This book aims to analyze the crimes against human rights that offended the Democratic Rule of Law in Brazil, committed by state agents in the Brazilian military dictatorship (1964/1985), asserting that they remained unpunished. In view of this, to address this issue, it is proposed that criminal offenders be held liable. The issue of our slow Transitional Justice will also be examined, arguing for the criminal prosecution of state agents who violated human rights in Brazil, demonstrating how and how this can occur, all in order to move away from impunity, hitherto guaranteed by the Brazilian Amnesty Law, ensuring the effectiveness of justice and the strengthening of democracy.

Chapter 8 tracks the uses and shortfalls of law as a path to ending impunity, echoing the gap between public and private in architecture, access, and accountability. We will trace the evolution of legal standards for VAW in international law and tribunals on sexual violence, transitional justice in Guatemala, Croatia, and Libya, and national treatment of private abuse in India and the Philippines. This contrasts with the architecture challenges of legal pluralism incorporating multiple local codes in Lebanon, Argentina, Nigeria, and South Africa, as well as parallel status problems in emerging debates on marital rape in Malawi and the Mideast. Contests over state responsibility and pathways to accountability are highlighted in Turkey, Mexico, Brazil, and Kenya. Yet a range of barriers for access to justice persist in insecure and inequitable states, and are profiled in Colombia, South Africa, Mexico, and India—with some innovative response in the latter cases. We will affirm a rights-based reading of the power of law but refine a feminist critique of its limits by distinguishing the legal reform requisites for different genres of human rights abuse and different types of gender regimes.

As the “enhanced interrogation” program of the US Central Intelligence Agency (CIA) at secret detention facilities developed, health professionals came to play a gradually increasing role in accommodating, facilitating, and finally, rationalizing torture. Ultimately, they contributed substantially to a redefinition that, although contrary to the United Nations Convention Against Torture, was adopted by the US Department of Justice and focused on whether interrogation methods were “safe,” by which was meant not resulting in death or permanent physical injury. This role evolved in stages: CIA health professionals accommodated the use of torture by their role in keeping it “safe”; participated directly in the infliction of torture; imposed purported “limitations” on enhanced methods consistent with the “safety” definition; and by 2005, provided the foundation for US Department of Justice legal opinions purporting to justify the use of methods of torture. In doing so, they rationalized their complicity in and culpability for torture.

Between Impunity and Imperialism: The Regulation of Transnational Bribery describes the legal regime that regulates transnational bribery, identifies and explains the rationales that have guided its evolution, and suggests directions for reform. The broad argument is that the current regime embodies a set of values, theories, and practices labeled the “OECD paradigm.” A key premise is that transnational bribery is a serious problem which merits a vigorous legal response, particularly given the difficulty of detecting instances of bribery. The shape of the appropriate response can be summed up in the phrase, “every little bit helps.” In practice this means that: prohibitions should capture a broad range of conduct; enforcement should target as broad a range of actors as possible; sanctions should be as stiff as possible; and as many enforcement agencies as possible should be involved in the enforcement process. The OECD paradigm embraces two interrelated propositions: that transnational bribery is a serious problem and that it demands a uniform response. An important challenge to the OECD paradigm, labeled the “anti-imperialist critique,” accepts that transnational bribery is a serious problem but denies that the appropriate legal responses must be uniform. This book explores both the OECD paradigm and the anti-imperialist critique, and provides a detailed analysis of their implications for the key elements of transnational bribery law. It concludes by suggesting that the competing views can be reconciled by moving toward a more inclusive and experimentalist regime which accommodates reasonable disagreements about regulatory design and is crafted with due attention to the interests of all affected parties.
