This chapter examines the most common types of disputes arising in connection with the development and operations of mining projects. These can be classified into two main categories: development and operating disputes, and offtake and sales disputes. Development and operating disputes include: disputes that may arise when the project owner and external mining contractor fail to agree on rates; hardrock drilling disputes arising from various geographic, geologic, and practical factors; and construction contract disputes. Offtake agreements or offtake contracts refer to all types of agreements for the sale and purchase of metals/minerals, including spot sales, metal streaming agreements, and in-kind mineral royalties. The most common types of disputes involve four essential aspects of the sale of metals and minerals: the quantity to be delivered; the quality of the metals/minerals delivered; the conditions of the delivery; and the payment of a price by the buyer.

Abandoned housing projects is one of the major problems in housing industry in Peninsular Malaysia.The reasons leading to this problem are many.This catastrophe has caused multifarious problems to the stakeholders, particularly the purchasers who become the aggrieved parties.To date, there is no effective and once-and-for-all means to face the problems of abandoned housing projects.One of the factors which causes abandonment of housing projects in Peninsular Malaysia, is the lack of political will on the part of the government to adopt an affirmative better housing delivery system such as the full build then sell system and the introduction of a housing development insurance to face the problems of housing abandonment.This book provides in-depth analysis of the terms and conditions of the statutory standard sale and purchase agreements as enshrined in Schedules G, H, I and J of the Housing Development (Control and Licensing) Regulations 1989.The objective of this book, among others, is to identify the weaknesses of the terms of the agreements, if any, which may have contributed to the problem of abandoned housing projects and their consequential troubles. As comparative analyses, the terms and conditions of the sale and purchase agreements as applicable and enforced in the Republic of Singapore and New South Wales, Australia, are chose.The purpose of these comparative analyses is to find the terms and conditions in these foreign jurisdictions agreements which can be learned and adopted in the statutory standard sale and purchase agreements (Schedules G, H, I and J).It is also for the betterment of the Malaysian housing industry as a whole, and to protect the interests of the stakeholders, in particular the purchasers, as against the problems of housing abandonment and its consequences.

Local governments frequently network with other local governments or other entities for efficient or effective delivery of local services. Networks enable local governments to discover ways to address externalities and diseconomies of scale produced by political fragmentation, functional interconnection, and uneven distribution of knowledge and resources. Local government networking can be informal or formal and bilateral or multilateral, in the form of deliberative forums or mutual aid agreements. This chapter uses the institutional collective action framework to underscore the link between problems of coordination and credibility of commitment that local governments face as they seek self-organizing solutions and the bridging and bonding networks they create in response to these problems. It then reviews the current state of scholarship in local government networks (LGNs) and shows that much progress has been made in both egocentric and whole LGN studies. Finally, it highlights important areas needing attention to advance LGN scholarship.

This chapter situates the claims for protection of traditional knowledge in the international intellectual property (IP) context. Drawing on examples, it discusses the meaning of “traditional knowledge” and how the goals and means of protecting that knowledge do not fit within the framework of IP law. In order to address the overlap with IP and provide protection against misuse of traditional knowledge, a number of international bodies have been involved in negotiations and treaty drafting. The chapter discusses those developments, and concludes that even though international resolution looks unlikely in the short-term, the protection of traditional knowledge will continue to feature in international IP debates until a minimum level of agreement at least reached. In order to attain such agreement, there needs to be relevant national laws and, as a practical matter, sufficient investment in the innovation of traditional knowledge in order to deliver the value of protection to its holders.

This chapter discusses the resources contained in or under the world’s oceans, which have been somewhat neglected by political theorists but which are hugely significant. It first discusses the case of fishing rights, in which we have seen a mixture of extended state control and unconstrained exploitation in the area beyond state jurisdiction, and shows that this approach has failed to deliver on either intra-generational justice or sustainability. It then discusses the mineral resources contained in the portions of the seabed which still fall beyond state control. Agreement has been reached, under the auspices of the International Seabed Authority, to harness the exploitation of these potentially valuable minerals to promote global equality. The chapter welcomes this development and identifies some wider lessons we might draw from it for the struggle to put resources to work to promote global equality.

Technological advancements are poised to completely transform the financial system, making it unrecognizable in just a few short decades. Banks are increasingly using financial technologies, or “fintech,” to deliver products and services and maximize their profits. Technology enthusiasts and some consumer advocates laude fintech for its potential to expand access to banking and finance. If history is any indication, however, fintech stands to reinforce digital forms of redlining and enable banks’ continued racialized exploitation of Black and Brown communities. Banking on a Revolution takes the perspective that the financial system needs a revolution—and not the impending revolution driven by technology. Studying various ways the financial system advantages whites by exploiting and marginalizing Black and Brown communities, Terri Friedline challenges the optimistic belief that fintech can expand access to banking and finance. Friedline applies the lens of financialized racial neoliberal capitalism to demonstrate the financial system’s inherent racism, and explores examples from student loan debt, corporate landlords, community benefits agreements, and banking and payday lending. She makes the case that the financial system needs a people-led revolution that centers the needs, experiences, and perspectives of those it has historically excluded, marginalized, and exploited.

This chapter examines how foreign judgments and arbitral awards are recognised and enforced in England. Unsatisfied foreign judgments and arbitral awards give rise to complicated questions concerning private international law. Owing to the principle of territorial sovereignty, a judgment delivered in one country cannot, in the absence of international agreement, have a direct operation of its own force in another. This chapter first considers the effect given to foreign judgments and arbitral awards before discussing the different regimes governing recognition and enforcement of foreign judgments. In particular, it looks at judgments from outside the European Union and European Free Trade Association (EFTA), judgments from an EU or EFTA state, and judgments from other parts of the UK. It also analyses issues relating to insolvency, family law, and wills and successions and concludes with an overview of rules under which foreign arbitral awards are recognised and enforced.

Colombia is in a privileged position to take advantage of international climate agreements to finance sustainable development initiatives. The country is a signatory of the United Nations Framework Convention on Climate Change (UNFCCC), the Kyoto Protocol, and the Paris Agreements. As a non-Annex I party to the UNFCCC, Colombia produces low emissions in relation to global numbers (0.46% of total global emissions for 2010) and exhibits biogeographical conditions that are ideal for mitigation of climate change through greenhouse gas sequestration and emission reductions. Simultaneously, recent extreme climatic events have harshly compromised the country’s economy, making Colombia’s vulnerability to climate change evident.While these conditions should justify a strong approach to climate change communication that motivates decision making and leads to mitigation and adaptation, the majority of sectors still fall short of effectively communicating their climate change messages. Official information about climate change is often too technical and rarely includes a call for action. However, a few exceptions exist, including environmental education materials for children and a noteworthy recent strategy to deliver the Third Communication to the UNFCCC in a form that is more palatable to the general public. Despite strong research on climate change, particularly related to agricultural, environmental, and earth sciences, academic products are rarely communicated in a way that is easily understood by decision makers and has a clear impact on public policy. Messages from the mass media frequently confuse rather than inform the public. For instance, television news refers to weather-related disasters, climate variability, and climate change indiscriminately. This shapes an erroneous idea of climate change among the public and weakens the effectiveness of communications on the issue.The authors contrast the practices of these sectors with those of nongovernmental organizations (NGOs) working in Colombia to show how they address the specific climate communication needs facing the country. These NGOs directly face the challenge of working with diverse population groups in this multicultural, multiethnic, and megadiverse country. NGOs customize languages, channels, and messages for different audiences and contexts, with the ultimate goal of building capacity in local communities, influencing policymakers, and sensitizing the private sector. Strategies that result from the work of interdisciplinary groups, involve feedback from the audiences, and incorporate adaptive management have proven to be particularly effective.

The aim of the volume is to open up new approaches to the understanding of the work of one of our most important poets. Although it is indeed intended to provide the substantial and sufficiently comprehensive contribution to Harrison scholarship that his official eight-decades-alive merit, and the Editor’s Introduction to the volume is sensitive to the needs of the reader in terms of bibliographical signposts, the four sections focus primarily on areas that have been hitherto little explored: (1) his more recent poems; (2) the continuation of his relationship with ancient theatre after the landmark Oresteia and Trackers of the 1980–1990 decade, his evolving dramatic relationship with Euripides, and with French authors (Hugo, Molière, Racine); (3) the international angle. The origins of Santa Claus, or so I am told, is that the young Bishop Nicholas secretly delivered three bags of gold as dowries for three young girls to their indebted father to save them from a life of prostitution. Armed with immortality, a factory of elves and a fleet of reindeer, his has been a lasting legacy, inextricably linked to Christmas. Of course, this Christmas looks a little different. Amidst a global pandemic, shimmying down the chimneys of strangers certainly does not adhere to social distancing guidelines. Some borders remain closed, and in some instances, the quarantine period is far too long. After all, he only has 24 hours to spread cheer across the world. As with the rest of us, Santa Claus is likely to get the remote working treatment. The reindeers this year are likely to be self-driving, reminiscent of an Amazon swarm of technology, and the naughty and nice lists are likely to be based on algorithms derived from social media accounts. In the age of the fourth industrial revolution, it is difficult to imagine that letters suffice anymore. How many posts were verified as real before shared? Enough to get you a drone. Fake news? Here is a lump of coal. Will we see elves in personal protective equipment (PPE) and will Santa Claus, high risk because of age and his likely comorbidities from the copious amount of cookies, have to self-isolate in the North Pole? In fact, will there be any toys at all this year? Surely production has been stalled with the restrictions on imports and exports into the North Pole. Perhaps, there is a view to outsourcing, or perhaps, there is a shift towards local production and supply chains. More importantly, as we have done in many instances in this period, maybe we should pause to reflect on the current structures in place. The sanctification of a figure so clearly dismissive of the Global South and to be critical, quite classist must be called into question. From some of the keenest minds, the contributions in this book make a strong case against this holly jolly man. We traverse important topics such as, is the constitution too lenient with a clear intruder who has conveniently branded himself a Good Samaritan? Allegations of child labour under the guise of elves, blatant animal cruelty, constant surveillance in stark contrast to many democratic ideals and his possible threat to national security come to the fore. Nevertheless, as the song goes, he is aware when you are asleep, and he knows when you are awake. Is feminism a farce to this beloved man – what role does Mrs Claus play and why are there inherent gender norms in his toys? Then is the worry of closed borders and just how accurate his COVID-19 tests are. Of course, this brings his ethics into question. While there is an agreement that transparency, justice and fairness, nonmaleficence, responsibility, and privacy are the core ethical principles, the meaning of these principles differs, particularly across countries and cultures. Why are we subject to Santa Claus’ notions of good and evil when he is so far removed from our context? As Richard Thaler and Cass Sunstein would tell you, this is fundamentally a nudge from Santa Claus for children to fit into his ideals. A nudge, coined by Thaler, is a choice that predictably changes people’s behaviour without forbidding any options or substantially changing their economic incentives. Even with pinched cheeks and an air of holiday cheer, Santa Claus has to come under scrutiny. In the process of decolonising knowledge and looking at various epistemologies, does Santa still make the cut?
