Some claim that consent requires common knowledge. For a doctor to obtain consent, a doctor must know that her patient has given her permission to perform surgery, and her patient must know the doctor knows that he has given this permission. Some claim that such common knowledge requires communication, and so consent requires communication: the patient must tell the doctor he consents for both to know consent took place, and for both to know the other knows consent took place. I first defend the claim that consent requires common knowledge, responding to recent objections. I then argue that, though consent requires common knowledge, it does not always require communication. It does not require communication when the agent obtaining consent can infer common knowledge based on non-behavioral facts about the world.

This thesis examines same-sex attracted women's understandings of sexual consent. The thesis uses the theory of compulsory heterosexuality to analyse interviews with twenty-three women about their experiences in sexuality education and their relationships. The findings point to gaps in Australian sexuality education that position same-sex attracted women outside of mainstream discourses about sexual consent. The omission of same-sex attracted women from discussions about consent has implications for the prevention of sexual assault. Participants recommended that sexuality education focus on ethical approaches that are inclusive of queer experiences and perspectives to better prevent sexual violence in all types of women's relationships.

This dissertation examines the right of a state to use extraterritorial defensive force against a non-state actor without the territorial state?s consent. Article 51 of the United Nations Charter provides states with the right to unilaterally use defensive force but only after an armed attack has occurred. This right of self-defence is narrow and does not provide adequate protection to states facing an imminent threat. Fortunately, the right of self-defence is an inherent right that predates the Charter. Indeed, in terms of customary international law, states have the right to defend themselves before a threat materialises, provided the principles of necessity and proportionality are met. Article 51 makes no mention of the identity of the attacker. This is because the only relevant element of the right of self-defence is the gravity of the armed attack not the nature of the attacker. Indeed, despite the International Court of Justice?s interpretation of article 51, the attacker can be any subject of international law. In the case of an attack by a non-state actor, attribution to a state is not required for the right of self-defence to be valid. However, since non-state actors often operate from the territory of another state, the defending state must attempt to obtain the consent of the territorial state. If consent cannot be obtained, the territorial state?s right to sovereignty and territorial integrity must be balanced with the defending state?s right of self-defence. Current state practice demonstrates that this balance is increasingly leaning tipped in favour of the right of self-defence. Unfortunately, states have yet to unite around clear legal standards governing the right to use extraterritorial force against non-state actors. This dissertation provides recommendations aimed at bridging the gap between the current state practice and the legal norms on self-defence.

ABSTRACTThe Belgian Euthanasia Act of 2002 (The Act), amended in 2014 to include the Minor Act (The Minor Act), has drawn international criticisms for its liberal laws and practices regarding Euthanasia. This paper is a response to allegations that the liberal laws on Euthanasia has encouraged doctors to adopt a paternalistic 2 approach towards their patients by terminating their lives without their explicit consent, i.e. engaging in Involuntary Euthanasia.3, 4, 5Although in theory, only Voluntary Euthanasia (explicit patient request and therefore consent) is permitted in Belgium 6 the allegations implied that in practice, Involuntary Euthanasia (no explicit patient request and therefore consent is given) is practiced, especially in the Intensive Care Units (ICU) in Belgium.This paper attempted to make distinctions between Terminal Sedation and Euthanasia based on current dominant discourse in Bioethics and argued that it is not Involuntary Euthanasia that is practiced in the ICU but Non-Voluntary Euthanasia or Terminal Sedation (explicit patient request and therefore consent is unavailable) is practiced based on the intent of the doctor. In presenting its arguments, this paper focused specifically on the reports it procured from its qualitative research. Finally, in order to understand if doctors in the ICU are Gods or Monsters, the paper attempted to answer four questions namely:1. Are doctors in Belgium Gods, who help end lives?2. Or are they Monsters, who help end lives?3. Or are they pre-hippocratic doctors, historically called Witch-Doctors, who are“for hire” to either “cure or to kill” with no loyalty to the Hippocratic Oath?4. Or are they mutated witch-doctors pressured to practice Euthanasia in a countrywhere the laws are perhaps fatally flawed?

In this paper, the author analyzes the alleged consent, stating their stance against it and proposing, instead, the alleged will, considering that the last is right for describe the legal fiction used to recreate the moment in which the legal holder knows the fact and have the possibility of providing consent to excute the ‘ilicit’ action. In this line, the author reviewed the theories that explain the legal nature of the alleged will, rejecting it as a noncriminal behavior and considering it an autonomous underlying justification. Also, the author describes the requirements of this alleged will, differentiating it from other situations as subrogation. Finally, the author makes a review of the two categories where the alleged will occurs: performances in foreign interest and actions on self-interest.
En el presente artículo, la autora analiza la figura jurídica del consentimiento presunto, señalando su postura contraria a dicha formulación y proponiendo, en su lugar, el término voluntad presunta, por considerarlo más exacto para describir la ficción jurídica utilizada para recrear el momento en el que el titular del bien jurídico habría consentido la actuación del autor, en caso de haber conocido el hecho y de haberse encontrado en la posibilidad de brindar su consentimiento. En dicha línea, la autora repasa las teorías doctrinarias formuladas para explicar la naturaleza jurídica de la voluntad presunta, descartando que se trate de una causa de atipicidad penal y optando por considerarla una causa de justificación autónoma. Does the holder’s consent means that the behavior is unlawful, or is it a non-criminal behavior?In this paper, the author answers all these questions, emphasizing that, according to the type of State we live in, the legal-criminal rights are protected to allow the self-realization of every person. Based on that, the author maintains that all criminal-legal rights are of free disposal, and that  the  holder’s  consent  is  a non-criminality cause.

My applied research is conducted for my client, a CNM-friendly attorney in D.C. I investigate the experience of polyamorous people that use lawyers they perceive as consensually non-monogamous (CNM)-friendly. I probe what it means to be "CNM-friendly," how one promotes oneself as a CNM-friendly lawyer to potential clients and the world at large, and the relationship between being a CNM-friendly lawyer and activism.

The monograph discusses the application of nonparametric criteria of agreement (Kolmogorov, Cooper, Kramer-Mises -Smirnov, Watson, Anderson -Darling, Zhang) when testing simple and complex hypotheses. The appendix contains tables containing percentage points and statistical distribution models necessary for the correct use of criteria when testing simple and, most importantly, various complex hypotheses. In comparison with the first edition, more attention is paid to the application of criteria in non-standard application conditions, in particular for the analysis of large samples. It is shown that in applications, the properties of criteria can change significantly due to the presence of rounding errors, and this must be taken into account when forming statistical conclusions. Following the recommendations in data analysis will ensure the correctness of statistical conclusions and increase their validity. It is designed for specialists who, in one way or another, face issues of statistical data analysis, processing of experimental results, the use of statistical methods to analyze various aspects and trends of the surrounding reality in their activities. AbstractAffirmative consent was first articulated on college campuses in the United States in the 1990s. Affirmative consent demanded verbal, positive consent during each sexual encounter, and for each individual part of the sexual activity. Consent had to be meaningful and enthusiastic. While later interpretations would shift and change, and in many instances, non-verbal communication might count as affirmative consent, the model required active and positive participation from everyone during a sexual encounter. An absence of agreement—through silence or passivity—does not meet the standard of affirmative consent.This chapter outlines what affirmative consent was and is, how and why it developed, and why it has been widely imagined as a useful tool for navigating sexual encounters, and for preventing sexual violence. It charts what was initially a radical, alternative suggestion, to a concept that is now institutionalised in the mainstream. Just as importantly, it investigates the challenges of affirmative consent, in particular noting that power imbalances do not allow all people the freedom and bodily autonomy to assert consent. The chapter examines cases where affirmative consent cannot be freely given or denied, including situations where intimate partner violence occurs, or where other practices of coercion or powerlessness are in place. Finally, the chapter traces some of the recent legislative changes across Western cultures, which have enshrined affirmative consent in the law, despite the challenges of ensuring equal access to autonomy.

AbstractYoung people in Australia are particularly vulnerable to sexual assault with over 40% of reported assaults occurring between the ages of 15 and 35. Despite this, there is little research exploring how young people are engaging with changing perspectives on sexual consent negotiation. Key components of consent frameworks explored in this research are the relationship between the victim and perpetrator, and behaviours of the victim and perpetrator, including the ways in which consent is communicated or sought [or not sought]. Contemporary societal perspectives on consent were explored using survey data from 379 Australians aged 18–35. Results indicate widespread acceptance of affirmative consent approaches to consent, including recognition of passive forms of non-consent communication. However, a substantial minority of participants continue to hold consent views which demonstrate a failure to recognise non-consent in certain contexts and an absence of consideration of contextual cues that may factor into a person’s capacity to give free and enthusiastic consent. This highlights the importance of effective education on consent recognition and communication amongst young people.

AbstractConsent is more complicated than a simple ‘yes’ or ‘no’. This chapter serves as an introduction to many of the central ideas around consent in current cultures. It identifies the ways consent, violence, and coercion were and are conceptualised. It seeks to problematise simple concepts of consent and to highlight the ways power and authority influence consent. Our contemporary landscape retains important historical legacies that have left significant holes in social ideas of bodily authority and sexual autonomy. To better understand these gaps and omissions, this chapter traces the long history of consent and non-consent within social, cultural, and legal frameworks. For instance, across the nineteenth century, expectations of physical violence and force were slowly written out of the statutes surrounding rape: consent, rather than physical violence, became the criteria that distinguished sexual assault. Nonetheless, in the absence of physical violence, it remained almost impossible to convict an offender of rape, and force remained central to the way rape was ‘proven’ at trial. As this chapter explores, ideas about consent shifted over time and place, but many understandings remained resistant to change.

The article deals with a necessity of granting the general meeting’s consent with a division of business share in limited liability company in various situations. First, it discusses a need of granting the general meeting’s consent with a division of business share in connection with transfer or passing of business share. Although the Business Corporations Act requires the granting of the general meeting’s consent with a division of business share in connection with transfer or passing of business share, the authors conclude that such a consent is required by law only in cases when the business share is being divided in connection with transfer or passing of business share at the shareholder’s will. Additionally, they are of opinion that Section 43(3) of the Business Corporations Act, which requires granting the general meeting’s consent with a division of business share, is non-mandatory and thus shareholders may in the articles of association conclude that the general meeting’s consent with a division of business share is not necessary or that the consent shall be granted by another corporate body. Furthermore, the article discusses whether the general meeting’s consent is required when a business share is being divided in connection with cancellation of co-ownership or during the inheritance proceeding when the testator did not dispose with a business share mortis causa. In this regard, the authors conclude that the application of Section 43(3) of the Business Corporations Act, which requires granting the general meeting’s consent with a division of business share, is excluded by special regulation of co-ownership’s cancellation or division of the estate in the Civil Code, and thus the general meeting’s consent with a division of business share is not required in these cases.

It is an intense and demanding process and puts considerable strain on both recipients and donors. The choice of donor has an impact on the transplantation process from scheduling to outcome. There are several common donor issues whether the donor is related or unrelated including eligibility, confidentiality, informed consent and right to refuse consent.

Technological advancements in Sri Lanka have normalized and popularized the use of pornography, particularly with a focus on schoolgirl-related content. Unfortunately, the potential negative consequences associated with this content category have been largely disregarded. This study aims to examine the portrayal of Sri Lankan schoolgirls in Sri Lankan pornographic videos, focusing on behaviours, scenarios, and power dynamics. It analyses the representation of agency, autonomy, and consent, emphasizing gender equality. This sheds light on the objectification and sexualisation of schoolgirls in pornographic videos, emphasizing concerns about protection against harmful societal stereotypes. Employing a content analysis approach, the study purposively selects videos from three popular adult websites based on recent uploads and explicit references to schoolgirls. A comprehensive coding system is developed to analyse descriptive characteristics, sexual behaviours, scenarios, agency, autonomy, consent, and power dynamics, ensuring intercoder reliability through rigorous familiarization and systematic analysis. The analysis of 111 Sri Lankan schoolgirl pornographic videos reveals significant findings. The portrayal of performers wearing school uniforms (48.5%) raises concerns about the objectification of schoolgirls. Dominant themes include romantic scenarios (79.2%), with prevalent sexual behaviours involving vaginal intercourse (65.7%) and non-penetrative activities (63.9%) and promoting less safe sexual practices. Power dynamics vary between equal (77.4%) and unequal (22.5%) relationships. Results suggest that Sri Lankan pornography perpetuates stereotypes portraying schoolgirls as sexually assertive individuals. Further research is needed to understand the motivations behind the demand for this genre and its societal impact, enabling efforts to combat harmful stereotypes.

<div class="section abstract"><div class="htmlview paragraph">Autonomous vehicles or self-driving cars and semi-autonomous cars provide numerous driving assistance to the driver and passengers. However, with the advancements in driving technology the driver’s experiences and preferences are also taken into consideration for achieving the advanced safety goals. The drivers’ comfort and experiences are considered with the design and development of modern-day vehicles makes the driver’s preferences crucial for providing the driving experience. During the process of driving, the experience received by the driver is associated with the functional safety of the automotive system and hence the experience should be smooth with respect to safety. In this regard, the personalization in the space of the driver assistance system is gaining importance in analysing the driver’s behaviors and providing personal driving experiences to the driver. From the driver’s perspective the driving environment, the driving patterns of the different drivers, road conditions, etc. changes constantly. And hence, instead of providing a static driving experience to the driver through the usage of advanced driver assistance systems, an addition of personalized driving experiences to the driver assistance system makes the driving experience smooth. One of the critical driver assistance systems is the E-mirror, which is a camera-based system to replace the rear view, and side view mirrors of the vehicle by providing a smart experience to the driver. The E-mirror personalization is achieved by recommending the driver his preferred E-mirror control settings over his previous usage history. So, here an E-mirror recommendation system is proposed, which provides user-consent based recommendations to the driver to enhance the driving experience. The personalized smart E-Mirror provides personalized experiences to the users based on their previous user settings and mirror preferences. This reduces the need for constant or periodic change in the E-mirror adjustments for every user or every usage of the user. The personalized system observes the user activity over a prolonged period of time in using the E-mirror across the different driving styles, driving environments, climate conditions for all the users and collects a driver behavioral data in using the e-mirror through his settings and preferences. The personal experience of the user is achieved by recommending to the user about the e-mirror settings over a pre-defined recommendation criterion. The proposed E-mirror recommendation system receives numerous vehicular, non-vehicular and driver’s activity parameters in modelling the users’ behaviors through a deep learning recommendation algorithm. The collected user activity data for the E-mirror preferences are observed and the model is trained on on-device for providing the E-mirror setting recommendations to the driver upon receiving the user-consent. Hence, the personalized e-mirror recommendation system automatically controls the E-mirror camera settings after receiving the recommendations and also after getting user consent for the same.</div></div>

Advancement in information and communication technology (ICT) laid the foundation for open education practices (OEP). The open educational resources (OER) movement has been high on the accessibility and inclusivity agenda, however, the OPAL report: Beyond OER – Shifting Focus to Open Educational Practices (OPAL, 2011) suggests extending the focus beyond the use of OER in higher education to innovative OEP. OEP is defined as “a broad description of collaborative practices that include the creation, use, and reuse of OER, as well as pedagogical practices employing participatory technologies and social networks for interaction, peer-learning, knowledge creation, and empowerment of learners” (Cronin, 2017, p. 18). // Lecturers introduced OEP into a second-year module. Working in interprofessional teams, health and social care students (N:1734) conducted research and used open technologies to design a learning object. Learning objects were assessed, and with students’ consent, shared as OER. Within the evolving OEP domain, this SoTL research project explored students’ perceptions on the use of OEP in undergraduate, interprofessional education (IPE). Ethics approval was granted. Voluntary non-probability sampling was used. The study population comprised of all students registered for the module (N:1734) with 1145 (n) students giving written consent. // This qualitative study was anchored in a constructivist-interpretivist paradigm. A scoping review provided the theoretical foundation and empirical data was collected through an online reflection activity. Data was anonymised, thematically analysed, co-coded, and interpreted. // Participants perceived the introduction of OEP as very positive. Participants valued working collaboratively, gaining insight into diverse disciplinary approaches, and learning with, form, and about their peers. OEP allowed for increased engagement with the subject matter, better understanding, and knowledge retention. Participants valued learning new skills, being creative, co-constructing knowledge, and developing a learning object that can be used for more than just assessment purposes. Planning and acting in dynamic environments deals with non-deterministic events that might change the state of the environment without consent of the agent. In the worst case, some events might cause the agent to become ``trapped'' in a dead-end state, which in practice might mean damage or destruction of the agent. Presence of non-deterministic events often considerably increases the number of alternatives that might occur in a single step and hence traditional non-deterministic planning techniques might not scale. In this paper, we address a class of problems where non-deterministic events represent ``cyclic phenomena''. If they interfere with the agent, they might be dangerous for it (e.g. ships cruising through the area of AUV operations). We present techniques that initially analyse the problem whether it falls within this class by considering the notion of event reversibility and if so, these techniques generate a plan such that encountered unsafe states, in which the ``cyclic phenomena'' might interfere with the agent, can be eventually crossed without any risk of ``falling'' into a dead-end state. Our approach is evaluated in the AUV and Perestroika domains.

Abstract This paper describes an activity carried out as part of a University’s Summer on Campus program, which aimed to introduce high school students to the field of Human Factors. The program is designed to provide non-formal education activities in various scientific areas, being Human Factors in Engineering a crucial area of study that considers the individual, functionality, expectations, and impact of the end result while studying human emotions involved in cognitive processes like decision-making and perception. As Industry 5.0 emphasizes the importance of human involvement and collaboration with advanced technologies, it is crucial to understand and identify human responses to better understand human behavior. After the introduction to the topic of Human Factors and their importance for sustainability, several participatory and dynamic pedagogical activities were developed, including the collection of physiological data from high school students (n = 12) in a non-invasive way and after obtaining informed consent from their educational guardians, including GSR (Galvanic Skin Response) and ECG (electrocardiogram) signals. The importance of Human Factors in Engineering, the pedagogical approach used, the students’ attitudes and opinions regarding the set of Human Factors activities, and the lessons learned when approaching this topic with high school students are presented. The results indicated that the students were engaged and interested in the activities and showed an improved understanding of Human Factors and their importance in sustainability. Overall, this activity demonstrated the importance of introducing high school students to Human Factors, as it can help them develop a better understanding of human behavior, decision-making, and perception. By providing engaging and participatory activities, it is possible to foster interest and curiosity in this field, leading to future careers and research opportunities in Human Factors and related areas.

The most prevalent and unpleasant symptom that cancer patients encounter is pain. Pain is a highly subjective feeling resulting from the intricate interaction of bio-psycho-social aspects of the individual. The study aims to describe the correlates of severe pain in cancer patients in Sri Lanka. Methods: The descriptive study involved 384 cancer patients from Apeksha Hospital, Maharagama. Patients over 18 years who experienced cancer pain for three months or more, related to the primary lesion, secondary lesions, radiation, or chemotherapy were eligible. Patients whose pain is due to a non-cancerous source, triggered under three months of the assessment, and those who are too frail or disoriented with evidence of brain metastases are either unable or unwilling to give informed consent were excluded. The patients fulfilling inclusion criteria were recruited using the consecutive sampling method. The correlates of severe pain were determined using logistic regression A validated Sinhala version of the Short Form Brief Pain Inventory and a pre-tested socio-demographic questionnaire was used to collect data. The correlates of severe pain were determined using logistic regression. Statistically significant correlation was shown between severe pain and ‘male gender’, (AOR=1.723; p=0.035); ‘being in marriage’ (AOR =1.947; p=0.026); ‘patients with no perceived family commitments’ (AOR=1.8; p=0.013) and pain of three months or more duration (AOR = 1.76; p=0.021). In conclusion it is discovered that the severe pain is positively correlated with males, ‘being in a marriage,’ ‘no perceived family commitments, and in pain for over a three months duration. The usability validation process of medical devices outside controlled environments such as test facilities, laboratories, or by expert groups is vital to scrutinising the viability of the developed solution. This work outlines a case study in which the Spanish emergency service 061-Andalucia took part in the validation process of a non-contact vital sign measuring device through image processing, describing the methodology, participant sample, data analysis and conclusions. The measured vital signs were heart rate, respiratory rate, oxygen saturation, temperature, and blood pressure contactless at 2 meters (6.5 ft). In the study, three emergency service teams from three different operation bases in Malaga (Spain) underwent the validation process under semi-real conditions. Each team was provided with one measurement device used during the work shift on patients who were not in a critical stage, conscious and willing to participate in the study after being informed and signing a consent form. The primary goals of the validation were to analyse the ease of the process, reliability, and robustness of the measurements against the standard measurement equipment of the emergency service in different scenarios, as well as detect errors and limitations under semi-real conditions of use. Besides providing evidence of a potential improvement in the service through this new camera system, the satisfaction of the users/ patient and reducing equipment weight. Under these harsh conditions, the measurement device with a technical readiness level 7 reached reliability and robustness between 70% and 100%, depending on the measured vital signs and a high acceptance among the professionals of 66,66%.

When we think on initiatives on access to and reuse of data, we must consider both the European Intellectual Property Law and the General Data Protection Regulation (GDPR). The first one provides a special intellectual property (IP) right – the sui generis right – for those makers that made a substantial investment when creating the database, whether it contains personal or non-personal data. That substantial investment can be made by just one person, but, in many cases, it is the result of the activities of many people and/or some undertakings processing and aggregating data. In the modern digital economy, data are being dubbed the ‘new oil’ and the sui generis right might be con- sidered a right to control any access to the database, thus having an undeniable relevance. Besides, there are still important inconsistences between IP Law and the GDPR, which must be removed by the European legislator. The genuine and free consent of the data subject for the use of his/her data must remain the first step of the legal analysis.

This review is largely based on grey literature, in particular policy documents and reports by international development organizations. While there was substantial literature on approaches and principles to GBV documentation, there was less on remote service delivery such as helplines – much of this only in the wake of the COVID-19 pandemic. In addition, very little was found on actual examples of GBV documentation in developing contexts. By definition, gender featured strongly in the available literature; the particular needs of persons with disabilities were also addressed in discussions of overall GBV responses, but far less in GBV documentation. GBV documentation refers to the recording of data on individual GBV incidents in order to provide/refer survivors with/to appropriate support, and the collection of data of GBV incidents for analysis and to improve GBV responses. The literature notes that there are significant risks associated with GBV documentation, in relation to data protection. Failure to ensure information security can expose survivors, in particular, to harm, e.g. reprisal attacks by perpetrators, stigma, and ostracism by their families/ communities. This means that GBV documentation must be carried out with great care. A number of principles should always be applied when documenting GBV cases in order to protect survivors and prevent potential negative effects: do no harm, survivor-centered approach, survivor autonomy, informed consent, non-discrimination, confidentiality, and data protection (information security).

Background Opioid analgesia has become the mainstay for acute pain management in the postoperative setting. However, the use of opioid medications comes with significant risks and side effects. Due to increasing numbers of prescriptions to those with chronic pain, opioid medications have become more expensive while becoming less effective due to the buildup of patient tolerance. The idea of opioid-free analgesic techniques has rarely been breached in many hospitals. Emerging research has shown that opioid-sparing approaches have resulted in lower reported pain scores across the board, as well as significant cost reductions to hospitals and insurance agencies. In addition to providing adequate pain relief, the predicted cost burden of an opioid-free or opioid-sparing approach is significantly less than traditional methods. Methods The following groups were considered in our inclusion criteria: those who speak the English language, all races and ethnicities, male or female, home medications, those who are at least 18 years of age and able to provide written informed consent, those undergoing inpatient or same-day surgical procedures. In addition, our scoping review includes the following exclusion criteria: those who are non-English speaking, those who are less than 18 years of age, those who are not undergoing surgical procedures while admitted, those who are unable to provide numeric pain score due to clinical status, those who are unable to provide written informed consent, and those who decline participation in the study. Data was extracted by one reviewer and verified by the remaining two group members. Extraction was divided as equally as possible among the 11 listed references. Discrepancies in data extraction were discussed between the article reviewer, project editor, and group leader. Results We identified nine primary sources addressing the use of ketamine as an alternative to opioid analgesia and post-operative pain control. Our findings indicate a positive correlation between perioperative ketamine administration and postoperative pain control. While this information provides insight on opioid-free analgesia, it also revealed the limited amount of research conducted in this area of practice. The strategies for several of the clinical trials limited ketamine administration to a small niche of patients. The included studies provided evidence for lower pain scores, reductions in opioid consumption, and better patient outcomes. Implications for Nursing Practice Based on the results of the studies’ randomized controlled trials and meta-analyses, the effects of ketamine are shown as an adequate analgesic alternative to opioids postoperatively. The cited resources showed that ketamine can be used as a sole agent, or combined effectively with reduced doses of opioids for multimodal therapy. There were noted limitations in some of the research articles. Not all of the cited studies were able to include definitive evidence of proper blinding techniques or randomization methods. Small sample sizes and the inclusion of specific patient populations identified within several of the studies can skew data in one direction or another; therefore, significant clinical results cannot be generalized to patient populations across the board.

The COVID-19 pandemic has created enormous challenges for national economies, livelihoods, and public services, including health systems. In January 2021, the World Health Organization proposed an international treaty on pandemics to strengthen the political commitment towards global pandemic preparedness, control, and response. The plan is to present a draft treaty to the World Health Assembly in May 2021. To inform the design of a support system for this treaty, we explored existing mechanisms for periodic reviews conducted either by peers or an external group as well as mechanisms for in-country investigations, conducted with or without country consent. Based on our review, we summarized key design principles requisite for review and investigation mechanisms and explain how these could be applied to pandemics preparedness, control, and response in global health. While there is no single global mechanism that could serve as a model in its own right, there is potential to combine aspects of existing mechanisms. A Universal Periodic Review design based on the model of human rights treaties with independent experts as the authorized monitoring body, if made obligatory, could support compliance with a new pandemic treaty. In terms of on-site investigations, the model by the Committee on Prevention of Torture could lend itself to treaty monitoring and outbreak investigations on short notice or unannounced. These mechanisms need to be put in place in accordance with several core interlinked design principles: compliance; accountability; independence; transparency and data sharing; speed; emphasis on capabilities; and incentives. The World Health Organization can incentivize and complement these efforts. It has an essential role in providing countries with technical support and tools to strengthen emergency preparedness and response capacities, including technical support for creating surveillance structures, integrating non-traditional data sources, creating data governance and data sharing standards, and conducting regular monitoring and assessment of preparedness and response capacities.
