Findings To prepare thoroughly for a securities arbitration case and to plan a strategy for the key step of cross-examination, a lawyer needs to know the broad financial market context; the technical details of the relevant financial products, portfolio management strategies and transactions; the points of view of both the client and the opposing party; the details of all the documents introduced; and the background of the client’s and the adversary’s witnesses. Ideally, medical malpractice actions should deter medical negligence and compensate victims in a manner that is fair, speedy, cost-effective and accessible. Tort critics, however, argue that tort law in general and malpractice actions in particular do not match this ideal. But there is considerable debate about whether the identified faults are inherent or optional in tort adjudication. Those who believe adjudication itself is faulty propose alternative strategies including no-fault compensation schemes, public law prosecution and arbitration. In the paper's first section we consider whether the performance of the traditional adversarial system of dispute resolution in medical malpractice cases is inadequate. Arbitration's effectiveness as an alternative to litigation is then evaluated with reference to three arbitration models employed in the United States. We conclude that arbitration reforms offer distinct advantages but are no panacea for some basic justice problems that stem from political, legal and economic power imbalances between physicians and their clients.

Abstract The settlement of commercial disputes by commercial arbitration is gradually becoming popular in the business community. In the course of economic integration, Vietnam has acknowledged the role of arbitration and attempted to develop its arbitration legal framework in compliance with international practices. However, Vietnam’s arbitration system still faces various issues and thus, has required further reform. There are often cancellations of the referee’s decision, the procedure to cancel the award often lacks clarity, and the venue for the arbitration center’s dispute to be resolved is limited. In addition, the management, quality assessment and training of arbitrators is one of Vietnam’s problems. In Asia, Korea is known as one of the most pro-arbitration jurisdictions in the region. Since the adoption of the Arbitration Act in 1966 that governs both domestic and international proceedings, the Korean arbitration legal framework has always been kept consistent with generally accepted international practices. Recently, the Korean government has introduced an action plan to further promote the robust development of the commercial arbitration industry over the five-year period, from 2019 to 2023, and the goal is to turn Korea into one of five countries that have the world’s best arbitration system. Given the close cultural background and integration strategy of Vietnam and Korea, it is believed that the Korean experience can serve as a good reference for Vietnam in developing commercial arbitration law and policy. This paper begins with analyzing the background of the Vietnamese arbitration system and highlighting some limitations of Vietnamese arbitration. It then switches to the Korean arbitration system and development plan on promotion of dispute settlement by arbitration. The paper focuses on analyzing four main strategies that would: (1) strengthen the foundation of the arbitration industry; (2) activate domestic arbitration; (3) secure competitiveness in the arbitration industry; (4) expand the attraction of international arbitration. The Korean action plan can suggest some interesting strategies for Vietnam to further strengthen its commercial arbitration system.

In certain disputes, it may be important to acquire evidence from the other party, but it is difficult to do so because the international arbitration process envisions only a limited form of discovery from the opposing party in the form of document production. There is, however, the potential of an unexplored option in US law to help fill this void. 28 U.S.C. § 1783, also known as the ‘Walsh Act’, enables a United States court, under certain circumstances, to subpoena a national or resident of the United States who is in a foreign country to personally appear as a witness before the court, or before someone designated by the court, or to produce specific testimony or documents. Considering the ubiquity of American parties in international disputes, section 1783 has the potential to become an important tool in the arsenal of a disputes lawyer. Indeed, considering how section 1782 has been increasingly applied in international arbitration, it is possible that section 1783 might evolve as an important component in considering strategies for international arbitration. Like section 1782, however, due to its lack of use to date and vague statutory language, its applicability to various forms of international arbitrations remains an unfortunately open question. Decision making in a complex world, characterized both by predictable regularities and by frequent departures from the norm, requires dynamic switching between rapid habit-like, automatic processes and slower, more flexible evaluative processes. These strategies, formalized as “model-free” and “model-based” reinforcement learning algorithms, respectively, can lead to divergent behavioral outcomes, requiring a mechanism to arbitrate between them in a context-appropriate manner. Recent data suggest that individuals with obsessive-compulsive disorder (OCD) rely excessively on inflexible habit-like decision making during reinforcement-driven learning. We propose that inflexible reliance on habit in OCD may reflect a functional weakness in the mechanism for context-appropriate dynamic arbitration between model-free and model-based decision making. Support for this hypothesis derives from emerging functional imaging findings. A deficit in arbitration in OCD may help reconcile evidence for excessive reliance on habit in rewarded learning tasks with an older literature suggesting inappropriate recruitment of circuitry associated with model-based decision making in unreinforced procedural learning. The hypothesized deficit and corresponding circuitry may be a particularly fruitful target for interventions, including cognitive remediation.

This essay discusses the practical aspects of mediation and arbitration. The article outlines effective steps to implement win-win, win-lose, lose-win, and lose-lose negotiation strategies. It is posited that with a win-win strategy, the job of a mediator or arbitrator is to find a win-win scenario that is acceptable to both sides. The role of a mediator or arbitrator when the parties are engaging in win-lose, lose-win, and lose-lose strategies is different in that at least one of the parties is not seeking a win for all sides. In particular, when the parties are not involved in a win-win, and court is an option, the parties need to gain as much information about the opposing party as possible to use it to their advantage in court. This is unfortunate but, at times, a necessary result of not participating in a win-win outcome.

This dissertation allowed the researcher to analyze 171 pieces of youth-created artwork and narratives by children aged six to nine who took part in the peace education, mentorship, and literacy program, READING PEACE PALS, implemented with an underserved population at a Boys and Girls Club in the U.S. Qualitative content analysis (Krippendorf, 1980; 2004) was used to analyze the artwork and narratives to gain insight into children’s conceptualization of peace, violence, and bullying and their strategies for addressing bullying and violence. The findings uncovered the myriad of unique ways youth conceptualize and define peace and the strategies they employ to combat the bullying and violence in their lives. Youth artwork demonstrated conceptions of positive peace. However, youth narratives included more descriptions of negative peace. Youth also addressed connection, empowerment, and their responsibility for creating peace. Strategies to combat bullying and violence included bringing in an adult, power in numbers, and ways to address the bully. In addition, the findings of this dissertation, when triangulated with the findings previously found in Georgakopoulos, Duckworth, Silverman, and Redfering (2017) in terms of student perceptions of affective, cognitive, and behavioral learning and the social impact that the learning in the peace education program had on them show similarities in terms of youth conceptions of peace and the strategies they employ to combat violence and bullying in their lives. Conversely, the artwork and narratives offered a unique lens and captured more vivid and detailed expressions than the surveys were able to convey.

Pour faire face à la complexité croissante des systèmes développés, cette thèse propose une approche méthodologique multi-vues permettant d'accompagner les étapes du cycle de développement de systèmes complexes, dont notamment les systèmes multi-énergies, depuis leur conception jusqu'à leur pilotage en temps réel. Un niveau d'arbitrage entre les différentes missions du système est également intégré et permet d'évaluer plusieurs stratégies. Ce niveau est appliqué au cas du véhicule électrique entre les missions d'autonomie, de confort et de vitesse. La méthodologie développée dans cette thèse est centrée autour de la modélisation fonctionnelle, sur laquelle ces travaux se concentrent. Celle-ci décrit de manière modulaire et au moyen de modèles mathématiques juste nécessaires et de liens énergétiques le comportement des éléments du système et leurs interactions. Afin de prendre en compte au mieux la réponse dynamique des éléments, leurs contraintes et les éventuelles perturbations, des algorithmes de commande prédictive ``PFC'' sont développés puis implémentés au sein des éléments fonctionnels. Ces algorithmes servent également de support pour l'introduction d'un problème d'optimisation pour gérer le processus d'allocation des ressources dans un système multi-sources. Ces concepts sont appliqués au pilotage d'un parc éolien couplé à une unité de stockage, avec la prise en compte de contraintes de congestion sur le réseau. Enfin, l'extension de cette méthodologie à l'optimisation des systèmes multi-énergies soulève de nouvelles problématiques, notamment le couplage entre plusieurs domaines énergétiques, la prise en compte de variables manipulables discrètes et un conflit entre la nécessité d'avoir à la fois un horizon de prédiction long et une résolution temporelle fine. Pour répondre à cette problématique, le modèle fonctionnel est couplé à deux niveaux d'optimisation supérieurs qui permettent de déterminer respectivement l'architecture optimale du système et les plannings de démarrages, d'arrêts et de charge des moyens de production. Cette approche est validée avec la conception et le pilotage d'un réseau urbain multi-énergies dans la commune de Bolbec
In order to face the increasing complexity of the developed systems, this thesis proposes a multi-view methodological approach allowing to accompany the stages of the development cycle of complex systems, including multi-energy systems, from their design to their real time control. A level of arbitration between the different missions of the system is also introduced and enables to test several strategies. This level is illustrated in the case of the electric vehicle with arbitrations between autonomy, vehicle speed and passenger comfort. Functional modeling, on which this work focuses, is the cornerstone of the methodology. This describes in a modular way and through the use of just necessary mathematical models and energy links the behavior of the elements of the system and their interactions. In order to take into account the dynamic response of the elements, their constraints and disturbances, some predictive control algorithms ``PFC'' are developed and implemented within the functional elements. These algorithms are also used to introduce an optimization problem to manage the resources allocation process in a multiple source system. These concepts are applied to the control of a wind farm coupled with a storage unit, taking into account congestion constraints on the electric grid. Finally, the adaptation of this methodology to the optimization of multi-energy systems raises new issues, including the coupling between several energy fields, the consideration of discrete manipulable variables and a conflict between the need for both a high prediction horizon and a fine temporal resolution. To address this issue, the functional model is coupled to two higher levels of optimization that allow to determine respectively the optimal system architecture and the source commitment schedule. This approach is validated on the design and the control of a multi-energy urban network in the town of Bolbec

One of the most common alternative dispute resolution methods used in the Sri Lankan construction industry is arbitration. However, challenging arbitration awards based on legal grounds at the courts has been a current trend by the disagreeing party. If this situation occurs continuously, the purpose of having arbitration as an alternative dispute resolution method can be abandoned. Therefore, the study aims to identify the causes where arbitration is challenged in multi-story building construction projects in Sri Lanka through a case study. The methodological choice was qualitative and used semistructured interviews from six arbitrators and 2 case studies that referred to courts to challenge arbitration awards as research strategies. The study found the poor attitude of parties, lack of technical knowledge, reliability, and capability of the arbitrator to act according to the arbitrary acts imposed by the government as the main causes. Further. The study recommends arbitrators consider the reasons to act well enough and reject the cases if the arbitration is likely to be challenged in courts, train arbitrators to be reliable and on technical knowledge, and improve parties' attitudes by educating on the arbitration procedure and its benefits. The Covid-19 pandemic has created a new norm in which technology is at the forefront of keeping the globe running and rebuilding better after the crisis. Several countries practiced virtual ADR during the pandemic than in the pre-pandemic situation, and the virtual shift has gained traction. The research aims to explore the potentiality of the ADR methods in the virtual platform for the settlement of the dispute and make recommendations for effective legal implementation of those methods in the Construction Industry in Sri Lanka. The research aim was achieved through a qualitative approach; collected data through two stages: a preliminary interview and a semistructured interview with experts and finally analysed with manual content analysis. Key research findings are the opportunities and challenges to implement and conduct ADR in the virtual platform in the Sri Lankan construction industry. In addition, the strategies were collected to identify the potentiality of virtual ADR. The research concludes that the blended approach is suitable for Sri Lanka and the entire virtual ADR is not suitable. The entire virtual ADR shall be potential for Sri Lanka if all the opportunities are utilized and all the strategies are followed. As the virtual ADR is a game-changer for the SL construction industry, regulatory bodies and arbitration institutions must take initiatives to implement and conduct virtual ADR successfully in the future.

The Efficient Market Hypothesis (EMH), is one of the most important hypotheses in the financial economy, which argues that yields have no memory (correlation), which implies that agents cannot have abnormal returns in the financial markets, base arbitration operations. This essay intends to investigate the efficiency, in its weak form, in the stock and bond markets of Portugal and EDP, in the period from December 31, 2019, to August 10, 2020. With the purpose of achieving such an analysis, whether: (i) with the evolution of the global pandemic (Covid-19) the Portuguese and EDP stock and bond markets show signs of (in) efficiency? (ii) Does the increased integration between the Portuguese and EDP stock and bond markets result in risk transmission? The model 𝐷𝐹𝐴 shows the existence of long memories in these markets, suggesting that they are not efficient, which validates the first research question. This situation has implications for investors, since some returns can be expected, creating opportunities for arbitrage and abnormal earnings. However, to confirm the inefficiency of these markets, based on our results, we must prove the existence of anomalous returns. In order to answer the second investigation question, we carried out the integration test that shows that these markets are mostly integrated. To validate whether financial integration results in risk transmission between the analyzed markets, we estimate the trendless cross-correlation coefficients (𝜆𝐷𝐶𝐶𝐴), which shows 4 pairs of markets showing risk transmission (4 out of 10 possible). In conclusion, the authors suggest that these results are of interest, among others, to international investors interested in expanding the geographical scope, regarding the implementation of portfolio diversification strategies.

Based on these events, it is intended in this paper to test the persistence of profitability in the financial markets of Argentina, Brazil, Chile, Colombia, Peru and Mexico, in the period between January 2018 to July 2020. In order to perform this analysis where undertaken different approaches in order to analyze if: (i) the financial markets of Latin America are efficient in their weak-form during the global pandemic (Covid-19)? ii) If so, the persistent long memories cause risks between these regional markets? The results suggest that the returns don’t follow the i.i.d. hypothesis, from dimension 2, reinforcing the idea that returns of stock indexes have a non-linear nature or a significant non-linear component, exception made to the Argentina market, which was expected in virtue of the Ljung-Box (with the return squares) test results, and ARCH-LM. Corroborating the exponents Detrended Fluctuation Analysis (DFA), indicate the presence of persistent long memories, namely into the following markets: Colombia (0.72), Chile (0.66), Brazil (0.58) and Peru (0.57). The Argentina market does not reject the random walk hypothesis, while the Mexican market suggests some anti-persistence (0.41). This situation has implications for investors, once that some returns can be expected, creating arbitration opportunities and abnormal income, contrary to the supposed from the random walk hypothesis and information efficiency. The t-test results of the heteroscedasticity form the two samples suggest that there is no risk transmission between these regional markets, with the exception to the BOVESPA / BOLSAA MX markets, that is, the existence of persistent long memories in the returns does not imply the risk transmission between markets. These finds allow the creation of strategies of diversification inefficient portfolios. These conclusions also open space for the market regulators to implement measures that guarantee a better informational information of these regional markets.

Abstract This work investigates how the green-house gas (GHG) emissions of a producing oil field can be reduced through adaptation of the reservoir management, i.e. the injection and production guidelines. Indeed, the world’s energy production must be decarbonized as far as possible, and this includes minimization of the emissions associated to the oil and gas extraction itself. An additional decision criterion for oil and gas projects is the hydrocarbon carbon intensity, which is the emissions total divided by the production total, expressed in kgCO2eq/boe. The reservoir management strategies now attempt the joint optimization of all the following dimensions: net present value, short-term production, final recovery, and now oil carbon intensity. In some WAG fields, several controls are available even after the development is finalized: flow rates of both gas and water in each injector, duration of injection of each phase, possible conversion from WAG to water injection. A method has been devised to perform the joint optimization: a reservoir simulator is coupled with a surface model containing GHG emissions equations for compressors, pumps, turbines according to their throughputs. In brown fields, this emissions model can be calibrated on historical profiles and energy consumption per machine, while in green fields, a synthetical model can be built from theoretical operating curves and calibrated a posteriori. In this work, the method was applied on a giant Middle-East carbonate oil field under Miscible WAG injection. Numerous reservoir management scenarios were run, resulting in new production and injection profiles, together with their associated GHG emissions profiles, without the need for time-consuming loops between subsurface and development or exploitation teams. All scenarios were ranked in recovery and carbon intensity simultaneously. For the selected field, it was found that reservoir management actions can be strong levers to reduce the carbon intensity of the produced oil, where required – typically by 10% or more. The most efficient reservoir management actions for GHG reduction were those that reduce the gas injection rate and therefore the associated gas compression requirements. The actions did not impact the short- and mid-term oil production but lead to a reduction of one point of ultimate recovery. Reservoir management decisions must consequently be compromises between ultimate recovery, carbon intensity and net present value. The integrated production and emissions prediction tool proves extremely helpful to identify the relevant reservoir management scenarios, perform informed arbitration or enforce hard-fixed carbon intensity constraints.

В статье представлен анализ геополитических последствий международных кризисов в Латинской Америке конца XIX – начала XX в. Первый венесуэльский кризис, в основе которого лежал территориальный спор между Венесуэлой и Британской империи, обострил отношения между Вашингтоном и Лондоном. Американское правительство посчитало, что территориальные претензии Великобритании к одной из латиноамериканских стран угрожают жизненным интересам США и находятся в противоречии с принципами доктрины Монро. Исходя из этого, Белый дом потребовал созыва международного трибунала для решения этого территориального спора. Британское правительство сначала отказалось принимать американское предложение, а затем под давлением международных обстоятельств согласилось на арбитраж и признало доктрину Монро. После этого начался процесс сближения двух стран, ускорившийся после Англо-бурской и Испано-американской войн. В ходе второго венесуэльского кризиса, связанного с финансовыми претензиями ряда европейских стран к венесуэльскому правительству, главным оппонентом США выступила Германская империя, попыталась укрепить свои финансовые и военные позиции в Латинской Америке. Это ухудшило отношения между Вашингтоном и Берлином и привело к ещё более тесному англо-американскому сотрудничеству. The article presents a comparative analysis of the geopolitical consequences of the international crises in the end of XIXth – beginning of the XXth century. The first Venezuelan crisis caused by a territorial dispute between Venezuela and the British Empire, worsen also relations between Washington and London. The government of the USA considered that the territorial claims of Great Britain to one of the Latin American countries threatend the vital interests of the United States and were in contradiction with the principles of the Monroe doctrine. Based on such considerations, the White House demanded the convening of an international tribunal to resolve this territorial dispute. The British government originally refused to accept the American proposal, and then, under the pressure of international circumstances, agreed to arbitration and actually recognized the Monroe doctrine. Afterwards, the process of rapprochement between the two countries began. During the Second Venezuelan crisis, caused by the financial demands of a number of European countries to the Venezuelan government, the main opponent of the United States was the German Empire. The German-American confrontation in Venezuela seriously worsened relations between Washington and Berlin and led to the closer Anglo-American cooperation.
