Cette étude consiste à démontrer que les procédures administratives d’urgence ont entraîné une modification de la conception du rôle du juge administratif : d’une part, par rapport aux libertés fondamentales dont le juge administratif a dû déterminer et encadrer la notion ; d’autre part, par rapport à l’autorité administrative vis-à-vis de laquelle le juge administratif a retiré un pouvoir accru qui lui donne la vigueur d’un juge administrateur. Cette étude est présenté en deux parties on s’attacher, dans une première partie, à montrer comment les procédures d’urgence, mises à sa disposition par la loi du 30 juin 2000, permettent au juge administratif de faire cesser les atteintes aux libertés fondamentales. Dans une deuxième partie, on tentera de mettre en lumière l’évolution du rôle du juge administratif dans ses relations avec l’administration. Les procédures d’urgence ont conduit à l’élargissement de ses pouvoirs, ce qui a entraîné un renforcement de l’autorité du juge administratif par rapport l’administration
This study is aims to demonstrate that the administrative procedures of urgency has led to a redefinition of the role of administrative judge: first, in relation to the fundamental libertie whose the administrative judge had a duty to determine this concept. Secondly, in relation to administrative authority vis-à-vis which the administrative judge withdrew an increased power that gives it the force of a administration judge. This study is presented in two parts: in the first part, we show how the urgency procedures provided by the law N° 2000-597 of 30 June 2000, allows the administrative judge to stop violations of fundamental liberties. In The second part we attempt to highlight the changing role of the administrative judge in its relations with the administration. The urgency procedures have led to the expansion of its powers, which led to a strengthening of the authority of the administrative judge against the administration

The system of precedents established by the Civil Procedure Code bases on the need for integrity and stability of the legal system, as well as on the imperative guarantee of the uniqueness of the decisions set by the courts that have the competence to standardize the jurisprudence. The objective is to ensure that equal cases are treated in the same way, thus fulfilling the fundamental right of equality laid down in the Federal Constitution. That is, to apply precedents is to exercise the jurisdictional activity guided on the coherence of judgments, based on the arguments already established by the high courts, but above all is to bring rationality to the legal system and to the courts avoiding that these decisions be discarded, ignored or disrespected without any plausible reasoning, or reasons for it. Therefore, all those who have the power to judge, even if in an administrative jurisdiction, should adhere to and respect precedents established by the major courts, since they are bound to them by the constitutional principle of efficiency. This principle mandates that the Public Administration achieve the same purpose with the use of fewer resources, that is, applying this principle in judicial activity, the administrative judge must adhere to established precedents, considered public goods, avoiding that a thesis already judged and pacified is ignored or discarded without its due overruling. The present paper aims to demonstrate that the Tax Administrative Courts must follow precedents, because they are bound by Civil Procedure Code, but, above all, by a duty of efficiency, ordered by such principle, which dictates public agents and obliges them to act with rationality in administrative functions and activities, including here the judicial exercise of such courts
A sistemática de precedentes trazida pelo Código de Processo Civil fundamenta-se na necessidade de integridade e de estabilidade do sistema jurídico, bem como na imperiosa garantia de unicidade dos entendimentos firmados pelos tribunais que têm por competência uniformizar a jurisprudência, garantindo-se, assim, que casos iguais sejam tratados da mesma forma, concretizando, por conseguinte, o direito fundamental de igualdade previsto na Constituição Federal. Ou seja, aplicar precedentes é exercer a atividade jurisdicional pautado na coerência dos julgamentos, baseando-se nas teses já firmadas pelos tribunais de competência superior, mas, sobretudo, é trazer racionalidade ao sistema jurídico e aos órgãos judicantes, evitando-se que esses entendimentos pacificados sejam descartados, ignorados ou desrespeitados sem que haja fundamentação plausível ou motivos determinantes para tanto. Logo, todos aqueles que tem o poder-dever de julgar, mesmo que em sede administrativa, devem se pautar e respeitar os precedentes firmados pelas cortes maiores, visto que se encontram vinculados a eles pelo princípio constitucional da eficiência. Tal princípio ordena que a Administração Pública atinja o mesmo fim com a utilização de menos recursos, ou seja, trazendo à atividade jurisdicional, deve o julgador administrativo, por este princípio, aplicar os precedentes firmados, como bens públicos que são, evitando-se que uma tese já julgada e pacificada seja ignorada ou descartada sem a sua devida superação. O presente trabalho objetiva, portanto, demonstrar que os Tribunais Administrativos Tributários devem seguir precedentes, por estarem vinculados à sistemática do Código de Processo Civil, mas, acima de tudo, por um dever de eficiência, ordenado por tal princípio, que pauta os agentes públicos e os obriga a agir com racionalidade no trato das funções e das atividades administrativas, incluindo-se, aqui, o exercício jurisdicional desses tribunais

Local government is arguably the most significant sphere of government to lay citizens, as it is the point of contact of citizens with their government. Local government enables a direct link between the general public and the basic services that they are entitled to by means of their constitutional and legislatively entrenched rights. It is the only sphere of government that allows and encourages face-to-face engagement between citizens and their governors, providing the necessary platform for interaction, contact and communication. It is imperative therefore that this tier of government operate optimally and competently, as it represents a reflection of the operation of government wholly. Research unfortunately illustrates that public perceptions of local government are negative, with levels of trust in local government being substantially lower than those in provincial and national governments. The responsibility for failure to perform would lie squarely on the shoulders of those individuals leading any institution. The leading incumbents driving a municipality are the political and administrative heads, i.e. executive mayor and municipal manager.

This thesis discusses the notion of tax evasion in Rwanda. It looks at the role of tax administration and fiscal codes in Rwanda in the implementation of tax anti-evasion measures in the country. The tax administration and fiscal codes provide opportunities for the Rwandan people to realize a tax evasion free society not only because of the tax administration departments in place to curb tax evasion, the types of taxes, the measures of collection, but also the reasonable fiscal procedure process in tax payment and also in allowing the taxpayer participation in the tax assessment process, an essential component of co-operative taxpayer attitudes for potential tax revenue collections to thrive.
However, this thesis scrutinizes the reality in Rwanda for the extent to which tax administration and tax laws have gone to achieve the goal of curbing tax evasion.
Tax administration measures and fiscal code provisions in place, can not be said to be perfect as at times it is foreign ideas imported into Rwanda, which must be adopted often as a conditionality to that much needed development assistance. This in light of the persistent institutionalized corruption existing in Rwanda, and the reality of public participation in the tax assessment process given the Rwandan culture of evading taxes, makes the anti-evasion process inadequate in Rwanda, thus further "watering down" the sufficiency of the tax law and tax administration as a previously perceived usable strategy for curbing tax evasion. The thesis argues therefore that the tax administration and fiscal codes in curbing tax evasion are limited by existence of these realities unless modifications are made in the implementation of measures against tax evasion in Rwanda.

Le régime d'autorisation est traditionnellement présenté comme un instrument depolice institué dans le but d'éviter que l'exercice de certaines libertés ne trouble l'ordre public. De cette fonction du régime d'autorisation se déduisent les principaux caractères de l'acte d'autorisation, acte unilatéral de police, précaire et incessible. Chacun de ces caractères se trouve cependant partiellement démenti par certaines évolutions du droit positif, en particulier par le phénomène de patrimonialisation qui touche un nombre croissant d'autorisations. Jusqu'à présent, ces évolutions n'ont été appréhendées que comme des exceptions à des principes dont la prétention à la généralité valait encore. L'ampleur de ces évolutions invite cependant à douter de la pérennité d'une telle présentation. L'objet de cette recherche est de montrer que ces évolutions sont la conséquence de ladiversité fonctionnelle du régime d'autorisation. En effet, le régime d'autorisation n'est pas nécessairement un instrument de police. Il est également utilisé comme un moyen soit de répartir l'accès à une ressource rare, soit d'organiser l'exercice d'une activité d'intérêt général. Cette diversité fonctionnelle du régime d'autorisation donne naissance à des catégories d'autorisations, catégories qui, une fois ordonnées, forment une typologie. Cette approche plurielle permet de comprendre pourquoi les autorisations répondent à des régimes juridiquesdifférents
The authorisation scheme is traditionally presented as a policing system. From thisfunction of the authorisation scheme one can deduce the principal characteristics of the authorisation, unilateral police decision, precarious and untransferable. However, each of these characteristics is refuted by certain developments of substantive law, particularly by the phenomenon of patrimonialisation which affects an increasing number of authorisations. Until now, these developments have only been understood as exceptions to well-established principles. However, the scope of these developments casts doubt on the durability of such a way of seeing.The objective of this research is to show that these developments are the consequence of the functional diversity of the authorisation scheme. The authorisation scheme is not necessarily a policing system. It is also used as a means to allocate resources or to organise an activity of general interest. The functional diversity of the authorisation scheme gives rise to several categories of authorisations, categories that once organised form a typology. This pluralapproach makes it possible to understand why the authorisations operate under different legal frameworks

In this article, the author highlights the benefits of incorporating the concepts “concession contract” and “long term contract” within the new Civil and Commercial Code of the Nation in Argentina. For the author, these contractual arrangements are fundamental in Administrative Law to understand the scope of the concession of public services, specifically in regard to the introduction of changes in the contract. This also means that foreign police concepts or theories as ius variandi, which only add authoritarian elements under the contract, are not longer required.
En el presente artículo, el autor resalta los beneficios de la incorporación de los conceptos “contrato de concesión” y “contrato de larga duración” dentro del nuevo Código Civil y Comercial de la Nación argentina. Así, para el autor, estas figuras contractuales son fundamentales en el Derecho Administrativo para poder comprender los alcances del contrato de concesión de servicios públicos, específicamente, en cuanto a la introducción de variaciones en la ejecución del contrato. Ello conlleva, además, que ya no se tenga que recurrir a conceptospoliciales extraños o a teorías como la del ius variandi que únicamente añaden elementos autoritarios en el marco del contrato.

This thesis offers to study “la transaction administrative” (agreement between two public agencies and a public agency and private individual in order to resolve conflict) in consideration of its legal environment: a transactional method of resolution administrative dispute can it validly grows into French law? It appears that the administrative transaction has developed where it is designated to do so. Promote this mode of dispute resolution assumed to clarify the definition and the legal regime. Here, like the transaction of private law, the administrative transaction is characterized by three elements: the existence of a dispute- under the administrative judge - an agreement and mutual concessions. Their apprehension is, however, subject to some adjustments to take account of the issues of administrative law that necessarily raise administrative disputes. This is a transaction largely inspired by the transaction of private law and slightly derogatory to common law that the Conseil d’Etat has shaped. The administrative transaction has been actually developed. However, a bigger development does not seem possible, at least in the short term, as the obstacles are significant. These are numerous, of heterogeneous nature and in some cases, hardly remediable. Neither the French legal system, nor the characteristics of the transaction allow a massive development of this dispute resolution. It is therefore likely that the administrative transaction remains in France, a secondary means of dispute resolution. But secondary does not necessarily mean minor, and if further progress is possible, the result of the administrative transaction is, essentially, very honourable
La présente thèse se propose d’étudier la transaction administrative à l’aune de son environnement juridique : un mode transactionnel de règlement des litiges administratifs peut-il valablement se développer en droit français ? Il apparaît alors que la transaction administrative s’est développée là où elle est désignée pour ce faire. Promouvoir ce mode de règlement des litiges supposait d’en clarifier la définition et le régime juridique. En l’occurrence, comme la transaction de droit privé, la transaction administrative est caractérisée par trois éléments : l’existence d’un litige ─ relevant du juge administratif ─, un accord de volontés et des concessions réciproques. Leur appréhension fait, en revanche, l’objet de quelques adaptations de façon à tenir compte des problématiques du droit administratif que soulèvent nécessairement les litiges administratifs. C’est donc une transaction largement inspirée de la transaction de droit privé et faiblement dérogatoire au droit commun que le Conseil d’Etat a façonnée. Depuis, la transaction administrative s’est effectivement développée. Toutefois, un plus grand développement encore ne semble pas envisageable, du moins à court terme, tant les entraves sont importantes. Celles-ci sont nombreuses, de nature hétéroclite et pour certaines, difficilement remédiables. Ni le système juridique français, ni les caractéristiques propres de la transaction ne se prêtent à un développement massif de ce mode de règlement des litiges. Il est donc probable que la transaction administrative demeure, en droit français, un mode secondaire de règlement des litiges. Mais secondaire ne signifie pas nécessairement mineur, et si des progrès sont encore envisageables, le bilan de la transaction administrative est, pour l’essentiel, très honorable

This study examined the beliefs, perceptions, actions, and congruency between beliefs and actions of participants completing an anonymous survey regarding if clients should be informed of the AAMFT organization, code of ethics, and grievance procedure. Two hundred thirty-one participants returned the survey, representing AAMFT clinical members, AAMFT state division officers, and the AAMFT national ethics committee board members. The findings include the respondents' beliefs, actions, and congruency between the two for informing clients about the organization, code of ethics, and grievance procedure. Most participants believe clients should be informed and the results indicate that the participants are mainly consistent with their actions, except for grievance procedures. The findings seem to indicate that as the perceived risk for the therapist increases, the amount of information shared decreases. The beliefs and actions regarding the grievance procedure seemed to be the most ambiguous.

Malgre les apparences, un lien existe cependant. Toutefois il ne doit pas etre cherche dans l'objet (le theme traite) comme dans la these, mais dans le sujet (l'auteur des etudes). Il y a toujours derriere et au fondement des ecrits publies, une doctrine qui peut se resumer ainsi : le juge est aussi citoyen. Si dans son role de juge, il doit resoudre le litige porte devant lui dans le respect du droit, dans son role de citoyen, il doit reflechir sur l'efficacite de l'institution a laquelle il a l'honneur d'appartenir et sur la legitimite du droit qu'il applique. C'est cette double perspective qui explique les deux axes d'une reflexion qui a ete consignee dans un peu moins d'une centaine de publications qui ont porte essentiellement sur la procedure contentieuse, les contrats publics, le droit des etrangers, le droit communautaire et le systeme fiscal francais
If, as it may presumed, a summary is always possible when a thesis for obtaining the doctorate is presented, it is quiet different when what is presented is a collection of studies which do not have and, seemingly, cannot have between them any direct relationship. Actually and in spite of appearances, that relationship exists. However it should not be sought in the object (the treated topic) as in the thesis, but in the subject (the author of the studies). There is always behind those studies and founding them a doctrine which could be summarized as follows: the judge is also a citizen; if as a judge, he must solve litigations in the respect of the right, as a citizen, he can avoid to reflect on the effectiveness of the institution to which it has the honour to belong and on the legitimacy of the right which he applies. It is this double prospect which explains the two axes of a reflexion which was consigned in a little less than one hundred publications which related primarily to procedural rules, public contracts, immigration rules, community law and french tax system

Asmens konstitucinės teisės į teisminę gynybą pirminis realizavimo etapas yra kreipimasis būtent į pirmosios instancijos administracinį teismą, t.y. apygardos administracinį teismą. Šiame teisme nustatomos bylai reikšmingos aplinkybės, renkami, tiriami ir vertinami įrodymai bei paprastai priimamas teismo sprendimas, kuriuo ginčas išsprendžiamas iš esmės. Tai lemia išskirtinę proceso pirmosios instancijos administraciniame teisme vietą asmens konstitucinės teisės į teisminę gynybą realizavimo sistemoje. Todėl šį procesą reguliuojančiuose įstatymuose neturėtų būti prieštaravimų bei spragų, taip pat proceso pirmosios instancijos administraciniame teisme teisinis reguliavimas turėtų atitikti Konstitucijoje įtvirtintiems teisės į teisminę gynybą imperatyvams. Tyrimo objektas – administracinių bylų procesas pirmosios instancijos administraciniame teisme: teorinės ir teisinės praktikos problemos. Darbo tikslas – nustatyti administracinių bylų proceso pirmosios instancijos administraciniame teisme veiksmingumą. Darbe pirmą kartą Lietuvoje sistemiškai analizuojamas proceso pirmosios instancijos administraciniame teisme teisinio reguliavimo modelis. Darbe atskleistos proceso pirmosios instancijos administraciniame teisme teisinio reglamentavimo problemos bei pasiūlyti galimi jų sprendimo būdai, taip pat užsienio valstybių administracinės justicijos analizė būti panaudota siekiant sukurti optimalų administracinių bylų proceso teisinio reguliavimo modelį.
Initial stage of implementation of the constitutional right of a person to judicial protection is an application to the administrative court of first instance, i. e. to regional administrative court. At the administrative court of first instance circumstances relevant to the case are determined, evidence is collected, investigated and evaluated and usually court decision resolving the case in essence is adopted. This determines an exceptional place of the procedure at the administrative court of first instance in the system of implementation of the constitutional right of a person to judicial protection. Therefore, legislation regulating the procedure should be clear and bear no contradictions or gaps, moreover, legal regulation of the procedure at the administrative court of first instance should be in compliance with imperatives of the right to judicial protection conferred by the Constitution. The object of the research is the procedure of administrative cases at the administrative courts of first instance: theoretical and legal issues in the jurisprudence. The objective of the thesis is to determine the efficiency of the procedure of administrative cases at the administrative courts of first instance. The thesis in a systematical manner examines the model of legal regulation for the procedure at the administrative court of first instance in Lithuania the first time. Il est fondamental, dans chaque système juridique, de pouvoir contester une décision prise par l'administration notamment dans un pays où celle-ci est omniprésente dans tous les domaines de la société. Dans la plupart des pays, cette contestation prend la forme d'un recours gracieux ou d'un recours juridictionnel. Jusqu'en 1996 au Vietnam, il existe seulement le recours gracieux devant l'Administration mais ce recours s'est révélé inefficace. Dès lors, l’ordonnance de 1996, suivi de deux amendements ont instauré pour la première fois le recours juridictionnel. Néanmoins, la compétence de la juridiction administrative demeure très restreinte, l’Administration conserve la compétence générale dans le règlement des conflits avec les administrés. Ainsi, le droit d'accès au juge n'est pas assuré car la plupart des requêtes introductives d’instance est rejetée faute de compétence du juge. Une récente loi en 2010 est de nouveau intervenu pour élargir la compétence de la juridiction administrative. Malgré la volonté du législateur, les nouvelles dispositions ne répondent pas encore à l'exigence de plus en plus forte de la société vietnamienne pour examiner des recours contre l’Administration devant un organe indépendant. Il est urgent de trouver un mécanisme qui permet d’assurer le droit d'accès au juge. Cette thèse aborde les problématiques relatives à l'introduction d'instance de premier ressort devant la juridiction administrative vietnamienne ; et à la lumière du droit français, elle apporte des propositions d’amélioration de la législation vietnamienne en la matière
Contesting an administrative act is a fundamental right in every legal system. In Vietnam, it is possible to make an appeal for reconsideration but this process is not effective. Thus, in 1996, the Vietnamese legislator established, for the first time, a jurisdictional appeal. However, this appeal was very limited thereby rendering ineffective the right of access to administrative justice. The amendments of contentious rules in 1998 and 2006, and more recently the law on administrative procedures in 2010 (taken into effect as of 1st of July 2011) were issued with the aim of expanding the competence of administrative jurisdiction. Indeed, in the absence of the satisfaction of rules regarding competence and admissibility, the petition instituting proceedings can be rejected by the administrative judge. The right of access to justice is additionally prevented par gaps in the law on administrative procedures or the strict interpretations of the judge. Furthermore, the overlapping of rules may influence the rights of citizens. Although there are many administrative disputes, the new dispositions don’t meet the needs of Vietnamese society. Toutefois, elle se révèle comme étant plus qu’une simple obligation déontologique : elle revêt également un aspect procédural, dans sa dimension objective. Cette double dimension est à la source des riches développements du principe d’impartialité, appliqué à l’Administration. Celui-ci vise, d’une part, à réguler les risques de conflits d’intérêts qui traversent l’Administration. Il permet, d’autre part, de garantir l’effet utile des procédures administratives, conçues pour encadrer le pouvoir discrétionnaire de l’Administration et garantir la meilleure opportunité des décisions administratives. Fundamental requirement of Justice, impartiality is also a duty of public servants. However, impartiality turns out to be more than an ethical duty : it assumes a procedural angle, in its objective extent. This double aspect causes rich developments of the principle of impartiality, applied to the Administration. This principle aims at regulating the risks of conflicts of interests which cross the Administration. It also enables to secure the effectiveness of administrative procedures, understood as a legal framework of administrative discretion and the guarantee of the adequacy of administrative decisions. En la tramitación de los procedimientos administrativos sancionadores, los funcionarios afrontan dificultades para notificar los actos administrativos, las cuales no solo se limitan a la determinación del domicilio correcto del administrado en el cual se harán llegar los actos, sino además en el hecho de que, una vez determinado dicho domicilio, se presentan supuestos de diligencias de notificación infructuosas, ya sea porque la dirección resulta inexistente o porque el administrado ya no reside en dicho lugar, ello debido a que el domicilio declarado por el administrado ante el Registro Nacional de Identificación y Estado Civil es incorrecto o no se encuentra actualizado, siendo que dicha situación, sumado a una legislación que pretende ser muy garantista, ha llevado a que las entidades de la Administración Pública destinen recursos significativos en la notificación de actos a través de la publicación de edictos. Usando el método de investigación descriptiva con enfoque cualitativo, en la presente investigación se demostrará que la aplicación del régimen de notificación establecido en la Ley del Procedimiento Administrativo General, Ley N° 27444, viene siendo ineficiente, generando costos innecesarios a la Administración. Ante dicha situación, se concluye que se deben ejecutar una serie de acciones, que no solo implican la modificación de la citada Ley, y de la Ley Orgánica del Registro Nacional de Identificación y Estado Civil, Ley N° 26497, sino que además implican dotar al procedimiento de expedición del Documento Nacional de Identidad y al procedimiento del cambio del dato domiciliario, del uso del Sistema Georeferenciado para mejorar la confiabilidad de los datos declarados por los ciudadanos, desarrollar una campaña de concientización respecto de la importancia de actualizar el domicilio en el Documento Nacional de Identidad, y optimizar las acciones de fiscalización del RENIEC respecto del cumplimiento de la obligación de actualizar el domicilio.
In the processing of administrative sanctions procedures, officials face difficulties in notifying administrative acts, which are not only limited to the determination of the correct domicile of the petitioner to which the documents will be sent, but also in the fact that, once this domicile is determined, there are cases of unsuccessful notification diligences. This may happen because the address is non-existent, the petitioner no longer resides in that location, or because the domicile declared by the petitioner before the National Registry of Identification and Marital Status is incorrect or is not updated. This situation, added to a legislation that seeks to provide all possible guarantees, has led to the Public Administration entities allocate significant resources in the notification of acts through the publication of legal notices. The descriptive research method involving a qualitative approach has been applied to conduct this research study, which will demonstrate that the application of the notification regime established in the General Administrative Procedure Act, Law No. 27444, is inefficient, and creates unnecessary administrative costs. It, therefore, follows that a series of actions must be executed, which do not only imply the modification of the Law mentioned above, and the Organic Law of the National Registry of Identification and Marital Status, Law No. 26497, but also the implementation of the Georeferenced System to improve the reliability of the data declared by citizens in their Identity Cards. This action will be critical to carry out an awareness campaign regarding the importance of updating the domicile in the Peruvian Identity Card to optimize RENIEC's inspection actions regarding fulfillment with the obligation to update the domicile.

La codification de la procédure administrative est un thème à la croisée de deux mythes fondateurs, en apparence inconciliables, du droit civil et du droit administratif. Sujet a priori antinomique où s’entrecroisent deux icônes doctrinales : la codification et son patrimoine napoléonien ; la jurisprudence et sa filiation au Conseil d’Etat. L’une exclut l’autre puisqu’elles occupent le même espace symbolique, celui de l’avènement d’un droit général, unifié et systématique. La thèse suivie propose de participer à la déconstruction de ces mythes en retenant une conception dépassionnée et objective de la codification. Cette dernière se conçoit comme une simple méthode de systématisation du droit écrit, sans vertu préconçue, si ce n’est de faciliter l’accès au droit. Le choix d’étudier la procédure administrative, outre son origine jurisprudentielle, se renouvelle par la publication récente d’un code des relations entre le public et l’administration. Les caractéristiques généralistes de ce code ainsi que la reprise de solutions jurisprudentielles s’associent aux mythes civilistes et administrativistes pour mieux les désavouer. La codification rencontre la jurisprudence et les équilibres fondamentaux de la matière demeurent immuables : aucune sclérose du droit, aucun déclassement du juge. La technique s’adapte à son objet, elle ne constitue pas un élément de rupture, mais elle parvient, à l’inverse, à conserver les équilibres en présence. L’intérêt de cette approche consiste alors à minimiser les impacts de la codification pour mieux la banaliser et permettre son développement dans une matière qui lui échappe encore en grande partie
The codification of administrative procedure is a theme at the crossroads of two founding myths of civil and administrative laws outwardly incompatible. This issue is a priori conflicting. Indeed, two doctrinal icons intertwine : on the one hand, the codification and its Napoleonian heritage, on the other hand, the jurisprudence and its filiation with the Conseil d’Etat (Council of State). One excludes the other since they lodge in the same symbolic space that of the advent of a unified and systematic law. This thesis aspires to refute these myths by embracing a dispassionate and objective conception of codification. Codification is designed as a simple method of systematizing written law, without preconceived virtue if not facilitating access to law. As well as being jurisprudential, the choice to study the administrative procedure has been reasserted by the adoption of the Code of relationships between the public and the administration. The general characteristics of this new code, along with the codification of legal precedents, link up with both civil and administrative myths to better disavow them. Codification encounters jurisprudence and the fundamental balances remain immutable. Subsequently, not only is there no sclerosis of the law, but also no downgrading of the judge. It follows that the technique is suited to its purpose. Instead of constituting a breach, it does retain the balances involved. Therefore, this thesis consists of making codification commonplace by minimizing its impacts and enabling its development in a discipline that still mainly eludes it

Background: Pre-eclampsia (PET) is one of the major causes of maternal and neonatal morbidity and mortality1. Misclassification of PET can lead to biased or erroneous results in epidemiologic studies resulting in false conclusions. Objectives: The objectives of this thesis are to determine the validity of PET diagnosis in pregnant women in administrative database using the ICD-10-CA codes, to explore the nature of misclassification, and to estimate whether misclassification of PET diagnosis in administrative database may result in biased conclusions. Methods: Pregnant women who participated in the Ottawa and Kingston (OaK) Birth Cohort study and delivered in the Ottawa Hospital were included in the study. All cases with hypertensive disorder of pregnancy in the study population were adjudicated to confirm diagnosis of PET. This adjudicated dataset was used as a reference standard. The PET incidence in hospital discharge database was compared with PET incidence calculated from the reference standard database. Results: 2887 of the requested charts were available for review. The PET incidence was much lower in administrative database (1.47%) than in the OaK Birth Cohort Study (3.6%). The results of the study demonstrated that hospital discharge database via ICD-10-CA was not very sensitive to determine incidence of PET since sensitivity of ICD-10-CA diagnostic codes for PET was low (35.92% with 95% Confidence Intervals (CI): 26.7; 45.9) but specificity, PPV, and NPV were high. The majority of misclassified cases belonged to the category (according to the proposed classification) “PET pregnancies coded with incorrect ICD-10-CA code” (78.88%) followed by the category “Pregnancies affected by PET coded as normal” (14.08%). Conclusion: Using hospital discharge database and ICD-10-CA coding to determine incidence of PET in certain settings may yield low sensitivity. Researchers should validate the results when using the hospital discharge database for PET research to ensure that the findings based on analyses of such data demonstrate what they claimed to demonstrate.

In Turkey, most of the existing buildings are vulnerable to earthquakes due to their poor material quality and inaccurate design. Besides, so many destructive earthquakes occurred in the past, because Turkey is located on a seismically active region. Therefore, existing buildings should be assessed and necessary precautions should be taken before a probable earthquake. To assess seismic performance of the existing buildings, the 2007 Turkish Earthquake Code offers two methods which are linear and nonlinear. For linear assessment, members are controlled by comparing the force demands and capacities where for nonlinear assessment, strains corresponding to the plastic rotations of the members are compared with the limits given in the code. In this study, the building, which stands in Bakirkö
y district of istanbul, was assessed according the linear elastic and nonlinear static procedures given in the 2007 Turkish Earthquake Code. In addition, it was retrofitted by adding shear walls to the structural system and same assessment procedures were performed. In the last case study, building is re-designed according to the code and re-assessed. Comparative results and conclusions were summarized in the last chapter.

La participation du citoyen à la décision administrative est une notion qui se développe en droit positif. Toutefois, sa définition et ses contours ne font pas l’objet de consensus. La doctrine associe régulièrement la participation du citoyen à la démocratie administrative. Or, la participation remplit d’autres fonctions. Elle permet certes au citoyen de participer activement à la définition de l’intérêt général, mais elle lui permet aussi de défendre ses intérêts particuliers. Parallèlement, la participation du citoyen permet tout autant d’améliorer que de légitimer la décision administrative. La participation apparaît sous les traits d’une notion malléable. Sa fonction varie selon la psychologie des acteurs et selon la nature de l’instrument participatif qui la concrétise juridiquement. La notion de participation du citoyen à la décision administrative regroupe plusieurs instruments : les procédures contradictoires, la représentation des intérêts, les processus référendaires et les procédures participation du public. L’unité de la participation se dévoile dans son régime juridique qui est articulé autour de garanties communes assurant l’effectivité de la participation, à savoir le droit à l’information préalable, le droit d’expression un point de vue et le droit à un délai suffisant. Moins systématiquement, le régime juridique de la participation s’ouvre à des garanties complémentaires en vue d’assurer sa sincérité. Ainsi en va-t-il du droit à la prise en compte du point de vue, de la présence d’un tiers garant ainsi que du droit au recours. Toutes ces garanties font cependant l’objet d’une application diversifiées. L’unité de la participation du citoyen n’implique en effet pas son uniformité
Citizen participation to administrative decision is a developing concept in positive law. Still, its essence and scope have not reached consensus. The doctrine associates citizen participation to administrative democracy. Yet, participation fullfills other functions. It of course allows citizen to actively define general interest yet it also allows the citizen to defend his very own interest. At the same time, citizen participation both improves and legitimates administrative decision. Participation appears as a malleable concept. Its function depends not only on the actors psychology but also on the nature of the participatory instrument that legally implements it. The concept of citizen participation to administrative decision regroups several instruments, including the right to a hearing, representation of interests, referendum processes, and public participation procedures. The unity of participation gains meaning in its legal system, which is articulated around common guarantees ensuring the effectiveness of participation, that is to say, the right to prior information, the right to express a point of view and the right to an appropriate period of time to do so. Less systematically, the legal system of participation opens up to complementary guarantees to ensure its sincerity. This applies to the right of having a point of view considered, the presence of a third-party guarantor as well as the right to appeal. All these guarantees, however, are subject to diversified implementations. Indeed, citizen participation unity does not imply its uniformity

The recruiting of lay judges to the district courts is managed by the political parties. Despite repeated efforts the parties do not succeed in recruiting lay judges that reflect the structure of the inhabitants. Why not? This is the fundamental issue of this essay.

This study is a multiple case study of two parties with different success in their recruiting work. The purpose is to study the process of nomination regarding lay judges at the district courts, at the latest election (2006). The study comprehends two Swedish parties at two different district courts. The ambition is to find out how important the membership population of the political parties is for the recruiting and to what extent the parties recruit lay judges outside the party. The empiric investigation mainly consists of interviews with political representatives with experience from nomination work. The investigation shows that the parties who succeed with recruiting also have a satisfactory membership population, and the other way around. Recruiting outside the party is very unusual. At the interviews information is revealed that indicates that the parties use the recruiting of lay judges as a power instrument.

Turkey is located on a seismically active region and ranks high among all countries that have suffered losses of life and property due to earthquakes over many centuries. In addition, its building stock has usually poor construction quality with seismically improper structural systems. These lead to a need for rapid and reliable assessment and retrofit procedures. In the 2007 Turkish Earthquake Code, a new chapter is included for assessment and retrofit of existing buildings. The assessment procedures proposed in the Code are classified as linear elastic and nonlinear procedures. An engineer is allowed to choose one of these two procedures without any restriction. In this study, a research was undertaken in order to clarify the differences between the seismic assessment procedures in the 2007 Turkish Earthquake Code. For this purpose, two pairs of existing and retrofitted residential buildings were assessed according to the principles of both procedures proposed in the 2007 Turkish Earthquake Code. The assessment results were also compared with the actual performance observations from a 5-storey building which suffered damage during the 1999 Dü
zce earthquake. In addition, an anchorage design methodology was developed for the exterior coupled shear wall retrofit solution, and tested on a 6-storey case study building.

The research problem this dissertation addresses is how judicial practices generate administrative justice in asylum determination procedures. Previous research on immigration policies argues that when asylum determinations are processed in courts, principles of administrative justice are ensured and immigrants’ rights protected. In this dissertation, I challenge that argument by approaching administrative justice as an empirical phenomenon open for different types of interpretations. Instead of assuming that administrative justice characterizes courts, I assume that this concept acquires particular meanings through the practices of the courts. Empirically, this dissertation studies practices of assessing asylum claims at the Swedish migration courts. The migration courts are the result of a major reform of the Swedish asylum procedure that took place in 2006, with the motive to end inhumane rejections of asylum seekers by enhancing administrative justice in the asylum process. By interviewing and observing judges at the migration courts, litigators from the Migration Board and public counsels from different law firms, this interpretive and ethnographic study analyzes how administrative justice acquires meanings in the daily practices of assessing asylum claims at the migration courts. The main result is that a ceremonial version of administrative justice is generated at the migration courts. This version of administrative justice forefronts symbolic dimensions of justice. The asylum appeal procedure succeeds in communicating justice through rituals, building design and metaphors, which emphasize objectivity, impartiality and certainty on behalf of the judicial practices. However, these symbols of justice disguise several unfair aspects of the asylum appeal procedure, such as inequality in resources and trustworthiness between the state’s representative and the asylum applicants as well as the uncertainty inherent in both the factual and the credibility assessment of asylum claims. The implications of these findings are that immigration policy research needs to reconsider the relationship between the courts and immigrants’ rights by paying more attention to the everyday practices of ensuing administrative justice in courts than on the instances when courts oppose political attempts to restrict immigrants’ rights.

The New administrative procedure code came with a broad range of new legal institutes and altered many others. The purpose of this thesis is to place the New administrative procedure code and the Old administrative procedure side by side to compare them with one another and to attempt to evaluate the contribution of the New administrative procedure code to the Czech legal system. The structure of the thesis follows the structure of the New administrative procedure code. The present dissertation is dedicated to the study of interim measure and the requirements for its decree, carrying out its comparative analysis in the scope of the administrative process and in the scope of the civil process.This research work is divided into four distinct parts:A first part, corresponding to Chapter I, centered on the notion, evolution and characteristics of interim measures.A second part, corresponding to Chapter II, focused on the categories and purposes of interim measures.A third part, corresponding to Chapter III, focuses on the characterization, analysis and comparison of the requirements for the execution of the interim measures in the scope of the two procedural laws, and then proceed to a critical and jurisprudential analysis of the same.Finally, a fourth part, corresponding to Chapter IV, centered on the duty of procedural management of the judge in the guardianship.At a time when the two procedural laws are becoming increasingly similar, we propose in this dissertation to present the resemblances and variances between the two, regarding interim measures and the requirements for its decree. A minha dissertação está dividida em diversos momentos. Primeiramente, irei fazer uma breve introdução ao processo de execução fiscal, abordando o seu âmbito e objeto, como se procede à sua instauração e quem tem legitimidade para o instaurar, bem como a natureza do processo que como veremos apresenta uma grande divergência doutrinal e jurisprudencial. Nesta primeira parte da minha dissertação é onde surge a dispensa da prestação de garantia, mais concretamente na parte onde me debruço sobre a suspensão da execução. Finalmente, refiro os requisitos que têm que estar preenchidos para ser deferido o pedido de dispensa da prestação de garantia realizado pelo contribuinte à administração tributária. Na segunda parte da minha dissertação, debruço-me sobre a matéria da prova onde refiro os princípios e meios de prova que são aplicáveis em direito tributário, bem como coloco a questão da audiência prévia na dispensa da prestação de garantia, que como veremos mais à frente apresenta um problema de prazos, e dessa forma refiro se é ou não aplicável no processo de execução fiscal. Ainda quanto à prova, refiro quem tem o ónus da prova na matéria da dispensa da prestação de garantia, onde saliento a alteração legislativa que ocorreu ao art. 52.º, n. º 4, da LGT, pela Lei n. º 42/2016, de 28 de dezembro e as implicações dessa alteração. Por fim, abordo a questão da renovação da prestação de garantia, onde surgem dois problemas que passam pelo indeferimento do pedido de renovação da dispensa da prestação de garantia pela Administração Tributária, onde mais uma vez se coloca a questão da audiência prévia do executado e se o executado tem de fazer nova prova dos requisitos para se proceder a esta renovação.
My dissertation is divided into several moments, in which I will first make a brief introduction to the process of fiscal execution, addressing its scope and object, how it is established and who has the legitimacy to establish it, as well as the nature of the process, which as we shall see presents a great doctrinal and jurisprudential divergence. In this first part of my dissertation, this is where the exemption from the provision of guarantee arises, more specifically in the part where I deal with the suspension of execution. Finally, I refer to the requirements that have to be fulfilled in order to be granted the application for exemption from the provision of guarantee made by the taxpayer, to the tax administration.In the second part of my dissertation, I look at the subject of proof, where I refer to the principles and means of proof that are applicable in tax law, as well as I put the question of the previous hearing in the exemption from the provision of guarantee, which as we will see later, presents a problem of deadlines, and thus I refer to whether or not it is applicable in the tax enforcement process. Also, as for the evidence, I refer to who has the burden of proof in the matter of the exemption from the provision of guarantee, where I refer to the legislative amendment that occurred to article 52, n. º 4 of the LGT, by Law No. 42/2016 of 28 December and the implications of that amendment. Finally, I am concerned about the question of the renewal of the guarantee, where two problems arise, which are the rejection of the application for renewal of the exemption from the provision of guarantee by the Tax Administration, where once again the question arises of the prior hearing of the executed, and whether the executed has to provide a new proof of the requirements for this renewal.

Some inland taxes from tax assessment to tax collection could not be approved within the tax period. If a tax cannot be approved within the tax period for reasons, by law, it can no longer be collected; therefore, the tax will not be collected naturally. The tax form is to be forwarded to taxpayers within the tax period to have the notice procedure completed. If the tax form cannot be delivered within the tax period, by law, it may not be collected. While the fiscal deficit is worsening, the mission is to have tax collected for making up fiscal deficit and for upholding social justice and tax fairness. According to the study, there are around 7,000 cases lost a year after the tax assessment deadline due to insufficient manpower of assessors, excessive overload, and the high rotation rate. This has prohibited the task of tax assessment from being completed before the deadline and the tax paper from being delivered to taxpayers or delivered to taxpayers properly. Also, tax cases are lost after the tax collection deadline due to taxpayers have no income or assets, inheritors of the deceased taxpayer waive their right to inheritance or limited inheritance, the distribution of residual assets after corporate resolution or liquidation is insufficient to pay tax, and the taxpayer is without income but with assets; however, confiscation and auction is not enforceable for it is not in conformity with the principle of proportionality. In terms of the high rotation rate, the suggestion is to have a special tax recruitment plan held every 3~5 years for retaining assessors to have the tax collecting experience passed on. Also, tax branches (tax collection offices) must understand the nature of each district and have important tax income investigated and collected forcefully. Finally, for tax arrearage of taxpayers who are without any asset or income for enforcement, it is recommended to have the tax collection period amended for a period of 15 years in accordance with Civil Law Article 125. The purpose of this study is to have suggestions for improvement recommended to the responsible tax units in accordance with the defined problems in order to have a breakthrough on tax collection. While facing the shortage of tax income, it is important to have the taxable income collected for the replenishment of Treasury income in order to fund domestic construction, boost the economy, and upgrade citizen’s financial conditions and life satisfaction.
