This book provides timely analysis of the cross-border exercise of banking activity in the EU and its supervision, from the perspective of the ‘home-host rule’. It examines the current system and the efficacy of recent reforms considering whether the centralization of decision making and a more effective mutualization of financing tools could increase the efficiency of the EU banking system. The EU banking market is very integrated since banking institutions based in the Union are free to perform their activities within the common market. This has allowed EU banking institutions to significantly increase their cross-border operations. This way of working is based on the home country control principle according to which EU institutions performing cross-border activities continue to be supervised by their home country supervisor. However, this system has raised challenges for effectively performing supervision and resolution. The book analyses how far recent reforms under the banking union regime have addressed these issues. It analyses the main pillars of the banking union. It also analyses how international standards and EU requirements undertake to divide responsibilities between the home and host state and the extent to which they align interests between the home and host and minimize potential conflicts of interests. The book provides a valuable resource for academics researching on central banking union and regulation, and helps legal practitioners to address questions of supervision, resolution, and insolvency with a cross-border element.

The hybrid and transnational nature of current conflicts poses one of today’s most pressing global security challenges, with crises ranging from western Africa to the Himalayas. This chapter evaluates the policies, strategies, and mechanisms in place in conflicts that encompass transnational security threats such as terrorism, organized crime, and cross-border sectarian insurgencies in the context of UN peace operations. International efforts aimed at addressing these threats have been ad hoc and piecemeal. Further work needs to focus on maximizing the use of existing regional initiatives and reinforcing the policy, operational, and political support for UN missions operating in these environments. The chapter draws from the Malian conflict to reflect on these issues.

Since the Rwandan Genocide in 1994, the border areas of Rwanda, Uganda, and the Democratic Republic of the Congo have been characterized by armed conflict and waves of cross-border migration, which have affected speakers’ realizations of the varieties of Kinyarwanda spoken in the area. The resulting recontextualized language use is best explored through a theoretical background of language ideologies and “border thinking.” With respect to Kinyarwanda, the fluid practice Kinyafranglais and the youth language Imvugo y’Umuhanda have emerged in relation to post-genocide language purification processes in Rwanda. In the ongoing conflict in DR Congo, secret metaphors in Kinyabwisha are used by Congolese armed groups when planning military operations, but they are also adopted by civilians when addressing delicate war-related topics. Pragmatic change in Rufumbira (Uganda) in the adjacent areas affect the realization of linguistic taboos, “sex talk,” and politeness strategies, which all deviate from patterns found across the border(s).

Underground warfare, a tactic of yesteryear, has re-emerged as a global and rapidly diffusing threat. Like many other aspects of contemporary warfare, the renewed use of the subterranean in armed conflict presents a challenge for democracies wishing to abide by the law. This book analyzes traditional concepts of the laws of war as they relate to underground warfare, contemplating questions such as whether tunnels constitute legitimate targets, the assessment of proportionality in anti-tunnel operations, and the availability of advanced warning in this complex terrain. It begins with an examination of two sets of opposing principles: unity of proceedings versus plurality and universality or territoriality in the administration of the debtor's assets in insolvency. This chapter examines the crucial role of Financial Market Infrastructures (FMIs) during a crisis. It addresses the three asymmetries surrounding the rules on FMIs’ defaults and looks at how to improve the legal soundness of crisis prevention and crisis management measures for FMIs. The first asymmetry stems from the fact that different bankruptcy procedures are applied to different systemically important financial market participants, as well as the fact that conflicts of laws arise from the bankruptcy of entities with cross-border operations. The second arises from the expansion of FMI services and relates primarily to two otherwise benign features which central counterparties (CCPs) offer to their members for the products they clear: credit risk mitigation and loss mutualization. The third and final asymmetry stems from the fact that supervisory authorities have been insufficiently attuned to each other’s legitimate interests and have focused resolutely on their own markets.

This chapter provides an overview of the law of set-off in Romania, both outside and within the context of insolvency. Under Romanian law, set-off is of two types: legal set-off, which arises by operation of law, and contractual set-off, which arises through a written agreement between parties. The rules for legal set-off are laid down in the Romanian civil code adopted by Law no. 287/2009 (the New Civil Code). The chapter first considers legal and contractual set-off between solvent parties before discussing set-off against insolvent parties. It explains bilateral set-off as well as financial collateral and challenge in insolvency proceedings. It also analyses the provisions of EU Regulations, EU Insolvency Regulation, and the New Civil Code that are relevant to cross-border set-off.
