Der volle Inhalt der QuelleThe Anjou region has two different types of collective spaces, the commons, land that is still collective and some meadows with "second communal grass", which are semi-private lands. The local farmers let their animals graze there for most if not or all year round. These green spaces are made up of Landes and also mainly of rich humid meadows which are running along the Loire valley, the Sarthe and the Loir. The prospect put in place between the 15th and 19th centuries was one of long term and diversification of approach. To fully understand the stakes of the collective spaces, one would need to take the point of view of its protagonists : the local community ; especially by analysing the running and funding of the trials taken against the Lords. The access to Angevines lands was therefore conditioned by the rural community's contributing faculty. You would also have to study the relationship between the rural society and it's environment, especially the profit made from flooding lands. This historical work is also linked with some constants in the landscape and the rural society. The usual questions relating to collective spaces are also tackled : the right to work the land, the judicial questions of possession and ownership, the stakes of the trials and the consequences of the French Revolution. The present research wonders from this point of view, on the economic rationality of the behavior of loan in an environment at first of non mobility, then mobility of the households and the companies. The first part of this thesis, brings two original theoretical contributions to the understanding of the local financial behavior by leaning on two axes. First of all in an environment of not mobility, this thesis shows that the model the decisive voter remains relevant in a context where on one hand the community offers durables goods (which engender recurring loads) and where she can borrow (wthat entails symmetrically recurring financial charges). The second part joins in a prospect econometric of analysis of the local financial behavior. First of all, the thesis confirms for the main part the model of request and intertemporal offer to the better public long-lasting premises stemming from the research and the watch, any equal things besides, that the dynamic specifications possess an explanatory power higher than the specifications in statics. Finally, establishing a link between the debts and the level of the investment of development, the model of stimultaneous equations concerning the debts and the investments concludes, in the sustainability of local public debt in France

The Colombian Civil Code has copied colonial Spanish law in the matter, which in turn was inspired by Roman law. However, the absence of an exhaustive and coherent regulation in Colombia has forced the interpreter to study its foundation and further developments to interpret it. An update of this legal system is, therefore, imperative. Beginning with the concept of public property and its constitutional regulation, it is poss ible to analyze the elements of its public use, which will allow proposing a definition of those assets. It is necessary to analyze the regulation of these public properties under the light of their social and economic value. The protection granted by the law to the concepts of public property, public use and public user, has to be assessed under the new approach of the administrative authorizations pertaining to such public property. This notion of social and economic value will also allow scholars/people to have a new vision of the regulation of administrative authorizations, the exclusive rights (in rem) they confer and the income they produce

Der volle Inhalt der QuelleDoes the CAP direct payment distribution benefit to the most environmentally friendly farms? Following an environmental assessment state of the art, a set of environmental indicators has been created to rank farms on their potential environmental impacts using FADN datas. Then, these classes have been connected with the amounts of direct payments received. Results are processed on three types of farm (specialized in cereals and oilseeds, meat cows and milk cows). Associated with a comprehensive study of the reforms of the CAP since 1992, this empirical study allows to stand back on the consequences of the political decisions. It seems that if the 2nd pillar direct payments are directed in favour of the more environmental friendly farms, their weight remains too low compared with the aids of the 1st pillar, which are higher in the less virtuous farms. This is largely connected to the weight of the DPU in the direct payments, and to the French choice to base their calculation with regard to the history of the farm. That is why the simulations of the redistribution of the subsidies of the 1st pillar on horizon 2019 show that the rebalancing of these payments between the farms by a national harmonization will contribute to level the gap of 1st pillar direct payments by hectare between french farms. The comparison with the United Kingdom and Germany shows the effects of the subsidiarity, in particular during the decoupling: the harmonization of the decoupled payments allows the most environmental friendly farms to get higher direct payments per hectare

The first chapter explores the relationship between the optimal tax schedule and the optimal provision of public goods, either through government funding or through charitable contributions. The second chapter analyzes the consequences for optimal capital taxation of two capital market failures: scale dependence and uninsurable risk in returns to savings. The third chapter looks for the right combination between the personal and the corporate income tax to optimally tax capital income. The part one examines how the engineer profession and their mathematical training lead these "ingenieurs economistes" to investigate a no-exploited branch of economics named later the public economics and to look for a impartial way for the public choice, with mathematical formulations. The part two analyzes their economic thought concerning public transport and gets two major resultats as follows. At the first, the "ingenieurs economistes" define a conception of market failure (public goods, increasing return to scale, etc. ) And justify governmental intervention in this case. At the second, they develop also the analyse of external effects of transport and so put forward the redistributive and stabilizing functions of public spending

Der volle Inhalt der QuelleThe characteristics of joint possession right and banckruptcy reveal the opposition between two juridical systems that are organized according to their final aim. Applying these two systems requires confonting their areas of applications and their juridical schemes. The confontation between their personal fields and their real fields shows first how banckruptcy cannot properly solve the issues of an undiivided company. The recognition of the position as failing co-developers of the tenants in common is facilitated by the managing rules of joint possession. The exclusion of an undivided good from the bankruptcy carried on against one of them, makes a positive outcome structurally impossible for the company. Then , the confrontation of their juridical systems makes clear their reciprocal conjunction. The civil rules that protect relatively the property rights of the joint possession's members, on one hand, justify the interference of joint possession when executing banckruptcy, and on the other hand, develop the impact of the trading measures, limiting the debtor's ability of managing the goods of his patrimony. Consequently, this analysis demonstrates the necessity of elaborating a set of rules that will overrule the appropriation method of an undivided good of a company, so that banckruptcy right can no longer fail to fulfil the satisfaction of its objectives in expanding situations

Der volle Inhalt der QuelleThe research analyzed the current legal basis of urban public property in Brazil and its impacts on the management of urban public goods. In order to be successful, the deductive-interprative method was adopted, which was supported by bibliographical and legislative research in Brazilian sources and in the western Latin European states - Portugal, Spain, Italy and France. This indicates that the research in comparative law was one of the main methods employed. These elements allowed to construct a conceptual and exegetical scheme. Through it the semantic and normative contents of the categories "public interest", "right to the city", "social function" and "social function of urban public property" were defined and the interrelations between, them were demonstrated. Thus, the new theorizing about the public interest identifies it to the realization of fundamental rights, which allows to recognize urban publicproperty as a social function. After all, this proprietary species is justified by the participation of public goods in the realization of the right to the city, which indicates the impacts of the social function of urban public property. It complies with the prerogatives of public owners, non-owners and beneficiaries of little of private use of urban public goods. It determines the exercise of these prerogatives, the possibilities of affectation of these goods and justifies the democratization of the decision-making process about their destiny. Therefore, it can be affirmed that the results obtained with the research provide elements that allow to reconstruct the theory of urban public goods / urban public property and to establish paramaters for the proper management of these goods

However, their origin is the taking into account of the “complexity” of our world. The judicial environment of health-work has been subject to important dysfunctions which amount for injury to the individual's or the population's health and one can observe that most of the dysfunctions are tied to the difficulties of applying the principle of equal treatment in health-work, the weakening of solidarity inside the companies themselves because of new work organizations or the absence of solidarity from the company to the society, in regards of public or environmental health care. The principle of equal treatment and the concept of solidarity have underlined the social balance in health-work, but now seem to lose efficiency. The French system, inherited from principles dated from the end of the 19th century and unable to comply with the security requirements demanded by the society, is now letting a phase-in of new ways of thinking the relationship between health and work where the principles of dignity and altruism, the globalization methods of deduction and anticipation of the risks and the adoption of responsibility ethics – with the welfare of the individuals as a primary objective – are the backbone of a new paradigm. French law has evolved for the last few years under the influence of these concepts giving hope that will nonetheless need the full support of the state authority as well as the support of a fair and abiding company which would be recipient in solving the problems of society and the world, in order to prevail

Seventy years after the World War II ended, it occupies public space in all its components and drives the adoption of laws recognizing victims and punishing speech of negation. Meanwhile, the legislature must meet its conventional obligations and the requirements of international criminal justice. But again, the political contingencies are strong, which block legal thinking and lead to the creation of controversial provisions. This phenomenon, striking in France, is less at our german neighbor, yet reliant on a heavy legacy memorial. This observation may surprise those who do not consider the joint but divergent evolutions of the two states since 1945, on the « treatment » of international crimes by nature and their consequences ; hence the usefulness of a transverse, historical and comparative approach to these issues

Der volle Inhalt der QuelleRegardless of our culture or way of life, we have to “live” somewhere, and for more than half of the world’s population, their life takes place in a city. Urban areas are attractive for many reasons, but they also concentrate many problems of pollution, poor health conditions and social challenges. Above all, it is clear that people do not benefit equally of good living conditions, and the distribution of urban quality reveals significant disparities. How then could we define what is a good living environment in favor of people’s wellbeing? Wellbeing is an ambiguous concept for which no unique and absolute indicator can ever be found, but the question of its assessment remains. Urban planning that designs and shapes the places we live in, public health with its definition of health as complete well-being, or philosophy that, since Aristote described what makes a life a “good life”, we have access to many ways of considering the concept of wellbeing. For epistemological and ethical reasons, we have chosen to study urban wellbeing starting from the people in their living environment. Our work focuses on the French designated “priority” neighborhoods, because of the spatial and social inequalities observed on those territories. This thesis is based on several participatory action-researches conducted with municipalities near Paris and La Rochelle about urban public actions and urban renovation programs. Our work is particularly underpinned by the realization of Health Impact Assessments (HIA) of two urban projects, for which we chose to experiment an open approach with the implication of municipal agents and local actors. The objective was also to research the conditions of collective learning about the links between health, wellbeing and urbanism. This work relies on literature data, but also on people’s experience of their living environment that we collected through ethnographical types of field survey. The stories that we gathered draw the attention to the relation between people and their neighborhood, and what really matters to them. They also enable us to understand the fact of living in a place as a total human experience, far from analytical approaches that tend to be compartmentalized into different predefined parameters. Inspired by relational sociology, we sought for regularities, forces and tensions in those different individual stories, and we argue that this enables us to overcome some of the difficulties that usually arise in concertation processes. It also enables to clarify the issues that the territory is facing, and to drive the discussions in the process of project assessment on the real experience of people in their neighborhoods. Finally, we have developed a heuristic framework to approach expressions of place attachment, that we considered as a proxy for wellbeing in this research. The categories that we found in the surveys (familiarity, integration, safety and comfort, control of one’s life, injustice, fulfillment) work together as a system and they differ completely from functionalist and utilitarian approaches that are still fully present in urban programs, public health or urban ecology. Studying the conditions of possibilities of place attachment and of the empowerment of people in their living environment opens very interesting perspectives to design and develop local policies, especially in the urban realm. Feelings of injustice are very present in the survey, and considering the real experience of people is the only way to understand where inequalities are experienced as unjust, an approach that we consider relevant to overcome the limits of a static analysis of inequalities based on statistics

In a diachronic view, the compared approach of two irrigating communities anciently organized brings to light the dynamic feature of the water management rules. In a context of the inequation of the supply and the demand, the community rules organize a fair distribution of water shortage. But, although constantly renewed, these rules fail to satisfy the irrigators' rising need in water and are no longer respected. The public authorities are demanded to make these communal rules applied. The states suggest technical solutions conditionned by the application of the national rules. The pair "leading citizens / administrative agents" play a central role in the implementation of a local governance of water, a way of regulation which articulates the national rules and the communal rules
