Any science striving for the creative development of its content cannot be indifferent to its past, to the history of its ideas, discoveries, and conclusions. This idea is entirely related to the philosophy of law - one of the most ancient sciences of law. With the development of humankind, with the formation of the first states, there is a gradual departure from mythology, which is being replaced by philosophy and religion as forms of social consciousness. Traditions of human life are fixed in their norms. Among the norms, the norms of law also function. In the ancient East states, in which powerful theocratic monarchies took shape, the first philosophical and legal views were also formed. The peculiarity of the development of the coun- tries of the Ancient East, when the state became the owner of the land, slaves, etc., leaves its imprint on the formation of political doctrines about the state aimed at substantiating the despotism and omnipotence of the monarch.

Mozi1 can be described as broad and profound, which covers the natural sciences, philosophy and social sciences, Mozi has made great achievements in mathematics, mechanics, optics, engineering science, etc. In terms of natural science, philosophy and logic, thoughts including «whole world as one community», «homogeneity of benefit and morality», «respect the rules», «peaceful coexistence», «mutual aid» advocated by Mozi, are complementary and consistent with his scientific rationality and scientific spirit. On this basis, Mozi further demonstrated his labor-based and ability-based view, power contract view, view of rule of law, and social overall view, etc. With the serious incompleteness and loss of the documents of Mozi, and the practical rationality and empirical way of thinking of traditional Confucianism have become cultural factors restricting the further development of science, technology and spiritual civilization. So the numerous scientific and technological achievements created by Mozi, and the ideological system of Mohism have not been fully and completely inherited and developed. In a certain sense, the elements of science, democracy and other elements lacking in the feudal social ideology with Confucianism as the mainstream need to be supplemented by the clear scientific rationality and scientific spirit of Mohist. To revitalize traditional culture and promote economic and social development, it is still necessary to continue to excavate and carry forward the scientific rationality and ethical spirit of Mohism.

The paper analyzes the status aspects of human rights during the period of existence of the Roman state. Considering the fact that it was the empire lasted for several centuries, the position of a human in it and his/ her rights changed. The modern understanding of human rights originates from the period of the end of the 18th and the beginning of the 19th century, when The School of Natural Law laid the foundations of the understanding of human, natural rights, which did not exist in that form during the ancient period. The primary social differentiation of the population in ancient Rome was based on a simple division of people into free ones and slaves. From this premise, they built the foundations of their rights as well as their social, legal and political positions. In theory, Roman history is chronologically divided into four periods: The period of Kings, The period of the Republic, the Principate and the Dominate. In those periods, the social structure differed significantly. The aim of this paper is to show the position of the population in each of these periods, their rights and mutual relationships. The Roman law represents the cradle of contemporary continental law, and the germ of human rights was "sown" exactly in that period, which, for this reason, deserves to be the subject of a deeper professional analysis.

The paper analyzes the process of formation and development of Chinese character 法 which forms fundamental category of traditional law. Since ancient times, the law has been responsible for the regulation of social relations. It played an important role in shaping the legal culture of the state. The origins of European law are rooted in the legal and political teachings of ancient civilization. Traditional law has long played a prominent role in the life of the state and society in China. The functions of the law were in the methods of government and in the system of punishments. One of the most important features of Chinese culture is that it is closely related to the history of writing. Pictograms are the basis of Chinese characters writing. They originate in the archaic art of ancient China. Ancient signs are one of the main sources of information about ancient Chinese writing. The author analyzes the original image of this character, which was found on the ritual bronze vessel of the Western Zhou dynasty. It includes three main parts. The most interesting is the character of zhi (廌 ), which is translated as “a magic animal”. According to Chinese mythology, it is portrayed as a companion of the judge Gao Yao. It is also a symbol of justice.

The article reflects one of the fundamental directions of scientific research conducted of the Institute of State and Law of the Russian Academy of Sciences in the field of Philosophy, Sociology and Psychology of Law in the context of the history of Russian civilization, the Russian State and the theory of law. The article attempts to theoretically comprehend the phenomenon of suicide from the standpoint of socio-legal addictions (addictions) and deviations (deviations from norms), firstly, as a medical and psychological phenomenon, and secondly, as a person’s reaction to personal adversity, social circumstances, moral, material and other plans. Formulations revealing the essence of suicide are given in the works of ancient thinkers, philosophers, sociologists and jurists of other times. The quantitative and qualitative characteristics of suicidal behavior, the extent of the spread of suicide in the history of various civilizations, including the Slavic-Russian-Russian, are summarized. On this basis, the author's idea of suicide is given, based on philosophical, legal and theological teachings, the results of sociological research, official statistics and the conclusions of modern researchers.

Introduction. The purpose of the article is to show the effect of the law of correspondence as a factor of stability of the social system and the relevance of this problem for ancient Indian philosophy. The problem of the stability of society was not directly considered in ancient Indian philosophy or in modern literature, especially through the prism of the law of correspondence.Methodology and sources. The work uses content analysis, system approach, dialectics and the concept of self-organization. In addition, the main analysis of the problem of stability in ancient Indian philosophy is carried out on the basis of the law of correspondence between the real relations that connect people at a given moment and the essence of the “social”. This law was formulated and proposed by V.V. Tuzov. The essence of the “social” could be conditionally expressed through the concepts of “equality”, “humanism”, mutual assistance, “justice”. Real relations may deviate from the essence, but by a certain amount, a measure. Going beyond the limits of the measure deprives the system of stability, and it becomes uncontrollable. The main source of analysis is the academic edition of the text Arthashastra (ancient Indian political and economic treatise), as well as “History of political and legal doctrines”, “Development of ideas about management in philosophical thought”.Results and discussion. The article analyzes the ancient Indian philosophical texts to reveal in them, in a latent or explicit form, the concern of philosophers with the problem of maintaining the stability of the state and society. Attention is focused on the fact that there is a need to observe the law of conformity in the recommendations for rulers on how to govern the people.Analysis of the main source of ancient Indian philosophy, which deals with the problems of governance, shows that the recommendations to the king, which are set forth by the author of Arthashastra Kautilya, imply, in the end result, the need to maintain a balance of interests between the ruling class and the people, that is, to observe the measure for which society loses its stability due to for the impoverishment of the people. In other words, in the management recommendations, the law of conformity, which was discussed above, appears in a latent form.Conclusion. The problem of the stability of the social system in a class society was and remains extremely relevant. The philosophical law of correspondence between real relations and the essence of social relations, which ensures the stability of society while observing the measure, requires justification. Since the principle of forming relationships and the nature of interaction has remained unchanged for centuries, the reflections of ancient philosophers on management, on the structure of society, on the relationship between different groups in it, and on the interaction of interests, on the one hand, confirm the operation of this law, on the other hand, could be useful for modern management.

Article proposed discusses the problems of historical development of medical and social relations as preconditions for the emergence of norms of medical law in the states of the Ancient World. The purpose of this work is the retrospective review of public relations, which became a prerequisite for the emergence of legal acts in the field of medicine of the ancient world; identification of their regularities, features and dialectical relations; separation of relations in the field of medicine, which, due to their public significance, needed and need legal settlement, in particular, at the expense of labor law; development of author’s conclusions and outlining of perspective directions of further scientific exploration. The research methodology is based on common scientific methods and empirical methods. In particular, it is concluded that the aforesaid relations needed to be regulated by the norms of labor, criminal and administrative law, which created a medical and legal triad of the settlement of public relations in the specified sphere. According to the historical and chronological feature, medical and social relations for the first time were regulated by the norms of labor law (norms on the remuneration of doctors, the Laws of Hamurapi, XVIII century BC). This fact generates a medical and legal paradox, since labor law as an independent branch is not recognized as a scientific doctrine for that period of time, but already in the XVIII century BC there were its subjects (doctors), sources (Laws of Hamurapi) and norms, even in conditions of slave rule. Above leads to certain doubts in the axiomatics of the formation criterion of social development and the correctness of approaches in determining the time of acquisition of independent status by the branch of labor law.

The social sciences are often thought to be inferior to the natural sciences because they do not have laws. Bohman writes that “the social sciences have never achieved much in the way of predictive general laws—the hallmark of naturalistic knowledge—and so have often been denied the honorific status of ‘sciences’” (1994, pg. vii). Philosophers have suggested a number of reasons for the dearth of laws in the social sciences, including the frequent use of ceteris paribus conditions in the social sciences, reflexivity, and the use of ‘odd’ concepts. This thesis argues that the scarcity of laws in the social sciences is primarily due to the concepts that social scientists often work with. These concepts are described as Nomadic and are characterised by disagreement about what can reasonably be included within the scope of a concept. The second half of the thesis explores the implications of this analysis. It argues firstly, that counterfactual analysis is problematic when using Nomadic concepts. Secondly, it argues that taking an intentional perspective on behaviour often involves the use of Nomadic concepts so, if social scientists do hope to formulate laws, then they are more likely to succeed if they focus on behaviour that is not intentional.

This dissertation attempts to provide a theoretical framework for explaining the choices made by international decisions-makers as to what constitutes law. It is proposed that the practice of international human rights courts recognises that different normative instruments coexist in an un-ordered space, and that meaning can be produced by the free interaction of those instruments around a problem. Based on such practice, the author advances his normative plurality hypothesis, which states that decision-makers must survey the acquis of international law in order to identify all the instruments containing relevant normative information for a particular situation. The set of rules of law applicable to the situation must then be complemented with other instruments containing specific normative information relevant to the situation, resulting in a complete system of norms advancing a common purpose.
Cette thèse vise à fournir un cadre théorique pour expliquer les choix effectués par les décideurs internationaux sur ce qui constitue la loi. Il est proposé que la pratique des tribunaux internationaux des droits de l'homme reconnaît que différents instruments normatifs coexistent dans un espace non-ordonné, et que le sens peut être produit par le libre jeu de ces instruments autour d'un problème. With the advancement of intermediated systems coupled with the rapid development of information technology, securities holding patterns have drastically changed from direct holdings to intermediated holdings, which facilitated the explosive increase of securities transactions during the last half century. In intermediated systems, traditional functions of securities certificates have faded away and intermediated securities credited to securities account books play a key role in determining proprietary issues. In spite of the innovative development of intermediated systems, legal regimes for the systems have not kept up with the development of the systems. Specifically, there has been much legal hindrance in cross-border securities transactions. In this regard, this thesis first attempts to research substantive laws for intermediated systems in the United States, the United Kingdom, Canada, Japan and Korea. The Unidroit draft convention on intermediated securities is also discussed as neutral fact-centred international substantive rules. In the substantive law analysis, this thesis suggests preparing new rules that are internally sound and internationally compatible, friendly to users and markets, and readily accessible clear, intuitive rules which satisfy basic legal needs of intermediated securities holders and ensure market efficiency and stability. In the private international law analysis, this thesis finds the traditional lex rei sitae (or the lex situs), which calls for application of the law of the place where securities are located, is no longer a proper connecting factor in proprietary issues of an intermediated securities disposition, given that the location of securities has no meaningful function in intermediated systems. The Hague Securities Convention, which refers to the PRIMA (Place of Relevant InterMediary Approach) that localises an intermediary, went beyond the PRIMA and selected its primary rule in an account agreement between an account hold
Avec l'avancement des systèmes d'intermédiaires et les développements technologiques récents, les modèles de détentions des titres d'investissement ont changé dramatiquement au cours des cinquante dernières années. ce qui a facilité l'expansion accrue des transactions. Dans les systèmes intermédiés, la fonction traditionnelle des titres certifiées est en train de se dégrader, et ainsi les titres intermédiés crédités aux livrets de comptes sécuritaires jouent un rôle important dans la détermination des droits de propriété et des droits prioritaires. Malgré les innovations des systèmes d'intermédiaires, les régiments juridiques applicables à ces systèmes n'ont pas évolués au même rythme. This thesis addresses The Development and The Future of English and Islamic Law within the given historical, political, social and legal context of the Sudan. In so doing it uses a comparative methodology. Part I highlights the genesis and the development of Islamic Law in the Sudan over three centuries. Emphasis is on the legal aspect of this long history, though other relevant factors are highlighted as well. The characteristics of this era are significant in understanding later developments of both English and Islamic Law as well as their future in the Sudan. Part II focuses on the factors that were conductive to the development of English Law from 1899 to 1956. It examines how the British investment in English legal education, legal training, dissemination of English language and different aspects of the Sudanese public life created a factor of unexpressed consciousness of legal training and affinity which led to the ultimate adoption of English Law and the assimilation of the Sudan into the English legal heritage. Part III presents how the generation of the Sudanese lawyers who were reared in the colonial era enhanced the development of English Law after the independence. Their methodology of adopting and not adapting English Law is thoroughly examined. [...]
Cette thèse traite du développement et de l’avenir de la loi anglaise et islamique dans le contexte historique, politique, social et légal du Soudan. Pour se faire, elle utilise une méthodologie comparative. La partie 1 souligne l’origine et le développement de la loi islamique au Soudan sur une période de trois siècles. L’emphase porte sur l’aspect légal de cette longue histoire, bien que d’autres facteurs significatifs soient également mentionnés. Les caractéristiques de cette période sont nécessaires afin de comprendre le développement ultérieur de la loi anglaise et islamique ainsi que leur avenir au Soudan. La partie il traite des facteurs qui ont mené au développement de la loi anglaise de 1899 à 1956. The purpose of this study was to conduct a policy analysis of Seth’s Law 2012. Bullying on school campuses is a severe and pervasive problem that has been shown to cause detrimental risk factors and negative outcomes for many LGBTQ youth. This study utilized a qualitative design, collecting data from primary and secondary sources that addressed this legislation. Results indicate that LGBTQ youth are bullied at higher rates than heterosexual youth. Additionally, the results indicated that stricter anti-bullying legislation that holds the Department of Education and its school districts accountable for following such laws is needed. Implications for social work practice, policy, and research were discussed.

Existing theoretical approaches to international human rights law governing the State's duty to respect and ensure the right to not be arbitrarily deprived of life do not provide a satisfactory analytical framework within which to consider the problem of a rogue civil airliner – a passenger-carrying civil aircraft under the effective control of one or more individuals who intend use the aircraft itself as a weapon against persons and property on the surface. A more satisfactory approach is provided by the addition of a norm of proportionality of effects that is analogous to that which has been developed within the framework of international humanitarian law and modern constitutional rights law. This additional norm would apply only where there is an irreconcilable conflict between the State's duties in respect of the right to life and all of the courses of action available will result in innocent persons being deprived of life.

The national legal system is determined by traditional elements characterizing the culture and customs that exist in the social environment in the form of moral standards and the law. However, the attitude of the population to the letter of the law, as a rule, initially contains negative properties in order to preserve personal freedom, status, position. In an exciting series of Interdisciplinary Dialogues on the societal impacts of AI, we invite a guest speaker and panellists from the fields of science and engineering, health and humanities and social sciences to discuss the advances, challenges and opportunities raised by AI. The first dialogue in this series began with Yoshua Bengio, who, concerned about developments in generative AI and the major risks they pose for society, initiated the organization of a conference on the subject. The event took place on August 14, 2023 in Montreal, and was aimed at initiating collective, interdisciplinary reflection on the issues and risks posed by recent developments in AI. The conference took the form of a panel, moderated by Juliette Powell, to which seven specialists were invited who cover a variety of disciplines, including: computer science (Yoshua Bengio and Golnoosh Farnadi), law (Caroline Lequesne and Claire Boine), philosophy (Jocelyn Maclure), communication (Sonja Solomun) and political science (Hugo Loiseau). This document is the result of this first interdisciplinary dialogue on the societal impacts of AI. The speakers were invited to respond concisely, in the language of their choice, to questions raised during the event. Ours is an age of pervasive political turbulence, and the scale of the challenge requires new thinking on politics as well as public ethics for our world. In Western countries, the specter of Islamophobia, alt-right populism, along with racialized violence has shaken public confidence in long-secure assumptions rooted in democracy, diversity, and citizenship. The tragic denouement of so many of the Arab uprisings together with the ascendance of apocalyptic extremists like Daesh and Boko Haram have caused an even greater sense of alarm in large parts of the Muslim-majority world. It is against this backdrop that M.A. Muqtedar Khan has written a book of breathtaking range and ethical beauty. The author explores the history and sociology of the Muslim world, both classic and contemporary. He does so, however, not merely to chronicle the phases of its development, but to explore just why the message of compassion, mercy, and ethical beauty so prominent in the Quran and Sunna of the Prophet came over time to be displaced by a narrow legalism that emphasized jurisprudence, punishment, and social control. In the modern era, Western Orientalists and Islamists alike have pushed the juridification and interpretive reification of Islamic ethical traditions even further. Each group has asserted that the essence of Islam lies in jurisprudence (fiqh), and both have tended to imagine this legal heritage on the model of Western positive law, according to which law is authorized, codified, and enforced by a leviathan state. “Reification of Shariah and equating of Islam and Shariah has a rather emaciating effect on Islam,” Khan rightly argues. It leads its proponents to overlook “the depth and heights of Islamic faith, mysticism, philosophy or even emotions such as divine love (Muhabba)” (13). As the sociologist of Islamic law, Sami Zubaida, has similarly observed, in all these developments one sees evidence, not of a traditionalist reassertion of Muslim values, but a “triumph of Western models” of religion and state (Zubaida 2003:135). To counteract these impoverishing trends, Khan presents a far-reaching analysis that “seeks to move away from the now failed vision of Islamic states without demanding radical secularization” (2). He does so by positioning himself squarely within the ethical and mystical legacy of the Qur’an and traditions of the Prophet. As the book’s title makes clear, the key to this effort of religious recovery is “the cosmology of Ihsan and the worldview of Al-Tasawwuf, the science of Islamic mysticism” (1-2). For Islamist activists whose models of Islam have more to do with contemporary identity politics than a deep reading of Islamic traditions, Khan’s foregrounding of Ihsan may seem unfamiliar or baffling. But one of the many achievements of this book is the skill with which it plumbs the depth of scripture, classical commentaries, and tasawwuf practices to recover and confirm the ethic that lies at their heart. “The Quran promises that God is with those who do beautiful things,” the author reminds us (Khan 2019:1). The concept of Ihsan appears 191 times in 175 verses in the Quran (110). The concept is given its richest elaboration, Khan explains, in the famous hadith of the Angel Gabriel. This tradition recounts that when Gabriel appeared before the Prophet he asked, “What is Ihsan?” Both Gabriel’s question and the Prophet’s response make clear that Ihsan is an ideal at the center of the Qur’an and Sunna of the Prophet, and that it enjoins “perfection, goodness, to better, to do beautiful things and to do righteous deeds” (3). It is this cosmological ethic that Khan argues must be restored and implemented “to develop a political philosophy … that emphasizes love over law” (2). In its expansive exploration of Islamic ethics and civilization, Khan’s Islam and Good Governance will remind some readers of the late Shahab Ahmed’s remarkable book, What is Islam? The Importance of Being Islamic (Ahmed 2016). Both are works of impressive range and spiritual depth. But whereas Ahmed stood in the humanities wing of Islamic studies, Khan is an intellectual polymath who moves easily across the Islamic sciences, social theory, and comparative politics. He brings the full weight of his effort to conclusion with policy recommendations for how “to combine Sufism with political theory” (6), and to do so in a way that recommends specific “Islamic principles that encourage good governance, and politics in pursuit of goodness” (8).
