-shares as a sample to empirically examine the relationship between financial environment, distance and international operation. First of all, the study found that there is a significant positive correlation between the financial environment and the international operation of the company. In other words, the better the financial environment in which the company is located, the more likely it is that the company will conduct international operations. Second, there is also a significant positive correlation between distances and international operations, which means that the closer the geographical location of the registered place of a company and the central city of the province, the more likely it is that the enterprises within the jurisdiction are operating internationally. Furthermore, the urban distance can produce a ‘regulatory effect’ between the financial environment and the international operation of the enterprise. That is the positive correlation between the financial environment and the international operation of the enterprise depends on the ‘city distance’. Considering the influence of ‘city distance’, the positive impact of the financial environment on international operations is even more pronounced.

This article addresses recent developments in the application of national antitrust laws to cross-border business activities, and the resulting need for antitrust enforcement authorities in different countries to co-ordinate their enforcement efforts. This article attributes the increase in cross-border antitrust enforcement to four trends: the increasing globalisation of business, the increasing proliferation of new antitrust laws around the world, the increasing acceptance of the "effects" test for antitrust jurisdiction, and the increasing liberalisation of trade barriers. The article then highlights both political and practical problems that have arisen from the points of view of antitrust enforcement agencies and affected private sector interests, stemming from the increasing extraterritorial application of antitrust laws. This article presents an overview of international co-operation agreements, focusing on US bilateral and multilateral co-operation agreements, and discusses how international co-operation in this area may affect private sector interests. Companies based in Europe should understand that any cartel conduct in which they may be involved, and any merger transactions, may be subject to review by antitrust enforcement authorities in multiple jurisdictions, including the United States, to the extent that those activities may injure or threaten injury to consumers in those jurisdictions.

The findings of this study help to identify factors explaining success in international operations of large U.S. corporations. Successful foreign direct investment (FDI) and continuous involvement of large U.S. corporations is crucial for economic development of a country and social uplifting of many citizens of the world. Data were collected on selected U.S. corporations perception of the success variables in their international operation. Results indicate that large market size, geographical diversification, and low production/operating cost are the three most important success determinants of international operations.

AbstractThe duty to respect international humanitarian law (IHL) in military operations requires effective tools of compliance. Peace operation forces are seldom involved in armed conflict and IHL applies formally only in a minorityof operations. The increasingly volatile environments in which peace operation personnel are required to work, and the trend of enforcement capabilities of such forces, will arguably make the question of compliance with IHL all the more important. Multinational peace operations often include a range of actors–such as the UN, another organisation leading the operation, troop contributing nations (TCNs) and the host state. Differences in training and education as well implementation of IHL in different TCNs makes compliance with IHL in multinational operations a challenging task. The use of special units with their culture of secrecy involves other complex questions. On a more general level, it is not clearly established how responsibility under international is dividedamong the main actors in a multinational peace operation. A number of practical measures are suggested to overcome challenges to an effective compliance of IHL.

Amid the proliferation of international judicial and quasi-judicial bodies, worries about the possible fragmentation of international law are increasing. Such fears, however, may be misplaced. A close examination of the jurisprudence of nine international judicial bodies, looking specifically for instances of explicit reference to one another's decisions, shows the practice to be widespread, of variable frequency and covering both procedural and substantive issues. Taken in conjunction with other scholarship about the similar treatment of important doctrines across all (or most) bodies, this study suggests that unity, not fragmentation, may emerge from the proliferation of international courts and tribunals.

AbstractEUNAVFOR Operation Atalanta has been the first maritime operation of the European Union and it has certainly been successful given the significant decrease of pirate attacks off the Somali coast. However, various issues have been raised concerning its legal basis under international law and its legal framework, including questions of responsibility. These issues are particularly interesting since the EU has a more integrated legal order than other organizations involved in such operations (eg UN, NATO). The present article attempts to address these issues against the background of international and European law. Even though the legal basis of the Operation is clear from a European law perspective, there have been certain misconceptions concerning the legal basis of the Operation under international law. The delineation of the Operation's legal framework requires a careful analysis of the rules applicable to each of its phases and of its addressees, since each phase is subject to different rules which are binding on different actors. Finally, there is an extensive discussion of questions of responsibility, which were heavily influenced by the applicable Rules of Engagement and of the actual conduct of the Operation. The conclusion is that, at least on the high seas, responsibility should primarily rest with the flag States rather than with the EU. However, in most cases the EU is indirectly responsible for violations of international law, except in cases where suspected pirates are transferred to third States pursuant to EU agreements with such States, in which case it bears primarily responsibility.

The problem of international debts is, by its character, one of the most complex problems which the world economy is now facing. It complicates both the global balance of payments and the financial – credit system stability, with pronounced negative impacts on the currency stabilisation. It hinders the development of international economic co-operation and its higher forms – international economic integration. It is one of the reasons that the symmetrical forms of interdependence are pushed off and displaced by the asymmetrical ones. The global debts problem deteriorates, namely during the last time in interaction with the negative manifestations of the global problems (for example, at present very strongly with the environmental problems), the complex international co-operation climate.
