As acoustical engineers, we are often asked to develop community noise-related guidelines, regulations, laws, ordinances, and project specifications. This paper will describe the ingredients needed to develop a robust and defensible construction noise specification that is both enforceable and effective. It will be based on the author's past and current experiences developing such specifications, including those used for the Big Dig project in Boston, FHWA's construction noise handbook, the New York City construction noise regulation, as well as dozens of large-scale construction projects across the country. The goals of proactive and reactive noise control and the difference between a performance-based versus a prescriptive-based specification will be explained, community noise criteria will be suggested, and examples will be provided for important clauses in such a specification. Lastly, a listing of "lessons learned" over the decades will be provided.

We examine here the costs and benefits of reinforcing some existing buildings in Boston at the time of remodelling with significant change of use. The buildings of interest are the unreinforced masonry warehouses and the reinforced concrete manufacturing buildings that are remodelled into apartment or office buildings. Given some estimates of the Boston seismicity and of the performance of these buildings in earthquakes with and without additional reinforcement, we evaluate three possible levels of reinforcement that the Masssachusetts Seismic Advisory Committee could recommend as part of the building codes. For the unreinforced masonry buildings, the first upgrading level is the addition of floor and roof diaphragms, and the two subsequent levels involve addition of internal walls and reinforcement of the existing ones. For the reinforced concrete buildings, the first level involves increase of the shear walls' size, and higher upgrading levels involve addition of shear walls and increase of the columns' size. We introduce in our study the market effects of the additional costs. We conclude that only the first levels of reinforcement that we considered could be adopted as regulations, and that higher standards should be left to the choice of the buildings' occupants.

This research to determine the competitive position based on the Boston Consulting Group matrix, to find out internal variables including strengths and weaknesses as well as external variables including opportunities and threats and to find out relevant marketing mix strategies to increase the number of visits. The study was conducted at Handara Golf and Resort in Bedugul Bali. Data analysis techniques used are the Boston Consulting Group matrix analysis and SWOT analysis. The analysis shows that using BCG matrix analysis, the company is in the position of dogs with a growth rate of 7.09% and an analysis of market share of 0.17. Using a SWOT analysis shows that the most dominant external opportunity variable with the acquisition of 3.80 results. Where the opportunity indicator is an increase in the number of tourists, growth in online sales, buyers want more images in electronic commerce or e-commerce when buying a product, most of the time on mobile devices is used, social media plays a major role in the distribution of most of the time used on mobile devices, technological advances over the use of social media, per capita income growing in Indonesia, located in the Pacific Ring of Fire, new regulations from Bank Indonesia. While the threat indicator is providing alternative tourist attractions throughout Indonesia to tourists other than in Bali and losing followers in the social media, it can be concluded that companies need to implement a turn-around strategy because external opportunities are more oriented to supporting the company's Handara Golf and Resort Bali.

Partially linear models find extensive application in biometrics, econometrics, social sciences, and various other fields due to their versatility in accommodating both parametric and nonparametric elements. This study aims to establish statistical inference for the parametric component effects within these models, employing a nonparametric empirical likelihood approach. The proposed method involves a projection step to eliminate the nuisance nonparametric component and utilizes an empirical-likelihood-based technique, along with the Bartlett correction, to enhance the coverage probability of the confidence interval for the parameter of interest. This method demonstrates robustness in handling normally and non-normally distributed errors. The proposed empirical likelihood ratio statistic converges to a limiting chi-square distribution under certain regulations. Simulation studies demonstrate that this method provides better inference in terms of coverage probabilities compared to the conventional normal-approximation-based method. The proposed method is illustrated by analyzing the Boston housing data from a real study.

Introduction:This presentation is a continuation of a WADEM presentation from 2013 entitled: Fires in Social Settings: An Examination of Prevention Strategies.Method:Nightclubs should be a place of fun and frivolity, but sometimes they become a place of death and destruction. The fire at the Cocoanut Grove in Boston Massachusetts, USA, in November, 1942 was the deadliest nightclub fire worldwide with a death toll of 492 and over 130 injured. Since that tragedy, regulations that could prevent or mitigate lethal incidents at nightclubs continue to be unenforced globally. This presentation will describe not only elements leading up to the Cocoanut Grove fire, but the resulting advances that have improved the lives and safety of the public.Results:The discussion begins by examining the general environment within the U.S. in fall of 1942. Appointed and elected officials tasked with protecting the public to reduce occurrences for such disasters failed in their performance of their respective roles. Groundbreaking medical advances used to treat the victims include the use of penicillin, methods of treating cutaneous burns, the use of electrolyte balance to aid in determining the ongoing treatment of burn victims, as well as other medical advances improved directly as a result of the fire. Additionally, the first systematic study of grief and survivors’ guilt and the recognition of what is now called Post Traumatic Stress Disorder commenced.Conclusion:Finally the divergent theories of the sources of the fires, how fire codes have changed in the aftermath as well as how the parties that were directly or indirectly responsible for the fire were disciplined by the judicial system will be reviewed.

ObjectiveWe evaluated retailer compliance with a cigar packaging and pricing regulation in Boston, Massachusetts, enacted in February 2012, and the regulation's impact on availability of single cigars.MethodsGrape-flavoured Dutch Masters (DM) single-packaged cigars were examined as market indicator. At quarterly intervals from October 2011 to December 2014, availability and price of DM single cigars were observed through professional inspector visits to tobacco retailers in Boston (n=2232) and 10 comparison cities (n=3400). Differences in price and availability were examined between Boston and the comparison cities and across Boston neighbourhoods.ResultsThe mean price of DM single cigars sold in Boston increased from under $1.50 in 2011 to above $2.50 in 2014, consistent with regulation requirements. Rates of retailer compliance reached 100% within 15 months postpolicy enactment based on observed price, and 97% at 30 months postenactment based on final sale prices. There was a 34.5% net decrease in the percentage of Boston retailers selling single cigars from 2011 to 2014. The number of Boston neighbourhoods with 3 or more retailers selling single cigars per 100 youth residents decreased from 12 in 2011 to 3 in 2014. No change in price or per cent of retailers selling single cigars was observed in the comparison cities in the same period.ConclusionsRetailers throughout Boston are in compliance with the regulation. The regulation has been effective in reducing levels and disparities in availability of flavoured single cigars popular with youth across Boston neighbourhoods, regardless of socioeconomic status and racial/ethnic composition.

The Anthropocene heralds a new era of heightened and unknown risks, particularly regarding the impacts of climate change. This article explores the initial phase of organizing for climate adaptation in Boston, Massachusetts, examining how multiple actors, including business, government, and community organization, are interacting as they attempt to comprehend, assess, and act on this issue. To understand this process of organizing, we develop the concept of ‘risk regime’ as a contingently stabilized system with governance, economic, and discursive dimensions. We draw from theories of risk, organizational resilience, and urban regimes and value regimes to develop the ‘risk regime’ framework, which provides a nuanced view of contestation, collaboration, and accommodation among actors with differential interests, knowledge, and influence on the process. We suggest how the character, evolution, and stabilization of the regime is influenced by competing imaginaries regarding, for example, the nature and manageability of risk, the need for radical change, and the role of markets versus regulations in addressing tensions between economic and sustainability goals. We demonstrate that the regime for adaptation has grown out of the organizational and discursive infrastructure for addressing climate mitigation, or carbon control, but that the unique character of adaptation presents different, and perhaps more difficult challenges.

Context.—Managing the quality of point-of-care testing (POCT) is a continuing challenge. Advances in testing technologies and the development of specialized informatics for POCT have greatly improved the ability of hospitals to manage their POCT program. Objectives.—To present the evolving role of technology improvement, informatics, and program management as the key developments to ensure the quality of POCT. Data Sources.—This presentation is based on a review of the literature and on our experiences with POCT at the Massachusetts General Hospital (Boston). Conclusions.—Federal and state regulations, along with accreditation standards developed by the College of American Pathologists and The Joint Commission, have established guidelines for the performance of POCT and have provided a strong incentive to improve the quality of testing. Many instruments for POCT have incorporated advanced design features to prevent analytic and operator errors. This, along with the development of connectivity standards and specialized data management software, has enabled remote review of test data and electronic flow of information to hospital information systems. However, documentation of manually performed, visually read tests remains problematic and some POCT devices do not have adequate safeguards to prevent significant errors. In the past 2 decades the structure of a successful POCT management program has been defined, emphasizing the role of POCT managers working in conjunction with a pathology-based medical director. The critical skill set of POCT managers has also been identified. The POCT manager is now recognized as a true specialist in laboratory medicine.

Historians of the American Revolution have celebrated Boston’s role in early resistance to Britain, while neglecting its post-1776 history. After the British evacuation, pre-existing social and economic problems re-emerged in 1776-77. Trying circumstances caused patriot unity to collapse. The issues of army enlistment and price regulation revealed different ideas among the elite and the laboring classes about the people’s obligations to the American cause. The result was elite patriots moving the public discourse around patriotism in a direction that suited their interests and ensured their positions of power. They accused those who disagreed of a lack of virtue and remaining loyal to Britain. This thesis shows how, for Boston, the Revolution was not a solution.

The City of Boston land use has altered the surrounding watersheds through creation of infrastructure, damming, landfill, and expansion of impervious surfaces. The continued growth of the City has historically outstripped the capacity of its combined storm and sanitary sewer system, necessitating discharges into area water bodies. In light of model forecasts by the Intergovernmental Panel on Climate Change predicting precipitation increases it is likely the already strained system will need additional capacity. Boston's tradition of expanding artificial capacity is compared to the City of Curitiba's enhanced natural capacity stormwater management plan. Limitations in both are discussed and the author concludes the City of Boston would benefit from increasing decentralized natural capacity through green rooftechnology. To investigate this claim remote sensing data was analyzed over three neighborhoods. The resulting available green roofing area was then combined with historical climate data to create a retention response model. The extrapolated city-wide model predicted retention of 19%-27% of total building received rainfall from 1983-2009. This model was then correlated with Combined Sewer Overflow (CSO) discharge National Pollutant Discharge Elimination System report data. The retention volume was found to accommodate most discharges in the FY2009 as well. Thus, extensive green roof technology presents a supplemental capacity building strategy for the City of Boston to avoid increases in future CSOs.

Purpose: Vacation house,a part of Sweden ́s history that decreases annually, mainly because existing vacation houses are being extended and permanented and few new ones are being built. One reason why many vacation houses are permanented is that the detailed development plan for the area is insufficient or missing to maintain the area as a vacation house area. In addition to the detailed development plan there is other legislation that is followed at building permits. For vacations houses there is no regulation in the legislation which causes difficulties for building permit management for individuals and authorities. The aim of the survey is to gather material with the aim to establish a definition of vacation houses into the legislation. Method: The survey is conducted as a qualitative study with semi-structured interviews with nearby municipalities building permit departments, equal in size as Jönköping's municipality and with smaller municipalities. The material from the semi-structured interviews was compared and strengthened with document analysis from previous research. The document analysis has reviewed previous researches, studies, judiciary, books and detailed development plans. Findings: The result shows that a definition of vacation houses should be legislated in Plan- och bygglagen and can be applied by Boverket’s building regulations with a clearer explanation of vacation houses. To give municipalities common ground to emanate from to preserve the nature of vacations house areas. How the vacations house areas should be designed and how their design can be preserved is most suitable in the detail development plan. It is in the detail development plan the area of a vacation home can be limited. If the area of the vacation homes is limited, the survey show that it will result in that fewer vacation homes are permanentized as the conveniences which permanent homes require will not fit. Implications: The results of the survey can be used to give municipalities an understanding of how building permits of vacation houses ́ are currently handled by other municipalities. The study contributes with improvement proposals for detailed development plan in the municipality of Jönköping. The conclusion of the result is that a more comprehensive study should be conducted to include municipalities throughout Sweden to ultimately lead to a joint definition for vacation houses.Limitations: The result is based on interviews with six municipalities and document analysis. A more comprehensive survey can interview more municipalities throughout Sweden to obtain a more generalized result, as well as to include authorities such as county administrative boards and Boverket. In a more comprehensive survey, more methods can be used as observations for better understanding of building permit handling of vacation homes and surveys to be able to reach out to all municipalities in Sweden.
Syfte: Fritidshusen, en del av Sveriges historia som minskar årligen, främst på grund av att befintliga fritidshus byggs till och permanentas samt att det byggs få nya. En anledning till att många fritidshus permanentas är att detaljplanen för ett område är otillräcklig eller saknas för att behålla området som ett fritidshusområde. Förutom detaljplan är det övrig lagstiftning som följs vid bygglov. För fritidshus saknas en definition i lagstiftningen vilket medför svårigheter för bygglovhantering för privatpersoner och myndigheter. Syftet med studien är att ta fram material som kan utnyttjas för att införa en definition av fritidshus i lagstiftning. Metod: Undersökningen genomförs som en kvalitativ studie med semi-strukturerade intervjuer med närliggande kommuners bygglovsavdelningar, både i jämnstorlek med Jönköpings kommun och med mindre kommuner. Materialet från de semi-strukturerade intervjuerna bearbetades sedan genom att jämföras och stärkas med litteraturstudie från tidigare forskning. Litteraturstudien har granskat tidigare undersökningar, studier, domar, böcker och detaljplaner. Resultat: Resultatet visar att en definition utav fritidshus bör lagstiftas i plan- och bygglagen och kan tillämpas av Boverket med en tydligare förklaring till fritidshus. Detta för att ge kommuner en grund att utgå ifrån för att bevara fritidshusområdens karaktär. Hur fritidshusområden ska utformas och hur dess karaktär kan behållas görs lämpligast i detaljplaner. Det är även i detaljplanen ytan kan begränsas för ett fritidshus. Begränsas ytan för ett fritidshus visar undersökningen att färre fritidshus kommer permanentas då de bekvämligheter en permanentbostad bör ha inte kommer att rymmas. Konsekvenser: Undersökningens resultat kan användas för att ge kommuner förståelse för hur bygglov av fritidshus hanteras i dagsläget av andra kommuner. Studien bidrar med förbättringsförslag för detaljplaner i Jönköpings kommun. Slutsatsen av resultatet är att en mer omfattande studie bör genomföras för att inkludera kommuner inom hela Sverige för att i slutändan utmynna till en gemensam definition för fritidshus. Begränsningar: Resultatet är baserat på intervjuer med sex kommuner och litteraturstudier. En mer omfattande undersökning kan intervjua fler kommuner över hela Sverige för att få ett mer generaliserbart resultat, samt att inkludera myndigheter som länsstyrelser och Boverket. I en mer omfattande undersökning kan fler metoder tillämpas som observationer för bättre förståelse av bygglovshantering av fritidshus och enkäter för att nå ut till alla kommuner i Sverige.

The desire to enhance and make ourselves better is not a new one and it has continued to intrigue throughout the ages. Individuals have continued to seek ways to improve and enhance their well-being for example through nutrition, physical exercise, education and so on. Crucial to this improvement of their well-being is improving their ability to remember. Hence, people interested in improving their well-being, are often interested in memory as well. The rationale being that memory is crucial to our well-being. The desire to improve one’s memory then is almost certainly as old as the desire to improve one’s well-being. Traditionally, people have used different means in an attempt to enhance their memories: for example in learning through storytelling, studying, and apprenticeship. In remembering through practices like mnemonics, repetition, singing, and drumming. In retaining, storing and consolidating memories through nutrition and stimulants like coffee to help keep awake; and by external aids like notepads and computers. In forgetting through rituals and rites. Recent scientific advances in biotechnology, nanotechnology, molecular biology, neuroscience, and information technologies, present a wide variety of technologies to enhance many different aspects of human functioning. Thus, some commentators have identified human enhancement as central and one of the most fascinating subject in bioethics in the last two decades. Within, this period, most of the commentators have addressed the Ethical, Social, Legal and Policy (ESLP) issues in human enhancements as a whole as opposed to specific enhancements. However, this is problematic and recently various commentators have found this to be deficient and called for a contextualized case-by-case analysis to human enhancements for example genetic enhancement, moral enhancement, and in my case memory enhancement (ME). The rationale being that the reasons for accepting/rejecting a particular enhancement vary depending on the enhancement itself. Given this enormous variation, moral and legal generalizations about all enhancement processes and technologies are unwise and they should instead be evaluated individually. Taking this as a point of departure, this research will focus specifically on making a case for ME and in doing so assessing the ESLP implications arising from ME. My analysis will draw on the already existing literature for and against enhancement, especially in part two of this thesis; but it will be novel in providing a much more in-depth analysis of ME. From this perspective, I will contribute to the ME debate through two reviews that address the question how we enhance the memory, and through four original papers discussed in part three of this thesis, where I examine and evaluate critically specific ESLP issues that arise with the use of ME. In the conclusion, I will amalgamate all my contribution to the ME debate and suggest the future direction for the ME debate.

The discharge of waste into a water resource and its disposal on land can easily cause pollution, especially of the water resource. However, it has long been accepted that these activities also form an integral part of a holistic waste management strategy aimed at achieving sustainability. The South African Constitution ensures a basic right to an environment that is not harmful to human health and wellbeing, and states that pollution must be prevented, the environment must be protected, and sustainable use of resources must be promoted, through "reasonable legislative and other measures" .. The other measures that are currently used by the Department of Water Affairs and Forestry to determine whether a waste disposal or discharge action is allowable, are contained in the documents "Procedures to Assess Effluent Discharge Impacts" and "Minimum Requirements for the Handling, Classification, and Disposal of Hazardous Waste". These measures are evaluated to determine whether they are reasonable and effective in distinguishing between sustainable use and pollution in terms of newly promulgated legislation aimed at managing the environment and the water resource. The criteria used for this evaluation are based on the principles of sustainability, the components of risk analysis, and the scientific concepts and principles of waste discharge and disposal management. Based on this evaluation, the shortcomings of current mechanisms are highlighted, and their advantages are incorporated into a proposed integrated regulatory framework for an assessment and decision-making approach based on risk harmonisation, which has various advantageous applications, including: • The identification of cleaner production alternatives; • The identification of an appropriate medium of disposal or discharge (water or land); • The selection of the Best Practical Environmental Option (BPEO) for treatment, disposal or discharge methods; • The licensing of sustainable waste disposal or discharge actions; • The setting of charges for waste discharge activities; • The prioritisation of regulatory intervention; and • The rehabilitation of contaminated areas. The findings of this investigation comprise the first step taken in South Africa towards the harmonisation of assessment and decision-making approaches, which could have important implications for integrated waste and environmental management in the future.

This chapter explores how three war correspondents—Iris Carpenter, Lee Carson, and Ann Stringer—outmaneuvered rapidly shifting battlelines and military regulations to become part of an elite group attached to the “Fighting First” Division of the United States Army in the European Theater of Operations. Despite military policies preventing female war correspondents from covering the front, all three women—Carpenter for the Boston Globe, Carson for International News Service, and Stringer for United Press—used their reporting skills, and the military connections these skills earned them, to find and break news so often that by March 1945 their bylines appeared regularly beneath front-page headlines, often internationally syndicated. In 1946, Carpenter, Carson, and Stringer received theater medals from the United States War Department for “outstanding and conspicuous service with the armed forces under difficult and hazardous combat conditions.”

Boston clinician Elliott Joslin likened the power of insulin with the vision of Ezekiel, the Old Testament prophet who saw a valley of dry bones rise up and be restored to life. Banting faced claims by John Murlin and Ernest Scott of their prior discovery of insulin. Furthermore, while insulin saved patients’ lives, further research showed it could also cause hypoglycaemic shock. This discovery led the University of Toronto to take the controversial step of filing a patent on insulin to ensure regulation of its production. This chapter explores the many important social and political issues that arose in the wake of the new drug’s success, including questions of who should pay for insulin and who should be responsible for its administration.

This chapter details Burke's political life from 1774 to 1783. His first three years in parliament as a member for Bristol were dominated by the deteriorating situation in the colonies. The following six were devoted to retrieving them for the Empire. Relations were first soured by a group of “intolerable” Acts passed during the aftermath of the Boston Tea Party. Among these the Massachusetts Bay Regulating Act, which received the royal assent on 20 May 1774, overturned the province's 1691 charter. Another intolerable measure was the new Bill for the government of Quebec that was debated in the Commons the same summer. The discussion centered on the obligations imposed on victors after a conquest.

The Paper describes the past, present and future of high speed trains following the passing of the High Speed Ground Transportation Act fifty years ago. In the distant past, electrically-powered Metroliners ran between Washington and New York and Turbo Trains powered by gas turbines ran between Boston and New York on the Northeast Corridor. In the recent past, AEM-7 and HHP-8 electric locomotives supplied by EMD and Alstom respectively for operation with Amfleet railcars also ran on the Northeast Corridor. At the present time, electrically-powered Acela trainsets and ACS-64 electric locomotives supplied by Siemens are in service on the Northeast Corridor. Trains of Horizon and Amfleet railcars hauled by General Electric P-42-DC diesel locomotives operate between Chicago and St. Louis and Chicago and Detroit on the Mid West Regional Rail System. The future consists of two on-going projects that are being implemented, three projects that are in the planning stage and six projects that are in the concept phase. Features to be considered in the design of a high speed train system include: Design Standards and Regulations, Motive Power, Train Configuration, Maximum Axle Load, Dual-Mode Propulsion, Emergency Power, Double Deck Configuration, Jumbo Train Arrangement, Radial Trucks and Hi-Lo Bi-Track System.
