With a longitudinal study we analyse the efficiency and effectiveness of the new model on the wider organization and on HR people and this is particularly interesting in moment where several organisation and functions are focusing attention on this blueprint. Using the most recent suggestions on research design are analysed longitudinally HR unit of 42 countries of multinational financial services firm, before, during and after the HR transformation. Outcomes shows that new blueprint implementation is linked to cost reduction and increase the delivery of value, but some issues pop up in terms of perception of internal mobility, that actually is not linked to the implementation of the new model. Using a multi methodology, model is tested in order to understand impact of the new blueprint and its implication for theory and practitioners.

In education, many authors underline the need for individuals to learn lifelong; otherwise they risk being excluded from the so-called "knowledge society." Besides, in order to participate actively in the world of work, people are supposed to be well aware of their own limits and resources. To do this, they may need new pedagogical opportunities to learn key competencies, such as learning to learn and to develop self-reflexivity in a perspective of lifelong learning. Internationally the interest in ePortfolio is growing for the role that it seems to play in fostering the skills needed in a knowledge-based society, addressing not just students but also workers-citizens with a lifelong learning, inclusive perspective. Furthermore ePortfolios have been used in several contexts in order to develop employability and self-awareness and to showcase the effective skills to prospective employers. Many authors assume that the constituent elements of the ePortfolio, such as reflexivity, capitalization and transferability of skills, can effectively promote employability by increasing the job seekers’ awareness about their own skills acquired in different contexts (formal, non-formal, informal) and by giving the employer more information for selection purposes. The aim of the research was to explore whether, to what extent and under which conditions ePortfolio can be a tool in support of job transitions, on the one hand promoting awareness in job seekers’ own resources, on the other hand allowing the transparency of these towards employers. The research design contemplated a systematic review of literature, the analysis of presentation ePortfolio projects, and a multiple-case study on Italian ePortfolios. The research results allowed us to identify possible important aspects to be considered for an ePortfolio for job transitions in the Italian context.

Der volle Inhalt der QuelleSince its introduction, transcranial magnetic stimulation (TMS) has been used to explore brain functions in healthy participants or to induce meaningful therapeutic effects in patients. Despite its growing popularity and proven results in several application fields, this technique suffers from high inter and intra subject variability in response to stimulation. Different physical and physiological parameters affect the effectiveness and repeatability of the stimulation process such as the coil placement and orientation, the head geometry and the activity state of the brain. The general aim of the studies presented in this dissertation, is to explore how this variability could be explained considering different parameters. Specifically, the first project has the purpose to study how neuronal fiber bundle direction related to the stimulation direction could affect the effectiveness of the TMS outcome determined by the amplitude of the motor evoked potential (MEP). Fiber direction information in the region of interest (ROI) was extracted from the subject specific tractogram obtained from diffusion MRI (dMRI) data, while the direction of stimulation was derived from the neuronavigation system for each of the twelve homogeneous stimulation points tested. The relative angle obtained between the two directions was related to the MEP amplitude to determine the presence of a range of angle values concurrent to wider stimulation outcomes. In the second study, the variability of the stimulation process was evaluated by relating the MEP amplitude with parameters obtained from the simulation of the TMS induced E-field. Specifically, for each of the stimulation directions acquired in the first study the E-field was simulated on the subject specific head model, to extract the volume interested by the E field and its peak value. Finally, a relationship between these parameters and the mean MEP amplitude was assessed searching for a causal link that motivates the outcome variability. The SimNIBS toolbox used for E-field simulation and the alternatives available in the literature presents some limitations regarding the possibility to upload dMRI data for white matter anisotropy conductivity estimation. Furthermore, to date no one offers the possibility to upload subject specific tractogram to study how neuronal fiber bundles are affected by the E-field. Given these premises, we present some preliminary results about the development of a new toolbox for E-field simulation. This toolbox offers the possibility to consider tissues anisotropy extracted from multi-shell dMRI data and create subject-specific fiber tracking maps with different approaches. The work done is at a preliminary stage, but the model adopted is flexible for various applications. In fact, feasibility tests demonstrate its possible use also for real time applications, and forward model solutions for EEG and TMS-EEG source analysis. Regarding the TMS-EEG data, looking at the literature, a standardization of the preprocessing steps is needed to obtain comparable results. For this reason, the multiplicity of methods adopted for artifact remotion which could generate variability in the results,was inspected. Precisely, a processing pipeline for artifact remotions and data analysis was developed and tested to ensure robust results and a certain level of standardization. In conclusion the inter and intra subject variability in the TMS outcome were explored considering different aspects with the aim of identifying parameters and biomarkers that could improve the effectiveness of this technique. In the presented studies we considered multiple methods of acquisition (EMG-EEG) and analyzed different type of MR images (structural and dMRI) that could support the user once uploaded into the neuronavigation system and, finally, we took into consideration the possibility of modeling the induced E-field, covering most of the methodologies that gravitate around this instrument.

Der volle Inhalt der QuelleThis PhD thesis, titled “Skin color discrimination in primary school. Intercultural education and antiracism”, wants to continue a previous study started between 2013 and 2016. In this study, I analyzed colorism as a phenomenon among children, with specific attention to gender studies. This is an empirical study which started from a very detailed bibliography review, especially related to US’ colorism. Then I move to some Italian studies who focused on the intersection between intercultural education, racism and antiracism. Starting from this theoretical framework I started my empirical research in two very different Italian schools, in Bologna (Emilia-Romagna) and Catania (Sicily). I choose these schools because they both defined themselves as interculturally involved. In this sense, I wanted to understand if they included some antiracist goals in their projects. Using a qualitative methodology, I realized some focus groups with children (78 children) and some interviews with teachers (20 teachers). Indeed, I analyze all the documental material related to these intercultural projects.

Der volle Inhalt der QuelleThe thesis work examines the recent phenomenon of work done by means of a digital platform, with a closer look at the well-known events concerning riders in the food delivery sector, in order to debate whether this leads to a new conclusion in the old discussion of the delimitation of the dependent employment case. As mentioned in the introduction, on demand forms of employment, contextualized within the greater phenomenon of the so-called gig economy, of which an in-depth analysis is provided, are now spread on a global scale and pose questions linked to every economic and social legal sector (employment law, tax and trade law, private law, etc.). The subject, which in the thesis work is limited to issues relating to employment relationships, poses the legal form of the same relationship as a more urgent question: paradoxically, the legislation, up to the last intervention of the law of November 2nd 2019, No. 128, the jurisprudence, with the latest ruling of the Court of Appeal of January 24th 2020, No. 1663, and finally the legal interpretation, variously addressed – but in truth not resolved – the legal form of the case, mainly providing a “remedial” approach to the problem, i.e. aimed at acknowledging and guaranteeing protection, of course urgent, for on demand workers. Conversely, the research study conducted thus far highlighted, since the precursory parts, the need to contextualize the employment relationships carried out by means of a digital platform in compliance with the principle of legal certainty and, in particular, proposed a new theory aimed at recognizing the status of subordination of the food delivery sector workers, criticizing the opposite theory based on the fact that the hetero-direction of platforms towards the riders could not be ascertained since they are free to choose if and when to work. In the first place, the study was carried out by rebuilding the idea of subordination, starting from its first assumptions. The reconstruction was naturally conducted in accordance with the interpretations formerly recoverable in the tenet and accounting for the main orientations developed by jurisprudence. In the first chapter it is observed how, indeed, the elements traditionally attributed to the subordination of the employment relationship converge to the so-called hetero-direction. By contrast, the hetero-organization element almost never found appreciation in the legal interpretation and jurisprudence as an identification feature of the dependent employment case, and it was interpreted as the placement of the worker within the entrepreneur’s organization. However, in the second chapter, the study tried to prove that hetero-organization is as important an element as hetero-direction in order to determine the subordinate nature of an employment relationship. The theory was debated starting first and foremost from the regulatory data, i.e. through the interpretation of the “dependence” element, mentioned in section 2094 of the Italian Civil Code, as well as by recovering a historic ruling of the Constitutional Court (No. 30 of 1996) which narrowly defined subordination as the existence of a double alienation of the result and organization, precisely. Once clarified the concept of subordination that we intend to support, the thesis work, in the third chapter, attempts to verify if, in light of the idea of subordination as a hetero-organization of work by the employer, on demand employment relationships in the food delivery sector can be classified as subordinate. The attempt required a specific analysis of the factors that characterize the employment relationship of the so-called riders: in this part, in fact, data relating to the spread of the phenomenon, the economic and social impact on our system, as well as the main consequent legal issues were reconstructed. Specifically, precious was the analysis of the rulings that, in different legal systems of other countries, learned about the employment relationship in question in order to detect the main elements that jurisprudence made use of in respect to the definition of the case present in each system. As for Italy, the traditional principle of prevalence of the implementation of the executive phase over paper will was also taken into consideration for qualifying purposes. From here we came to ascertain the existence of a double alienation in the employment relationship between couriers and digital platforms, also accounting for the rulings of the European Court of Justice over the entrepreneurial nature of the latter, by carrying out an in-depth analysis of the concrete organization of work and its transformations underway. Once intertwined these data, it was argued that the employment relationships of cycle-couriers carried out by means of digital platforms can be considered subordinate employment relationships, given the existence of the result alienation as well as the organization alienation . Furthermore, an attempt was made to object to the main if not the only subject that would preclude recognition of the subordinate nature of the riders’s employment relationship; namely the fact that, being able to choose if and when to work, they would benefit from a decision-making autonomy incompatible with subordination. Then, the fourth chapter offers an in-depth analysis of the main union events that affected on demand jobs, for two essential reasons: first because the position of traditional and non-traditional unions was crucial, not only in Italy, in regulating employment relationships in the food delivery sector, and then because the transformations of the methods of implementation of work services, represented by the massive use of technology, also affected the industrial relations, to such an extent that unprecedented questions were posed for the union law, referred to in the carrying out of the research study. Finally, in the last chapter, the most recent law No. 128/2019 was taken into consideration, which regulates the employment relationship carried out also by means of a digital platform, both through the extension of the regulation of subordinate work to hetero-organized collaborators, pursuant to section 2 of Legislative Decree No. 81/2015, as amended by section 1 of the same law, and through the application of a significant protection system to the riders who are self-employed. Hence, once again, a regulatory intervention that eludes the legal form profile of the case, posing significant issues of legal certainty and following the path of a merely remedial approach to the urgent question of the riders’ exploitation, perhaps extending the protections stemming from the status of subordination, yet, without explicitly recognizing it.

Der volle Inhalt der QuelleWithin the scope of medical professions, the role of the chief medical officer is not so much investigated. The present quality-type research has been carried out on the activity of chief medical officers in three hospitals in Milan and aims to investigate this profession starting from the innovations it underwent during the last twenty years and from the goals it intends to reach. The hypothesis we formulated is that the role we are analyzing has undergone such deep changes that: a) on the surface, fundamental skills required for an efficient practice of this profession have changed; in particular, the “productive” activity has been entrusted to the hospital medical director, while programming and strategic coordination has been ascribed to the chief medical officer; b) in depth, since the characteristics considered as typical by Freidson were compromised and hence dissolved, chief medical officers have been acquiring a new professionalism, marked by traditional knowledge but also by new managerial skills. Changes occurred in this profession have been studied in the present dissertation both from a regulatory and from an historical point of view, in order to trace out the new scope of its managerial activities. Detecting skills is important: for including them among the educational needs of this profession to be acquired thanks to specific training paths, for tracing their recurrence and development in the frame of a normative isomorphism, which would be useful for the chief medical officer himself in order to start/monitor the changes as much in the hospital as in the whole organizational health field.

The hypothesis we formulated is that the role we are analyzing has undergone such deep changes that: a) on the surface, fundamental skills required for an efficient practice of this profession have changed; in particular, the “productive” activity has been entrusted to the hospital medical director, while programming and strategic coordination has been ascribed to the chief medical officer; b) in depth, since the characteristics considered as typical by Freidson were compromised and hence dissolved, chief medical officers have been acquiring a new professionalism, marked by traditional knowledge but also by new managerial skills. Changes occurred in this profession have been studied in the present dissertation both from a regulatory and from an historical point of view, in order to trace out the new scope of its managerial activities. Detecting skills is important: for including them among the educational needs of this profession to be acquired thanks to specific training paths, for tracing their recurrence and development in the frame of a normative isomorphism, which would be useful for the chief medical officer himself in order to start/monitor the changes as much in the hospital as in the whole organizational health field.

Der volle Inhalt der QuelleWith the present study, an attempt has been made to address the issues concerning coordinated and continuous collaborations that fall under that legal case defined as parasubordination, halfway between autonomy and subordination. This dichotomy has always constituted a subject of discussion in doctrine and recently in jurisprudence (Foodora Case Court of Turin, judgment no. 778/2018; Court of Appeal of Turin, Labor Section, judgment 26/2019; Court of Cassation no. 1663/2020) as it raises the question of how to succeed in protecting those "gray" forms of work that have developed in recent years through digital platforms. Following the amendments implemented, as of today under Article 2, Paragraph 1, (Legislative Decree No. 81/2015) new text, the discipline of the subordinate employment relationship applies to collaborative relationships that result in predominantly personal, continuous work performance and whose mode of execution is organized by the principal It is therefore a question of understanding what the effect of th yese changes might be on the current balances between autonomy and subordination and the new protections dictated by the changed legislative environment, also in light of supranational examples. The digital revolution and the expansion of the so-called gig economy, has pushed the legislature toward new intervention to provide a minimum basis of guarantees for self-employed workers on digital platforms along the lines of other European legal systems. Against this backdrop hinges the legislature's introduction of Chapter Va into Legislative Decree 81 of 2015 by Law No. 128 of 2019. The novella turns out to be inspired by a dual rationale, with two distinct fields of application referring to the discipline of hetero-organized collaborations by the principal and the new discipline in Chapter V- bis entitled "Protection of work through digital platforms": while the former concerns the extension of subordinate work to hetero-organized collaborations, for the latter some basic guarantees are provided ad hoc on the assumption that if Article 2, paragraph 1 does not apply, self-employed workers on platforms are guaranteed a minimum safety net consisting of a core of fundamental social rights. The study of this legislation therefore aims to ascertain what the effects of such a change might be in the system of labor law discipline considering the perennial dichotomy between salaried employment with its associated protections and self-employment with all its facets. In this context, the school case of the Territorial Labour Inspectorate of Milan was taken into consideration, which by delegation of the Public Prosecutor's Office at the Court of Milan conducted an assessment on the legal qualification of riders, for whom the real unknown constitutes the analytical remodulation of the subordination bond, whereby a worker who had always been recognized as hetero-directed has become hetero-organized with the consequences in terms of protections connected to it. Drawing from this finding, the inspection powers and penalty profiles arising from a legal qualification of hetero-directed and hetero-organized workers were discussed. Finally, the December 9, 2021 proposal for an EU directive was analyzed, which is intended to promote the correct identification of the employment status of platform workers in order to ensure uniformity of views in national legal systems without prejudice to workers' rights and protections.

Following an investigation of the current state of the practice through the assessment of various contractual models, the thesis argues against the adoption of a unifying or general model, which would not allow for the recognition of the various functions and goals which can be achieved through cash pooling. Based on the foregoing, the thesis also focuses on some of the most important disciplinary profiles concerning a single, widely-adopted, cash pooling model, characterized by an exclusive line of credit to the pooler.

Der volle Inhalt der QuelleThe climate emergency and environmental depletion have become important issues for United Nations countries, and Governments are imposing stringent environmental regulation policies to move towards sustainable growth. In this scenario, pursuing green growth requires firms to adopt new strategies in terms of energy saving, the use of renewable power sources, and the adoption of sustainable production processes. These changes have significant economic consequences for firms and industries, as recent and large literature has pointed out. However, few studies have dealt with the role of environmental regulation at the sectoral level. This dissertation contributes to this topic by investigating how environmental regulation affects productivity at the sectoral level in a sample of selected European economies. It studies the effect of these instruments on productivity by measuring the adjusted productivity growth in thirteen Italian manufacturing industries and enlarged the sample by including other four EU countries. Productivity growth is measured using the Malmquist-Luenberger index, which is based on the Directional Distance Function (DDF). The main result of the Italian context investigation is that environmental regulation does not have a negative impact on almost all industries. A bootstrapping approach has been then used to assess the robustness of estimated results. Instead, in the European context, we find environmental regulations have a negative effect on productivity growth in several industries in the manufacturing sector for almost all the countries included in the analysis.

Der volle Inhalt der QuelleThe present research highlights the aesthetical world of Victor de Sabata (1892-1967), as seen as a coherent whole in its complex artistic dimension. The focus and main topic are represented by the so-called “contemplative-poem” Gethsemani (1925), probably the most idiomatic opus by the musician from Trieste. Victor de Sabata, as a composer, stays aloof from the different vagues of compositional styles of the first half of 20th century, and moves from the dissolution of the sonata-form already started by Richard Strauss to the creation of a sort of circular-type of music, giving no importance to the development of themes and preferring to varying them through a sort of puntillistic timbre-vaporization, using moreover a masterful skill to disincarnate the sound into a unique and original musical idea of Verklärung. The analysis of the musical poem illuminates even the general attitude of his conducting style, particularly concerning the EMI (His Master’s Voice) 1953 recording of Puccini’s Tosca with Maria Callas and the 1953 live concert in Salzburg with Death and Transfiguration by Richard Strauss. In addition, the Middle-European origins show a special assonance with some lyrics by Umberto Saba (1883-1957), especially the Preludio e fughe (1928) collection. The conclusions assert that there is a global circularity both as in the music composing as in his music conducting, delivering to the music history a quite transfigured legacy of a unique personality utterly independent from the dominating cultural tendencies of his century, foreshadowing a new perspective in music making as well.
