L'expression « contrat portant sur une chose future » signifie que les contractants peuvent valablement stipuler que la chose due sera future ; ils peuvent ainsi contracter sur une chose corporelle ou incorporelle qui n'existe pas encore, du moins dans son entièreté. Depuis la vente romaine de chose future, les contrats portant sur une chose future se sont diversifiés. La pratique de ces contrats est devenue courante en raison de leur importance économique. Prenant la mesure de cette diversité et de cette richesse, la réflexion sur le contrat portant sur une chose future a été envisagée sous le propos de théorie générale.Les contrats portant sur une chose future sont des figures familières sans que l'on les remarque forcément. Il convenait de les identifier dans un premier temps. Ce qui les caractérise et que l'on voit rapidement est que, chacun de ces contrats suppose une chose future qui en constitue l'objet ; la présente étude en propose une définition claire et distincte. Ce que l'on perçoit peut-être moins à l'analyse de ces contrats et qui, pourtant, leur est caractéristique, est qu'ils sont toujours des contrats commutatifs et non des contrats aléatoires. Ce trait montre que la théorie romaine de la vente de chose future, telle qu'elle a été toujours présentée, doit être utilisée aujourd'hui avec beaucoup de précautions pour expliquer tout le mécanisme du contrat portant sur une chose future.L'identification du contrat portant sur une chose future s'est poursuivie avec une référence à l'anticipation. Celle-ci est une explication doctrinale de l'article 1130 ancien, alinéa 1er, du Code civil qui disposait : « L'obligation peut avoir pour objet une chose future. » Elle explique aujourd'hui encore, après la réforme du droit des contrats, le nouvel article 1163, alinéa 1er. Ces trois références ou critères (la chose future, l'absence d'aléa et l'anticipation) ont permis d'identifier, d'un côté, les contrats spéciaux portant sur une chose future et, de l'autre côté, les sûretés conventionnelles portant sur une chose future.Après identification des divers contrats portant sur une chose future, il importait d'étudier leur régime juridique dans un second temps. Le contrat portant sur une chose future se distingue par deux règles communes et spécifiques : d'abord la naissance à la charge du débiteur d'une obligation préalable de faire consistant à faire advenir la chose promise en participant à sa création ou en exécutant un autre contrat ; et ensuite, la naissance au profit du créancier d'un droit éventuel, qui est le droit pur et simple en germe. En outre, la plupart des développements sur la validité et sur l'inexécution du contrat portant sur une chose future relèvent du droit commun du contrat. Les problématiques abordées n’ont pas permis de relever des spécificités tenant à l'aspect chose future, objet de la prestation.Sur le plan de la notion et du régime, il y a au total cinq critères et règles communs sur lesquels on peut s'appuyer pour parler de théorie générale du contrat portant sur une chose future
The expression "contract relating to a future thing" means that the contracting parties may validly stipulate that the thing due will be future; they may thus contract on a tangible or intangible thing that does not yet exist, at least in its entirety. Since the Roman sale of a future thing, contracts relating to a future thing have diversified. The practice of these contracts has become commonplace because of their economic importance. Taking the measure of this diversity and richness, reflection on the contract for a future thing has been considered under the heading of general theory. Contracts relating to a future thing are familiar figures without necessarily being noticed. It was necessary to identify them first of all. What characterizes them, and what is quickly apparent, is that each of these contracts presupposes a future thing which constitutes their object; this study proposes a clear and distinct definition of them. What is perhaps less obvious from an analysis of these contracts, and yet characteristic of them, is that they are always commutative contracts and not random contracts. This feature shows that the Roman theory of the sale of a future thing, as it has always been presented, must be used today with great care to explain the whole mechanism of the contract for a future thing. The identification of the contract relating to a future thing continued with a reference to anticipation. This is a doctrinal explanation of former article 1130, paragraph 1, of the Civil Code, which provided: "The subject-matter of an obligation may be a future thing". It explains even today, after the reform of the law of contract, the new article 1163, paragraph 1. These three references or criteria (the future thing, the absence of contingency and anticipation) have made it possible to identify, on the one hand, special contracts relating to a future thing and, on the other hand, contractual securities relating to a future thing. Once the various contracts relating to a future thing had been identified, it was important to study their legal regime in a second stage. A contract relating to a future thing is distinguished by two common and specific rules: first, the debtor is under a prior obligation to do something which consists in making the promised thing happen by participating in its creation or by executing another contract; and second, the creditor has a possible right, which is the pure and simple right in germ, in favour of the creditor. Moreover, most of the developments on the validity and non-performance of a contract relating to a future thing fall under the general law of contract. The problems discussed did not make it possible to identify any specific features relating to the aspect of the future thing, the object of the service.In terms of the concept and the regime, there are a total of five common criteria and rules on which to base a general theory of the contract relating to a thing in the future

Leadership succession planning is an important strategy, not only when a school is considered effective, but also for sustaining future effectiveness. This research examines the importance of more systematic leadership succession planning for the schools of the Sisters of St Paul of Chartres (SPC) Congregation in Thailand. The study includes a critical review of the relevant literature and the analysis emphasises the distinctiveness of the school leadership in a Catholic school as compared with state secular schools. The empirical research was conducted in Thailand and the UK, with samples of six experienced Principals, eight new Principals, eight Aspirant Principals, five experienced SPC Teachers and three UK Programme Directors of MA Catholic leadership. A qualitative research approach using interview and focus groups interview discussion was employed. Analysis of the field work data demonstrates the key themes in any future leadership programme need to include (a) a systematic programme of mentoring (in theory and practice), (b) an emphasis upon the importance of mission integrity and of the concepts of servant leadership and ( c) the development of discernment capacity in those preparing for leadership. It also demonstrated that Catholic values and the values of the culture of Thailand have to be carefully appreciated. The study concludes with various practice and policy suggestions for implementing a new form of leadership succession planning in the SPC Congregation in the future.

Dopo aver ritirato l’adesione degli USA al Trans-Pacific Partnership (TPP) con vari Paesi dell’Asia e dell’Oceania, e sospeso il negoziato sul Transatlantic Trade and Investment Partnership (TTIP) con l’Unione Europea, il presidente Trump ha minacciato la cancellazione del NAFTA qualora non venga rinegoziato alle condizioni richieste da Washington. Dopo aver ripercorso il contesto storico in cui il NAFTA è maturato, la tesi analizza la performance del trattato, suddividendola, grosso modo, in due periodi: il primo, che va dalla sua entrata in vigore al 2001, quando la Cina fa il suo ingresso nell’Organizzazione Mondiale per il Commercio; il secondo, che va da allora ai giorni nostri, in cui si assiste, tra l’altro, alla progressiva erosione di quote importanti di import/export fra USA, Canada e Messico, da parte della stessa Cina. Infine, nella prospettiva di una rinegoziazione del trattato, discuterò le proposte statunitensi al riguardo.

En 1805, le code napoleon affirmait un principe tres general de prohibition des pactes sur succession future qui assurerait la protection de la reserve hereditaire en constituant avec elle l'ordre public successoral. Il reviendra ainsi aux tribunaux d'elaborer, avec l'aide de la doctrine, une definition du pacte successoral prohibe appelee a connaitre de multiples developpements. Parallelement, le legislateur ne cessera, a partir des annees 1960, de multiplier les exceptions au principe de prohibition. . . Le droit francais en la matiere consiste donc en un systeme de prohibition reposant sur l'opposition : principe de prohibition exceptions que constituent les pactes successoraux expressement valides et reglementes par la loi. Ce systeme s'avere aujourd'hui dangereusement depasse : en droit positif francais avec la validation extra-legale de pactes successoraux consacres par la pratique notariale et la jurisprudence (clauses de reversion autour du pacte tontinier et stipulations post-mortem) - depasse en droit compare et dans la perspective de l'har- monisation des legislations europeennes (essor international de la succession contrac- tuelle et incapacite de notre legislation a resoudre les conflits de lois nes du reglement ds successions internationales). The code napoleon enacted in 1804 a general prohibition of any convention pertaining to the devolution of a future succession. Said prohibition aimed at the protection of the "reserve hereditaire" and constituted with it the successional law and order. The courts and legal commentators thus had the duty to give a definition of the prohibited convention which came to many developments. Meanwhile and from 1960 onwards, the legislator enacted several exceptions to the prohibition. . . This subject matter is hence based in french law on a prohibitory principle and exceptions thereto, the latter being expressly stated and regulated by the law. This legal scheme proves nowadays to be dangerously obsolete : in the law itself since many conventions are extra-legally validated by the notarial practice and the courts (joint-ownership -"tontine"- clause, and inability of our legislation to solve conflicts of laws issues arising out of in- ternational successions). Hence it may be proposed to amend the current legislation so as to introduce the "pacte de famille" (family convention) which -coupled with fiscal incentives - would add to our law a legal means to dispose of one's succession by contract - akin to the system already in force in germany and switzerland - and would introduce a new juridical category purposedly aiming at solving conflicts of laws issues

Since the Good Friday Agreement (1998), Northern Ireland's community leaders, politicians and service providers have struggled to build improved relations both horizontally (between communities) and vertically (with service providers). The legacy of over thirty years of inter-communal violence has led to an exclusive view and use of territory and space. It has acted as a physical barrier of exclusion rather than potential meeting point or ground of inclusion. In south Belfast, a traditional interface situation between the indigenous Loyalist and Republican communities has been ruptured by the emergence of permanent Chinese community now in its fourth generation. The majority of this community worked, and continue to work, in the catering industry. This thesis seeks to understand the role of territory and space in inter-community relations - particularly those of the Chinese community for whom south Belfast is now 'home'. Spatial alteration can then be perceived as marking dilution of cultural identities or those ways of life to which communal loyalty is pledged. This perspective shapes identity and perceived reduction in levels of spatial 'control' can increase a sense of loss amongst communities threatened by demographic change. This thesis examines space and territory as part of community relations through the use of semi-structured interviews combined with · desk-based research. The thesis illustrates how exclusive space encourages poor community relations, increases democratic deficit and entrenches social marginalization. More inclusive spatial creation and use promotes positive contact between communities and allows constructive, mutually beneficial relations with service providers to be instigated. A key factor in this change is not just spatial creation, but how it is used and the types of civic education undertaken within it. How this form of civic education meshes with more formal education undertaken in schools will determine the ability of communities to achieve social integration and engagement.

XYZ Farms, a family farming operation located in Northeast Iowa, has been in business since 1924. Currently the operation utilizes 1,300 acres of farm ground to produce corn, soybeans and alfalfa and feeds 3,000 head of hogs and 500 head of cattle annually. The family operation has evolved over the years and has passed ownership down within the family from generation to generation. It has come time that the operation’s current owners are looking to retire and peacefully transition the family operation on to the next generation. A non-conventional case study structure will highlight and assess the history of the family operation and introduce them to current practices and ownership. The purpose of this study is to evaluate and create a feasible transition plan for XYZ Farms, while minimizing the social and economic costs associated with farm business succession. Further analysis will allow the operation to identify and utilize a succession planning framework, which is important for farm families to possess when looking to build and begin the planning process. Quantitative, along with qualitative, analysis are utilized to understand the operations need for succession planning and the feasibility of doing so. Findings indicate that it is advantageous to work through a sound succession plan including an open line of communication with both current and future owners of the operation. The ability to have upfront conversations and meetings will allow for the discussion of the operation’s future between both parties involved. By implementing a sound and feasible succession plan, XYZ Farms will be able to continue to be a family owned and operated farm for many years to come.

Creating successful leaders is one of the challenges that social services organizations are facing. Employees may lack essential managerial skills to become productive leaders, and some managers may lack viable succession planning methods for preparing employees for leadership positions. The purpose of this case study was to explore methods that executive managers use to prepare employees for leadership positions. Path-goal theory and transformational leadership represent the conceptual framework that grounded this study. Semistructured interviews were conducted with 10 executive managers in the social services industry within southwest Georgia with experiences and skills specific to implementing successful succession planning. Company archives of corporate reports, government records, and business and management records were used for triangulation. The data were coded and analyzed using a modified van Kaam method. Participants verified the accuracy of the analysis of their responses through member-checking. The findings revealed 4 emergent themes: organizational management, hiring employees that fit the culture, leadership capabilities, and talent management. A recommendation from the study was that executive managers find methods to prepare employees for leadership positions. These findings may contribute to positive social change by identifying methods to prepare employees for leadership positions, thereby generating organizational sustainability, increasing organization revenue, and creating community economic development.

Despite this, the Ukrainian reproductive medicine is considered one of the best and cheapest in Europe.

To enable the use of renewable energy throughout the system, the Dutch government aims to rely strongly on hydrogen gas as a green energy carrier. This thesis is dedicated to assessing the feasibility of meeting the future Dutch hydrogen demand with locally produced green hydrogen through offshore wind. The aim was realized by modelling the Dutch hydrogen demand in 2050 based on government plans and comparing this with the amount of green hydrogen the Netherlands can produce through offshore wind. Methods used include extensive literature reviews, energy system modelling, scenario analysis, and calculations. The results show that between 1,28 and 2,04 EJ of wind energy is necessary to meet the regular electricity demand and the electricity demand for hydrogen production through electrolysis. This needs to be compared to an offshore wind energy potential in the Dutch North Sea that ranges between 0,67 and 1,79 EJ. An analysis of the results shows that the offshore wind demand could be met, but it is more likely that the offshore wind energy potential is insufficient to meet the demand. The government envisions five applications for hydrogen, namely to be used as feedstock for the process industry, to generate high temperature heat, as energy storage for renewables (balancing the grid), as a transport fuel, and in the built environment. The results indicate that the demand of these five applications is unlikely to be met completely with offshore wind green hydrogen. However, the large majority of the hydrogen demand is dedicated to be used as a feedstock for the process industry. If this feedstock were to be from another source, meeting the demand of the remaining hydrogen applications with offshore wind is more realistic. Consequently, a main take-away is that the creation of a wind and solar based electricity grid with green hydrogen as a balancing agent is feasible. The results of this research gave rise to several recommendations. Firstly, renewable energy generation should be maximized using the full scope of different available techniques (not only focusing on offshore wind). Second, different decarbonization pathways other than offshore wind green hydrogen should be explored to account for process industry feedstocks. Third, the government should work closely together with other North Sea-bordering countries in order to make the best use of the available space. Fourth and final, efforts should be steered towards maximizing the wind energy potential of the Dutch North Sea, which is ideally suited for wind energy generation and should therefore be used in the best way possible.

La loi du 3 décembre 2001 a modifié profondément la vocation successorale du conjoint survivant. D'une vocation réduite en usufruit, sa vocation s'exprime désormais en pleine propriété dans tous les cas de concours avec les parents du défunt. Toutefois, le conjoint survivant peut toujours être exhérédé puisqu'il n'est pas réservataire en présence de descendants. Cependant, ce dernier n'est pas complètement démuni puisqu'il bénéficie d'un droit à maintenance de nature réservataire qui prend la forme d'un droit garanti sur le logement familial en pratique. En outre, il peut également bénéficier de dispositions de dernières volontés qui permettent d'améliorer sa vocation successorale. Leur efficacité est assurée grâce au pacte de famille qui permet de déroger aux règles de la réserve. Le conjoint survivant apparaît comme héritier privilégié dans la dévolution légale par rapport aux héritiers de sang. La France s'est ainsi alignée sur les droits étrangers qui font du conjoint survivant un héritier privilégié. En revanche, elle demeure en retrait sur la question de la réserve du conjoint survivant

It receives a vocation in full ownership consequently when he is in competition with the parents of deceased instead of a vocation in usufruct. Nevertheless, he can be totally disinherited when he is competition with the children. But, it benefits from a right guarantee on the home family. He also benefits from dispositions of estate planning which to ameliorate his legal rights. The surviving spouse is favoured heir in intestate estate in comparison with the parents of deceased. France is been finally in a line with the rights foreigners who make of the surviving spouse a privileged heir. But, it’s always against attribution a reserved portion to the surviving spouse when he is competition with the parents of deceased

Atualmente coreografias de serviços Web possuem vários desafios de pesquisa, dos quais a qualidade de serviço (QoS) e o monitoramento de coreografias de serviçosWeb são linhas importantes. O objetivo deste trabalho é propor e implementar um mecanismo de monitoramento não intrusivo de coreografias de serviços Web baseado em SLAs (Acordos de Nível de Serviço) que especificam as restrições de atributos de QoS de maneira probabilística. Esta dissertação propõe um mecanismo para coreografias de serviços Web que: (1) define requisitos de QoS; (2) especifica contratos probabilísticos sobre parâmetros de QoS usando SLA; e (3) realiza um monitoramento não intrusivo de coreografias de serviços Web para detectar violações de SLA.
Web services choreographies are a more scalable and flexible way to compose services than a centralized approach like orchestrations, and its role in the integration and communication of large-scale systems is vital for the goals of SoC (Service Oriented Computing) and Future Internet. Currently,Web services choreographies have several research challenges. From all challenges, quality of service (QoS) and monitoring of Web services choreography are important research lines. The goal of this work is to propose and implement a mechanism for non-intrusive monitoring of Web services choreography based on SLAs (Service Level Agreements) that define constraints of QoS attributes in a probabilistic way. This thesis proposes a mechanism for Web services choreographies that:(1) defines QoS requirements; (2) specifies probabilistic contracts on QoS parameters using SLAs; and (3) monitors, non-intrusively, the enactment of Web services choreographies to detect SLA violations.

This study focuses on the efficiency of firms’ investment decisions of family businesses from listed firms in Taiwan during 2009 to 2015. Based on the theory of socioemotional wealth, we also examine the influence of the existence and succession of family founders on firms’ investments. We find that family businesses perform better than nonfamily businesses, are associated with lower investment if the firm is more likely to over-invest. We further show that they can effectively improve the inefficiencies both of over-invest and under-invest when the founder exists or the second generation successor succeeds, suggesting that family businesses will engage in less of inefficient investment projects to protect their socioemotional wealth. In addition, we finds that the electronics industry in the family business can maintain a positive link to improve investment efficiency. As for the traditional industries, because of they may face challenges in transition, have no significant relationship with corporate investment efficiency.

Family owned businesses strive to not only be successful as measured by profit, market position, and other determinants used to gauge businesses success, but they also strive in the continuity of transitioning management and ownership from one generation to the next. This study explores the experiences of second generation successors with the succession process and how those experiences may influence their approach to planning the next generation succession. A qualitative case study approach was followed, using data collected from twelve second generation family business owners. This research examined the succession experiences of these owners in the areas of succession planning, successor development, individual learning, and the culture of stewardship. A contribution to the body of knowledge is made by developing these areas. This research addresses a gap in the literature where no research existed which specifically focused on second generation experiences. A contribution to practice is made by outlining how these areas influenced second generation family business owners as they contemplate approaches to future succession. This research identifies possible areas for future research.

Although the focus is on the analysis of the legal institute according to its currently valid arrangement, the thesis also contains a brief historical excursus about the development of the pacta de contrahendo institute. The reason for it is the fact that a contract about a future contract is a legal institute with a long history which dates in the Roman law, where there cannot be any doubt that the long historical development of the institute of a contract about a future contract contributed to the forming of its current form and concept. From the point of view of the valid legal adjustment of a contract about a future contract implemented by the code of law the thesis deals with single necessities of this legal institute, as to say with the subjects which can conclude a contract about a future contract with essential necessities which condition its valid negotiation. The purpose of this Master's degree thesis is to deal with preparatory institute of private contractual law pactum de contrahendo. This institute passed through to contemporary legislative conception long progress, currently it is in Czech Republic simultaneously regulated in two codes and at the present time performed re-codification of the Czech private law is in submission of the new Czech Civil Code its explicit regulation also contained. The thesis focuses on preliminary agreement being concluded according to valid Czech Civil Code, on its purpose, utilization and function. Po drugie, obejmują zagadnienie uzasadnienia zakazu zawierania umów o spadek po osobie żyjącej (de lege lata i de lege ferenda). Autor rozprawy weryfikuje (m.in. za pomocą metod: historyczno-prawnej, prawnoporównawczej i dogmatycznej) następujące założenia: zakaz zawierania umów o spadek po osobie żyjącej obejmuje m.in. umowy zawierające rozrządzenia, a także wszystkie inne umowne czynności prawne, których celem jest przekazanie majątku na wypadek śmierci, w tym pojedynczych składników majątkowych (jeżeli przepisy nie zezwalają wyraźnie na zawarcie takich kontraktów); zakaz zawierania umów o spadek po osobie żyjącej jest konsekwencją obranego przez ustawodawcę modelu dziedziczenia, jednakże brak jest przeszkód, aby wprowadzić do polskiego systemu prawnego dziedziczenie umowne, tym bardziej że tego rodzaju rozwiązanie odpowiada potencjalnym potrzebom społeczeństwa, a także jest uzasadnione w kontekście europejskim. Rozprawa obejmuje w głównej mierze temat umów o spadek z perspektywy ich zakazu. Nie są w niej jednak pominięte kwestie ogólne, m.in. związane z umową zrzeczenia się dziedziczenia czy też umowami dotyczącymi spadku w rozumieniu unijnego rozporządzenia spadkowego.
The subject of the dissertation is the prohibition of contracts concerning inheritance of a still living person. Problems in this area relate firstly to the scope of art. 1047 and 941 of the Polish Civil Code (de lege lata) and secondly they include the issue of justification of the prohibition of contracts concerning inheritance of a still living person (de lege ferenda and de lege lata). The author verifies (using, inter alia, historical, comparative, and dogmatic methods) the following assumptions: the prohibition of contracts concerning inheritance of a still living person contains, among others, contracts with mortis causa dispositions and other contractual legal acts aimed at transferring an estate in the case of death, including individual things (if the regulations do not expressly allow such contracts); the prohibition of contracts concerning inheritance of a still living person is a consequence of the inheritance model chosen by the legislator, but there are no obstacles to regulating inheritance contracts within the Polish legal system, moreover, this kind of solution corresponds to the potential needs of society and is justified in the European context. The dissertation is mainly concerned with contracts concerning inheritance from a perspective of their prohibition. However, general issues (including, among others, waiver of inheritance contract and European succession regulation) are not omitted.

abstract: The workforce demographics in the United States are rapidly changing. According to census information, 35% of working adults are project to retire within the next 20 years. The construction is being particularly affected by this demographic shift as fewer employees are entering into the industry. This shift is especially bad among project professionals within the industry. The response to these changing demographics depends on how companies manage their talent and plan for successions. In order to investigate this workforce problem in the construction industry, the author has partnered with an expert panel of human resource executives from various companies in the construction industry. This research seeks to investigate methods in which construction companies can identify high potential project leaders early on in their careers through quantitative methodologies. The author first validated the research problem by gathering demographic data from six U.S. construction companies varying in size and industry expertise. As a result of analyzing information from 2,294 construction employees in the project management career path, the authors have found that 58% of these individuals are projected to retire within the next 12 years. The author also conducted a detailed literature review and six company interviews to investigate current succession planning practices in the industry. The results show that very few companies have contingency plans for early to mid-level employees. Lastly, the author conducted 76 employee psychological evaluations to measure personality and behavior traits. These traits were then compared to supervisory performance reviews of these employees. The results of this comparison suggest that high potential employees tend to showcase previous leadership experience and also tend to be more outspoken and are also able to separate their emotional bias from business decisions. Using these findings, the author provides an interview tool that employers can use to expand their talent pool in order to identify high potential candidates that may have been previously overlooked. The author recommends additional research in further developing the use of quantitative tools to evaluate early-career employees in order to more efficiently align resources within the shrinking talent pool.

Rothwell (2010, p. 6) defined succession management as "a deliberate and systematic effort by an organization to ensure leadership continuity in key positions, retain and develop intellectual and knowledge capital for the future and encourage individual advancement" on all organizational levels. Succession management is a resourcing strategy that ensures continuity of tasks by balancing organizational needs in terms of competences and personal attributes with available human resources. It is characterized by - proactivity, shown in requirement for continuous feedback and development thus being considered in real-time situation and data, which is especially relevant in fast-changing business environments and business dynamics; - being more elaborate than succession planning as it takes into account all organizational levels, consequently making it more complex; - requirement for systematic, detailed process, information and specified desired outcomes; - deliberate enforcement for retention; - comprehensiveness as it is intertwined and integrated with other organizational activities such as strategy, hiring, performance, compensation and similar. Speed of change has been increasing, challenges are becoming more complex, talent war has been emerging because a number of employees retiring is high than number of those entering workforce market. One of the key questions that every organization will be facing is how to retain Millennials, who will represent around 75% of global workforce (McGlashan, Meadows, Power & Spencer, 2015) in less than a decade and have a strong focus on the future, progression, attaining skills in various fields and want constant feedback, yet do not provide loyalty in return? Succession management hold answers to these issues. Some of its benefits are successful job filling, increased retention, objective employee assessment, proactive employee development, encouraged diversity and creation of positive atmosphere. One of the purposes of the thesis was to provide for a better understanding of what succession management is hence let me clarify the differences between similar expressions.

A gestão de sucessão é uma estratégia de recursos que garante a continuidade das tarefas, equilibrando as necessidades organizacionais em termos de competências e atributos pessoais com recursos humanos disponíveis. A gestão de sucessão e caracterizada por: - proatividade, revelada pela necessidade de feedback e desenvolvimento contínuo, sendo, portanto, considerada em tempo real, o que é especialmente relevante em ambientes de negócios em rápida mudança; - ser mais elaborado do que o planeamento sucessivo, pois considera todos os níveis organizacionais, tornando-o mais complexo; - exige processos sistemáticos, informações e resultados específicos - esforço deliberado em retenção; - integração com outras atividades organizacionais, como estratégia, contratação, desempenho, remuneração e outros. The “built in” negotiation of the Agreement on Government Procurement (GPA), pursuant to Article XXIV:7 (b) & (c) of the GPA, includes two folds of negotiations: amendment of the text of the GPA and market access negotiation/coverage negotiation. This thesis mainly observes market access negotiation and concludes from relevant material that it is stalled due to absent consensus among members of the GPA on goals and directions of the negotiation. The thesis further demonstrates the impasse of the negotiation from limited expansion of coverage committed by the United States of America and Canada under the GPA. The thesis suggests three reasons behind the stalled market access negotiation: the coverage committed under the GPA cannot exchange for concessions under other WTO agreements; no substantial coverage has been expanded by existing members to motivate overall expansion of the GPA; the burden of protective industry policies and associated political pressures within each members of the GPA. The Unites States and Canada has concluded an Agreement on Government Procurement earlier this year (2010) in which it allows further expansion of coverage under the GPA on a reciprocal basis. After the conclusion of such Agreement, several members of the GPA and the Director-General of the WTO welcomed such development and expected new momentum of the negotiation shall be aroused. However, in view of the coverage committed in the Agreement, the thesis suggests it could be of little help to the negotiation in a substantial way, but the emblematic effect it might have on other members of the GPA is still worth noticing. In light of the current situation, the thesis finally provides that there might be merit to encourage members of the GPA to re-negotiate Transparency Agreement on Government Procurement in order to multilateralize the GPA.

The diploma thesis deals with the social movement Fridays for Future and its activity in the Federal Republic of Germany. The study describes frames which are used by the movement to communicate with public and to mobilize its supporters. In the analysis the thesis is based on the framing theory, which was in more detail elaborated by David A. Snow and Robert D. Benford. Specifically, the thesis deals with the analyses of the frames that occurred in the selected speeches delivered by the activists of the movement Fridays for Future. To be more precise, it is the diagnostic, prognostic, and motivational framing. At the beginning of the movement there was the Swedish activist Greta Thunberg who came up with the idea of school strikes for climate. The movement resonated strongly in the German society and it managed to mobilize an extraordinary amount of people in comparison to other states. The central aim of this thesis is to characterize the movement Fridays for Future in Germany. The thesis concentrates on the official goals that the movement tries to push through at the level of the German politics. This study separates ECFA into three issues in term of tariff agreement, intellectual property rights (IPR) protection and investment protection agreement. This study uses them as important independent variables. In addition, business resources and management control are also discussed in this study. Firms’ original entry mode is a moderator to explore that how they influence future development condition of Taiwanese entrepreneurs. Data is collected by mail survey and E-mail. The empirical results can be summarized as following main points: 1. Intellectual Property Rights(IPR) protection、business resource and management have significant influences on future development of Taiwanese entrepreneurs. 2. Moderating effect of firms’ original entry mode has significant influences on Tariff agreement、IPR protection、business resources and future development. Non-Wholly owned firms will increase more resources and capital than Wholly Owned firms. 3. Moderating effect of firms’ original entry mode has negative influences on investment protection and future development. In the three years from the first five years of family business to the three years after the handover, the market value of enterprises has shrunk by an average of 60%. Taiwanese SMEs are currently facing the entrepreneurial mode of the handover time to continue the business model of the family business. Or it is the direction of the professional manager as the management of the future company, and the difficulties and ideas that the successor encounters in succession. This is the main topic of this case. The distribution of family-type Taiwanese enterprises accounts for 97% of SMEs. The concept and method of succession in China and the West are also very different. The West tends to hand over to those who have the ability, while the East tends to take over the family. The problem of succession has always been a problem that has plagued a generation of business owners. With the evolution of generations, is the current generation of entrepreneurs insisting on the second generation to take over? What is the idea of the second generation or successor? This study uses the Harvard case teaching method to write and discuss the issue of the second generation succession. The content brings the problem of the second generation succession from the main case, and then discusses the current situation that different companies are currently encountering. Analysis, from different angles to discuss the feasibility and development of the second generation succession, coupled with the factors of the times, the second generation's growth environment is also very different, resulting in some problems that may occur during the handover, when or the situation will come to mind Succession problem? This dissertation aims to investigate the Helsinki 3D+ project as an instrument for the implementation of the Environmental Principle of Informed Participation. To this end, it begins with a discussion of participatory democracy and the difficulties of this model in Brazil. Next, the conceptualization of Popular Participation is made, under the scope of Environmental Sustainability, and the discussion is expanded to the international level, through a brief history of the international legal foundation of the Principle of Informed Popular Participation. Continuously, the work is dedicated to explaining the Aarhus Convention and stops at the study of the Escazú Agreement. Finally, it seeks to bring the case study of the Helsinki 3D+ project and answer whether it meets the conditions to give applicability to the Escazú Agreement and the Principle of Informed Popular Participation. This dissertation aims to investigate the Helsinki 3D+ project as an instrument for the implementation of the Environmental Principle of Informed Participation. To this end, it begins with a discussion of participatory democracy and the difficulties of this model in Brazil. Next, the conceptualization of Popular Participation is made, under the scope of Environmental Sustainability, and the discussion is expanded to the international level, through a brief history of the international legal foundation of the Principle of Informed Popular Participation. Continuously, the work is dedicated to explaining the Aarhus Convention and stops at the study of the Escazú Agreement.
